Article 1. Position and Functions

1. The General Department of Population and Family Planning is an organization under the Ministry of Health, performing the function of advising and assisting the Minister of Health in state management and organizing the enforcement of laws Plan on population and family planning throughout the country, including areas such as population size, population structure, and population quality; organizing the implementation of public services related to population and family planning according to the provisions of the law. lThe General Department of Population and Family Planning has legal personality, bears the seal with the national emblem, and is a budgetary unit

Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of

a) resolutions DECREES:of the Government; draft decisions, directives of the Prime Minister; draft circulars, decisions, directives of the Minister of Health and other documents related to population and family planning;policies Strategies, plans, long-term, five-year, annual development programs, national target programs, action plans, projects, and important national works on population and family planning.on Issuing guiding documents within its authority regarding professional and operational matters related to population and family planning.

b) Assisting the Minister of Health in directing, monitoring, and inspecting the implementation of normative legal documents, strategies, plans, national target programs, projects, and proposals on population and family planning. trRegarding population size:

2. Managing population fluctuations, proposing solutions to adjust birth rates and population growth rates nationwide;

a) Building, guiding, inspecting, and organizing the implementation of indicators, measures, and solutions concerning population size, national technical standards for managing and using contraceptive devices according to the provisions of the law.

Managing organizational structure, staffing, finance, assets assigned; managing organizations under the General Department according to the division of responsibilities by the Minister of Health; implementing salary regulations and incentive policies, rewards, disciplinary actions, training, and capacity building for civil servants and employees under the jurisdiction of the General Department of Population and Family Planning according to the provisions of the law and the division of responsibilities by the Minister of Health.

12. Implementing administrative reform in the field of population and family planning according to the Ministry of Health's administrative reform plan.

13. Inspecting, auditing, handling complaints and grievances, and dealing with violations in the field of populationngplanning according to

Article 4. Leadership of the General Department of Population and Family Planning

1. The General Department of Population and Family Planning is an organization under the Ministry of Health, performing the function of advising and assisting the Minister of Health in state management and organizing the enforcement of laws Plan The General Department shall have a Director and not more than three Deputy Directors.

2. The Director and Deputy Directors trare appointed, dismissed, or removed from office by the Minister of Health in accordance with the provisions of the law.

3. The Director of the General Department of Population and Family Planning is responsible to the Minister of Health and to the law for all activities of the General Department. Deputy Directors are responsible to the Director and to the law for the areas assigned to them., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPThis Decision

Article 5. Effective Date

1. takes effect from May 10, 2013, and replaces Decision No. 18/2008/QĐ-TTg dated January 29, 2008, of the Government Chairman on the functions, tasks, authorities, and organizational structure of the General Department of Population and Family Planning under the Ministry of Health.shall Abolishes Decision No. 786/QĐ-BYT dated March 9, 2010, of the Minister of Health on the issuance of the Charter of Organization and Operation of the Training Center for Population and Health Cadres.

The Training Center for Population and Health Cadres under the Ministry of Health continues to operate until this Decision takes effect.

2. Article 6. Implementation Responsibility lThe Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen

of provincial-level People's Committees,ipopulation and family planning agencies, relevant agencies, organizations, and individuals are responsible for implementing this Decision.
