DIRECTIVE

REGARDING THE IMPLEMENTATION OF LABOR PROTECTION ORDINANCE IN THE CONSTRUCTION INDUSTRY

Labor protection work in the Construction Industry holds an extremely important position. As a construction industry and building materials production sector, working conditions are mobile, dispersed, labor-intensive, with some tasks performed at heights or in deep underground spaces, exposed to hot, dusty, and toxic environments... which pose risks of occupational diseases and workplace accidents.

On September 10, 1991, the State Council issued the Labor Protection Ordinance. The Council of Ministers issued Directive No. 359/CT on November 4, 1991; the Ministry of Labor - War Invalids and Social Affairs, the Ministry of Health, and the Vietnam General Confederation of Labor issued Circular No. 17/LĐ-TT on December 26, 1991, guiding the implementation of the Labor Protection Ordinance.

To implement the Labor Protection Ordinance in the Construction Industry, the Minister of Construction and the Executive Committee of the Vietnam Construction Union request the heads of units and the Executive Committees of the Trade Unions within the Industry to fulfill the following tasks well:

1. Organize the dissemination and guidance to workers to thoroughly understand the contents of the Labor Protection Ordinance, clearly define the rights and obligations of employers and employees in labor protection work. Organize training for cadres and workers to acquire knowledge about safety and hygiene; grasp technical procedures and regulations on safety and hygiene for each job and profession; understand labor protection policies and systems... ensuring that workers have the right to work in safe and hygienic conditions, prevent workplace accidents and occupational diseases, gradually improve working conditions.

2. During the production process, each unit must have plans and measures for workplace safety, hygiene, health protection, prevention of occupational diseases and workplace accidents, ensure adequate personal protective equipment according to prescribed regulations; strictly prohibit the practice of allocating white quotas and including labor protection costs in the unit price of wages (as stipulated in Circular 02-LĐ/TBXH dated January 19, 1990 of the Ministry of Labor - War Invalids and Social Affairs).

3. Each unit must strictly follow the procedures, regulations, and internal rules on workplace safety for equipment such as Construction Regulation 5308-91, electrical machinery regulations, boiler regulations, and pressure vessel regulations, etc. Prohibit the use and operation of pressure vessels without a permit from the competent state agency.

4. Organize mass movements to implement the Labor Protection Ordinance, movements to promote initiatives to improve working conditions, organize management, training, and encouragement for safety and hygiene officers. Adequate staff must be assigned to handle labor protection in the unit. These staff members must be familiar with the Labor Protection Ordinance.

5. Maintain inspection, self-inspection, and mass inspection systems for workplace safety and hygiene, the implementation of labor protection policies and systems, and improvements in working conditions. Through inspections, specific measures and systems should be implemented to care for the health of workers suffering from occupational diseases or injured in workplace accidents, especially showing concern for families where workers have died due to workplace accidents with responsibility and compassion.

6. Strictly implement statistical, investigative, reporting, and analytical work on workplace accidents and occupational diseases, timely and periodic quarterly and annual reports in full accordance with Decision 45-QĐ/LB dated March 20, 1982 of the Joint Ministries of Labor - War Invalids and Social Affairs, Health, and the Vietnam General Confederation of Labor. Seriously deal with violations concerning workplace safety for people and equipment according to the law. At the same time, promptly encourage and reward collectives and individuals with outstanding achievements in labor protection work.

Heads of units and Executive Committees of Trade Unions shall develop plans for implementation and periodically self-inspect the execution of the contents of this Directive, taking specific measures to guide the effective implementation of the Labor Protection Ordinance.

The Minister of Construction and the Executive Committee of the Vietnam Construction Union assign the Department of Organization and Labor and the Labor and Wages Department of the Vietnam Construction Union to supervise and inspect units within the Industry to effectively implement the Directive on the Labor Protection Ordinance. In 1992, inspections will be conducted in some construction and building materials production units, thereby drawing lessons learned.
