Regulations on the management and operation of civil aviation airports

Based on the Civil Aviation Law of Vietnam dated June 29, 2006 and the Law Amending and Supplementing Certain Provisions of the Civil Aviation Law of Vietnam dated November 21, 2014;
Based on the Land Law dated November 29, 2013;
Based on Decree No. 43/2014/NĐ-CP dated May 15, 2014 of the Government detailing the implementation of certain provisions of the Land Law;
Based on Decree No. 66/2015/NĐ-CP dated August 12, 2015 of the Government regarding air traffic control authorities;
Based on Decree No. 102/2015/NĐ-CP dated October 20, 2015 of the Government on the management and operation of civil aviation airports;

PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
Article 1. This Circular details the management and operation of civil aviation airports with civil aviation activities in Vietnam.
2. Contents regarding planning and managing airport planning; land management and use at airports; requirements for airport operation; construction, renovation, upgrading, maintenance, and repair management of facilities at airports; putting facilities into operation, temporarily closing airports; management and operation of aviation equipment and operational means at airports; ensuring airport operations; disaster prevention and rescue at airports; specialized aviation service business operations at airports are not applicable to dedicated airports as provided in this Circular.
Article 2. Applicability
This Circular applies to organizations and individuals related to civil aviation activities at Vietnamese airports.
Article 3. Definitions, Terminology, Abbreviations
1. Airport Reference Point (Aerodrome Reference Point) is the point marking the geographic location of the airport.
2. Airfield is the part of the airport used for aircraft takeoff, landing, and taxiing, including the runway and aprons.
3. Apron is the area designated within the airport where aircraft park to serve passengers boarding and disembarking; baggage loading and unloading; refueling; catering services; technical servicing or aircraft maintenance.
4. Runway is a rectangular area defined on the ground in the airfield used for aircraft takeoff and landing.
5. Runway Holding Position is the selected position on the taxiway or threshold area of the ILS/MLS system where aircraft and operational vehicles must stop and await instructions from air traffic controllers to continue taxiing, with the aim of ensuring safe runway operations without affecting the surface of the object-free zone (OLS).
6. Shoulder is the area adjacent to the edge of the prepared road surface designed to ensure smooth transition between the road surface and the adjacent surface.
7. Aircraft Safety Area on the Parking is the restricted area delineated by red lines around the aircraft parking position.
8. Specialized Aviation Equipment is equipment operating in restricted areas and internal airport roads, directly serving airport operations.
9. Internal Airport Road is the route for vehicles to move within the airfield, excluding aircraft.
10. Internal Airport Road is the road within the airport boundary, excluding local managed roads and internal airport roads.
11. Airport Operation Documents include airport operation documents and infrastructure facility operation documents at the airport.
12. Facility Operator is an organization or individual directly managing and operating facilities at the airport.

Chapter II
PLANNING AND MANAGEMENT OF AIRPORT PLANNING
Article 4. Preparing and Approving Planning Tasks, Adjusting Comprehensive Development Plans for the National Civil Aviation Airport System
1. Content of planning tasks, adjusting comprehensive development plans for the national civil aviation airport system includes: a) Legal basis and necessity;
b) Arguments and grounds for forming the scope, objectives, development orientation, and planning period;
c) Overview of forecasts for air transport demand, development needs of related industries, national economy and society;
d) Requirements for data collection, analysis, evaluation of current status, and strategic environmental assessment in civil aviation transportation infrastructure;
e) Determination of development indicators, functions of each airport; specific requirements for air route network planning, aircraft fleet, flight operation management, aviation industry, human resources and training institutions, airlines, and development potentials and driving forces at different stages;
f) Determination of product catalogues and quantities;
g) Determination of solutions, schedules, and implementation organization;
h) Determination of budget estimates and funding sources for planning preparation.
h) Determine the budget and funding sources for planning, detailed planning of civil aviation airports, detailed construction planning of functional areas of civil aviation airports in accordance with the provisions of the law..
2. The Civil Aviation Authority of Vietnam shall be responsible for organizing the establishment and submitting to the Ministry of Transport for approval the tasks of master planning and adjusting the master planning for the development of the national system of airports and airfields.
Article 5. Establishment and Approval of Tasks for Detailed Planning and Adjusting Detailed Planning of Airports and Airfields
1. The contents of the tasks for detailed planning and adjusting detailed planning of airports and airfields include:
a) Arguments, scope, boundaries for planning and adjusting detailed planning of airports and airfields, bases for planning; determining the objectives and tasks of the planning;
b) Determining the nature and role of airports and airfields. Preliminary forecasting the nature and scale of airports and airfields along with basic indicators regarding land and technical infrastructure;
c) Determining requirements and surveying, evaluating the current status, natural conditions, topographical conditions of the area to select runway directions and establish flight procedures;
d) Determining requirements, scope, volume of topographical surveys, volume of geological surveys in the proposed areas for detailed planning of airports and airfields;
đ) Requirements for strategic environmental assessment and other requirements appropriate to the specific development goals of the area;
e) Determining the list, quantity of files, products, schedule, and organization of implementation;
g) Determining the total budget estimate and sources of funding for planning.
2. The Civil Aviation Authority of Vietnam shall be responsible for organizing the establishment and submitting to the Ministry of Transport for approval the tasks for detailed planning and adjusting detailed planning of airports and airfields..
Article 6. Establishment and Approval of Tasks for Detailed Planning and Adjusting Detailed Planning of Construction Functional Areas of Airports and Airfields
1. The contents of the tasks for detailed planning and adjusting detailed planning of construction functional areas of airports and airfields include:
a) Determining the boundaries, area of the region for establishing or adjusting detailed planning; land use indicators, technical infrastructure;
b) Basic principles for analyzing and assessing natural conditions, current status; requirements for maximum building height allowed; requirements for organizing architectural landscape space and technical infrastructure ensuring compatibility with detailed planning of airports and airfields;
c) Determining the list, quantity of files, products; schedule, and organization of implementation;
d) Determining the total budget estimate and sources of funding for detailed planning of construction functional areas of airports and airfields.
2. The Civil Aviation Authority of Vietnam shall approve the tasks for detailed planning and adjusting detailed planning of construction functional areas of airports and airfields.
Article 7. Utilization of Financial Sponsorship from Domestic and Foreign Organizations and Individuals for Airport and Airfield Planning
1. Financial sponsorship for planning of airports and airfields from domestic and foreign organizations and individuals is voluntary non-repayable financial assistance.
2. Based on the need for planning and the ability to meet funding from the state budget, the Civil Aviation Authority of Vietnam shall announce the list of airport and airfield planning projects requiring the use of non-state budget funding for planning.
3. The Civil Aviation Authority of Vietnam shall organize the receipt, management, and effective utilization of sponsorship funds for overall development planning of the national system of airports and airfields, detailed planning of airports and airfields, detailed planning of construction functional areas of airports and airfields in accordance with the provisions of the law., detailed planning for civil aviation airports, detailed construction planning for functional zones of civil aviation airports in accordance with the provisions of the law.
Article 8. Procedures for establishing, adjusting, and submitting the overall master plan for the development of the national civil aviation airport system
1. The Civil Aviation Authority of Vietnam shall organize the establishment and adjustment of the overall master plan for the development of the national civil aviation airport system and submit it to the Ministry of Transport. The dossier for approval of the overall master plan for the development of the national civil aviation airport system includes the following documents:
a) A proposal requesting approval of the planning;
b) Planning dossier, including the planning description, strategic environmental assessment report, and related drawings;
c) Opinions from relevant agencies and units;
d) Explanations on opinions from relevant agencies and units;
đ) Number of dossiers: 15 sets.
2. Within 60 days from the date of receiving all dossiers, the Ministry of Transport shall be responsible for soliciting opinions from relevant agencies and units, completing the dossier, and submitting it to the Prime Minister for examination and approval.
Article 9. Procedures for establishing, adjusting, reviewing, and approving detailed master plans for civil aviation airports
1. The Civil Aviation Authority of Vietnam shall organize the establishment and adjustment of detailed master plans for civil aviation airports and submit them to the Ministry of Transport. The dossier for approval of detailed master plans for civil aviation airports includes the following documents:
a) A proposal requesting approval of the planning;
b) Planning dossier, including the planning description and related drawings;
c) Opinions from relevant agencies and units;
d) Explanations on opinions from relevant agencies and units;
đ) Number of dossiers: 15 sets.
2. Within 45 days from the date of receiving all dossiers, the Ministry of Transport shall be responsible for soliciting opinions from relevant agencies and units, organizing reviews, and approving detailed master plans for civil aviation airports.
Article 10. Procedures for establishing, adjusting, reviewing, and approving detailed construction master plans for functional zones of civil aviation airports
1. The Civil Aviation Authority of Vietnam shall organize the establishment, adjustment, and approval of detailed construction master plans for functional zones of civil aviation airports.
2. The approval dossier includes:
a) A proposal requesting approval of the planning;
b) Planning dossier, including the planning description and related drawings;
c) Opinions from relevant agencies and units;
d) Explanations on opinions from relevant agencies and units.
Article 11. Public announcement of the master plan for civil aviation airports
1. Within 30 days from the date of approval, the master plan for civil aviation airports must be publicly announced.
2. The Ministry of Transport shall organize the public announcement of the overall master plan for the development of the national civil aviation airport system; coordinate with provincial People's Committees as required by law to organize the public announcement of detailed master plans for civil aviation airports.
3. The Civil Aviation Authority of Vietnam shall organize the public announcement of detailed construction master plans for functional zones of civil aviation airports at civil aviation airports as required.
Article 12. Responsibilities of the Civil Aviation Authority of Vietnam in managing the master plan
1. Supervise the implementation of the master plan for civil aviation airports.
2. Provide planning information to organizations and individuals upon request.
3. Report annually to the Ministry of Transport on the implementation of master plans for civil aviation airports or when requested by the Ministry of Transport.
Article 13. Responsibilities of the Civil Aviation Port Authority in managing the master plan
1. Inspect and supervise the implementation of the master plan for civil aviation airports.
2. Provide planning information to organizations and individuals upon request.
3. Coordinate with local authorities to manage boundary markers and boundaries of civil aviation airports according to approved master plans.
4. Report annually to the Civil Aviation Authority of Vietnam on the implementation of master plans for civil aviation airports or when requested by the Civil Aviation Authority of Vietnam.
Chapter III
MANAGEMENT AND USE OF LAND AT CIVIL AVIATION AIRPORTS
Article 14. Determination of Land Boundaries
1. Land at civil airports includes:
a) Land within areas exclusively used for civilian activities;
b) Land within areas exclusively used for military activities;
c) Land within areas jointly used for civilian and military activities managed by the military;
d) Land within areas jointly used for civilian and military activities managed by civilians.
2. Based on detailed planning of civil airports that have been approved by competent authorities, the Civil Aviation Administration of Vietnam shall take the lead and coordinate with the Air Defense and Air Force Command and related units to determine land boundaries within areas exclusively used for civilian activities and land within areas jointly used for civilian and military activities managed by civilians; report to the Ministry of Transport and the Ministry of National Defense for unified approval and approval according to regulations.
3. The Civil Aviation Authority shall implement boundary markers according to the land boundaries of civil airports within the management scope approved by the competent authority.
Article 15. Determination and Registration of Land Use Requirements in Planning and Adjusting Land Use Plans
1. Based on the overall planning for the development of the national civil airport system and detailed planning of civil airports that have been approved by competent authorities, the Civil Aviation Administration of Vietnam shall be responsible for determining land use requirements for building civil airports, report to the Ministry of Transport to register with the competent authority for national and provincial land use planning according to the laws on land.
2. Based on national and provincial land use plans that have been approved by competent authorities, the Civil Aviation Authority shall determine and consolidate land use requirements for the year's plan to build and expand civil airports and send registration documents to the People's Committee of the district, town, city under province (hereinafter referred to as the District People's Committee) where the land is located six months before January 1 of the following planning year after obtaining the consent of the Ministry of Transport.
Article 16. Basis for Allocation and Leasing of Land
1. Detailed planning of civil airports that have been approved by competent authorities.
2. Land use requirements reflected in investment projects, requests for land allocation and leasing.
Article 17. Procedures for Land Allocation
1. Organizations requiring land use submit one set of application documents for land allocation directly or through postal services or other means to the Civil Aviation Authority. The application documents for land allocation include:
a) Request for land allocation according to Model No. 01 stipulated in the Appendix issued together with this Circular;
b) A copy of the business registration certificate for air service providers at civil airports;
c) A certified copy of the investment orientation approval document, investment approval decision, and investment registration certificate;
d) Extract from the cadastral map of the land plot or cadastral survey of the land plot.
2. In cases where the application documents are incomplete or invalid, within three working days from the date of receipt of the documents, the Civil Aviation Authority shall notify and guide the applicant to supplement and complete the documents according to regulations.
3. Within five working days from the date of receipt of valid documents, the Civil Aviation Authority shall notify in writing the reasons for rejecting the land allocation request or issue a land allocation decision according to Model No. 02 stipulated in the Appendix issued together with this Circular; the organization shall hand over the land on-site and prepare a handover record according to Model No. 04 stipulated in the Appendix issued together with this Circular.
4. Within five working days from the date of the land allocation decision, the Civil Aviation Authority shall be responsible for sending the land allocation decision, extract from the cadastral map, or cadastral survey of the land plot to the Civil Aviation Administration of Vietnam and the Land Registration Office to update and amend the cadastral records and land database.
Article 18. Procedures for leasing land without public auction of land use rights
1. Organizations and individuals requiring land use shall submit one set of documents directly or through the postal system or by other appropriate means to the Civil Aviation Authority. The application for land lease includes:
a) Application for land lease according to Form No. 01 prescribed in the Appendix attached hereto;
b) Certified copy of the investment approval document, decision approving investment, and investment registration certificate;
c) Certified copy of the business registration certificate for air service providers and non-air service providers at airports and airfields;
d) Extract from the cadastral map of the land plot or cadastral survey of the land plot.
2. In case the submitted documents are incomplete or invalid, within no more than three working days from the date of receipt of the documents, the Civil Aviation Authority shall notify and guide the applicant to supplement and complete the documents in accordance with regulations.
3. Within no more than three working days from the date of receipt of valid documents, the Civil Aviation Authority shall send land administrative information to the tax authority to determine the rental price of the land or notify in writing the organization or individual applying for land lease of the reasons for rejecting the land lease.
4. Within no more than five working days from the date of receipt of the tax authority's notification on the rental price of the land, the Civil Aviation Authority shall issue the land lease decision according to Form No. 03 prescribed in the Appendix attached hereto; conduct on-site land handover and prepare the handover record according to Form No. 04 prescribed in the Appendix attached hereto; sign the land lease contract according to Form No. 05 prescribed in the Appendix attached hereto.
