Pursuant to Resolution No. 01/2007/QH12 dated July 31, 2007 of the National Assembly of the Socialist Republic of Vietnam, the twelfth session, first meeting, concerning the organizational structure of the Government and the number of Deputy Prime Ministers for the twelfth term;
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 92/2006/NĐ-CP dated September 7, 2006 of the Government on the establishment, approval, and management of comprehensive planning for economic and social development;
Pursuant to Decision No. 27/2007/QĐ-TTg dated February 15, 2007 of the Prime Minister approving the project "Developing Domestic Trade until 2010 with orientation to 2020";
Based on the authorization of the Prime Minister allowing the Minister of Industry and Trade to review and approve planning projects for the development of commercial infrastructure as stated in Official Letter No. 6428/VPCP-KTTH dated November 7, 2007 of the Office of the Government;
Considering the Report No. 346/VNCTM-TTr dated December 3, 2007 of the Institute of Trade regarding the approval of the project "Planning for the Development of Certain Key Commercial Infrastructure in the Southern Key Economic Zone until 2010 with orientation to 2020";
At the proposal of the Director of the Department of Planning and Investment,
DECISION:
Article 1. Approve the "Planning for the Development of Certain Key Commercial Infrastructure in the Southern Key Economic Zone until 2010 with orientation to 2020" with the following main contents:
1. Development Orientation
- The planning for the development of various types of commercial infrastructure in the Southern Key Economic Zone (hereinafter referred to as the Zone) must be consistent with the overall socio-economic development of the entire Zone, as well as that of each province directly under the Central Government within the Zone (hereinafter referred to as the province), during the period up to 2010 and with orientation towards 2020.
- Focus on developing major and medium-sized types of commercial infrastructure, starting from central markets with Ho Chi Minh City as the focal point, with a central radius of 50 kilometers. Develop large-scale commercial infrastructure projects in Ho Chi Minh City, Binh Duong, Dong Nai, and Ba Ria-Vung Tau to create "highlight" areas and facilitate regional, inter-regional, national, and international linkages.
- Harmoniously develop and reasonably distribute various types of commercial infrastructure within the Zone; gradually increase the proportion of modern commercial infrastructure and progressively improve the level of civilized trade in traditional commercial infrastructure.
- Maximize the mobilization of resources within the Zone, nationwide, and from abroad according to the provisions of the law to develop the system of commercial infrastructure in the Zone.
- The Southern Key Economic Zone has a faster economic growth rate, including a higher rate of trade-service development compared to other regions in the country, significantly impacting the economic and trade development of adjacent regions and the whole nation. Therefore, the State needs to create an investment environment and have special policies to mobilize at a high level the resources of all economic sectors to invest in the development of commercial infrastructure in the Zone.
2. Development Objectives
- Develop various types of commercial infrastructure commensurate with the increasing demand and diversity of trade activities throughout the Zone and each locality within the Zone.
- Develop harmoniously traditional and modern commercial infrastructure during the period up to 2010 and subsequent years.
- From 2011 to 2015, focus on developing wholesale markets, supermarkets, shopping centers, exhibition centers, warehouses, and oil storage facilities in key areas within the Zone, primarily in Ho Chi Minh City, Binh Duong, Dong Nai, and Ba Ria-Vung Tau; simultaneously upgrade, renovate, and enhance the efficiency of other types of commercial infrastructure.
- From 2016 to 2020, focus on developing modern commercial infrastructure in the Zone, including some projects with regional and international significance.
3. Planning for the Development of Certain Key Commercial Infrastructure
3.1. Planning for the Development of Type I Markets and Wholesale Markets
3.1.1 Development Goals
- Develop Type I markets and wholesale markets in the Zone towards improving technology for organizing commodity circulation and service provision at these markets, enhancing service levels and commercial civilization.
- Ensure maintaining the average annual growth rate of sales revenue and services through markets at 15-18% during the period 2006-2010, 13-14% during the period 2011-2015, and 11-12% during the period 2016-2020.
- Ensure providing employment for 6-8% of the labor force in urban areas of the Southern Key Economic Zone currently undergoing rapid urbanization.
