Based on the Law on the Organization of the Government dated December 25, 2001;

Considering the proposal of the Minister of Agriculture and Rural Development at the report No. 3672/TTr-BNN-KTHT dated October 26, 2012,

DECISION:

Article 1. Approves the Program for Resettling Residents in Areas Affected by Natural Disasters, Extremely Difficult Conditions, Border Regions, Islands, Spontaneous Migration, and Special-Use Forests for the period 2013-2015 and orientation towards 2020 (hereinafter referred to as the Resident Resettlement Program) with the following main contents:

1. Objectives

a) General objectives

Implementing planning and stabilizing resident resettlement in areas affected by natural disasters, extremely difficult conditions, border regions, islands, spontaneous migration, and special-use forests, aiming to stabilize and improve the living standards of residents, minimize losses caused by natural disasters and spontaneous migration; create job opportunities, increase income, contribute to poverty reduction, protect the environment, and consolidate national defense and security.

b) Specific Objectives

- During the period 2013-2020, implement the stable resettlement of 160,000 households, including 55,900 households during the period 2013-2015, comprising: 32,100 households in disaster-prone areas; 6,600 households in extremely difficult conditions; 8,600 households in border and island areas; 8,600 households in spontaneous migration and residing in special-use forests.

- Strive to reduce the poverty rate in project areas from 1.5% to 2% annually; the proportion of households using clean drinking water reaches 70%-80%, electricity usage reaches 90%-95%; the proportion of households having sturdy and semi-sturdy houses reaches 70%-80%.

Article 2. Scope and Objectives of the Program

a) Scope of Application

This program applies to the stable resettlement of residents according to state planning and plans in areas affected by natural disasters (landslides, land subsidence, whirlwinds, flash floods, flood pipes, flooding, saline intrusion, tsunamis, rising sea levels); extremely difficult conditions (lack of land, production water, drinking water, infrastructure, radioactive impact, environmental pollution, floating villages on rivers and lakes); border and island areas (including economic zones under national defense); spontaneous migration areas where living conditions are too difficult and special-use forests throughout the country until 2015 and orientation towards 2020.

b) Applicability

Households and individuals who are resettled stably according to centralized relocation, intermixed relocation, or in-place stabilization according to approved planning and plans include:

- Households whose housing and land have been lost due to landslides, flash floods, flood pipes, land subsidence, whirlwinds; households living in areas at risk of landslides, flash floods, flood pipes, land subsidence, flooding, whirlwinds, tsunamis, saline intrusion, rising sea levels; households living in extremely difficult conditions such as lack of land, production water, drinking water, infrastructure; floating communities on lakes and rivers, polluted environments, radioactive impacts;

- Households voluntarily moving to border land areas, economic zones under national defense, and islands;

- Households that spontaneously migrated to various locations within the country without planned resident resettlement, still facing difficult living conditions; households living in special-use forests requiring long-term resettlement and stabilization;

- Communities receiving relocated households through centralized and intermixed relocation.

Article 3. Principles for Implementing the Program

a) Resident resettlement must be consistent with approved resident resettlement planning, new rural construction planning, and related sectoral planning. Priority should be given to stable resettlement to prevent, avoid, and mitigate damage caused by natural disasters; address spontaneous migration and population movement near border villages.

b) Stable resident resettlement is both a goal and a solution for economic, cultural, and social development; national defense and ecological environment protection. Stable resident resettlement must focus on key areas, ensure essential infrastructure, and develop production to enable residents to live stably in their new locations.

c) Stable resident resettlement is the responsibility of relevant sectors and local authorities at all levels, with targeted central budget support combined with local budgets and other lawful capital sources on the territory to implement the resident resettlement program.

d) Resident resettlement mainly takes place within communes, districts, and provinces. In cases where it is necessary to move residents outside the province, coordination between the sending and receiving provinces is required to implement resettlement according to planning. Mainly implement intermixed relocation, combining with centralized relocation and in-place stabilization.

đ) Households resettled according to planning and plans will receive state support for relocation (if applicable), housing, food, and other assistance; investment in building essential infrastructure and developing production services to stabilize living conditions and promote sustainable community development.

e) Stable resident resettlement should aim to form new rural settlement points meeting criteria, build people's war defense and public security systems, and be compatible with the customs and cultural traditions of each ethnic group.

Article 2. Projects under the Program:

1. Project to stabilize residents in disaster-prone areas.

2. Project to stabilize residents in border and island areas.

3. Project to stabilize residents in particularly difficult areas.

4. Project to stabilize self-migrating residents and those residing in special-use forests.

Article 3. Implementation Measures for the Program

1. Regarding planning and plans

- Based on the overall socio-economic development plan, sectoral plans, and field-specific plans, develop the Residential Arrangement Plan for the period 2013-2015 with future directions until 2020 for each region and locality according to the target groups of migrants, subject to approval by competent authorities. During implementation, if there are changes, adjustments should be made to suit the actual conditions of each locality;

- On the basis of the approved Residential Arrangement Plan, detailed planning shall be carried out, projects for residential arrangement investment shall be established, reviewed, and approved to organize implementation according to annual plans;

- Develop a residential arrangement plan prioritizing high-risk disaster areas, which must be implemented first. Specific plans shall be made to complete ongoing residential arrangement projects in 2013.