5. Within no more than five working days from the date of issuance of the land lease decision, the Civil Aviation Authority shall be responsible for sending the land lease decision, extract of the land administrative map of the plot of land, or land administrative survey of the plot of land to the Vietnam Civil Aviation Administration and the Land Registration Office to update and amend the land administrative files and land database.
Article 19. Leasing land through public auction of land use rights
1. The Civil Aviation Authority shall be responsible for organizing and implementing the leasing of land through public auction of land use rights in accordance with the provisions of the law.
2. The Civil Aviation Authority shall approve the results of the successful bid for land use rights; send the decision approving the results of the successful bid for land use rights, extracts or surveys of the land administrative map of the area to the Vietnam Civil Aviation Administration and the Land Registration Office where the land is located to update and amend the land administrative files and land database; sign the land lease contract with organizations and individuals who have successfully bid for land use rights.
Article 20. Extension of land lease period
1. The extension of the land lease period shall be based on the detailed planning of the airport and airfield approved by the competent authority and the land use needs of organizations and individuals using the land.
2. At least six months before the expiration of the minimum lease term, organizations and individuals using the land shall submit one set of documents directly or through the postal system or by other appropriate means to the Civil Aviation Authority. The documents include:
a) Application for extension of the land lease period;
b) Original decision on land lease and land lease contract; financial settlement documents regarding land-related financial obligations in accordance with the law;
c) Document from the competent authority regarding adjustment of the investment project for cases where there is a change in the project operation period due to investment project adjustment (if applicable);
d) Document from the competent authority regarding the extension of the investment project period.
3. In case the submitted documents are incomplete or invalid, within no more than three working days from the date of receipt of the documents, the Civil Aviation Authority shall notify and guide the applicant to supplement and complete the documents in accordance with regulations.
4. Within no more than three working days from the date of receipt of valid documents, the Civil Aviation Authority shall send land administrative information to the tax authority to determine the rental price of the land or notify in writing the organization or individual applying for extension of the land lease of the reasons for rejecting the extension of the land lease.
5. Within no more than five working days from the date of receipt of the tax authority's notification on the rental price of the land, the Civil Aviation Authority shall issue the decision on extension of the land lease and sign the land lease contract with the organization or individual using the land.
6. Within no more than five working days from the date of issuance of the decision on extension of the land lease, the Civil Aviation Authority shall be responsible for sending the decision on extension of the land lease to the Vietnam Civil Aviation Administration and the Land Registration Office where the land is located to update and amend the land administrative files and land database.
Article 21. Procedures for land recovery due to violation of laws
1. In cases where there is a violation of laws that requires land recovery, upon expiration of the administrative penalty statute of limitations as prescribed by the law on handling administrative violations, the authority with the power to impose penalties shall be responsible for drafting an administrative violation record as the basis for the decision to recover the land.
In cases where there is a violation of land laws not subject to administrative penalties under the law on administrative penalties in the field of land, the competent supervisory and inspection agency shall draft a record confirming the violation act as the basis for the decision to recover the land.
2. Within no more than seven days from the date of drafting the record of the violation act, the competent supervisory and inspection agency shall be responsible for sending the record of the violation act to the Civil Aviation Port Authority.
3. Within no more than five working days from the date of receipt of the record of the violation act, the Civil Aviation Port Authority shall be responsible for reviewing and verifying the situation on-site if necessary, and issuing the land recovery decision according to Model No. 06 stipulated in the Appendix issued together with this Circular.
4. Within no more than five working days from the date of issuance of the land recovery decision, the Civil Aviation Port Authority shall be responsible for sending the land recovery decision, extract or survey map of the recovered land area to the Civil Aviation Administration of Vietnam and the Land Registration Office to update and amend the land records and land database.
Article 22. Procedures for land recovery due to termination of land use according to the law, voluntary return of land
1. The Civil Aviation Port Authority shall implement procedures for land recovery due to termination of land use according to the law, voluntary return of land when:
a) Receiving a document returning the land from organizations or individuals to whom the Civil Aviation Port Authority has transferred land without payment of land use fees or leased land, now moving to another place, reducing or no longer having a need to use the land;
b) Receiving a decision on dissolution or bankruptcy from the competent authority regarding organizations to which the Civil Aviation Port Authority has transferred land without payment of land use fees or leased land;
c) Receiving a death certificate or a decision declaring a person dead according to the law and a confirmation document of no heir from the competent authority regarding individuals to whom the Civil Aviation Port Authority has leased land.
2. Within no more than five working days from the date of receipt of the documents specified in Clause 1 of this Article, the Civil Aviation Port Authority shall be responsible for reviewing and verifying the situation on-site if necessary; issuing the land recovery decision according to Model No. 06 stipulated in the Appendix issued together with this Circular.
5. Within no more than five working days from the date of issuance of the land recovery decision, the Civil Aviation Port Authority shall be responsible for sending the land recovery decision, extract or survey map of the recovered land area to the Civil Aviation Administration of Vietnam and the Land Registration Office to update and amend the land records and land database.
Article 23. Management of land files at civil aviation ports and airports
1. The Civil Aviation Port Authority shall be responsible for managing all land files of civil aviation ports and airports.
2. Land files of civil aviation ports and airports include:
a) Decisions on land allocation, certificates of land use rights, ownership certificates of houses and other assets attached to the land for civil aviation activities at civil aviation ports and airports granted by provincial People's Committees or municipal People's Committees directly under the Central Government to the Civil Aviation Port Authority;
b) Files requesting land allocation and leasing submitted by organizations and individuals.
c) Other related documents.
Chapter IV
MANAGEMENT OF CIVIL AVIATION PORTS AND AIRPORTS
Section 1
REQUIREMENTS FOR CIVIL AVIATION PORTS AND AIRPORT OPERATIONS
Article 24. General Requirements
1. Airports, airfields, and airport infrastructure construction works shall be designed and operated in accordance with ICAO standards, applicable technical regulations, and the provisions of this Circular.
2. Airports and airfields must have approved and issued airport operation manuals and airport infrastructure operation manuals in accordance with the prescribed regulations.
3. Airport infrastructure construction works must be regularly inspected, spot-checked, and maintained to ensure compliance with design standards, operational standards, and issued operation manuals.
4. The airport operator is responsible for organizing the management and operation of airports and airfields; ensuring aviation safety, aviation security, and service quality in accordance with prescribed standards and conditions; issuing and implementing airport operation manuals.
5. The operator of the construction work is responsible for organizing the management and operation of the construction work within their scope of management; ensuring aviation safety, aviation security, and service quality in accordance with prescribed standards and conditions; issuing and implementing construction work operation manuals.
6. The Civil Aviation Authority establishes plans and delineates responsibilities for constructing and managing the perimeter fence of airports and airfields; assigns the responsibility for constructing and managing the perimeter fence within the scope of management of units and enterprises at airports and airfields.
7. The Civil Aviation Administration and the Civil Aviation Authority are responsible for building, storing, and updating technical documentation systems to serve the issuance of airport operation certificates and airport operations, including Vietnam's technical standards, ICAO regulations, and foreign standards recognized or applied by the Civil Aviation Administration related to airport infrastructure design, operation, and maintenance.
8. The Civil Aviation Administration is responsible for reviewing, evaluating, and implementing measures to ensure airport operation safety and informing ICAO of differences between Vietnamese legal regulations and ICAO standards.
Article 25. Requirements for Airport Infrastructure
1. Airport infrastructure is shared for airport activities, except for aircraft parking areas assigned concurrently to aircraft maintenance facilities.
2. The airport operator is responsible for constructing, managing, maintaining, and servicing airport infrastructure within their assigned management scope, ensuring compliance with legal regulations and airport operation manuals.
3. The operation of runways, taxiways, and aircraft parking areas must comply with published technical parameters and safety operation regulations. The Civil Aviation Administration issues guidelines on implementing safety operation regulations for runways, taxiways, and aircraft parking areas.
4. The service provider for flight support operations leads and coordinates with the airport operator to develop aircraft operation plans on runways, taxiways, and aircraft parking areas.
The airport operator is responsible for coordinating with the service provider for flight support operations to develop aircraft operation plans on runways, taxiways, and aircraft parking areas; updating these plans into the airport operation manual, except in cases of temporary application during renovation, upgrading, or repair phases.
5. The airport operator is responsible for determining and re-determining the main technical parameters of runways, taxiways, and aircraft parking areas when changes occur; reporting to the Civil Aviation Administration.
The Civil Aviation Administration publishes the main technical parameters of airports and airfields according to ICAO standards in the Aeronautical Information Publication.
6. The main technical parameters of runways include:
a) Runway identification code;
b) Runway length and width;
c) Shoulder length and width;
d) Approach surface, runway end safety area, stopway, and clearway;
đ) Runway threshold coordinates (WGS-84 coordinates);
e) Runway longitudinal slope;
g) Runway lateral slope;
h) Runway load-bearing capacity;
i) Surface layer type of runway and shoulders;
k) Friction coefficient;
l) Published distances: TORA, TODA, ASDA, LDA.
7. The main technical parameters of taxiways include:
a) Taxiway identification code;
b) Taxiway length and width;
c) Shoulder length and width;
d) Taxiway longitudinal slope;
đ) Taxiway lateral slope;
e) Taxiway load-bearing capacity;
g) Surface layer type of taxiway;
h) Taxiway strip.
8. Operation plans and aircraft parking position diagrams include:
a) Aircraft operation plan from runway, taxiway to parking area and vice versa;
b) Painted layout diagram of runway, taxiway, and aircraft parking area and parking positions;
c) Parking position coordinates and ground movement guidance system positions (WGS-84 coordinates);
d) Aircraft type for each parking position;
đ) Operation procedures and service provision plans for each parking position.
9. The airport operator must ensure that taxiways and aircraft parking areas are equipped with sufficient signal markings, signs, or lights to guide aircraft safely to parking positions according to standards; providing aircraft escort vehicle services (follow-me) only upon request of the aircraft operator. For airports that do not meet full standards for safe aircraft self-movement to parking positions, the airport operator is responsible for providing free escort vehicle services to guide aircraft to parking positions; reporting to the Civil Aviation Administration the plan to improve airport infrastructure.
10. The airport operator must assess the impact on operational safety when there are changes to the technical parameters and operation plans of airport infrastructure.
11. Persons and means shall only enter the airfield to perform tasks and must ensure the following requirements:
a) Strictly comply with all regulations on security and safety work at civil airports and aerodromes;
b) Maintain continuous communication via walkie-talkies with the air traffic control tower and ground control, strictly follow the instructions of air traffic controllers;
c) Wear reflective vests or vests equipped with reflective strips;
d) Maintain the minimum safe distance from aircraft according to ICAO standards based on the airport category when aircraft are operating.
12. The operator of civil airports and aerodromes must establish and install signage, lights, directional signs, signal markings, and prohibitory signs for airport infrastructure to guide and ensure operational safety; implement measures to prevent unauthorized intrusion that threatens safety on runways, taxiways, and aprons; set up waiting areas at intersections between taxiways and runways, standby positions, and internal road waiting positions; assess risks to ensure the safety of the area around the runway in case of overrunning or undershooting during takeoff or landing.
13. The operator of civil airports and aerodromes must arrange at least one isolated aircraft parking position for emergency situations at the airport, disease prevention, or aviation security and national defense security scenarios. The isolated aircraft parking position must be located far from other aircraft parking positions, buildings, or public facilities, ensuring convenience for security, safety, firefighting, and operational handling. Isolated aircraft parking positions should not be arranged above underground structures such as fuel storage tanks, fuel supply pipeline systems, power cables, or information cables.
14. The aircraft maintenance and repair area must be separated from the passenger terminal and cargo areas to minimize noise, exhaust gas, and fuel impact on the passenger terminal and cargo areas; there must be a system for collecting and treating wastewater, oil waste, and other hazardous waste to meet environmental technical standards.
15. The runway end safety areas, side safety areas, and other safety areas must comply with ICAO standards and the following requirements:
a) Ensure tightness and flatness; grass on the safety areas must be maintained at no more than 30 cm high;
b) The installation of auxiliary navigation equipment within the safety areas must comply with Vietnamese laws on airspace obstruction management and Annex 14 of the Chicago Convention.
16. Aircraft operations at civil airports and aerodromes must be consistent with the published load-bearing capacity of runways, taxiways, and aprons. For specific operational conditions, the Civil Aviation Administration of Vietnam will consider and decide on the applicable standards for aircraft operations where the Aircraft Classification Number (ACN) exceeds the Pavement Classification Number (PCN) of the runway, taxiway, or apron.
17. The operator of civil airports and aerodromes is responsible for measuring the load-bearing capacity of runways, taxiways, and aprons, removing rubber marks from runways; measuring the surface friction coefficient of new or upgraded runways; periodically or urgently measuring the surface friction coefficient of runways according to the guidance of the Civil Aviation Administration of Vietnam to ensure the minimum allowable surface friction coefficient of runways. The load-bearing capacity of runways, taxiways, and aprons and the surface friction coefficient of runways are published in the Aeronautical Information Publication and airport operation manuals. In cases necessary to ensure operational safety, the Civil Aviation Administration of Vietnam will designate competent entities with legal personality to conduct load-bearing capacity and friction coefficient measurements; the costs of these measurements shall be borne by the operator of civil airports and aerodromes.
18. The operator of civil airports and aerodromes is responsible for regularly inspecting the condition of runway surfaces, taxiways, and aprons to remove foreign objects; determine and announce the waterlogging status affecting operational activities in the airfield to service providers for flight operations to manage flight safety and ground operations according to regulations.
19. The operator of civil airports and aerodromes must implement measures to prevent aircraft from moving onto closed runways, taxiways, and aprons.
Article 26. Requirements for traffic within airports
1. Traffic routes within airports include:
a) Internal traffic routes within the airport;
b) Internal traffic routes within the air cargo terminal.
2. The airport operator is responsible for constructing, maintaining, and repairing internal traffic routes within the airport.
3. The Civil Aviation Authority is responsible for planning and organizing the construction and maintenance of internal traffic routes within the air cargo terminal according to the master plan using state budget funds as prescribed or allocating implementation costs to the relevant units.
4. Traffic within the airport must comply with the airport operation documentation.
5. Traffic outside the airport shall be carried out in accordance with the provisions of the law on traffic.
Article 27. Requirements for passenger terminals and cargo terminals
1. Passenger terminals and cargo terminals must have necessary areas for processing procedures according to the service process for passengers and goods; working areas for related state management agencies; areas reserved for passengers who do not meet entry conditions at international air cargo terminals; lost luggage procedures area; lost luggage storage area and unclaimed luggage; common area for resolving complaints between passengers and airlines and service providers; information guidance counters or equipment for passengers; medical assistance and initial first aid areas for passengers; quarantine areas for responding to urgent health situations; areas and equipment serving passengers requiring special assistance.