3.1.2 Principles of Distribution Planning
a. Principles of Distribution Planning for Type I Markets
- The average population density of the area served by a Type I market must reach at least 600 people/km². The area served by a Type I market is approximately 40 km².
- In the planned area for a Type I market, the average Gross Domestic Product per capita per year should be between 500 to less than 1000 USD or 8 million to less than 16 million VND.
- Have a location and infrastructure conditions relatively developed to ensure convenience for residents' regular shopping.
b. Principles of Distribution Planning for Wholesale Markets
- Agricultural production has entered a stage of rapid scale development, and the division of labor among stages in the agricultural product circulation process from production to consumption has become clearly defined.
- The rapid urbanization process in the region, both in terms of scale and quality, requires the establishment of facilities capable of ensuring the supply of goods, especially agricultural products, to the increasingly professional, civilized, and modern retail networks in urban areas.
- Merchants have the capacity and willingness to participate in providing support services for the circulation of goods from production to consumption. The organizational level of labor of merchants ensures the ability to expand the scale of operations and diversify fields of activity.
- Conditions regarding infrastructure, especially relatively developed transportation, reasonable freight rates ensure convenience for the development of commodity exchange and service provision.
- Distance between similar wholesale markets (attracting and distributing similar products): from 30 to 50 kilometers.
3.1.3 Planning Scheme
- In Ho Chi Minh City: Upgrade 4 type I markets including An Dong Market, Pham Van Hai Market, Ba Chiieu Market, Ben Thanh Market (2007 - 2015); renovate and expand the regional-scale comprehensive agricultural wholesale market Binh Dien; and two vegetable and fruit wholesale markets Hoc Mon and Thu Duc Markets (2007-2015).
- In Binh Duong Province: Upgrade and expand Khuong Xa- Thu Dau Mot Market (2007 - 2010); construct six new type I markets including Phu Tho Market, Lai Thieu New Market, Tan Binh Market, Tan Thanh Market, My Phuoc Market, Thanh An Market (2007 - 2015). Construct two new comprehensive agricultural wholesale markets Dau Tieng and Lai Uyen (2007 - 2015).
- In Dong Nai Province: Upgrade and expand three type I markets including Bien Hoa Market (2007 - 2015), Long Thanh Market, Long Khanh Market (2010- 2015); construct a new type I market Sat Market (2007 - 2020). Construct one comprehensive agricultural wholesale market in Long Thanh Town (2011- 2020).
- In Ba Ria-Vung Tau Province: Upgrade and expand Vung Tau City Market (2007 - 2015); construct four new type I markets including Long Hai Market, Bac Lieu Town Market, Xuyen Moc District Market, Tan Thanh District Market (2007- 2015); construct a new comprehensive agricultural wholesale market in Bac Lieu Town (2007- 2015); construct two new seafood wholesale markets Cat Lo Port Market (2007 - 2010) and Bac Lieu Town Market (2007- 2015).
- In Binh Phuoc Province: Upgrade and expand four type I markets including Dong Xoei Market, Loc Ninh Market (2007 - 2015); Bu Dang Market, Chon Thanh Market (2011 - 2015); construct two new type I markets Tan Phu Market, An Loc Market (2011 - 2020); construct a new fruit and vegetable wholesale market Thanh Binh Market (2007 - 2015).
- In Long An Province: Construct a new type I market Ben Luc Market (2007 - 2015). Renovate and upgrade Hau Thanh Dong Wholesale Rice Market (2007 - 2010); construct a new fruit and vegetable wholesale market Thu Thua District (2007-2015); construct a new seafood wholesale market Can Giuoc (2016- 2020).
- In Tien Giang Province: Upgrade and expand four type I markets including Gao Market, Go Cong Market, My Tho Market, Vinh Binh Market (2007 - 2015). Renovate and upgrade Hoa Khanh Fruit and Vegetable Wholesale Market, Vinh Kim Fruit and Vegetable Wholesale Market (2007 - 2010), renovate and upgrade Phu Cuong Rice Wholesale Market (2007 - 2010).
