Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Pricing Ordinance No. 40/2002/PL-UBTVQH10 dated April 26, 2002;
Pursuant to Resolution No. 48/2007/NQ-CP dated August 30, 2007 of the Government on Adjusting Certain Main Content of Policies for Selling State-owned Housing to Tenants under Decree No. 61/CP dated July 5, 1994 of the Government and the Rental Price of State-owned Housing that has not been Renovated or Rebuilt;
At the proposal of the Minister of Construction and the Minister of Finance,
DECISION:
Article 1. Issuing the Standard Rental Price List for State-owned Housing that has not been Renovated or Rebuilt as follows:

The determination of the grade and category of housing shall be carried out in accordance with Circular No. 05-BXD/DT dated February 9, 1993 of the Ministry of Construction on guiding the method for determining usable area and grading housing.
Article 2. The Standard Rental Price List for State-owned Housing prescribed in Article 1 of this Decision shall not apply to State-owned Housing that has been Renovated or Rebuilt; Official Housing; Social Housing built with state budget funds.
For State-owned Housing that has been Renovated or Rebuilt, the rental price shall be implemented according to the rental price of social housing prescribed in Decree No. 90/2006/NĐ-CP dated September 6, 2006 of the Government on "Detailed Provisions and Guidance on Implementation of the Law on Housing".
Article 3. Implementing exemptions and reductions in rent for housing that the State has not yet renovated or rebuilt as follows:
1. Exempt rent for the following groups:
a) Persons who were engaged in revolutionary activities before January 1, 1945; Mothers of Vietnam's Heroic Sons and Daughters; Heroes of People's Armed Forces, Labor Heroes; war invalids, persons receiving benefits equivalent to war invalids, war invalids type B, disabled veterans with a disability rate due to injury or illness from 81% upwards; dependents of martyrs currently receiving monthly pension support.
b) Groups entitled to rent reduction as stipulated in Clause 2 of this Article who are currently living alone without support (confirmed by the People's Committee of the commune, ward, town where the rented housing is located).
2. Reduce rent for the following groups:
a) Persons affected by toxic chemicals during the resistance war; war invalids, persons receiving benefits equivalent to war invalids, war invalids type B, disabled veterans with a disability rate due to injury or illness from 61% to 80%, will have their rent reduced by 90%.
b) Persons joining revolutionary organizations between January 1, 1945 and before the August 19 Revolution (as stipulated in Article 10 of the Preferential Treatment Ordinance for Those Contributing to the Revolution in 2005), war invalids, persons receiving benefits equivalent to war invalids, war invalids type B, disabled veterans with a disability rate due to injury or illness from 41% to 60%, will have their rent reduced by 80%.
c) Dependents of martyrs as stipulated in Clause 1 of Article 14 of the Preferential Treatment Ordinance for Those Contributing to the Revolution; war invalids, persons receiving benefits equivalent to war invalids, war invalids type B with a disability rate due to injury from 21% to 40%; persons contributing to the revolution currently receiving monthly allowances; persons contributing to the revolution awarded the Commemorative Medal "The Nation Honors Your Contributions" or the Certificate "Contributed to the Country", members of families contributing to the revolution awarded the Commemorative Medal "The Nation Honors Your Contributions" or the Certificate "Contributed to the Country" will have their rent reduced by 70%.
d) Persons engaged in revolutionary activities, resistance against the enemy captured and imprisoned; persons engaged in national liberation, defending the country and performing international duties awarded the Order of Resistance War First Class or the Order of Victory First Class will have their rent reduced by 65%.
3. Conditions for Rent Exemption and Reduction
a) Persons exempted or reduced in rent must be named in the housing lease contract (including representatives and other members named in the lease contract).
b) In cases where a person belongs to multiple groups entitled to rent exemption or reduction, the highest level of reduction shall be applied.
c) In cases where a household has two or more members entitled to rent reduction as stipulated in Clause 2 of this Article, the rent will be waived.
Article 4. Specific Provisions
1. The tenant of State-owned housing must ensure proper use of the housing and may not sublet it to others without authorization.
2. The tenant has the responsibility to fully fulfill financial obligations related to the leased housing; if the tenant fails to pay rent for three consecutive months or longer without a valid reason (such as being on a business trip, studying, or hospitalized), legal provisions regarding housing shall be applied to handle the situation.
Article 5. Responsibilities of Provincial and Municipal People's Committees
1. Based on the standard rental price list prescribed in Article 1 of this Decision, they shall establish specific rental prices for State-owned housing in their jurisdiction, ensuring compatibility with urban levels, location, height, and technical infrastructure conditions of the leased housing, in accordance with guidelines from the Ministry of Construction.
2. Depending on the duration of use, degree of damage, and deterioration of the leased housing, and the extent to which tenants have invested in repairing damages to the leased housing, rental prices may be adjusted downward but the maximum reduction shall not exceed 30% of the rent payable according to the prices set forth in this Decision.
3. In cases where the State adjusts the basic salary, provincial and municipal people's committees shall adjust the rental price of housing accordingly, in proportion to the increase in the basic salary.
Article 6. Responsibilities of the Ministry of Construction
1. To establish adjustment factors for prices to suit urban levels, location, height, and technical infrastructure conditions of the leased housing.
2. To coordinate with the Ministry of Finance to guide the collection and management, and use of rental income from State-owned housing, ensuring sufficient funding for management, maintenance, and repair to maintain the quality of the leased housing fund.
3. Directing, inspecting, and resolving any difficulties arising during the implementation of this Decision according to the authority granted.
Article 7. This Decision takes effect fifteen days after its publication in the Official Gazette. This Decision replaces Decision No. 118/TTg dated November 27, 1992, of the Government Prime Minister on rental prices for housing and incorporating housing payments into salaries. Provisions contrary to this Decision are abolished.
Article 8. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