2. Service providers operating terminals must maintain and ensure minimum hygiene conditions as follows:
a) Terminals must be kept clean, dry, and have safety warning signs;
b) Passenger terminal restrooms must have name tags of the person in charge of cleaning and the time and content of the work performed.
3. Signage systems in the terminal must be fully installed and clearly visible at passenger and cargo processing areas, baggage handling areas, and other necessary areas as prescribed.
4. In renovation and repair areas within the terminal, partitions and measures ensuring safety, security, environmental hygiene, and notices about renovations and repairs must be provided.
5. Service providers operating passenger and cargo terminals must develop fire prevention plans, organize training, drills, and regular inspections for fire prevention in accordance with the law.
6. Maintenance procedures and plans for terminal components must be approved and implemented according to the approved maintenance plan.
7. Service providers operating passenger and cargo terminals issue, organize the dissemination, and supervise compliance with terminal operation documentation.
8. Service providers operating passenger terminals arrange positions to promote distinctive Vietnamese culture suitable for specific conditions of each air cargo terminal.
9. Service providers operating passenger terminals select authorized taxi operators at the terminal based on principles ensuring competition and transparency; publicly announce in the terminal the authorized taxi companies, taxi fares; ensure taxi service capacity meets actual terminal needs; ensure civility, courtesy, and public order in taxi operations; issue regulations for taxi operation control, with specific measures for dealing with violations by taxi companies and drivers according to agreed terms; organize dispatch counters and develop operational plans ensuring safety, order, and no congestion in taxi activity areas; ensure a minimum number of authorized taxis meeting passenger throughput requirements during operational hours.
Article 28. Requirements for Aircraft Fuel Supply Infrastructure
1. The components of aircraft fuel supply infrastructure include: fuel storage tanks, fuel reservoirs; fuel refueling stations, fuel distribution stations; fuel supply pipeline systems.
2. Fuel storage facilities, fuel reservoirs, refueling stations, and pipeline systems must be designed according to applicable standards and maintain safe distances as prescribed by laws on protecting the safety of fuel facilities, fire prevention and fighting, and environmental protection.
3. Enterprises permitted to supply fuel at airports must develop fuel supply plans, layout diagrams for fuel reservoirs, refueling stations, and aircraft fuel supply pipeline systems (if any).
Article 29. Requirements for Power Supply Systems
1. Aviation facilities and equipment at airports must be maintained with continuous and backup power supply as specified in the operational documentation for such facilities and equipment.
2. The time required to switch from the regular power system to the backup power system must meet the standards set for each component and piece of equipment at the airport.
3. The airport operator is responsible for planning the construction, maintenance of the common power supply system at the airport in accordance with the approved detailed master plan of the airport; using agencies and units must pay the shared maintenance costs to the airport operator as agreed upon.
4. Based on the approved detailed functional area development plan, aviation service enterprises have the right to establish their own power supply systems.
Article 30. Requirements for Water Supply and Drainage Systems
1. The operator of the facility must organize inspections and ensure that the water quality supplied within the managed facility meets the prescribed standards.
2. The drainage system in the airfield area must be connected smoothly to the overall drainage system of the airport and adjacent areas; there must be a drainage plan for the highest predicted rainfall.
3. Wastewater must be collected and treated before being discharged into receiving sources in accordance with environmental protection laws.
4. The airport operator is responsible for establishing protective systems and specific procedures to prevent unauthorized access through drainage systems; they are also responsible for constructing, maintaining, and repairing the common water supply and drainage systems at the airport in accordance with the approved detailed master plan of the airport; using agencies and units must pay the shared maintenance costs to the airport operator as agreed upon.
5. In cases where the water supply and drainage systems primarily serve certain units or enterprises, the Civil Aviation Authority shall designate relevant enterprises to be responsible for constructing, maintaining, and repairing these systems and allocating the implementation costs.
Article 31. Requirements for Air Transport Security Infrastructure
1. Standards for air transport security infrastructure shall be implemented in accordance with laws on air transport security.
2. The airport operator is responsible for constructing and managing the operation of the following facilities:
a) Facilities serving air transport security and emergency services at the airport;
b) Perimeter fencing facilities ensuring air transport security in the airfield area.
Article 32. Requirements for infrastructure serving emergency airport operations and fire prevention at airports
1. The airport operator must invest in building airport infrastructure to meet the regulations on fire prevention and emergency airport operations, specifically:
a) Having a fire truck parking area, warehouse, materials, tools, equipment, raw materials to serve emergency airport operations and fire prevention according to applicable standards; the location of the fire truck parking area must be arranged within a restricted zone with convenient traffic access to quickly reach runways, taxiways, aprons, consistent with emergency airport operation plans;
b) Ensuring the number of fire trucks, water capacity, foam and powder quantities appropriate to the approved airport firefighting level;
c) Establishing an emergency airport coordination center and an emergency alarm station ensuring adequate manpower, means of transportation, equipment, communication systems, documentation, and emergency situation handling plans to perform duty shifts and respond to all emergency situations;
d) Establishing a service road system to serve emergency airport operations ensuring that emergency operation vehicles can quickly reach positions within the airfield in accordance with specified timeframes.
2. The airport operator shall issue procedures for inspecting infrastructure components and equipment; maintain materials, supplies, and water reserves to serve emergency airport operations and fire prevention at airports.
Article 33. Requirements for aircraft parking lot lighting systems and aviation security fencing
1. The aircraft parking lot lighting system provides sufficient light to assist pilots in maneuvering aircraft into and out of parking positions; provides sufficient light for passenger boarding and disembarkation, baggage loading and unloading, refueling, and other services related to aircraft; ensures the security of the airport. Parking lot lights must not directly face the air traffic control tower, ground control tower, or the direction of aircraft landing and taxiing into parking positions; if the parking lot does not have fixed lighting equipment, mobile lighting equipment must be available to provide lighting for aircraft.
2. The security fence and gate lighting systems must be reasonably arranged, providing sufficient brightness for nighttime personnel and vehicle checks and intrusion detection without causing glare that hinders functional force patrols or other aviation activities.
Article 34. Airport Operation Safety Supervisors and Air Service Quality Supervisors at Airports
1. Air service quality supervisors and airport operation safety supervisors under the Civil Aviation Administration of Vietnam and Airport Authorities are issued supervisor cards by the Civil Aviation Administration of Vietnam to perform their duties.
2. Individuals holding airport operation safety supervisor cards must meet the following conditions:
a) Graduated from a university in engineering, construction, or law;
b) Have at least five years of work experience in airport management and operation;
c) Possess proficient English language skills (TOEIC 450 or equivalent and above);
d) Hold training certificates on airport operation standards, safety supervision issued by the Civil Aviation Administration of Vietnam or qualified aviation staff training institutions.
3. Airport operation safety supervisors have the following authorities:
a) To supervise, inspect, investigate, and verify compliance with airport operation safety regulations;
b) To access operational areas at airports during duty performance times;
c) To request organizations and individuals involved to provide relevant documents or evidence concerning aviation safety incidents or investigations;
d) To inspect and copy licenses, certificates, technical logs, documents, or files related to airport management and operation;
đ) To temporarily suspend the activities of aviation staff at airports to prevent and stop threats to aviation safety, fire hazards at airports, and to assist in incident investigations; to record incident details.
4. Air service quality supervisors at airports must meet the following conditions:
a) Graduated from a university in economics, engineering, or law;
b) Have at least five years of work experience in airport management and operation or air transport;
c) Possess proficient English language skills (TOEIC 450 or equivalent and above);
d) Hold training certificates on air service provision standards and air transport issued by the Civil Aviation Administration of Vietnam or qualified aviation staff training institutions.
5. Air service quality supervisors at airports have the following authorities:
a) To supervise, inspect, and verify compliance with air service quality regulations at airports;
b) To access operational areas at airports during duty performance times;
c) To request organizations and individuals involved to provide relevant documents or evidence concerning air service provision and air transport at airports or to assist in verifying violations of this Circular;
d) To inspect and copy licenses, certificates, documents, or files related to air service provision and air transport at airports;
đ) To temporarily suspend the activities of aviation staff at airports in cases of serious breaches of air service provision commitments and standards at airports; to record incident details.
6. In cases where violations of laws on the management and operation of civil aviation airports are discovered, directly affecting operational safety, the airport operational safety supervisors and air service quality supervisors shall immediately report to the Civil Aviation Authority of Vietnam to take urgent measures to suspend the operations and services provided by organizations and individuals constructing, operating facilities, or providing related services at the airport.
7. The airport operational safety supervisors and air service quality supervisors shall be responsible for their decisions in accordance with the provisions of the law.
8. The supervision, inspection, investigation, and verification files of the airport operational safety supervisors and air service quality supervisors shall be stored at the Civil Aviation Authority of Vietnam and the Airport Affairs Office for five years.
9. Organizations and individuals involved must strictly comply with the decisions and requirements of the supervisors when performing their duties.
10. The Civil Aviation Authority of Vietnam shall issue guidance documents regarding the procedures and contents of inspections and supervisions conducted by the airport operational safety supervisors and air service quality supervisors.
Article 35. Requirements for Reporting Accidents, Incidents, and Safety Events at Civil Aviation Airports
1. Depending on the nature and degree of threat to the operational safety of civil aviation airports, accidents, incidents, and safety events at civil aviation airports are classified as follows:
a) Accident (Level A): aircraft accidents occurring at civil aviation airports; incidents causing death during the operation and provision of air services at civil aviation airports;
b) Serious Incident (Level B): serious aircraft incidents occurring at civil aviation airports; serious safety incidents leading to temporary closure of runways, taxiways, aircraft parking areas, or temporary closure of civil aviation airports; incidents causing severe injury to persons during the operation and provision of air services at civil aviation airports;
c) High Threat Incident (Level C): incidents causing damage to airport infrastructure; damaging equipment and facilities in the flight area, or threatening the safety of persons and equipment operating in the flight area, directly impacting the safety of aircraft operations;
d) Potential Threat Incident (Level D): incidents involving collisions between vehicles, equipment, or persons; incidents affecting the safety of airport infrastructure operations;
đ) Event (Level E): events not directly threatening aviation safety but affecting the provision of air services at civil aviation airports;
2. Reports on accidents and incidents include initial reports; preliminary reports; final reports with analysis results. The Civil Aviation Authority of Vietnam provides specific guidelines on the categories, responsibilities, and contents of reporting for Level A accidents, Level B, C, and D incidents, and Level E events.
3. The Civil Aviation Authority of Vietnam is responsible for organizing investigations, verifying, analyzing Level B and Level C incidents; directing handling and remedying accidents and incidents; issuing preventive recommendations to prevent and stop accidents and incidents; reporting to the Ministry of Transport about Level B incidents including initial reports and final reports; reporting to the Ministry of Transport about Level A accidents.
4. The Airport Affairs Office is responsible for organizing investigations, verifying, analyzing Level D incidents; directing handling and remedying incidents; issuing preventive recommendations to prevent and stop accidents and incidents; reporting to the Civil Aviation Authority of Vietnam about Level D incidents including initial reports and final reports.
5. Relevant agencies and units are responsible for analyzing Level E events; implementing preventive measures against accidents and incidents.
6. Organizations and individuals are encouraged and facilitated to voluntarily report potential events that may cause operational safety issues at civil aviation airports to the Civil Aviation Authority of Vietnam. The Civil Aviation Authority of Vietnam is responsible for ensuring:
a) Voluntary reports and subsequent analyses are used in a restricted manner and do not disclose or reveal information related to the person or organization making the report unless required by competent state authorities or the organization or individual making the report agrees to disclosure;
b) Secrecy of voluntary reports and information derived from voluntary reports does not affect the person or organization making the report;
c) Implement necessary safety measures, inspections, and monitoring based on voluntary reports.
Section 2
AIRPORT REGISTRATION AND OPERATING LICENSE CERTIFICATE
Article 36. Procedures for Issuing, Reissuing, and Revoking Certificates of Airports and Airports Registration
1. The owner or organization managing the airport shall submit one set of application documents for issuing the certificate of airport registration directly, via postal service, or through other appropriate means to the Civil Aviation Administration of Vietnam. The documents include:
a) An application form for issuing the certificate of airport registration according to Form No. 09 stipulated in the Appendix issued together with this Circular;
b) A certified copy of the decision on establishment or business registration certificate of the owner or organization managing the airport; a certified copy of the identity card or citizen identification card or passport of the airport owner who is an individual;
c) A certified copy of the investment orientation decision or investment decision for the airport;
d) A certified copy of the documentation confirming the infrastructure structure of the airport has completed acceptance procedures in accordance with regulations on basic construction investment.
2. In cases where the airport is under construction, the owner or organization managing the airport shall submit one set of application documents for issuing a temporary certificate of airport registration directly, via postal service, or through other appropriate means to the Civil Aviation Administration of Vietnam. The documents include those mentioned in points a, b, and c of Clause 1 of this Article.
3. Within ten days from the date of receipt of the documents as prescribed, the Civil Aviation Administration of Vietnam shall be responsible for reviewing the documents, including the following contents:
a) The airport is constructed in accordance with the overall planning for the development of the national airport system that has been approved;
b) The infrastructure of the airport is constructed and technically accepted in compliance with technical standards as prescribed and operational capacity;
c) The plan for constructing the infrastructure of the airport complies with technical standards as prescribed for temporarily registering the airport under construction and operational capacity.
4. Within three working days from the date of review, the Civil Aviation Administration of Vietnam shall register the airport in the Register of Airports and issue the certificate of airport registration according to Form No. 07 stipulated in the Appendix issued together with this Circular, or notify in writing the reasons for refusing to issue the certificate of airport registration.
5. At the latest sixty days after completion of construction, the airport which has been issued a temporary registration certificate must be registered in accordance with the provisions of this Circular.
6. The registration of the airport becomes effective from the date recorded by the Civil Aviation Administration of Vietnam in the Register of Airports.
7. If the certificate of airport registration is lost, torn, or damaged, it may be reissued. The person holding the certificate of airport registration shall submit an application for reissuing the certificate directly, via postal service, or through other appropriate means according to Form No. 09 issued in the Appendix accompanying this Circular to the Civil Aviation Administration of Vietnam.
Within three working days from the date of receipt of the application as prescribed, the Civil Aviation Administration of Vietnam shall consider and decide on reissuing the certificate of airport registration or notify in writing the reasons for refusing to reissue the certificate to the applicant.