- In Tay Ninh Province: Upgrade and expand two type I markets including Tay Ninh Town Market (2007 - 2015), Long Hoa Market (2007 - 2020); construct three new type I markets Trang Bang Market, Go Dau Market, Tan Chau Market (2007 - 2015). Construct two new comprehensive agricultural wholesale markets Hoa Thanh Town and Bau Nang Market (2007 - 2010).
3.2. Planning for the Development of Supermarkets and Shopping Centers
3.2.1 Objectives of Development
- Increase the proportion of retail sales and service revenue of this type in the total turnover of goods and services in the Region from 3% in 2005 to 10% in 2010; 15-18% in 2015 and 20-25% in 2020.
- During the period 2006 - 2010, focus on developing category II and III supermarkets in urban areas and industrial zones being developed according to the economic and social development plan. During the period 2011 – 2020, develop category I supermarkets and shopping centers in major urban areas such as Ho Chi Minh City (Districts 1, 2, 3, 7), Binh Duong, Dong Nai, and Ba Ria-Vung Tau.
- Corresponding to the increase in revenue, the number of workers at supermarkets and shopping centers in the Region must ensure an increase from 5-7% of the current total number of commercial workers in the Region to 10% in 2010; 11.4% in 2015 and 11.8-12% in 2020.
3.2.2 Principles of Distribution Planning
- In the area planned for supermarkets, the average annual gross domestic product per capita must reach over 1,000 USD or over 16 million VND. For the area planned for large supermarkets, the average annual gross domestic product per capita needs to reach over 2,000 USD or over 32 million VND.
- The density and scale of supermarkets and shopping centers are determined in accordance with the size of the city. Large supermarkets and shopping centers are mainly planned in cities of class 2 or higher.
- Determining the location for constructing large supermarkets and shopping centers must take into account their impact on urban order, environment, and traditional commercial areas.
3.2.3 Planning Scheme
- In Ho Chi Minh City, construct four new shopping centers including Nguyen Hue Shopping Center, Phu My Hung Shopping Center, Phu My Hung Shopping Center, Tan Binh Comprehensive Shopping Center, and Phuong Dong Shopping Center (2007-2010); convert four markets into supermarkets-shopping centers including Cu Chi Supermarket-Shopping Center, An Khanh Supermarket-Shopping Center, Phuong 1 Supermarket-Shopping Center, Phuong 3 Supermarket-Shopping Center (2007-2010); convert Phuong 16 Market into a supermarket-shopping center (2011-2020); construct a category I supermarket and a regional-level category I shopping center in District 2 (2011-2020).
- In Binh Duong Province: construct five new supermarkets including My Phuoc I, My Phuoc II, My Phuoc III, My Phuoc IV, My Phuoc Ward 3 (2007-2010); construct one new regional-level category I supermarket in Binh Duong (National Highway 13) (2011-2020); construct two new shopping centers in VISP Industrial Zone and Dong Hiep Industrial Zone (2007-2010); construct one new regional-level category I shopping center in National University Village (2016-2020).
- In Ba Ria-Vung Tau Province: Construct three new supermarkets including Vung Tau City Comprehensive Supermarket (2007-2010); Long Dien Supermarket, My Xuan Supermarket (2011-2015). Convert Bac Lieu Market into a market-supermarket-shopping center (2016-2020).
- In Dong Nai Province: construct two new supermarket-shopping centers including Tam Hoa Shopping Center, Tan Hiep Shopping Center (2011-2015).
- In the province of Bình Phước: Construct two new supermarkets in Đồng Xoài town (2011-2015); Construct a new commercial center in Đồng Xoài (2016-2020);
- In the province of Tiền Giang: Convert five markets into market-supermarket-commercial centers including: Mỹ Tho commercial center (2007-2010); Gạo supermarket-commercial center, Gò Công supermarket-commercial center (2011-2015); Thiên Hộ supermarket-commercial center, Cai Lậy supermarket-commercial center (2016-2020).
- In the province of Long An: Transform Phường 1 market in Long An town into a market-supermarket-commercial center (2007-2010); construct three new supermarkets including: Bến Lức supermarket, Hậu Nghĩa town supermarket, Mộc Hóa supermarket (2016-2020).
