GUIDELINES COMPLEMENTARY TO POLICY ON LOANS FOR SMALL PROJECTS TO CREATE EMPLOYMENT ISSUED BY THE STATE PLANNING COMMITTEE DECISION NO. 17-TT/LB ON SEPTEMBER 9, 1992
TO COMPLEMENT THE POLICY ON LOANS FOR SMALL PROJECTS TO SOLVE EMPLOYMENT ISSUES
IN ACCORDANCE WITH RESOLUTION NO. 120-HĐBT OF THE COUNCIL OF MINISTERS ON APRIL 11, 1992

To implement Resolution No. 120-HĐBT of the Council of Ministers dated April 11, 1992 on the policy, direction, and measures to solve employment issues in the coming years; the Ministry of Labor - Invalids and Social Affairs - Ministry of Finance - State Planning Committee issued Circular No. 10-TT/LB dated July 24, 1992 guiding the loan policy for small projects to create employment. In order to ensure that the implementation of the loan policy is carried out quickly and smoothly while still ensuring the objectives and effectiveness, the Joint Ministries issue additional guidelines for some points in Circular No. 10-TT/LB dated July 24, 1992 as follows:

1. The classification of examination and approval of loan projects from the national fund for employment resolution shall be implemented as follows:

a) The Joint Ministries of Labor - Invalids and Social Affairs - Finance - State Planning Committee will base on the capital of the national fund for employment resolution and the ability to create jobs for workers in each locality during each period to announce the limit of capital that can be used for loans in each province, centrally governed city, and certain sectors and social organizations. The announcement will clearly state the amount of loans according to new economic project plans and small job creation project plans.

b) For new economic projects: Based on the allocated capital for new economic projects and the application documents of the new economic project owner, the Chairman of the People's Committee of the province or centrally governed city will examine and approve the loan project for job creation for households and private individuals who have moved to new economic zones. The decision of the Chairman of the People's Committee of the province or centrally governed city will be sent to the Joint Ministries (through the Advisory Board on Management and Operation of the National Fund for Employment Resolution) to serve as the basis for transferring loan funds to the locality through the State Treasury system. The State Treasury (where the loan project is located) will immediately proceed with lending to the target group according to the guidelines set forth in the Loan Regulations No. 1360/TC-KBNN dated July 27, 1992 of the Ministry of Finance.

c) For small job creation projects.

Within the allocated capital limit and within the scope of projects constructed in accordance with government guidance, the Chairman of the People's Committee of the centrally governed province or city will organize the examination and issuance of approval decisions. This decision, together with a summary table of approved projects in the area, accompanied by a letter requesting authority to manage loan funds from the Chairman of the People's Committee of the province or centrally governed city, will be sent to the Joint Ministries for review and verification (if necessary). The Ministry of Labor - Invalids and Social Affairs will issue a decision authorizing the organization to implement the project, and the Ministry of Finance will transfer loan funds to the locality through the State Treasury system. The State Treasury will carry out lending according to the prescribed regulations.

The scope of examination and approval of small job creation projects by the Chairman of the People's Committee of the centrally governed province or city includes projects established by local mass organizations, trade unions, and professional associations. In some key areas, if deemed necessary and more convenient, central agencies of these organizations may guide their organizations to establish projects and compile them for review and approval by their central agency before sending them to the Joint Ministries for resolution. The content of compilation and review shall follow the guidelines set forth in Circular No. 10/TT-LB dated July 24, 1992.

2. Regarding the loan term: For each project receiving a loan, the term specified in Circular No. 10/TT-LB dated July 24, 1992 is the term of one loan period. When the term expires, the borrower must repay the principal and interest to the State Treasury. In cases where there is a genuine need, such as raising long-term crops, the borrower may apply for additional loan periods from the State Treasury if they comply with the conditions stipulated in the loan agreement. At the same time, the State Treasury will report to the Joint Ministries for monitoring and management.

3. For households and private individuals residing within the territory of state-owned forestry and agricultural enterprises, which have economic relations with these enterprises, the forestry and agricultural enterprises may establish small loan projects to create employment for households and private individuals in the area and submit them to the People's Committee of the province or centrally governed city for approval like other small projects. The basic principle for this case is not to lend through forestry and agricultural enterprises but to lend directly to the borrowers of the project, ensuring the separation of operating capital from employment resolution loan capital. If these forestry and agricultural enterprises meet the conditions and ensure clear separation of capital, they will also be entrusted by the State Treasury to lend to the target group as stipulated in Circular No. 10-TT/LB dated July 24, 1992. A few forestry and agricultural enterprises serving directly for new economic projects such as raising seedlings will also be able to borrow from the national fund for employment resolution upon proposal by the managing agency and review and approval by the Joint Ministries (through the Advisory Board on Management and Operation of the National Fund for Employment Resolution).

This circular takes effect from the date of signature and replaces the points that are inconsistent in Joint Circular No. 10-TT/LB dated July 24, 1992. During the implementation process, if there are difficulties, please promptly reflect them to the Joint Ministries for study and resolution.