8. The certificate of airport registration shall be revoked if it no longer meets the conditions for obtaining the certificate of airport registration.
Article 37. Establishment and Management of the Register of Civil Aviation Airports
1. The Civil Aviation Administration of Vietnam shall be responsible for establishing, updating information, and managing the Register of Civil Aviation Airports.
2. The Register of Civil Aviation Airports shall be established in both paper and electronic formats.
3. The Register of Civil Aviation Airports shall include the following information:
a) The date entered into the Register of Civil Aviation Airports for each type of registration;
b) Certificate of issuance for each type of registration: number, date of issuance;
c) Name and address of the owner or operator of the civil aviation airport;
d) Name of the civil aviation airport;
đ) Location and coordinates of the reference point of the civil aviation airport;
e) Airport classification;
g) Purpose of operation;
h) Operational capacity;
i) Construction, renovation, upgrading, and expansion process of the civil aviation airport.
Article 38. Amendment of Content of Registration Certificate for Civil Aviation Airports
1. The person granted the registration certificate for civil aviation airports must update information on changes to the civil aviation airport and request amendments to the content of the registration certificate for civil aviation airports when there are changes in:
a) Name and address of the owner or operator of the civil aviation airport;
b) Name of the civil aviation airport;
c) Location and coordinates of the reference point of the civil aviation airport;
d) Airport classification;
đ) Purpose of operation;
e) Operational capacity.
2. The person granted the registration certificate for civil aviation airports shall submit one set of documents directly, through postal service, or by other appropriate means to the Civil Aviation Administration of Vietnam, including the following documents:
a) Application form for amending the content of the registration certificate for civil aviation airports according to Form No. 09 prescribed in the Appendix issued together with this Circular;
b) Documents proving the proposed changes.
3. Within five working days from the date of receipt of the application, the Civil Aviation Administration of Vietnam shall review the amendment of the content of the registration certificate for civil aviation airports; issue a new registration certificate for civil aviation airports; revoke the previously issued registration certificate or notify in writing the reasons for rejecting the amendment.
Article 39. Procedures for Issuance, Reissuance, Amendment, and Revocation of Operation Certificates for Civil Aviation Airports
1. The organization entrusted with managing and operating the airfield shall submit one set of documents requesting issuance of the operation certificate for civil aviation airports directly, through postal service, or by other appropriate means to the Civil Aviation Administration of Vietnam. The application package includes the following documents:
a) Application form for issuing the operation certificate for civil aviation airports according to Form No. 09 prescribed in the Appendix issued together with this Circular;
b) Airport operation documents.
2. Within ten days from the date of receipt of all required documents, the Civil Aviation Administration of Vietnam shall be responsible for reviewing the airport operation documents, including the following contents:
a) Factors ensuring aviation safety, aviation security, and service standards;
b) Compliance with technical standards of the airport according to technical regulations and ICAO provisions;
c) List of non-compliance (if any);
d) Verification of actual conditions of the airport concerning the operation documents.
3. Within two working days from the completion of the review, the Civil Aviation Administration of Vietnam shall issue the operation certificate for civil aviation airports according to Form No. 08 prescribed in the Appendix issued together with this Circular or notify in writing the reasons for rejecting issuance to the applicant.
4. The operation certificate for civil aviation airports shall be amended in the following cases:
a) Change or transfer of the airport operator;
b) Change in the purpose or operational capacity of the civil aviation airport, airport classification.
5. The airport operator shall submit one set of documents requesting amendment of the operation certificate for civil aviation airports directly, through postal service, or by other appropriate means to the Civil Aviation Administration of Vietnam, including the following documents:
a) Application form for amending the content of the operation certificate for civil aviation airports according to Form No. 08 prescribed in the Appendix issued together with this Circular;
b) Documents proving the proposed changes.
Within five working days from the date of receipt of the documents, the Civil Aviation Administration of Vietnam shall organize reviews, verify actual conditions, approve the amendment of the operation certificate for civil aviation airports or notify in writing the reasons for rejecting approval to the applicant.
6. The operation certificate for civil aviation airports that is lost, torn, or damaged shall be reissued. The airport operator shall submit an application for reissuance of the certificate directly, through postal service, or by other appropriate means to the Civil Aviation Administration of Vietnam.
Within three working days from the date of receipt of the application, the Civil Aviation Administration of Vietnam shall examine and decide on reissuing the certificate or notify in writing the reasons for rejecting reissuance to the applicant.
7. The operation certificate for civil aviation airports shall be revoked in accordance with Clause 4, Article 51 of the Civil Aviation Law of Vietnam.
Article 40. Airport Operation Documents
1. Airport operation documents include the following main contents:
a) Purpose, basis for construction, operational conditions of the airport;
b) Organizational system, functions, tasks, and authority of the airport operator; human resources system ensuring operations;
c) General information about the airport, including diagrams on location, overall layout, functional zoning, equipment systems; name, location, coordinates, height above sea level, and terrain of the airport, height above sea level of the runway threshold; name, address, contact phone number of the airport operator;
d) Operational plan and aircraft parking position layout diagram;
đ) Infrastructure technical specifications of the airport as prescribed in this Circular;
e) Information on lighting systems, navigation aids, and auxiliary navigation equipment, air traffic control equipment;
g) Obstacle limitation surface diagram of the airport; obstacle diagram within the airport and adjacent areas;
h) Information on maintenance equipment in the airfield area; non-movable aircraft towing equipment; communication equipment mounted on vehicles moving in the airfield area;
i) Diagram of the laser light and lighting equipment impact zone;
k) Operational procedures and safety measures during airfield operations;
l) List of non-compliance with applicable technical standards and regulations, accompanied by a risk assessment report according to the guidance in the airport safety management system document; risk reduction plans and corrective action timelines;
m) Emergency plan for the airport; airport safety management system; aviation security program; runway safety program; wildlife management procedures;
n) Environmental impact assessment report, environmental protection plan, or environmental protection project of the airport approved;
2. The airport operator must amend and supplement the airport operation documents when there are changes related to the contents of the airport operation documents, submit for approval by the Civil Aviation Administration of Vietnam. The application dossier includes:
a) Request for approval;
b) Draft of amended and supplemented contents;
c) Documentation proving the amended and supplemented contents;
d) Number of dossiers: 01 set.
Within seven days from the date of receipt of the dossier as prescribed, the Civil Aviation Administration of Vietnam shall organize verification, on-site inspection, approve the amendment and supplementation of the documents or notify in writing the reasons for rejecting the approval to the applicant.
3. Based on ICAO standards, the Civil Aviation Administration of Vietnam issues guidelines for building airport operation documents.
Article 41. Airport Safety Management System
1. The airport operator is responsible for general coordination, ensuring safety, continuity, and synchronization of airport operations; ensuring sufficient personnel with appropriate qualifications to ensure normal airport operations; implementing obstruction management work at the airport and surrounding areas as prescribed.
2. The airport operator must establish and implement the airport safety management system, including the following main contents:
a) Safety operation objectives and policies;
b) Scope of application of the safety management system; organizational structure of the safety management system at the airport;
c) Safety assurance measures; risk management; safety reporting system;
d) Training, retraining on safety.
3. All organizations and individuals providing services at the airport must comply with the approved airport safety management system.
4. The airport operator promulgates rules, organizes the dissemination and supervision of compliance with regulations on ensuring aviation safety at the airport; identifies violations and transfers them to the Air Port Authority for handling as prescribed.
5. The Civil Aviation Administration of Vietnam and the Air Port Authority inspect and supervise the implementation of the airport safety management system.
Article 42. Non-compliant List
1. The non-compliant list includes works and equipment constructed or installed at airports that do not meet applicable technical standards and regulations related to:
a) Requirements for airport infrastructure structures;
b) Air navigation obstacle management requirements.
2. During operation, if non-compliant items are discovered or recommended based on operational standards, the airport operator must review, assess, update the information in the airport operation manual, and report to the Civil Aviation Administration of Vietnam for publication according to regulations.
Article 43. Human Resources System for Airport Operation
1. The airport operator must ensure a complete human resources system to meet actual operational conditions and implement aviation security, safety, and service quality regulations.
2. Key personnel of the airport operator include: airport director; position responsible for airport operation; position responsible for aviation safety; position responsible for aviation security.
3. The list of key personnel must be clearly stated in the airport operation manual.
4. The person appointed to the position of airport operation manager must meet the following conditions:
a) Bachelor's degree;
b) At least five consecutive years of work experience in international airports and three consecutive years in domestic airports in areas such as flight operations management, airport operation management, or aviation safety;
c) Training and instruction on airport design and operation, ground service provision procedures for aircraft.
5. The person appointed to the position of aviation safety manager must meet the following conditions:
a) Meet the conditions specified in points a and b of Clause 4 of this Article;
b) Training and instruction on airport design and operation, aviation safety management systems.
6. The person appointed to the position of aviation security manager must meet the conditions stipulated by laws on aviation security.
Chapter V
MANAGEMENT OF CONSTRUCTION, RENOVATION, UPGRADE, MAINTENANCE, AND REPAIR OF WORKS AT AIRPORTS; PUTTING WORKS INTO OPERATION; TEMPORARILY SUSPENDING AIRPORT OPERATIONS
Article 44. Approval for Construction, Renovation, Upgrade of Works; Maintenance, Repair of Works, Installation, Maintenance, and Repair of Equipment at Airports
1. The project investor for construction, renovation, upgrade of works; maintenance, repair of works, installation, maintenance, and repair of equipment at airports shall submit one set of application documents for approval to the Civil Aviation Administration of Vietnam in the following cases:
a) Construction, renovation, upgrade of works;
b) Maintenance, repair of works, installation, maintenance, and repair of equipment causing the cessation of operation of facilities providing air services for more than 24 hours, except in urgent situations directly threatening aviation safety and security requiring immediate action;
c) Maintenance, repair of works, installation, maintenance, and repair of equipment carried out during continuous non-service periods of flights from 30 days or longer.
2. The application documents shall include:
a) Request for approval;
b) Construction organization plan, measures to ensure security, safety, and environmental hygiene at the airport during construction;
c) Agreement on ensuring safe airport operation with relevant agencies and units.
3. Within fifteen days from the date of receipt of complete documents as prescribed, the Civil Aviation Administration of Vietnam shall be responsible for reviewing and issuing an approval document and implementing it for relevant agencies and units related to airport operation safety. In case of refusal, a written notification must be issued to the applicant, specifying the reasons.
4. For construction, renovation, upgrade, maintenance, and repair works for joint civil-military use, and temporary suspension of airport operations, the Civil Aviation Administration of Vietnam shall notify the Air Defense-Air Force Command to coordinate military-related issues.
5. In cases where the airport operates under limited visibility conditions as prescribed, construction and maintenance of works near the airport power system are not permitted. The facility providing air service assurance at the airport has the responsibility to inform the construction site supervisor about operating the airport under limited visibility conditions to stop construction activities.
6. The Civil Aviation Administration of Vietnam shall organize inspections and monitor the progress and quality of construction projects belonging to airport infrastructure according to the classification and delegation of authority by the Minister of Transport.
7. Maintenance, repair of works or installation, maintenance, and repair of equipment by facilities providing air services at airports must notify the Civil Aviation Authority in advance of the plan, construction method, and safety assurance plan for airport operations and flight activities in the following cases:
a) Cessation of operation of works or facilities providing air services for less than 24 hours;
b) Cessation of operation of works or facilities providing air services for more than 24 hours in urgent situations directly threatening aviation safety and security requiring immediate action;
c) Implementation during continuous non-service periods of flights below 30 days.
8. The Civil Aviation Authority shall be responsible for inspecting compliance with the construction organization plan, security, safety, and environmental hygiene measures in the construction area, and the safety assurance plan for airport operations. If the inspection finds that the construction plan, construction method, or operational plan does not ensure safety for airport operations and flight activities, the Civil Aviation Authority shall require the investor to temporarily halt construction activities.
Article 45. Putting into operation, temporarily suspending air transport infrastructure works and airport facilities
1. The operator of works belonging to the air transport infrastructure and airport facilities submits one set of application documents for putting the works or part thereof into operation directly, through postal service, or by other appropriate means to the Civil Aviation Authority of Vietnam. The application documents include:
a) A request document for putting the works or part thereof into operation including information on location and scope of use; time of use; main technical parameters of the work item; lifespan of the work;
b) A copy of the acceptance documents for putting the works into operation in accordance with the provisions of the law;
c) Operation and service provision materials, including the following contents: operation plan, operation procedures, air service provision; layout diagram of service-providing infrastructure; maintenance procedures.
2. The operator of works belonging to the air transport infrastructure and airport facilities submits one set of application documents for temporarily suspending part of the air transport infrastructure and airport facilities directly, through postal service, or by other appropriate means to the Civil Aviation Authority of Vietnam. The application documents include:
a) A report requesting temporary suspension of part of the air transport infrastructure and airport facilities including information on reasons for temporary suspension; location and scope of temporary suspension; time of temporary suspension;
b) A copy of the detailed drawing diagram of the area subject to temporary suspension;
c) Plan to ensure continued operations related to the suspended works;
d) Measures to ensure security and safety related to the suspended works.
3. Within seven days from the date of receipt of complete application documents in accordance with regulations, the Civil Aviation Authority of Vietnam examines and decides on putting the works or part thereof belonging to the air transport infrastructure and airport facilities into operation, temporarily suspending part of the air transport infrastructure and airport facilities. In case of non-approval, the Civil Aviation Authority of Vietnam must issue a notification document stating the reasons.
4. The Air Traffic Control Unit shall implement inspection to ensure compliance with the plans to maintain operations and measures to ensure security and safety related to the suspended works.
Article 46. Temporarily Suspending Airports for Renovation, Expansion, and Repair of Infrastructure
1. The operator of airports sends one set of application documents for temporarily suspending airports directly, through postal service, or by other appropriate means to the Civil Aviation Authority of Vietnam. The application documents include:
a) A request document for temporarily suspending airports including information on the name of the airport; reasons for temporarily suspending the airport; time of temporary closure of the airport;
b) Decision approving the project for renovation, expansion, and repair of infrastructure by the competent authority;
c) Construction organization plan, safety measures, and environmental protection measures.
2. Procedures for temporarily suspending airports:
a) Within ten days from the date of receipt of complete application documents in accordance with regulations, the Civil Aviation Authority of Vietnam is responsible for reviewing and reporting the review results to the Minister of Transport;
b) Within five working days from the date of receipt of the review result report, the Minister of Transport decides on temporarily suspending the airport.