- In the province of Tây Ninh: Transform Long Hoa market into a market-supermarket-commercial center (2011-2015); construct two new supermarkets including Gò Dầu supermarket, Trảng Bàng supermarket (2016-2020).
3.3. Planning for the development of exhibition centers
3.3.1 Objectives of development
- Increase the scale of exhibitions to reach an average of 300-400 enterprises currently to an average of 600-800 enterprises/exhibition by 2010 and over 1,000-1,500 enterprises/exhibition during the period from 2011 to 2020.
- Raise the proportion of foreign enterprises participating in exhibitions to 15-18% by 2010 and approximately 22-25% during the period from 2011 to 2015; from 28-32% during the period from 2016 to 2020.
3.3.2 Principles of distribution planning
- Areas that have experienced rapid development of enterprises in both quantity and scale.
- Regional markets that are rapidly developing and attracting businesses both within and outside the region, both in terms of supply and consumption of goods.
- Locations with geographical economic advantages or potential for developing economic and trade relations between regions and areas.
- The determination of the location for building exhibition centers must take into account their impact on local security, culture, and environmental protection.
3.3.3 Planning schemes
- Period 2006-2010: Construct an exhibition center in the new urban area of Phú Mỹ Hưng, South Saigon. The scale of this center allows for organizing up to 1,500-1,800 booths at the same time. The planned land area is 15 hectares.

3.4. Planning for the development of warehouse systems
3.4.1 Objectives of development
- Develop some units providing comprehensive logistics services according to the operational model of logistics centers.
- Strive to have, after 2010, cities such as Ho Chi Minh City, Bình Dương, Đồng Nai, Bà Rịa-Vũng Tàu have facilities providing comprehensive logistics services, and by 2015 all cities in the region will have logistics service facilities, with Ho Chi Minh City and Đồng Nai playing central roles in the region and the area.
3.4.2 Principles of distribution planning
- The scale and scope of the goods market, including both the raw material input market for production and the consumer goods market, are quite developed.
- The division of labor in the circulation of goods on the domestic market and for import-export activities has developed at a relatively high level.
- Areas with transportation conditions and the degree of convergence or concentration of consumer markets.
3.4.3 Planning schemes
- In Ho Chi Minh City:
The Phú Mỹ-Tân Thuận Đông-Nhà Bè warehousing complex for imported and exported goods. This is a large-scale complex built to serve imports and exports, including agricultural products and rice. The construction scale is from 40-50 hectares in 2010 and will be expanded to 80 hectares by 2020.
The Cây Khô port warehousing complex (Nhà Bè). This is a complex linked to the operation of the river port, Cây Khô wholesale market, part of Bình Đông port relocated here with a capacity of 750,000 tons/year. Cây Khô port serves as a transshipment and distribution hub for agricultural supplies for the Mekong Delta. It is planned to build from 15-20 hectares from 2008 to 2010 and expand to 30 hectares by 2020.
The Phú Định river port warehousing complex in District 8, Ho Chi Minh City. This is a transshipment complex serving the river port and the system of distribution warehouses moving from the city center. The construction scale is about 45-50 hectares. In addition to serving the commercial needs of Ho Chi Minh City, this complex also plays a role in distributing goods for the Mekong Delta.
The An Lạc-Bình Điền warehousing complex (Bình Chánh). This is a concentrated complex along National Highway 1 from An Lạc to Bình Điền, mainly serving distribution and partly storing foodstuffs, processed foods, agricultural supplies, etc., for Ho Chi Minh City, Long An, and the Mekong Delta, with a construction scale of 30-35 hectares.
The An Sương intersection warehousing complex (Hóc Môn). This is a major warehousing complex with a scale of 30-35 hectares, serving some distribution warehouses for newly developed urban areas and the Tân Thới Hiệp industrial zone.
The Linh Xuân-Linh Trung warehousing complex (Thu Duc). This is a regional distribution complex and some specialized warehouses serving production in the Thu Duc area, with a scale of 30-35 hectares.
