CIRCULAR
Regulations on the management and utilization of funds for implementing the Short-term Training Project on Information Security and Safety within the Human Resource Development Program on Information Security and Safety until 2020
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
To implement Decision No. 99/QD-TTg dated January 14, 2014 of the Prime Minister approving the Human Resource Development Program on Information Security and Safety until 2020;
At the proposal of the Director of the Administrative and Public Service Financial Department;
The Minister of Finance hereby issues this Circular regulating the management and utilization of funds for implementing the Short-term Training Project on Information Security and Safety within the Human Resource Development Program on Information Security and Safety until 2020, which has been approved by the Prime Minister under Decision No. 99/QD-TTg dated January 14, 2014.
Article 1. Scope of Application
This Circular regulates the management and utilization of funds for implementing the Short-term Training Project on Information Security and Safety (ISAS) within the Human Resource Development Program on Information Security and Safety 2020, which has been approved by the Prime Minister under Decision No. 99/QD-TTg dated January 14, 2014 (hereinafter referred to as Program 99).
Article 2. Subjects Implementing the Project
4. Members of the national network for incident response to ensure cybersecurity; units specialized in incident response and cybersecurity; operational teams for emergency response to ensure cybersecurity; cybersecurity incident response teams.
2. People's Committees of provinces and centrally governed cities.
3. Enterprises, financial organizations, banks, state-owned corporations, and economic groups.
Article 3. Sources of Funds
1. State budget, including central and local budgets according to the current budget allocation.
2. Revenue sources of agencies and units permitted to retain and use according to the law.
3. Contributions from enterprises and other lawful funding sources as prescribed by law.
Article 4. Training Recipients
1. Officials, civil servants, and employees working in information security and safety (ISAS) at specialized units for information technology in ministries, ministerial-level agencies, government agencies, and other central agencies.
2. Officials, civil servants, and employees working in ISAS at specialized units or departments for information technology under general bureaus, bureaus, or public service units (if any).
3. Officials, civil servants, and employees working in ISAS at provincial Departments of Information and Communications, Information Technology Centers under People's Committees of provinces and centrally-administered cities (including Data Centers, Data Integration Centers, and technical operation units of local information technology application systems such as electronic portal systems, email systems, single-window electronic systems, and electronic document management systems).
4. Leaders and key officials of central ministries, agencies, and localities.
5. Specialized officials in ISAS at enterprises, financial organizations, banks, state-owned corporations, and economic groups.
Article 5. Content and Levels of Expenditure
The content and levels of expenditure for activities implementing the Short-term Training Project on ISAS under Program 99 shall be carried out in accordance with Circular No. 139/2010/TT-BTC dated September 21, 2010 of the Ministry of Finance on the preparation of budget estimates, management, and utilization of state budget funds for training and capacity building for officials and civil servants. In addition, this Circular provides guidance on certain additional contents and levels of expenditure as follows:
1. Rent for facilities, including:
a) Rent for classrooms.
b) Rent for computers, projectors, and specialized equipment for practical training on information security such as Firewalls, IPS/IDS, Routers, Switches, and other necessary equipment.
The level of expenditure will be based on actual implementation while adhering to legal provisions regarding the selection of contractors in regular procurement.
2. Expenditure for domestic principal lecturers, assistant lecturers, and technical staff:
a) Expenditure for remuneration of principal lecturers, assistant lecturers, and technical staff:
Based on actual circumstances, available budget resources allocated by competent authorities, and the complexity of the course, the agency or unit responsible for organizing the training courses will decide specific expenditure levels appropriate to high-demand courses that may require hiring experts with remuneration agreed upon or applying a multiplier factor of 1.5 to 3.0 times the current rate, specifically as follows:
- Remuneration for domestic principal lecturers: A maximum of not more than VND 100,000 per hour per lecturer for courses training management knowledge and ISAS operations for managers; not more than VND 120,000 per hour per lecturer for advanced skill courses for ISAS personnel; not more than VND 200,000 per hour per lecturer for courses leading to international ISAS certification;
- Remuneration for assistant lecturers and technical staff: Not more than VND 50,000 per hour per person.
In cases where special technical requirements arise, the Ministers of Ministries, Heads of Central Agencies, and Chairmen of Provincial People's Committees will decide the specific remuneration levels for lecturers in writing to implement.
b) Food and accommodation expenses for domestic principal lecturers, assistant lecturers, and technical staff:
Depending on the location and duration of the training sessions, the agencies or units responsible for organizing the training courses will decide on food allowances for lecturers but not exceeding the lodging allowance stipulated in Circular No. 97/2010/TT-BTC dated July 6, 2010 of the Ministry of Finance on travel expenses, meeting organization costs for state agencies and public service units, and guidelines issued by ministries, sectors, and localities to implement Circular No. 97/2010/TT-BTC of the Ministry of Finance.
c) Travel expenses for domestic principal lecturers, assistant lecturers, and technical staff: including air tickets, train tickets, taxi fares for travel during teaching, reimbursed based on actual expenses incurred.