Article 47. Temporary Closure of Airports When the Airport Operation Certificate is Revoked
1. The Civil Aviation Administration of Vietnam shall submit one set of application files for the temporary closure of airports directly or through postal services to the Ministry of Transport. The application files include:
a) A request for permission to temporarily close the airport including information on the name of the airport, reasons for temporarily closing the airport, and the duration of the temporary closure;
b) The decision to revoke the airport operation certificate;
c) The issued airport operation certificate.
2. Within five working days from the date of receiving the complete application files from the Civil Aviation Administration of Vietnam, the Minister of Transport shall decide on the temporary closure of the airport.
Article 48. Temporary Closure of Airports in Cases of Natural Disasters, Epidemics, Environmental Pollution, Accidents, and Other Abnormal Situations Threatening Aviation Safety and Security
1. The airport operator shall immediately report to the Civil Aviation Port Authority about the need to temporarily close the airport in cases of natural disasters, epidemics, environmental pollution, accidents, and other abnormal situations threatening aviation safety and security within no more than 24 hours. The Director of the Civil Aviation Port Authority shall be responsible for reviewing and deciding on the temporary closure of the airport within no more than 24 hours and reporting to the Civil Aviation Administration of Vietnam.
2. The procedures for temporarily closing the airport in cases of natural disasters, epidemics, environmental pollution, accidents, and other abnormal situations threatening aviation safety and security with a closure period exceeding 24 hours are as follows:
a) The airport operator shall immediately report to the Civil Aviation Administration of Vietnam regarding the temporary closure of the airport. The report includes information on the name of the airport, reasons for temporarily closing the airport, and the duration of the temporary closure;
b) Upon receipt of the report from the airport operator, the Civil Aviation Administration of Vietnam shall submit to the Ministry of Transport a proposal to temporarily close the airport;
c) Within 24 hours of receiving the application from the Civil Aviation Administration of Vietnam, the Minister of Transport shall decide on the temporary closure of the airport.
Chapter VI
MANAGEMENT AND OPERATION OF AIRPORT EQUIPMENT AND OPERATING FACILITIES AT AIRPORTS
Article 49. General Provisions
1. Airport equipment and operating facilities at airports must meet technical and environmental standards applicable, including those of ICAO.
2. Equipment in the field of flight operations support; equipment installed and operated in the airfield area must be granted an operation permit by the Civil Aviation Administration of Vietnam.
3. The manager and operator of airport equipment and operating facilities at airports shall establish and implement operational and maintenance procedures consistent with the manufacturer's operational and maintenance documentation; have backup equipment to ensure uninterrupted provision of air transport services; organize training and updates for control and operation staff on technical documentation, operational and maintenance procedures, and regulations on ensuring safe operation in the airfield area.
4. Investment and operation of airport equipment and operating facilities at airports must be consistent with the airport master plan, infrastructure conditions, service range of the equipment and facility operators, and intended use.
5. The service life of operating facilities at airports must comply with applicable standards.
Article 50. Procedures for Issuing and Reissuing Exploitation Licenses for Equipment in the Field of Air Traffic Assurance; Equipment Installed and Operated in Airfield Areas
1. The manager or exploiter of the equipment shall submit one set of application documents directly or through postal service or other appropriate means to the Civil Aviation Authority. The documents include:
a) A request letter for issuing an exploitation license detailing the following contents: type of equipment; purpose of use; scope and area of installation and operation; applicable standards; manpower for exploiting the equipment;
b) Certificate of Origin (CO) and Quality Certificate (CQ) of imported equipment;
c) Technical qualification certificate for equipment and specialized aviation means produced, assembled, or improved in Vietnam;
d) Operating manuals provided by the manufacturer;
đ) Completion records of installation procedures, inspection, and testing of the system;
e) Other documents and materials as prescribed by specialized laws for each type of equipment (if any).
Within seven days from the date of receipt of complete documents as stipulated, the Civil Aviation Authority shall organize an assessment and decide on issuing the exploitation license or notify in writing the reasons for refusing to issue the license to the applicant.
2. An exploitation license for equipment that is lost or damaged may be reissued upon request. The manager or exploiter of the equipment shall submit a request letter for reissuing the license directly or through postal service or other appropriate means to the Civil Aviation Authority. Within three working days from the date of receipt of the request letter as stipulated, the Civil Aviation Authority shall review and decide on reissuing the license or notify in writing the reasons for refusal to the applicant.
3. The exploitation license for aviation equipment shall be revoked if the exploitation of such equipment poses a risk to safety at airports or airfields.
Article 51. Issuance of Technical Qualification Certificates for Equipment and Specialized Means Produced, Assembled, or Improved in Vietnam
1. The applicant for issuance of a technical qualification certificate for equipment and specialized means produced, assembled, or improved in Vietnam shall submit one set of application documents directly or through postal service or other appropriate means to the Civil Aviation Authority. The application documents include:
a) A request letter for issuing a technical qualification certificate for equipment and specialized means, describing the product and its main technical specifications, parameters, limits, and features;
b) Copies of applied technical and environmental standards;
c) Copies of related documents: technical design and details; materials; production methods and processes; installation, operation, maintenance instructions; assembly of the product; main technical specifications, parameters, limits, and features;
đ) Copies of acceptance completion handover records or final operational acceptance records;
đ) Copies of inspection, testing, and evaluation records of the product according to applied technical standards conducted by entities meeting legal requirements;
e) Reports on trial operation results according to the product's technical specifications, parameters, limits, and features.
2. Within fifteen days from the date of receipt of the documents as stipulated, the Civil Aviation Authority shall carry out necessary inspections and tests, decide on issuing a technical qualification certificate for equipment and specialized means according to Model No. 10 prescribed in the Appendix issued together with this Circular, or notify in writing the reasons for refusing to issue the certificate to the applicant. Inspection and testing work includes the following tasks:
a) Determining the applied technical and environmental requirements and standards;
b) Inspecting the actual product and acceptance results;
c) Reviewing necessary technical specifications, parameters, limits, and features to prove compliance or conformity of the product with applied technical requirements and standards, including information about materials and manufacturing, assembly processes of the product;
d) Inspecting the results of product inspection, testing, and evaluation according to applied technical and environmental standards; in case of necessity, conducting or requiring the applicant to hire independent organizations capable of performing necessary inspections and tests to verify compliance with applied technical requirements;
đ) Inspecting trial operation results.
3. The technical qualification certificate for equipment and specialized means is valid for equipment and means produced, assembled, or improved according to design and applicable technical standards and regulations.
Article 52. Issuance and Revocation of Registration Numbers for Specialized Vehicles Operating at Airports
1. The Civil Aviation Inspection shall issue registration numbers for specialized vehicles operating at airports, except for vehicles that frequently participate in traffic outside the restricted areas of airports.
2. Airlines shall submit one set of application documents for issuing registration numbers for specialized vehicles operating at airports directly, via postal service, or through other appropriate means to the Civil Aviation Inspection. The application includes:
a) A request for issuance of registration numbers, specifying the need for vehicle usage; year of manufacture, serial number of the vehicle; whether the vehicle has been used or not.
b) Certificate of technical quality and environmental protection.
Within five working days from the date of receiving complete applications, the Civil Aviation Inspection shall issue registration numbers for vehicles or notify in writing the reasons for refusing to issue registration numbers for vehicles.
3. Registration numbers shall be revoked in the following cases:
a) Expiration of the operational life of vehicles with a specified operational life according to the manufacturer's regulations;
b) Airlines no longer have a need to use vehicles for operations at airports.
Article 53. Specifications for Registration Numbers of Specialized Vehicles Operating at Airports
1. The part consisting of letters is the IATA code of the airport where the vehicle operates.
2. The first digit indicates the management unit operating the vehicle, specifically:
a) 1 for vehicles operated by airport operators;
b) 2 for vehicles of airlines;
c) 3 for vehicles of other aviation service providers.
3. The next two digits indicate the type of vehicle operating in the restricted area of the airport, as defined by the Civil Aviation Administration.
4. Following the two digits indicating the type of vehicle operating in the restricted area of the airport are sequential numbers assigned to each type of vehicle, starting from 01.
5. The size and color of the registration plate, characters, and numbers on the registration plates of vehicles operating in the restricted area of the airport shall comply with the regulations on the size of automobile registration plates issued by state agencies.
Article 54. Operation of Vehicles in Restricted Areas of Airports
1. The operation of vehicles in restricted areas of airports must comply with the standard operating procedures of the vehicle manufacturer, operator, and IATA guidelines to ensure safety during operation.
2. Based on specific conditions of each airport, the airport operator shall specify the speed limit for vehicles operating in the restricted area of the airport to ensure safe operation within the airfield.
3. The Civil Aviation Administration shall provide guidance on minimum requirements for the operation of vehicles in restricted areas of airports.
4. Specialized aviation vehicles operating at airports shall be suspended from operation in the following cases:
a) Not inspected or failing to meet operational requirements according to the technical documentation of the vehicle;
b) Causing aircraft accidents or incidents.
5. Specialized aviation vehicles suspended from operation as stipulated in Clause 4 of this Article may resume operation in the following cases:
a) All violations specified in Point a of Clause 4 of this Article have been rectified;
b) The cause of the incident or accident related to the vehicle has been identified.
Article 55. Maintenance of Equipment and Means of Operation in Restricted Areas of Airports
The operator of equipment and means of operation in restricted areas of airports must perform maintenance on such equipment and means in accordance with relevant laws on maintenance and the manufacturer's technical guidance to ensure safety during operation.
Article 56. Technical Documentation for Means of Operation in Restricted Areas of Airports
The operator of means of operation in restricted areas of airports must establish technical documentation for such means. The technical documentation includes: technical guidance documents; operational technical documents; history and records of modifications and changes in type.
Article 57. Technical Guidance Documents for Means of Operation
1. Technical guidance documents are documents issued by the manufacturer or the operator of the means to guide the implementation of technical standards during the design, manufacture, operation, and maintenance of the means. Technical guidance documents include:
a) User manuals;
b) Maintenance manuals;
c) Technical training materials.
2. User manuals provide necessary technical information and specific regulations and instructions for operators, maintainers, and repairers of means of operation in restricted areas of airports. User manuals include the following main contents:
a) Type of means;
b) Introduction to functions, components of systems, including technical data of each system;
c) Types of fuels, lubricating oils, hydraulic fluids, compressed air, quantities required for each type;
d) Structure and operating principles of the means, including assemblies, control mechanisms: engines, clutches, gearboxes, power transmission mechanisms, various gauges, hydraulic, electrical, pneumatic, fuel, lubrication, fire prevention systems;
đ) Operating principle diagrams of assemblies and systems;
e) Assembly and wiring diagrams of assemblies, systems;
g) Procedures for operation and technical safety requirements during operation;
h) Common malfunctions, causes, and corrective measures.
3. Maintenance manuals for means of operation in restricted areas of airports provide necessary information and guidance for maintenance work. Maintenance manuals include the following contents:
a) Type of means;
b) Introduction to types of maintenance and cycles for performing them;
c) Specific content of each type of maintenance;
d) Lubrication diagrams, cycles, and quantities, types of lubricants to be replaced;
đ) Instructions on methods and sequences for disassembly and assembly of assemblies, systems, and parts, and technical safety requirements during disassembly and assembly;
e) Maintenance procedures for systems and parts accompanied by diagrams and drawings;
g) Possible malfunctions that can occur or be detected during maintenance, causes, and corrective measures;
h) Methods of adjustment, inspection, and testing during maintenance and repair;
i) Tools and measuring devices and their usage when conducting maintenance and repair.
4. Technical training materials include documents used in teaching, guidance, and reclassification for technical staff at technical training facilities or training classes, courses, and refresher programs for aviation personnel. Technical training materials may be compiled and approved by the manufacturer, the operator of the means, or training institutions before use.
Article 58. Technical Operation Documents of the Means
1. Technical operation documents are necessary materials for the process of operating and managing the technical means. Technical operation documents approved by the means' manager and operator include:
a) Technical logs, technical minutes;
b) Technical statistical documents;
c) Technical reports;
d) Emergency reports.
2. Technical logs record the daily or shift-by-shift technical status of the means.
3. Technical minutes record technical incidents concerning the means during the operation process.
4. Technical statistical documents aim to compile and evaluate the operational status of the means within certain cycles, including statistical data on: hours of operation, number of work sessions, kilometers traveled, technical incidents, and other indicators specified by the entity.
5. Technical reports are comprehensive documents reporting the technical operational situation of the means, including: reports on the quantity of means meeting safety and environmental standards and obtaining operating permits; means not meeting safety and environmental standards and not obtaining operating permits, awaiting scrapping; newly invested means.
6. Emergency reports are reports when the means operate in restricted areas of airports causing incidents or malfunctions affecting aircraft. Incident reports include the following contents:
a) Name and code of the means causing the incident;
b) Date, time, location where the technical incident occurred;
c) Minutes confirming the development and post-incident condition;
d) Preliminary determination of possible causes of the incident and extent of damage;
đ) Recommendations and measures for handling.
Article 59. Technical History and Records of Renovation and Change of Type of the Means
1. The technical history of the means is a document recording the origin, name, code, main function, operation process, and maintenance of the means.
2. The technical history is established by the means' manager and operator and includes the following contents:
a) Name and address of the operator;
b) Name, code, registration number of the means;
c) Purpose;
d) Country of manufacture;
đ) Frame number, engine number, main assembly numbers;
e) Production date, usage date;
g) Maintenance and repair dates.
3. Records of renovation and change of type of the means are established by the means' manager and operator and include the following contents:
a) Name and code of the improved or changed type of means;
b) Reason for improvement or change;
c) Confirmation that the improvement or change of type of the means complies with technical standards approved by the competent authority;
d) Issuance date;
đ) Issuer.
Article 60. Personnel Controlling and Operating Means and Equipment Frequently Operating in Restricted Areas of Airports
1. Personnel controlling and operating means and equipment frequently operating in restricted areas of airports must be regularly trained and instructed according to regulations. In cases where personnel controlling and operating means and equipment have not been assigned to work in restricted airport areas for three months or more, they must be retrained to ensure safe operation.
2. Organizations proposing issuance of control and operation permits for means and equipment for the first time shall submit one set of application documents directly, via postal service, or through other appropriate methods to the Civil Aviation Administration of Vietnam. The application package includes:
a) Application form for issuing a permit from the organization managing personnel controlling and operating means and equipment, accompanied by a list of such personnel;
b) A copy of a valid motor vehicle driver's license (for personnel controlling means), and certificates of training in controlling and operating equipment and means issued by the manufacturer or a qualified training institution in accordance with regulations;
c) Two color photographs measuring 3 x 4 cm, taken within six months, similar to an identity card photograph.
Within twenty days from the date of receipt of complete applications, the Civil Aviation Administration of Vietnam will review the applications, organize inspections, and decide to issue permits or notify in writing the reasons for rejecting the permit application.