The Cát Lái warehousing complex (Thu Duc). This future complex will form a bulk cargo port for the Ministry of Transport. Therefore, this warehousing complex will have the function of serving the port and building distribution warehouses for future residential areas, with a scale of about 40-45 hectares.
- In Đồng Nai Province: This is a major warehousing complex mainly serving industrial zones, factories, and production bases in Đồng Nai Province, including: Đồng Nai River Port Warehouse, Phú Hữu Warehouse, Gò Dầu A and B Port Warehouses, Phước An River Port Warehouse, with a scale of 30-40 hectares.
- In the province of Binh Duong: This is the main warehouse complex located in the Song Than inland port area, approximately 20 kilometers from Tan Cang, with favorable conditions for transportation and advantageous in attracting and receiving goods, storing goods, supporting the process of developing the capacity to circulate goods, and domestic clearance for enterprises in industrial zones such as Song Than I, Song Than II, Tan Dong Hiep. The scale is 30-40 hectares.
- In the province of Ba Ria - Vung Tau: This is a warehouse complex including Go Dau C port warehouse area, Phu My port warehouse area, Cai Me port warehouse area (Song Thi Vai), Vung Tau port warehouse area (Ben Dinh - Sao Mai), Song Dinh port warehouse area (Song Dinh). The direct service range includes the provinces in the region, namely Ho Chi Minh City, Dong Nai Province, Ba Ria - Vung Tau Province, and Binh Duong Province. The indirect service range includes adjacent areas, the Mekong Delta region, western provinces of South Vietnam, and southern Central Highlands, with a scale of 30-55 hectares.
- In the province of Tay Ninh: The main warehouse complex in the border gate area of Moc Bai, located on the Xuyen A road connecting Ho Chi Minh City and Phnom Penh, within the Moc Bai Border Economic Zone, which is currently the commercial, tourism, service, and important domestic and international transportation hub of Tay Ninh Province and the region, with a scale of 20-30 hectares, including a bonded warehouse with an area of 5 hectares.
3.5 Planning for the development of the oil storage and port system
3.5.1 Objectives
- Adjust and supplement the planning of the oil storage and port system to be consistent with the socio-economic development planning in the region and environmental protection requirements.
- Increase the storage capacity of oil storage and port facilities in the region to match the overall economic growth rate of the region.
3.5.2 Principles of distribution planning
- Located relatively isolated from residential areas, public works, and other critical infrastructure.
- Possess the capability to develop one or more modes of oil transportation (pipelines, sea routes, river routes, road transport...).
- Have a favorable location for receiving and transferring oil within the region and to adjacent regions at low cost.
- Meet the conditions for environmental sanitation, ensuring safety for oil storage facilities...
3.5.3 Planning schemes
- Expand and upgrade existing oil storage and port facilities
Main reception ports:
+ Ho Chi Minh City: Expand the total warehouse of Nha Be and Cat Lai warehouses.
+ Dong Nai: Expand Phu Khanh warehouse.
River transfer ports:
+ Binh Duong: Expand Chanh My warehouse.
+ Ho Chi Minh City: Expand Phu My 30/4 warehouse.
- Construct new main ports
+ Ho Chi Minh City: Construct new Nha Be Vinapco warehouse, in the Hiep Phuoc Industrial Park - Nha Be District with a scale of 28-30 hectares.
+ Ba Ria - Vung Tau - Dong Nai: Construct new warehouses in the Cai Me - Ba Ria - Vung Tau area with a scale of 15-20 hectares, and Nhon Trach - Dong Nai with a scale of 20 hectares.
- Construct new transfer warehouses:
+ Dong Nai: Construct new Petrolimex warehouse, replacing Bien Hoa and Long Tan warehouses.
With a scale of 15-20 hectares.
+ Long An: Construct new Ben Luc warehouse to support Moi Hoa warehouse (2 hectares).
+ Binh Duong: Construct new Petrolimex warehouse to support Phu Cuong warehouse (2 hectares).
+ Tien Giang: Construct three new warehouses including Go Cong Dong, Cai Be, and My Phuoc warehouses (from 1-1.5 hectares per warehouse).
