DECISION
Regarding the allowance for responsibility for Judges, Court Secretaries, and Appraisers in the Judiciary

PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 370/2004/NQ-UBTVQH11 dated September 30, 2004 of the Standing Committee of the National Assembly approving the salary scale for leadership positions, the allowance scale for leadership positions for state officials; the salary scale for specialized and vocational positions in the Judiciary and Prosecution;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;
Considering the proposal of the President of the Supreme People's Court after consultation with the Minister of Home Affairs and the Minister of Finance,
DECISION:
Article 1. Judges of the People's Courts at all levels (including the President of the Supreme People's Court), Court Secretaries, and Appraisers in the Judiciary shall be entitled to an occupational responsibility allowance as follows:
1. The President of the Supreme People's Court and Judges of the Supreme People's Court shall receive an occupational responsibility allowance equal to 20% of their current salary plus the leadership position allowance and the seniority allowance exceeding the ceiling (if applicable).
2. Judges of the People's Courts of provinces and centrally-administered cities shall receive an occupational responsibility allowance equal to 25% of their current salary plus the leadership position allowance and the seniority allowance exceeding the ceiling (if applicable).
3. Judges of the People's Courts of districts, urban districts, towns, and provincial-level cities shall receive an occupational responsibility allowance equal to 30% of their current salary plus the leadership position allowance and the seniority allowance exceeding the ceiling (if applicable).
4. Court Secretaries at all levels shall receive an occupational responsibility allowance equal to 20% of their current salary plus the leadership position allowance and the seniority allowance exceeding the ceiling (if applicable).
5. Senior Appellate Reviewers shall receive a responsibility allowance equal to 15% of their current salary plus leadership position allowance and seniority allowance exceeding the standard range (if applicable).
6. Principal Appellate Reviewers shall receive a responsibility allowance equal to 20% of their current salary plus leadership position allowance and seniority allowance exceeding the standard range (if applicable).
7. Appellate Reviewers shall receive a responsibility allowance equal to 25% of their current salary plus leadership position allowance and seniority allowance exceeding the standard range (if applicable).
Article 2. The financial resources for the payment of the occupational responsibility allowance for Judges, Court Secretaries, and Appraisers in the Judiciary shall be allocated in the annual state budget according to the provisions of the State Budget Law.
Article 3. The Supreme People's Court shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to provide guidance on the implementation of this Decision.
Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Abolish the provisions regarding the allowance for Judges and Court Secretaries at all levels set forth in Article 1 and Article 3 of Decision No. 06/2001/QĐ-TTg dated January 10, 2001 of the Prime Minister concerning the allowance for certain judicial positions.
The occupational responsibility allowance for Judges, Court Secretaries, and Appraisers in the Judiciary as stipulated in this Decision shall be effective from October 1, 2004.
Article 5. The President of the Supreme People's Court, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