3. Control and operation permits for personnel operating means and equipment in restricted airport areas can be renewed upon expiration of the permit validity period, loss, or damage. Organizations applying for renewal of such permits shall submit one set of application documents directly, via postal service, or through other appropriate methods to the Civil Aviation Administration of Vietnam. The application package includes:
a) Application form for issuing a permit from the organization managing personnel controlling and operating means and equipment, accompanied by a list of such personnel;
b) A copy of a valid motor vehicle driver's license (for personnel controlling means), and certificates of training in controlling and operating equipment and means issued by the manufacturer or a qualified training institution in accordance with regulations;
c) Two color photographs measuring 3 x 4 cm, taken within six months, similar to an identity card photograph.
Within thirty days (in case of permit expiration) and five working days (in case of lost or damaged permits), from the date of receipt of complete applications, the Civil Aviation Administration of Vietnam will review the applications, organize inspections (in case of permit expiration), and decide to issue permits or notify in writing the reasons for rejecting the permit application.
4. Organizations applying for additional qualifications to control and operation permits for personnel operating means and equipment in restricted airport areas shall submit one set of application documents directly, via postal service, or through other appropriate methods to the Civil Aviation Administration of Vietnam. The application package includes:
a) Application form for issuing additional qualifications from the organization managing personnel controlling and operating means and equipment, accompanied by a list of such personnel;
b) A copy of a valid motor vehicle driver's license (for personnel controlling means), and certificates of training in controlling and operating equipment and means issued by the manufacturer or a qualified training institution in accordance with regulations;
c) Two color photographs measuring 3 x 4 cm, taken within six months, similar to an identity card photograph.
Within three working days from the date of receipt of complete applications, the Civil Aviation Administration of Vietnam will review the applications and decide to issue additional qualifications or notify in writing the reasons for rejecting the application.
5. The Civil Aviation Administration of Vietnam shall revoke the license of aviation control personnel, equipment operators, and vehicle drivers operating in restricted areas of airports in the following cases:
a) The license has been tampered with or used for purposes other than intended;
b) The personnel have committed acts that directly threaten the safety and security of civil aviation at airports, or have concealed violations of regulations concerning aviation safety and security;
c) The personnel have been found to be using drugs, have been convicted of criminal offenses, or have caused disorder and disrupted public order within airport premises;
d) The personnel have not been assigned to work in restricted areas of airports for three months or more without being retrained but continue to perform duties according to their licenses.
6. Personnel controlling, operating equipment, and driving vehicles in restricted areas of airports must comply with the following requirements:
a) They may only perform tasks specified on their license;
b) Adhere to speed limits as prescribed; maintain control over speed in all situations and conditions; shall not accelerate or brake suddenly when approaching or leaving aircraft; must observe before and after movement and maintain control over speed when starting, moving, turning to approach aircraft, reversing, or backing up;
c) Follow designated routes and methods of movement to avoid collisions with other vehicles; comply with the airport operator's regulations regarding vehicle lanes, runways, taxiways, and movement areas within restricted airport zones;
d) Adhere to labor safety rules and fire prevention regulations as prescribed; wear appropriate work attire as required by their unit;
đ) When driving vehicles on airfield runways, they must have two-way radios for communication and follow air traffic controller instructions;
e) When needing to move across or cut across runways or taxiways, permission from the air traffic controller is required; continuous communication and adherence to the air traffic controller's guidance must be maintained;
g) When driving vehicles on runways, taxiways, or aircraft parking areas and encountering incidents or damage, they must immediately report to the air traffic controller and quickly remove the vehicle from the operational area for repair; repairs shall not be conducted on active aircraft or vehicle runways;
h) Upon reaching a service position, they must apply handbrakes, chocks, or wheel blocks; when encountering stop signs on service roads, they must stop to observe, and can proceed only if there are no safety hazards;
i) They must reduce speed to the maximum extent possible or stop vehicles to ensure safety in the following situations: when aircraft are taxiing; when running on service roads crossing taxiways; when passing through aircraft parking areas, baggage handling areas, passenger movement areas; when visibility is limited; when yielding to oncoming vehicles or allowing following vehicles to pass;
k) Tow trucks shall not exceed four coupling units, and the total length of coupling units shall not exceed 12.2 meters (40 feet), excluding the towing bar length. Before towing, it must be ensured that cargo containers are securely closed, and coupling unit locks are firmly and safely installed; coupling units may only be detached when the tow truck has completely stopped; towing while releasing coupling units is prohibited;
l) Headlights and rotating lights must be turned on during nighttime or low visibility operations; high beams shall not be used;
m) Vehicles shall not be parked on service roads except in cases specified in points h and i of this Article or due to improper parking causing obstruction to other vehicles; when stopping, drivers must park in designated locations;
n) Vehicles shall not cross the distance between: aircraft tug and taxiing aircraft; aircraft and ground signalers; aircraft guidance systems and taxiing aircraft entering parking positions;
o) Vehicles shall not operate under aircraft fuselages, wings, or engines, except for certain service vehicles that must partially operate under the aircraft during service; vehicles higher than 3.90 meters shall not operate under boarding bridges; vehicles shall not be used contrary to their approved functions and purposes; vehicle operators shall not leave their posts while engines are running, except for fuel trucks equipped with interlock braking systems;
p) When approaching aircraft, they must adhere to the following rules: approach only when the aircraft has fully stopped, chocked, main engines off, and warning lights extinguished, except in cases where support equipment is needed to shut down the engines; approach aircraft in the prescribed sequence; park in designated positions according to each aircraft type's servicing diagram and shall not interfere with other operational vehicles; guiding personnel must be present for vehicles approaching aircraft in reverse mode, except for those with automatic docking systems;
q) While refueling aircraft, vehicles operating on the airfield within a 15-meter radius of the refueling point shall not start their engines;
r) Smoking is prohibited on the airfield;
7. Airport operators are responsible for issuing, disseminating, and implementing safety rules on the airfield.
Article 61. Quality Safety Technical Inspection and Environmental Protection for Specialized Aircraft Equipment
1. Specialized aircraft equipment must be subject to periodic quality safety technical inspection and environmental protection (hereinafter referred to as inspection) according to the technical documentation of the equipment. The inspection cycle for equipment is defined as follows:
a) For unused equipment, the first inspection cycle is 24 months from the date of registration number issuance;
b) For used equipment, the inspection cycle is 12 months from the date of registration number issuance or the previous inspection.
2. The Civil Aviation Authority organizes the implementation or designates competent organizations to conduct inspections of specialized aircraft equipment; guides the content of inspections; oversees inspection activities.
Chapter VII
NATURAL DISASTER PREVENTION AND AIRCRAFT RESCUE AT AIRPORTS AND AIRFIELDS
Article 62. General Provisions
1. Natural disaster prevention and rescue operations at airports and airfields include:
a) Disaster prevention work;
b) Emergency airport operations.
2. Natural disaster prevention and rescue operations at airports and airfields shall be carried out in accordance with regulations on disaster prevention and rescue in aviation, ICAO standards, and national technical standards and norms issued or recognized for application.
3. The airport operator shall take the lead and coordinate with enterprises operating within the airport area in disaster prevention and rescue operations, and initial responses to unlawful interference in civil aviation activities.
4. The airport operator must ensure minimum equipment and means to serve disaster prevention and rescue operations according to applicable standards; the airport operator may mobilize equipment and means of enterprises operating within the airport area.
5. The Civil Aviation Authority directs the airport operator and other enterprises operating at airports to establish disaster prevention and rescue facilities and forces; exercises related to drill activities and signing agreements concerning disaster prevention and rescue operations at airports.
Article 63. Natural Disaster Prevention at Airports and Airfields
1. Responsibilities of the Airport Operator:
a) Issuing and implementing disaster prevention plans and programs for airports and airfields in accordance with regulations;
b) Establishing and signing agreements on disaster prevention operations with agencies and units within the airport area and local authorities as prescribed;
c) Inspecting, reviewing, supplementing, and maintaining disaster prevention equipment and facilities;
d) Inspecting and maintaining aircraft mooring systems at parking areas; inspecting and organizing reinforcement of facilities, structures, workshops, and stations;
đ) Regularly and periodically inspecting drainage systems at airports and ensuring the connection between internal airport drainage systems and external drainage systems to prevent flooding during the rainy season;
e) Inspecting lightning protection systems at facilities, terminals, and stations within the airport and airfield area.
2. Responsibilities of Other Enterprises Operating at Airports and Airfields:
a) Developing specific disaster prevention plans and programs for their units;
b) Inspecting, reviewing, supplementing, and maintaining systems serving disaster prevention operations, facilities, structures, and stations of their units;
c) Cooperating with the airport operator in disaster prevention and aftermath mitigation.
Article 64. Emergency Airport Operations
1. Emergency airport operations include the following situations:
a) Search and rescue for aircraft accidents outside the airport terminal area within the responsibility scope of the airport operator;
b) Emergency airport operations for aircraft incidents and accidents within the airport terminal area;
c) Emergency airport operations related to fire, explosion, collapse due to typhoons, flooding, illegal interference, and medical emergencies at airport facilities, workshops, and stations;
d) Emergency airport operations under harsh environmental conditions and complex terrain near the airport, close to the sea;
đ) Emergency intervention against illegal interference with civil aviation activities as prescribed.
2. The airport operator shall develop an emergency airport plan; establish a professional emergency force at the airport in accordance with ICAO regulations; and closely coordinate with local authorities and relevant agencies in emergency airport operations.
3. Air service providers within the airport area shall ensure sufficient personnel and equipment according to the emergency airport plan of the airport operator.
4. The emergency airport plan includes the following contents:
a) General provisions: purpose, applicable subjects, scope of responsibility, legal basis for development, classification of emergency situations, and procedures for amending and supplementing documents;
b) Organization of emergency operations including: emergency command team, airport emergency center, emergency alarm station, on-site command team; establishment of areas, flow diagrams, and entrance gates for personnel and equipment participating in emergency response;
c) Assignment of responsibilities among units in organizing, coordinating, and implementing emergency operations;
d) Communication system serving emergency operations;
đ) Personnel, equipment, and devices used in emergency operations;
e) Investigation and recovery: responsibilities of units in investigating and recovering from incidents and accidents;
g) Emergency duty roster and training, inspection, and drill programs;
h) Reporting regulations;
i) Coordination regulations with local emergency command teams;
k) Appendices including: search and rescue responsibility zones of the airport; notification diagrams for emergency situations; notification and alarm diagrams for illegal interference; command and control diagrams for emergency situations; communication information, code names, and frequencies specified for emergency operations; telephone directories of individuals and organizations involved in emergency operations; square grid diagrams of the airport and surrounding areas; gate and entrance diagrams for personnel and equipment participating in emergency response; hypothetical emergency scenarios.
5. The emergency airport plan includes on-site emergency, full-scale emergency, and is divided into stages:
a) Information gathering and situation assessment stage;
b) Alarm stage;
c) Emergency stage.
6. The airport operator commands and directs air forces to initially respond to emergency airport situations and search and rescue within the assigned responsibility area; transfers and coordinates with relevant agencies to implement search and rescue for aircraft within the assigned responsibility area after completing initial response actions in accordance with the Prime Minister's regulations on coordination for search and rescue and responding to illegal interference in the civil aviation sector.
7. The airport operator implements the emergency airport plan within the airport, specifically:
a) Deploying emergency rescue forces ready to respond and approach the accident site;
b) Activating the airport emergency center;
c) Notifying relevant cooperative units;
d) Medical services and first aid being ready to respond and approach the accident site;
đ) Notifying the aircraft operator in distress or disaster; collecting information related to hazardous goods on board the aircraft, and notifying relevant units;
e) Reporting to the Civil Aviation Authority; establishing communication with service providers related to airport closure, designation of emergency flight paths, and issuance of NOTAMs;
g) Notifying the accident investigation agency as prescribed;
h) Notifying the meteorological department to issue special weather reports;
i) Arranging immediate survey and photography of affected runways to promptly address issues;
k) Notifying the forensic examination department in cases of death and setting up temporary morgues.
8. Emergency airport drills must be organized regularly at each airport according to the following levels:
a) Comprehensive emergency airport drills must be conducted with a frequency not exceeding once every two years;
b) Basic emergency airport drills between comprehensive drills to address deficiencies identified during comprehensive drills.
Article 65. Airport Firefighting
1. The level of airport firefighting shall be determined according to ICAO standards. The level of airport firefighting shall be published in the Aeronautical Information Publication (AIP), flight rules within the airport area, and airport operation manuals; it shall be communicated to relevant agencies and units.
2. When there is a malfunction with firefighting equipment and facilities leading to a change in the level of airport firefighting, the airport operator must report to the Civil Aviation Administration of Vietnam, notify service providers ensuring flight operations, and follow the aviation information dissemination procedure to inform aircraft arriving at or departing from the airport. After the malfunction has been resolved, the airport operator must re-announce the information on the level of airport firefighting as prescribed.
Article 66. Requirements for Rescue Personnel, Firefighting Personnel, Communication Systems, Alarm Systems, Response Time, Firefighting Equipment, and Emergency Equipment at Airports roadograms andenergy facilities, firefighting equipment, emergency equipment at the airport
1. Rescue personnel and firefighting personnel must be trained at specialized training institutions according to appropriate rescue and firefighting training programs; they must hold appropriate certificates; participate in rescue and firefighting drills at airports. The training program for rescue and firefighting personnel must include individual action skills and team coordination capabilities.
2. Rescue personnel and firefighting personnel must regularly practice using firefighting equipment on firefighting vehicles to ensure proficient operation and maximum capacity utilization during firefighting and rescue operations; they must be proficient in using ropes, ladders, and other rescue and firefighting equipment attached to aircraft rescue and firefighting activities.
3. The airport operator must allocate an adequate number of firefighting personnel corresponding to the airport level; provide firefighting equipment, tools, uniforms, and accessories for rescue and firefighting personnel according to the airport's fire prevention and firefighting plan; position rescue and firefighting vehicles at designated locations as per the airport emergency plan; set up intermediate firefighting stations (satellite firefighting stations) to meet the response time requirements as prescribed.
4. The airport operator must ensure direct communication systems between firefighting stations and the control tower at the airport, other firefighting stations within the airport, firefighting vehicles, air traffic control tower, and ground control tower; alarm systems for rescue and firefighting personnel.
5. The airport operator must equip firefighting and emergency equipment suitable for the scale of the airport, frequency of aircraft operations, airport firefighting level, and geographical conditions of the airport and surrounding areas. For airports located in complex terrain and environmental areas, the airport operator must equip appropriate firefighting and emergency equipment.