4. Investment capital and land usage needs
4.1 For type I markets and agricultural product wholesale markets
- The land usage need for type I markets in the region is 714,576 square meters, of which newly constructed type I markets require 387,377 square meters. The investment capital requirement for newly constructed type I markets is 745.36 billion VND.
- The land usage need for agricultural product and seafood wholesale markets in the region is 1,512,000 square meters, of which newly constructed wholesale markets require 282,000 square meters. The investment capital requirement for newly constructed wholesale markets is 282 billion VND.
4.2 For supermarkets and shopping centers
The land usage need for supermarkets and shopping centers in the region is 1,153,857 square meters, of which the land usage need for newly constructed supermarkets and shopping centers is 1,003,492 square meters.
The investment capital requirement for newly constructed supermarket and shopping center systems in the region is 3,860.25 billion VND.
4.3 For trade exhibition centers
The land usage need for newly constructed trade exhibition centers in the region is 750,000 square meters.
The investment capital requirement for trade exhibition centers in the region is 1,500 billion VND.
4.4 For warehouse systems
The land usage need for constructing warehouse systems in the region is 5,400,000 square meters, of which the land usage need for constructing new warehouse complexes is 1,650,000 square meters.
The investment capital requirement for constructing new warehouse complexes is 2,475 billion VND.
4.5 For oil storage and port systems
- The land usage need for constructing oil storage facilities: 1,318,400 cubic meters, of which:
+ Currently under construction oil storage facilities are 645,400 cubic meters.
+ Main reception ports being upgraded and expanded are 310,000 cubic meters.
+ River transfer ports being upgraded and expanded are 70,200 cubic meters.
+ New main ports being constructed are 250,000 cubic meters.
+ Transfer ports are 43,000 cubic meters.
- Capital investment needs: 2,841.1 billion VND, of which:
+ Currently under construction oil storage facilities are 1,613.5 billion VND.
+ Main reception ports being upgraded and expanded are 124 billion VND.

6. Major solutions and policies
6.1 Management solutions
- Review and amend, supplement, or promulgate new legal documents to perfect the legal framework related to investment, business, and management activities of markets, supermarkets, shopping centers, oil storage and port facilities, and especially the operation of trade exhibition centers and logistics systems.
- Urgently develop and promulgate standards and specifications for various types of commercial infrastructure, creating conditions for provinces to build or revise and supplement planning and establish investment projects for the development of commercial infrastructure.
- Continue to promote administrative reform, innovate the content and methods of state management over the development and operation of various levels and types of commercial infrastructure.
6.2 Investment solutions and policies
- The State needs to amend and supplement policies to encourage domestic and foreign economic components to participate in investing in developing various types of commercial infrastructure in order to create favorable conditions for businesses to effectively utilize their own capital and other sources of capital for investing in developing commercial infrastructure at localities.
- Along with implementing investment incentive policies for projects under the list of preferential investment fields according to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law, relevant agencies need to promptly develop and submit to the Government for issuance mechanisms and policies providing incentives and support for projects developing commercial infrastructure like those investing in other production and business sectors as stipulated in Decision No. 27/2007/QĐ-TTg dated February 15, 2007 of the Prime Minister approving the Project on Developing Domestic Trade until 2010 and orientations until 2020.
- The State continues to use state budget funds to support investment in developing markets in accordance with the provisions of Decree No. 02/2003/NĐ-CP dated January 14, 2003 of the Government on Market Development and Management, Decision No. 559/2004/QĐ-TTg dated May 31, 2004 of the Prime Minister approving the Program on Market Development until 2010, and related legal documents.
6.3 Solutions and Policies Regarding Land
When formulating socio-economic development plans at local levels, People's Committees of provinces need to reasonably allocate land for investment in developing commercial infrastructure, ensuring current needs while being suitable for the increase in investment projects and the expansion of activities of various types of commercial infrastructure in the future. At the same time, there should be proactive and synchronized solutions and policies regarding land clearance to facilitate investors when constructing commercial infrastructure in the area.
6.4 Solutions and Policies Regarding Human Resources
- Utilize domestic and foreign capital to support training and human resource development for trading enterprises.