3. Expenditure for foreign lecturers:
a) Remuneration for foreign lecturers is agreed upon between the training institution and the lecturer but not exceeding VND 20,000,000 per day per person.
b) Other expenses for foreign lecturers such as food, accommodation, travel, and translation services are implemented in accordance with Circular No. 01/2010/TT-BTC dated January 6, 2010 of the Ministry of Finance on the regulations for receiving foreign guests visiting Vietnam, organizing international conferences and seminars in Vietnam, and hosting domestic guests.
4. Training and capacity building according to international certificates of companies (authorized units of companies): payment shall be made according to the contract between training institutions and providers, including training copyright costs and authentic training materials (if any); ensuring compliance with invoice regulations and bidding and procurement regulations for goods and services.
5. For online training and capacity building, in addition to the expenses stipulated in Circular No. 139/2010/TT-BTC dated September 21, 2010 of the Ministry of Finance, the following expenses are also allowed:
a) Expenses for developing framework programs, compiling programs, and textbooks: implemented according to Circular No. 123/2009/TT-BTC dated June 17, 2009 of the Ministry of Finance, which stipulates the content and levels of expenditure for developing framework programs and compiling programs and textbooks for university, college, and vocational secondary education courses.
b) Expenses for digitizing lectures to serve online training and capacity building: implemented according to Circular No. 194/2012/TT-BTC dated November 15, 2012 of the Ministry of Finance, guiding the level of expenditure for creating electronic information to maintain regular operations of state budget-funded agencies and units.
c) Expenses for producing video lectures: apply the standard for expenditure on producing knowledge dissemination programs as prescribed in Circular No. 30/2010/TT-BTTTT dated December 31, 2010 of the Ministry of Information and Communications, promulgating temporary standards on labor and equipment consumption in television program production.
d) Expenses for purchasing and developing software to serve online training and capacity building: implemented according to regulations on software development and procurement.
đ) Expenses for purchasing and maintaining lecture storage services on the Internet: payment shall be made according to the contract between training institutions and providers, ensuring compliance with invoice regulations and bidding and procurement regulations for goods and services.
6. During implementation, if the legal normative documents cited for application in this Circular are amended, supplemented, or replaced by new legal normative documents, they shall be applied according to the amended, supplemented, or replacing documents.
Article 6. Budget Preparation, Management, and Utilization
1. Budget Preparation: Annually, during the time for preparing the state budget according to the State Budget Law, agencies and units assigned tasks under Project 99 shall, based on the needs for short-term training on cybersecurity, develop plans and budgets for implementing the task of training cybersecurity personnel within their agencies and units, consolidate these into the annual training and capacity-building plan for civil servants and send it to the Ministry of Home Affairs for consolidation (for central ministries and agencies), and send it to the Department of Home Affairs (for local agencies), while simultaneously consolidating it into the annual budget plan of the ministry or agency to submit to the financial authority at the same level for consolidation and submission to the competent authority according to regulations.
2. Allocation and Assignment of Budget: Based on the approved budget, the head of the agency or unit is responsible for allocating and assigning the budget to organizations tasked with implementation (including the budget for implementing Project 99).
3. Utilization and Settlement of Budget: The utilization and settlement of the budget must ensure the implementation of Project 99 according to the State Budget Law, guiding documents, and provisions in this Circular; at year-end, it shall be consolidated into the annual budget settlement of the agency or unit according to regulations.
Article 7. Implementation Organization
1. The Ministry of Information and Communications shall take the lead in compiling training programs and textbooks to meet the requirements of short-term training courses; organize the selection of capable training units to implement short-term technical cybersecurity training courses for IT staff and high-level cybersecurity technicians in specialized IT units under central ministries and agencies and localities; train cybersecurity knowledge for leadership and key staff in ministries, sectors, and localities; and train according to international cybersecurity certification.
2. Central ministries and agencies and localities shall organize short-term cybersecurity training courses for staff working in cybersecurity in specialized IT units under central ministries and agencies; in provincial Departments of Information and Communications, IT centers under provincial People's Committees, and other relevant officials, civil servants, and employees within their management scope, based on the training programs, textbooks, and guidance from the Ministry of Information and Communications, and their own financial capabilities.
3. Enterprises, financial organizations, banks, holding companies, and state-owned economic groups: Depending on their needs and financial capabilities, they shall proactively negotiate with training institutions to send staff to attend courses and pay fees accordingly.
Article 8. Effective Date
1. This Circular takes effect from January 1, 2016.
2. During implementation, if difficulties arise, agencies and units shall report them to the Ministry of Finance for timely resolution./.
