DECREE
Abolishing part of Decree No. 59/2006/NĐ-CP dated June 12, 2006 of the Government detailing the Law on Trade regarding goods and services prohibited from trade, restricted trade, and conditional trade, and abolishing Decree No. 43/2009/NĐ-CP dated May 7, 2009 of the Government amending and supplementing the List of Goods and Services Prohibited from Trade under Decree No. 59/2006/NĐ-CP dated June 12, 2006 guiding the implementation of the Law on Trade regarding goods and services prohibited from trade, restricted trade, and conditional trade.
Pursuant to the Law on Government Organization dated June 19, 2015; the Law Amending and Supplementing Certain Articles of the Law on Government Organization and the Law on Local Administration Organization dated November 22, 2019;
Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated June 18, 2020;
Pursuant to the Law on Trade dated June 14, 2005;
Pursuant to the Investment Law dated June 17, 2020;
At the proposal of the Minister of Industry and Trade;
The Government issues this Decree to abolish part of Decree No. 59/2006/NĐ-CP dated June 12, 2006 of the Government detailing the Law on Trade regarding goods and services prohibited from trade, restricted trade, and conditional trade (hereinafter referred to as Decree No. 59/2006/NĐ-CP) and to abolish Decree No. 43/2009/NĐ-CP dated May 7, 2009 of the Government amending and supplementing the List of Goods and Services Prohibited from Trade under Decree No. 59/2006/NĐ-CP (hereinafter referred to as Decree No. 43/2009/NĐ-CP).
Article 1. Abolishing part of Decree No. 59/2006/NĐ-CP and abolishing entirely Decree No. 43/2009/NĐ-CP.
1. Abolishing entirely Decree No. 43/2009/NĐ-CP amending and supplementing the List of Goods and Services Prohibited from Trade under Decree No. 59/2006/NĐ-CP.
2. Abolishing part of Decree No. 59/2006/NĐ-CP as follows:
a) Abolishing point b, point c Clause 1 Article 4 and Articles 6, 7, 8.
b) Abolishing point 1, point 2, point 3, point 4, point 5, point 6, point 7, point 8, point 9, point 10, point 11, point 12, point 14, point 17, and point 18 at Section A on Goods and all of Section B on Services of Appendix I List of Goods and Services Prohibited from Trade.
c) Abolishing Appendix II List of Goods and Services Restricted from Trade and Appendix III List of Goods and Services Subject to Conditional Trade.
Article 2. Implementation clause
1. This Decree takes effect from February 15, 2025.
2. The Ministry of Natural Resources and Environment shall issue or submit to the competent authority for issuance legal documents managing special and toxic minerals before June 30, 2027.
3. The Ministry of Health shall issue or submit to the competent authority for issuance legal documents managing types of medicines for human treatment, types of vaccines, medical products, cosmetics, chemicals, and insecticides, bactericides in household and medical fields not yet permitted for use in Vietnam; types of medical equipment not yet permitted for use in Vietnam before June 30, 2027.
4. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees, municipal People's Committees directly under the central government, and related agencies and units are responsible for implementing this Decree.
