ISSUING REGULATIONS ON TROPICAL DEPRESSIONS, TYPHOONS, AND FLOODS

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

WHEREAS, THE LAW ON FLOOD AND STORM PREVENTION AND CONTROL OF MARCH 20, 1993, AND THE AMENDED AND COMPLEMENTED LAW ON FLOOD AND STORM PREVENTION AND CONTROL OF AUGUST 24, 2000;

WHEREAS, THE ORDINANCE ON EXPLOITATION AND PROTECTION OF METEOROLOGICAL AND HYDROLOGICAL FACILITIES dated December 2, 1994;

WHEREAS, DECREE NO. 24/CP OF MARCH 19, 1997, OF THE GOVERNMENT PROVIDING GUIDELINES FOR THE IMPLEMENTATION OF THE LAW ON METEOROLOGICAL AND HYDROLOGICAL WORKS EXPLOITATION AND PROTECTION;

Pursuant to Decree No. 08/2006/NĐ-CP dated January 16, 2006, issued by the Government, detailing certain provisions of the Ordinance on Flood and Storm Prevention, which was amended and supplemented on August 24, 2000;

CONSIDERING THE PROPOSAL OF THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT,

DECISION:

Article 1. ATTACHED TO THIS DECISION ARE THE REGULATIONS ON TROPICAL DEPRESSIONS, TYPHOONS, AND FLOODS.

Article 2. THIS DECISION SHALL TAKE EFFECT FROM MAY 1, 2011, AND REPLACE DECISION NO. 245/2006/QĐ-TTg OF OCTOBER 27, 2006, OF THE PRIME MINISTER ON THE ISSUANCE OF REGULATIONS ON TROPICAL DEPRESSIONS, TYPHOONS, AND FLOODS.

ALL PRIOR REGULATIONS ON THE RESPONSIBILITY SYSTEM FOR REPORTING TROPICAL DEPRESSIONS, TYPHOONS, AND FLOODS THAT CONTRADICT THIS DECISION SHALL BE ABOLISHED.

Article 3. THE MINISTER OF NATURAL RESOURCES AND ENVIRONMENT IS RESPONSIBLE FOR LEADING, ORGANIZING, DIRECTING, AND MONITORING THE IMPLEMENTATION OF THIS DECISION.

THE MINISTERS, HEADS OF GOVERNMENTAL BODIES AT THE SAME LEVEL AS MINISTRIES, HEADS OF GOVERNMENTAL BODIES, CHAIRPERSONS OF THE NATIONAL COMMITTEE FOR FLOOD AND STORM PREVENTION AND CONTROL, CHAIRPERSONS OF THE NATIONAL COMMITTEE FOR SEARCH AND RESCUE, AND CHAIRPERSONS OF THE PEOPLE'S COUNCILS OF PROVINCES AND URBAN CENTERS DIRECTLY UNDER THE CENTRAL GOVERNMENT ARE RESPONSIBLE FOR ENFORCING THIS DECISION./.