- Allocate and use state budget funds efficiently to upgrade material and technical facilities, build teaching staff, and develop curricula and content for distribution training for the system of commerce colleges, vocational schools, and trade training centers under the Ministry of Industry and Trade.
- Implement policies to encourage enterprises and localities to organize training and retraining of human resources participating in commercial activities through appropriate forms and methods suited to the conditions of each enterprise and locality.
6.5 Solutions and Policies Regarding Environmental Protection
- Investment projects for developing commercial infrastructure must fully comply with environmental laws.
- Enterprises and localities need to allocate sufficient resources to invest in building systems for collecting, sorting, transporting, and treating waste generated from commercial operations.
- Strengthen supervision and inspection of compliance with environmental laws by commercial establishments in the Region to prevent and promptly address violations by organizations or individuals to ensure sustainable and rapid development of trade in the Region.
Article 2. Implementation
1. Responsibilities of Ministries and sectors
1. 1 The Ministry of Industry and Trade is responsible for leading and coordinating with relevant ministries and sectors to guide and instruct People's Committees of provinces to implement this Decision, focusing on the following main tasks:
a. Direct and guide provinces to review, adjust, supplement, or develop new plans for the development of commercial infrastructure in provinces within the Region in accordance with the provisions of this Decision and related legal documents.
b. Direct, guide, and inspect provinces within the Region in establishing and organizing the implementation of investment projects for developing commercial infrastructure in accordance with the provisions of this Decision and related legal documents.
c. Review and propose to the Government to amend and supplement, or amend and supplement within its authority, legal documents related to mechanisms, policies, and solutions for developing and managing commercial infrastructure as stipulated in this Decision.
1. 2 Ministries: Planning and Investment, Finance, Agriculture and Rural Development, Construction, Science and Technology, Natural Resources and Environment, Transport, State Bank, and other relevant ministries and sectors shall cooperate with the Ministry of Industry and Trade to implement the solutions outlined in this Decision in accordance with their functions and responsibilities.
2. Responsibilities of localities
Direct provincial Departments of Commerce/Departments of Commerce and Tourism to coordinate with relevant agencies to perform the following main tasks:
a. For provinces within the Region that have had commercial infrastructure plans prior to the effective date of this Decision, conduct reviews; if they are not in line with the provisions of this Decision and other related legal documents, establish adjustment plans for the development of commercial infrastructure in the province, and submit them to the Provincial People's Committee for approval.
b. For provinces within the Region that have not yet developed commercial infrastructure plans, urgently develop plans for the development of commercial infrastructure in the province in line with the overall plan for developing trade in the province, the socio-economic situation of the locality, the overall planning orientation of the Region, and the provisions of this Decision.
c. During the implementation of this Decision, the planning schemes and project lists of each province included in the list of investment projects for developing commercial infrastructure attached to this Decision may be adjusted to suit the socio-economic development and trade development of each locality. However, before deciding to adjust these planning schemes and project lists, the Provincial People's Committee needs to consult and reach consensus with the Ministry of Industry and Trade.
d. Develop annual plans for the development of commercial infrastructure to be submitted to the Provincial People's Committee for approval.
d. Advise the Provincial People's Committee on the development, review, and guidance for implementing investment projects to develop commercial infrastructure within the province according to the planning and plans already approved by the Provincial People's Committee.
e. Advise the Provincial People's Committee on allocating and utilizing investment capital for developing commercial infrastructure, including state budget support funds, in an effective, practical, and purposeful manner.
f. Develop and submit to the Provincial People's Committee for issuance mechanisms, policies (in accordance with legal regulations) and solutions aimed at mobilizing and exploiting local resources, particularly those of businesses and individual traders, to develop commercial infrastructure within the province.
g. Regularly inspect the implementation of the planning for developing commercial infrastructure within the province to promptly propose competent authorities to handle violations in the development of commercial infrastructure investments.
h. Annually report to the Ministry of Industry and Trade and the Provincial People's Committee on the situation and results of implementing this Decision.
Article 3. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 4. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities in the Southern Key Economic Region, and related agencies are responsible for enforcing this Decision.