2. Regarding mechanisms and policies

a) Land policy:

- Based on current land laws, localities shall take measures to reclaim unused or inefficiently used land areas from organizations and individuals, or change land use purposes according to approved plans and programs to allocate to households and individuals under the residential arrangement project;

- Exempt or reduce land use fees for households migrating to disaster-prone areas; ethnic minority households in particularly difficult areas similar to coastal village households, river-dwelling people, and inhabitants of lakes and swamps, as stipulated in Decision No. 33/2011/QĐ-TTg dated June 10, 2011 of the Prime Minister.

b) Policy supporting infrastructure investment:

The state budget will support from development investment funds to build essential infrastructure for concentrated residential arrangement areas according to approved projects, including items such as compensation and land clearance (if necessary); leveling and filling residential land at resettlement sites;开荒平整集中垦荒土地(针对集中垦荒);区内项目交通道路(包括新建居民点到最近交通干线的道路);小型水利设施和生活用水工程及其他必要设施。

c) Direct support policy for household families:

The state budget (from economic affairs funds) will directly support household families and individuals specified in Point b, Clause 2, Article 1 of this Decision, including: relocation of people and assets, land reclamation, housing, food (for up to 12 months at the resettlement site), drinking water (in places without conditions to build centralized drinking water facilities); specific support levels as follows:

- Land reclamation for production, including support for paddy field reclamation at 15 million VND/hectare; fixed garden reclamation at 8 million VND/hectare;

- Households in areas with natural disaster risks or particularly difficult areas, if they relocate within the project area, will receive 20 million VND per household; if they relocate within the province, they will receive 23 million VND per household; if they relocate outside the province, they will receive 25 million VND per household. In cases where households lose their homes and production land due to natural disasters, they will receive an additional 12 months of food aid equivalent to 30 kg of rice per person per month;

- Households resettled in border villages between Vietnam and China, Vietnam and Laos, or Vietnam and Cambodia, if they move to border villages or remain stable in place, will receive support as stipulated in Point a, Clause 4, Article 1 of Decision No. 570/QĐ-TTg dated May 17, 2012 of the Prime Minister; if they move to other villages (not border villages), the support level is 32 million VND per household;

- Households resettled in border villages between Vietnam and Laos, or Vietnam and Cambodia, if they move to border villages, will receive 35 million VND per household; if they move to other villages (not border villages), the support level is 30 million VND per household; poor households in border villages will receive 10 million VND per household;

- Households relocating to islands in the South China Sea or Gulf of Tonkin: Support levels will be based on approved projects by competent authorities;

- Self-migrating households relocated to planned areas will receive 10 million VND per household in support.

Provincial People's Committees (hereinafter referred to as Provincial People's Committee) shall specify the funding levels for each support item according to local conditions.

d) Community support policy for mixed residential arrangements: Where communities are arranged in mixed settlements according to provincial-level People's Committee targets under the Residential Arrangement Program, if these are villages adjacent to the borders of Vietnam-China, Vietnam-Laos, or Vietnam-Cambodia, the support level is 80 million VND per household; for other areas, it is 50 million VND per household to carry out tasks such as adjusting residential and production land allocation to new households (reclamation, compensation according to regulations when land is reclaimed from organizations and individuals currently using the land), building or upgrading essential infrastructure such as classrooms, health stations, small-scale irrigation systems, rural roads, and community water supply facilities. The selection of infrastructure projects for upgrading or new construction shall be decided by the People's Committee of the commune in priority order and in accordance with local realities, with the participation of the local community.

e) In-place resident stabilization support: Households in areas with natural disaster risks but without land reserves for resettlement must be stabilized in place, receiving 10 million VND per household to upgrade housing, purchase boats, and other disaster prevention equipment.

f) Other policies

- The State supports: Vocational training for laborers in households resettled to areas under the residential arrangement project but lacking agricultural land reserves to ensure a stable livelihood, as approved by Decision No. 1956/QĐ-TTg dated November 27, 2009 of the Prime Minister regarding the vocational training program for rural workers until 2020; production development shall be carried out according to existing policies.

- The state budget supports the development of content and organization of training, enhancement, and training courses on management and implementation of the program for officials responsible for population resettlement and ensuring livelihood security, with specific funding levels according to the approved budget estimate by the competent authority.

3. Production Development

- Implement crop and livestock structure transformation in population resettlement projects; focus on developing commodity crops, large-scale animal husbandry, afforestation, forest enclosure and protection, and generating income from forests;

- Organize the supply of high-yield and quality seeds and livestock breeds for production. Strengthen agricultural extension services, forestry extension, fishery extension, technology transfer, production development, intensive farming, multiple cropping, and product quality improvement;

- Develop special industries, particularly traditional local crafts;

- Enhance information dissemination and market search activities; link production with product consumption for households in population resettlement project areas.