6. Ambulances and medical transport vehicles for transporting injured persons from accident aircraft must be directed by authorized personnel according to the airport emergency plan; they must be prepared in rescue plans for all emergency situations.
7. Response time is the period from the first alarm to when the first firefighting vehicle arrives at the accident site and starts foam discharge at a minimum rate of 50% of the discharge rate. The response time of firefighting vehicles must comply with the following provisions:
a) Firefighting vehicles must ensure a response time not exceeding two minutes to reach any point on active runways under good visibility and clean surface conditions without rain.
b) Firefighting vehicles must ensure a response time not exceeding three minutes to reach any part of the apron under good visibility and clean surface conditions without rain.
8. The firefighting and rescue vehicle system must be maintained to ensure that equipment operates effectively and meets the specified response times throughout the operational life of the vehicles.
9. Firefighting and emergency equipment at airports must always be ready to promptly respond to emergencies occurring within the search and rescue responsibility area of the airport.
Article 67. Prevention and Control of Fire and Explosions at Airports
1. The airport operator, organizations operating within the airport area must develop internal regulations for fire prevention and control, firefighting plans in accordance with the laws on fire prevention and fighting, including the following contents:
a) Complex fire situations and other characteristic fire situations, forecasting the development potential of fires;
b) Plans to mobilize forces and equipment, organize command, apply technical and tactical firefighting measures suitable for each stage and each fire situation;
c) Plans to coordinate contracts with fire prevention and firefighting agencies, military, police, and related units in the event of a fire or explosion at the airport.
2. The airport operator manages centralized fire prevention and control forces, mobilizing from businesses operating within the airport area; establishes specialized firefighting teams, regularly maintaining training regimes for firefighting methods, the use of firefighting equipment provided; arranges personnel to inspect fire safety work regularly; closely coordinates with local authorities and related agencies in implementing fire prevention and control.
3. Fire prevention and control training content must be appropriate to the specific fire hazards of the facility. For professional firefighting forces at airports, in addition to emergency firefighting training on the airport grounds, they must also be trained in firefighting tactics in indoor areas of the terminal.
4. Design, construction, repair, renovation, and operation of terminals must comply with current fire prevention and firefighting regulations.
5. The use of gas equipment and electrical equipment for food preparation in the terminal area must be permitted by the terminal service provider and comply with fire safety and firefighting regulations.
6. Smoking is not allowed in the airport except in designated smoking areas.
7. Aircraft maintenance workshops must have automatic firefighting equipment systems and fire prevention systems for aircraft.
8. Aviation fuel service providers must have storage tanks, transportation vehicles, refueling facilities, and testing laboratories that meet specified standards, inspected and licensed by competent authorities; have fire prevention plans approved by competent authorities.
9. Aviation fuel service providers must have response plans for natural disasters, oil spills affecting the environment, and systems for collecting and treating waste oil and spills; have agreements with agencies and units located in the area regarding handling fire and oil spill incidents.
Chapter VIII
ENSURING AIRPORT OPERATIONS
Article 68. Control and Mitigation of Harm Caused by Birds, Wild Animals, and Pets
1. The control and mitigation of harm caused by birds, wild animals, and pets shall be carried out in accordance with Vietnamese laws, ICAO standards, and standards and technical regulations issued or recognized for application by Vietnam.
2. The airport operator shall take the lead in coordinating with local authorities and related agencies and shall be responsible for:
a) Surveying and recording the status of birds and wild animals residing in the airport area and adjacent areas, including species, monthly and seasonal quantities;
b) Evaluating environmental impacts at the airport and adjacent areas attracting the presence of birds and wild animals;
c) Surveying the situation of pets in the airport area and adjacent areas;
d) Recording incidents threatening flight safety caused by birds, wild animals, and pets, including factors such as species, time of occurrence, and assessment of danger of each species;
đ) Issuing and notifying related units operating at the airport and organizations to implement bird, wild animal, and pet control programs at each airport;
e) Considering the implementation of projects and constructions aimed at preventing and limiting the attraction of birds and wild animals at the airport; preventing the keeping of animals at the airport; preventing the entry of pets into the airport;
g) Reporting monthly, quarterly, or as required to the Civil Aviation Administration of Vietnam on statistical results, surveys, and assessments of the impact of birds, wild animals, and pets on airport operations.
3. The Civil Aviation Administration of Vietnam shall notify ICAO of aircraft collisions with birds and wild animals.

1. The operator of the civil aviation airport must establish diagrams of areas affected by laser lights and high-intensity lighting devices on flight operations in the airport operation manual; send these diagrams to relevant agencies, units operating at the airport, and local authorities for coordination in control.
2. The control and reduction of hazards from laser lights and high-intensity lighting devices that are not aviation guidance lights shall be carried out in accordance with the provisions of this Circular and ICAO standards.
Article 70. Management of aviation obstacles
1. The management of aviation obstacles at airports and surrounding areas shall be carried out in accordance with the provisions of Vietnamese law and ICAO standards.
2. Cục Hàng không Việt Nam có trách nhiệm:
a) Xây dựng bề mặt giới hạn chướng ngại vật hàng không, độ cao công trình liên quan đến bề mặt giới hạn chướng ngại vật hàng không trong khu vực sân bay, khu vực giới hạn bảo đảm hoạt động bình thường của các đài, trạm vô tuyến điện hàng không; giới hạn chướng ngại vật khu vực lân cận cảng hàng không, sân bay; trình Bộ Tổng tham mưu phê duyệt;
b) Phối hợp với các cơ quan, đơn vị liên quan trực thuộc Bộ Tổng tham mưu, các bộ, ngành và Ủy ban nhân dân cấp tỉnh quản lý bề mặt giới hạn chướng ngại vật hàng không, ngăn ngừa và xử lý các công trình vi phạm bề mặt giới hạn chướng ngại vật ảnh hưởng đến hoạt động bay dân dụng; tuyên truyền, phổ biến tới các cơ quan, đoàn thể, cộng đồng dân cư nơi có sân bay và khu vực lân cận sân bay để tham gia duy trì, quản lý các bề mặt giới hạn chướng ngại vật, nhằm đảm bảo an toàn cho mọi hoạt động bay;
c) Công bố công khai bề mặt giới hạn chướng ngại vật hàng không, bản đồ chướng ngại vật trong khu vực hoạt động bay dân dụng, danh mục chướng ngại vật tự nhiên, nhân tạo có thể ảnh hưởng đến an toàn hoạt động bay.
3. Cảng vụ hàng không có trách nhiệm:
a) Tổ chức đo đạc, lập sơ đồ, bản đồ chướng ngại vật trong khu vực hoạt động bay dân dụng; thống kê, đánh dấu danh mục chướng ngại vật tự nhiên, nhân tạo có thể ảnh hưởng đến an toàn hoạt động bay cập nhật thông tin về chướng ngại vật; báo cáo Cục Hàng không Việt Nam;
b) Kiểm tra, giám sát việc tuân thủ các quy định về quản lý chướng ngại vật hàng không tại cảng hàng không, sân bay và khu vực lân cận cảng hàng không, sân bay.
Điều 71. Thông tin liên lạc bằng vô tuyến điện
1. Việc thông tin liên lạc bằng các thiết bị vô tuyến điện tại cảng hàng không, sân bay phải tuân thủ các quy định của pháp luật về quản lý tần số vô tuyến điện, pháp luật về hàng không dân dụng.
2. Tổ chức, cá nhân sử dụng các thiết bị vô tuyến điện tại cảng hàng không, sân bay sau khi được các cơ quan có thẩm quyền cấp phép phải thông báo việc sử dụng với Cảng vụ hàng không.
Ðiều 72. Yêu cầu về bảo vệ môi trường
Việc bảo vệ môi trường tại cảng hàng không, sân bay thực hiện theo các quy định của pháp luật về bảo vệ môi trường trong hoạt động hàng không dân dụng.
Điều 73. Yêu cầu đối với việc phòng, chống dịch bệnh
1. Phương tiện, cơ quan, tổ chức, cá nhân hoạt động tại cảng hàng không, sân bay phải tuân thủ các quy định của pháp luật về phòng, chống dịch bệnh tại cảng hàng không, sân bay, phòng, chống dịch bệnh lây lan qua đường hàng không, tuân theo các chỉ đạo của cơ quan nhà nước có thẩm quyền.
2. Nhà ga hành khách phải được đảm bảo các điều kiện sau đây:
a) Vệ sinh phòng bệnh thông thường; trong trường hợp có dịch bệnh phải được tăng cường vệ sinh, khử trùng thường xuyên bằng hoá chất diệt khuẩn được phép sử dụng theo quy định của Tổ chức Y tế Thế giới, ICAO, Bộ Y tế;
b) Bố trí đủ dung dịch sát khuẩn hoặc xà phòng rửa tay tại các khu vệ sinh;
c) Bố trí đủ trang thiết bị, bảo hộ, thuốc, hóa chất để thực hiện các biện pháp phòng chống dịch theo chỉ đạo của Bộ Y tế.
3. Trong trường hợp có dịch bệnh lây lan, người cung cấp dịch vụ nhà ga hành khách có trách nhiệm bố trí địa điểm kiểm tra để hành khách khai báo y tế; địa điểm để giám sát tình trạng sức khỏe, đo thân nhiệt hoặc áp dụng các biện pháp kiểm tra, xử lý y tế khác theo quy định của pháp luật. Địa điểm kiểm tra được quy định như sau:
a) Đối với hành khách đến: trên tàu bay hoặc trước khi vào nhà ga; hoặc trong nhà ga nhưng trước khi làm các thủ tục liên quan khác;
b) Đối với hành khách đi: trong nhà ga trước khi lên tàu bay.
4. Trong trường hợp có dịch bệnh lây lan, tùy mức độ cảnh báo dịch của Bộ Y tế, tàu bay thực hiện chuyến bay quốc tế, chuyến bay nội địa phải được khử trùng bằng hoá chất diệt khuẩn được phép sử dụng theo quy định của Tổ chức Y tế Thế giới, ICAO, Bộ Y tế. Việc khử trùng được thực hiện như sau:
a) Tàu bay, người, hàng hóa có dấu hiệu mang dịch truyền nhiễm nhóm A thì tàu bay phải được cách ly, kiểm tra và xử lý y tế trước khi làm thủ tục nhập cảnh, xuất cảnh, quá cảnh;
b) Khi phát hiện hành khách có dấu hiệu mang bệnh truyền nhiễm nhóm A thì phải tiến hành khử trùng tàu bay trước khi cho hành khách ra khỏi máy bay.
5. Thành lập Ban chỉ đạo phòng chống dịch bệnh dưới sự chủ trì, điều hành của Cảng vụ hàng không với sự tham gia của cơ quan kiểm dịch y tế quốc tế, người khai thác cảng hàng không, sân bay, doanh nghiệp cung cấp dịch vụ nhà ga hành khách, các cơ quan quản lý nhà nước tại cảng hàng không quốc tế. Ban chỉ đạo có trách nhiệm:
a) Triển khai thực hiện các biện pháp cần thiết theo hướng dẫn, chỉ đạo của cơ quan nhà nước có thẩm quyền đối với việc phòng chống dịch bệnh tại cảng hàng không, sân bay, phòng chống dịch bệnh lây lan qua đường hàng không;
b) Ban hành phương án phòng chống dịch bệnh tại cảng hàng không, sân bay, phòng chống dịch bệnh lây lan qua đường hàng không, quy trình xử lý cụ thể khi phát hiện có người nghi nhiễm dịch bệnh, trên nguyên tắc ưu tiên tuyệt đối cho quy trình xử lý y tế, đơn giản hoá thủ tục hàng không, thủ tục xuất nhập cảnh, hải quan theo quy định;
c) Thực hiện công tác tuyên truyền, nâng cao nhận thức cho cán bộ, nhân viên tại cảng hàng không, sân bay về công tác phòng chống dịch bệnh, vì sức khoẻ cộng đồng;
d) Tổ chức thực hiện các phương án hỗ trợ: bố trí vị trí đỗ tàu bay phải cách ly; bố trí vị trí đặt thiết bị kiểm tra y tế, bố trí luồng tuyến vào ra cho hành khách tại cảng hàng không, sân bay; bố trí khu vực cách ly cho hành khách bị nghi ngờ hoặc mắc bệnh truyền nhiễm lây lan theo yêu cầu; bảo đảm an ninh, hỗ trợ thực hiện các biện pháp bắt buộc đối với người, phương tiện; hỗ trợ về phục vụ kiểm dịch y tế, sát khử trùng, vệ sinh môi trường, phương tiện vận chuyển; huy động các nguồn lực của các tổ chức, cá nhân hoạt động kinh doanh tại cảng hàng không, sân bay trong việc thực hiện các biện pháp cấp bách phục vụ chống dịch bệnh lây lan.
6. Doanh nghiệp vận chuyển hàng không có trách nhiệm tuyên truyền cho hành khách khai báo tờ khai y tế một cách đầy đủ, chính xác, hợp tác với cơ quan, tổ chức có thẩm quyền trong việc phòng chống dịch bệnh lây lan; thông báo kịp thời cho các cơ quan có trách nhiệm về các chuyến bay xuất phát hoặc có hạ cánh tại các khu vực dịch bệnh truyền nhiễm lây lan; phối hợp với các cơ quan có thẩm quyền trong việc giải quyết hành khách bị nghi ngờ hoặc mắc dịch bệnh truyền nhiễm lây lan.
7. Cục Hàng không Việt Nam hướng dẫn, chỉ đạo các đơn vị thuộc ngành hàng không phối hợp với các cơ quan kiểm dịch y tế triển khai thực hiện các biện pháp phòng chống dịch bệnh tại cảng hàng không, sân bay, phòng chống dịch bệnh lây lan qua đường hàng không theo hướng dẫn của Tổ chức Y tế Thế giới, ICAO, quy định của Bộ Y tế.
Điều 74. Hoạt động quảng cáo
1. Việc xây dựng các công trình quảng cáo phải tuân thủ quy hoạch được phê duyệt, quy định của pháp luật về quảng cáo; quy định của pháp luật về xây dựng công trình tại cảng hàng không, sân bay; quy chuẩn kỹ thuật về xây dựng, lắp đặt phương tiện quảng cáo.
2. Người khai thác công trình được thực hiện hoạt động quảng cáo tại công trình thuộc phạm vi quản lý, khai thác.
3. Việc xây dựng công trình quảng cáo, lắp đặt phương tiện quảng cáo phải đảm bảo các yêu cầu sau:
a) Không làm ảnh hưởng đến mỹ quan, kiến trúc nhà ga, hệ thống biển báo trong nhà ga;
b) Không đặt biển quảng cáo, sử dụng tờ rơi, âm thanh để quảng cáo tại khu bay;
c) Không đặt biển quảng cáo tại vị trí cửa thoát hiểm của các công trình;
d) Không đặt biển quảng cáo ảnh hưởng đến công tác an toàn hàng không, an ninh hàng không, phòng cháy chữa cháy, an toàn giao thông, cản trở luồng di chuyển của hành khách và hàng hóa;
đ) Không sử dụng âm thanh để quảng cáo tại các công trình thuộc kết cấu hạ tầng cảng hàng không, sân bay; tại các công trình khác ảnh hưởng đến việc cung cấp dịch vụ hàng không;
e) Không lắp các đèn hiệu, biển quảng cáo có sử dụng đèn xoay, đèn laze và các thiết bị chiếu sáng gây ảnh hưởng đến hoạt động bay trong khu vực cảng hàng không, sân bay;
g) Không quảng cáo bằng khinh khí cầu, bóng bay, diều và các vật thể bay khác trong khu vực cảng hàng không, sân bay;
h) Không quảng cáo trên phương tiện hoạt động tại khu vực hạn chế của cảng hàng không, sân bay, các thiết bị tại sân đỗ tàu bay làm ảnh hưởng đến hoạt động bay hoặc tính năng hoạt động bình thường của phương tiện, thiết bị.
4. Cảng vụ hàng không có trách nhiệm kiểm tra, giám sát việc xây dựng công trình quảng cáo, hoạt động quảng cáo; đình chỉ việc xây dựng công trình quảng cáo, hoạt động quảng cáo vi phạm các quy định của pháp luật.
Điều 75. Phân bổ giờ cất hạ cánh
1. Cục Hàng không Việt Nam thành lập Hội đồng điều phối giờ cất, hạ cánh tại các cảng hàng không, sân bay để thực hiện khảo sát, công bố danh mục cảng hàng không, sân bay được điều phối, giới hạn khai thác của cảng hàng không, sân bay được điều phối theo quy định của pháp luật.
2. Cục Hàng không Việt Nam phân bổ giờ hạ, cất cánh tại các cảng hàng không, sân bay trên cơ sở đề xuất của Hội đồng điều phối giờ cất, hạ cánh; việc xác nhận giờ hạ, cất cánh đối với lịch bay thường lệ tại các cảng hàng không, sân bay được điều phối thực hiện theo tài liệu Hướng dẫn điều phối giờ hạ, cất cánh toàn cầu (Worldwide Slot Guidelines), tài liệu thông tin lịch bay tiêu chuẩn (Standard Schedules Information Manual) được cập nhật của IATA và quy chế điều phối giờ cất, hạ cánh của Cục Hàng không Việt Nam.
Điều 76. Sân bay căn cứ của hãng hàng không trong nước
1. Cục Hàng không Việt Nam công bố sân bay căn cứ theo đề nghị của hãng hàng không trong nước trên cơ sở:
a) Năng lực khai thác sân đỗ tàu bay thực tế tại sân bay đã có sự điều tiết của người khai thác cảng hàng không, sân bay;
b) Nhu cầu khai thác mạng đường bay của hãng hàng không trong nước liên quan đến sân bay căn cứ;
c) Bảo đảm an toàn khai thác tàu bay; hạn chế ảnh hưởng đến kế hoạch khai thác của các hãng hàng không trong nước, kế hoạch khai thác phục vụ bay của cảng hàng không, sân bay.
2. Trên cơ sở công bố sân bay căn cứ, số lượng vị trí đỗ qua đêm quy định tại khoản 1 Điều này, người khai thác cảng hàng không, sân bay bố trí vị trí đỗ tàu bay qua đêm tại sân bay căn cứ của các hãng hàng không trong nước.
Điều 77. Phân bổ sử dụng quầy làm thủ tục hàng không
1. Doanh nghiệp cung cấp dịch vụ khai thác nhà ga hành khách phân bổ quầy làm thủ tục hàng không (check-in) cho các hãng hàng không, doanh nghiệp cung cấp dịch vụ phục vụ kỹ thuật thương mại mặt đất trên nguyên tắc linh hoạt, đảm bảo tận dụng toàn bộ quầy làm thủ tục hàng không tại nhà ga hành khách trong các khung giờ cao điểm, không để xảy ra tắc nghẽn liên tục tại quầy làm thủ tục hàng không.
2. Cảng vụ hàng không có trách nhiệm giám sát việc thực hiện nguyên tắc phân bổ quầy làm thủ tục hàng không theo quy định tại khoản 1 Điều này.
Điều 78. Di chuyển tàu bay không có khả năng di chuyển
1. Phương án di chuyển tàu bay hư hỏng trên khu bay phải được quy định trong tài liệu khai thác sân bay.
2. Tàu bay bị hỏng hóc, mất khả năng di chuyển nằm trong khu vực có hoạt động bay cần phải được di dời đi nơi khác để không ảnh hưởng đến hoạt động hàng không bình thường. Việc di dời tàu bay mất khả năng di chuyển thuộc trách nhiệm của người khai thác tàu bay. Người khai thác tàu bay phải tổ chức di dời tàu bay bị sự cố theo yêu cầu và chỉ đạo của người khai thác cảng hàng không, sân bay. Trong trường hợp người khai thác tàu bay không đủ khả năng để tổ chức di dời, người khai thác tàu bay phải hiệp đồng với người khai thác cảng hàng không, sân bay để người khai thác cảng hàng không, sân bay tổ chức di dời với chi phí di dời do người khai thác tàu bay chịu trách nhiệm thanh toán.
3. Tổ chức di dời tàu bay mất khả năng di chuyển tại sân bay cần theo thứ tự như sau:
a) Xác định điều kiện mức độ hư hại của tàu bay bị tai nạn vào thời điểm sớm nhất để thông báo yêu cầu tới công ty cung cấp dịch vụ di dời nhanh chóng có mặt phục vụ theo hợp đồng đã được thoả thuận và dự kiến trước các phương án để phối hợp thực hiện di dời; thông báo cho cơ quan điều tra tai nạn, công ty bảo hiểm có mặt tại hiện trường;
b) Thiết lập đường để cho các loại xe đặc chủng ra, vào phục vụ việc di dời tàu bay;
c) Tháo nguồn ắc quy hoặc tháo dây tiếp mát, tháo nguồn ra khỏi thanh dẫn điện; tổ chức thông gió phần bên trong tàu bay, kiểm tra dập tắt lửa những chỗ còn cháy khói, tẩy rửa các chất lỏng, bẩn cả bên trong khoang tàu bay và trên mặt đất trước khi di dời tàu bay đi. Tiến hành giảm trọng lượng tàu bay như rút dầu, giải toả hàng hoá và tháo bớt những bộ phận có thể tháo của tàu bay để giảm trọng lượng, tạo điều kiện cho việc nâng nhấc tàu bay đi;
d) Vận chuyển chuyên gia và các thiết bị phục vụ di dời của công ty dịch vụ đã thuê ra hiện trường; chuẩn bị sẵn sàng các lực lượng, phương tiện cùng phối hợp với công ty dịch vụ thực hiện các bước di dời;
đ) Tổ chức nâng nhấc, sửa chữa phục hồi theo phương án đã được phê duyệt;
e) Sau khi đã di dời tàu bay mất khả năng di chuyển ra khỏi khu vực, tổ chức san gạt, thu dọn mặt bằng và kiểm tra tổng hợp; nếu đảm bảo đủ điều kiện an toàn, đưa đường cất hạ cánh vào khai thác theo quy định.
4. Các yêu cầu trong thời gian tổ chức di dời:
a) Xe cứu hỏa và cứu thương phải trực tại địa điểm sẵn sàng làm nhiệm vụ;
b) Phải đảm bảo thông tin liên lạc với đài kiểm soát tại sân bay và với các cơ quan liên quan để không ảnh hưởng đến hoạt động bay của đường cất hạ cánh còn lại;
c) Tổ chức di dời không làm tàu bay hư hỏng thêm trừ trường hợp có ý kiến của chủ tàu bay hay người khai thác tàu bay trong trường hợp tàu bay bị hư hại nhiều không còn khả năng phục hồi sửa chữa;
d) Chọn địa điểm di dời tàu bay đến nơi thuận lợi và có khả năng phải lưu lại một thời gian dài;
đ) Không hút thuốc lá tại hiện trường và khu vực phụ cận;
e) Di dời tàu bay đi phải được phép của cơ quan điều tra tai nạn.
5. Người khai thác tàu bay hiệp đồng với người khai thác cảng hàng không, sân bay để canh giữ, bảo vệ tàu bay hư hỏng sau khi được di dời đến vị trí đỗ tàu bay được xác định trong phương án di chuyển tàu bay hư hỏng để phục vụ công tác điều tra sự cố tàu bay theo quy định.
6. Trong kế hoạch hiệp đồng sẵn sàng xử lý khi có tình trạng tàu bay mất khả năng di chuyển xảy ra tại cảng hàng không cần phải nêu rõ địa điểm của ban chỉ huy hiện trường, các số điện thoại quan trọng và chỉ dẫn các đường ra, vào của các phương tiện phục vụ di dời tàu bay.
Chương IX
KINH DOANH DỊCH VỤ CHUYÊN NGÀNH HÀNG KHÔNG TẠI CẢNG HÀNG KHÔNG, SÂN BAY
Điều 79. Kinh doanh dịch vụ hàng không
1. Cục Hàng không Việt Nam cấp giấy phép cung cấp dịch vụ hàng không cho doanh nghiệp cung cấp dịch vụ hàng không tại cảng hàng không, sân bay theo quy định của pháp luật và nguyên tắc chống độc quyền.
2. Tài liệu chứng minh đáp ứng các quy chuẩn, tiêu chuẩn kỹ thuật chuyên ngành về bảo đảm an toàn hàng không, an ninh hàng không, phòng chống cháy nổ, bảo vệ môi trường bao gồm:
a) Chương trình an ninh hàng không, quy chế an ninh hàng không;
b) Tài liệu cung cấp dịch vụ bao gồm các nội dung: lĩnh vực cung cấp dịch vụ; phạm vi cung cấp dịch vụ (quy mô cung cấp dịch vụ, sơ đồ mặt bằng hạ tầng cung cấp dịch vụ); quy trình, phương án cung cấp dịch vụ hàng không; danh mục phương tiện, thiết bị;
c) Văn bản, biên bản nghiệm thu về phòng cháy chữa cháy của cơ quan phòng cháy chữa cháy; phương án phòng cháy chữa cháy được cấp có thẩm quyền phê duyệt;
d) Giấy kiểm định phương tiện chuyên ngành hàng không; giấy phép phương tiện hoạt động trong khu vực hạn chế; giấy chứng nhận đảm bảo an toàn kỹ thuật bảo vệ môi trường;
đ) Hồ sơ, tài liệu bảo vệ môi trường theo quy định pháp luật.
3. Hãng hàng không có quyền tự do lựa chọn doanh nghiệp cung cấp dịch vụ hàng không được phép tại cảng hàng không, sân bay. Vì lý do an toàn hàng không, an ninh hàng không, Cục Hàng không Việt Nam có thể chỉ định người cung cấp dịch vụ hàng không cho hãng hàng không trên cơ sở:
a) Khả năng đáp ứng của kết cấu hạ tầng;
b) Yêu cầu thực hiện các biện pháp an ninh hàng không đặc biệt.
4. Người sử dụng dịch vụ có quyền thực hiện đánh giá dịch vụ hàng không được cung cấp tại cảng hàng không, sân bay theo tiêu chuẩn áp dụng. Kết quả đánh giá theo tiêu chuẩn an toàn, an ninh hàng không phải được gửi cho Cục Hàng không Việt Nam, Cảng vụ hàng không để kiểm tra, giám sát, xử lý theo quy định.
5. Việc cung cấp dịch vụ hàng không tại cảng hàng không, sân bay thực hiện theo tiêu chuẩn của ICAO, tiêu chuẩn, quy chuẩn kỹ thuật áp dụng và quy định của Thông tư này.
6. Cầu hành khách được sử dụng cùng các dịch vụ kỹ thuật đồng bộ kèm theo tại cầu hành khách. Trong trường hợp có sự cố kỹ thuật đối với cầu hành khách, việc sử dụng dịch vụ kỹ thuật được thực hiện theo thỏa thuận giữa người sử dụng và đơn vị được phép cung ứng dịch vụ tại sân bay.
Điều 80. Cung cấp dịch vụ phi hàng không
1. Việc cung cấp dịch vụ phi hàng không tại cảng hàng không, sân bay được thực hiện trên nguyên tắc chống độc quyền.
2. Việc sử dụng mặt bằng tổ chức cung cấp dịch vụ phi hàng không trong nhà ga hành khách, nhà ga hàng hóa phải tuân thủ theo tài liệu khai thác nhà ga.
3. Doanh nghiệp cung cấp dịch vụ phi hàng không có trách nhiệm thông báo với Cảng vụ hàng không các nội dung sau:
a) Tên tổ chức cá nhân; loại hình cung cấp dịch vụ, danh mục sản phẩm, hàng hóa; vị trí, mặt bằng cung cấp dịch vụ;
b) Hợp đồng hoặc văn bản của doanh nghiệp cung cấp dịch vụ nhà ga chấp nhận doanh nghiệp được cung cấp dịch vụ phi hàng không tại cảng hàng không.
4. Cảng vụ hàng không kiểm tra, giám sát việc tổ chức cung cấp dịch vụ phi hàng không; xử lý hoặc đề nghị cơ quan có thẩm quyền xử lý các vi phạm trong việc cung cấp dịch vụ phi hàng không.
Chương X
ĐIỀU KHOẢN THI HÀNH
Điều 81. Hiệu lực thi hành
Thông tư này có hiệu lực kể từ ngày 15 tháng 12 năm 2016 và thay thế Thông tư số 16/2010/TT-BGTVT ngày 30 tháng 6 năm 2010 của Bộ trưởng Bộ Giao thông vận tải quy định chi tiết về quản lý, khai thác cảng hàng không, sân bay, Thông tư số 19/2011/TT-BGTVT ngày 31 tháng 3 năm 2011 của Bộ trưởng Bộ Giao thông vận tải sửa đổi, bổ sung một số điều của Thông tư số 16/2010/TT-BGTVT, Điều 3 Thông tư 38/2014/TT-BGTVT ngày 05 tháng 9 năm 2014 của Bộ trưởng Bộ Giao thông vận tải quy định về việc bảo đảm kỹ thuật nhiên liệu hàng không tại Việt Nam.
Điều 82. Tổ chức thực hiện
Chánh Văn phòng, Chánh Thanh tra Bộ, các Vụ trưởng, Cục trưởng Cục Hàng không Việt Nam, Thủ trưởng các cơ quan, tổ chức và cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.