4. Capital Solutions

- Based on the provisions of the State Budget Law, the central budget supplements targeted funds to the local budget and records them separately to implement the annual and five-year Population Resettlement Program, including investment capital and economic public service capital;

- Localities proactively allocate their managed capital in combination with integrating capital from various programs, projects, and other lawful sources within their jurisdiction to implement population resettlement, prioritizing projects in areas at high risk of natural disasters (landslides, flash floods, flood waves, flooding, tsunamis); border areas, islands (currently uninhabited or sparsely populated); and spontaneous migrants (living in extreme hardship).

5. Propaganda and Mobilization

Mobilize the participation of mass organizations, people's associations, social organizations, and mass media to promote and mobilize the public to understand the Party and State policies, actively participate alongside local authorities in implementing population resettlement according to planning and plans.

Article 4. Implementation Costs and Capital Sources

1. The total estimated capital for implementing the Population Resettlement Program during the period 2013-2020 (excluding investment capital for projects under national defense economic zones and special resettlement projects decided separately by the Prime Minister) is 16,774 billion VND, of which development investment capital is 12,990 billion VND and economic public service capital is 3,784 billion VND.

2. Investment capital sources: Central budget support: 10,064 billion VND (including development investment capital 7,794 billion VND and economic public service capital 2,271 billion VND), local budget and mobilization of other lawful capital sources 6,710 billion VND.

3. Central budget support during the period 2013-2015 is 3,400 billion VND, including: Development investment capital 2,600 billion VND and economic public service capital 800 billion VND.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. Responsibilities of Central Ministries and Sectors

a) The Ministry of Agriculture and Rural Development (the permanent agency of the Population Resettlement Program) shall take the lead and coordinate with relevant ministries and sectors to guide provincial People's Committees:

- Review, adjust, and supplement population resettlement planning; establish, review, approve investment projects for stable population resettlement according to regulations; develop annual and five-year population resettlement plans to compile and submit to the Prime Minister for approval;

- Prepare the budget estimate for directing the implementation of the program under the central government's expenditure responsibilities;

- Coordinate with the Ministry of Planning and Investment and the Ministry of Finance in allocating capital for the population resettlement program;

- Take the lead and coordinate with the Ministry of Finance and relevant ministries and sectors in researching, adjusting, and supplementing mechanisms and policies for population resettlement;

- Coordinate with provincial People's Committees in building and implementing some models of stable population resettlement tailored to each region and target group to evaluate and draw lessons for wider application;

- Take the lead in developing training content and programs on population resettlement and coordinate with localities and training institutions in organizing training and enhancement for officials at all levels involved in population resettlement work;

- Inspect, supervise, assess, and report to the Prime Minister on the results of population resettlement in localities; propose solutions to organize effective management and implementation of the Population Resettlement Program;

b) Ministry of Planning and Investment

- Take the lead and coordinate with the Ministries of Finance and Agriculture and Rural Development in allocating development investment capital for the Population Resettlement Program to implement annual and five-year plans;

- Agree with the Ministry of Agriculture and Rural Development and the Ministry of Finance on the allocation of capital to sectors and localities and record it separately in the annual plan;

- Guide sectors and localities in integrating other programs and projects within their jurisdiction with projects under the Population Resettlement Program;

c) Ministry of Finance

- Take the lead and coordinate with the Ministries of Planning and Investment and Agriculture and Rural Development in allocating economic public service capital for the Population Resettlement Program according to annual plans;

- Implement disbursement, monitor disbursement, guide management and use of state budget capital allocated for the Population Resettlement Program;

- Coordinate with the Ministry of Agriculture and Rural Development and relevant ministries and sectors in building mechanisms and policies for the Population Resettlement Program;

d) The Ministry of National Defense

Shall take the lead in implementing projects under the Population Resettlement Program in national defense economic zones.

đ) The Ministries of Public Security, Natural Resources and Environment, Labor, Invalids and Social Affairs, Information and Communications, Culture, Sports and Tourism, Education and Training, Health, Ethnic Minority Committee, and other relevant ministries and sectors shall, based on their functions and tasks, plan and guide localities in implementing the Population Resettlement Program.

2. Responsibilities of Provincial People's Committees

a) On the basis of the approved population resettlement planning, proceed to establish, review, and approve investment projects for stable population resettlement based on agreements on objectives, solutions, and total support capital from the central budget with the Ministries of Planning and Investment, Finance, and Agriculture and Rural Development.

b) Develop annual and five-year implementation plans for the Population Resettlement Program and report to the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, and the Ministry of Finance for consolidation and submission to the Prime Minister for approval.

c) Integrate funds from other programs and projects within the area with the Population Resettlement Program.

d) Direct provincial departments, agencies, and local authorities to closely cooperate with mass organizations to actively participate in implementing the Population Resettlement Program; strengthen management, inspection, and supervision of specific projects within the area.

đ) Report the results of implementing the Population Resettlement Program to the Ministry of Agriculture and Rural Development for consolidation and reporting to the Prime Minister.

e) Improve the specialized agency system for population resettlement at the local level; prioritize assigning dedicated staff at the district level and part-time staff at the commune level to effectively organize the implementation of the Program.

Article 6. Implementation Provisions

1. This Decision takes effect from the date of signature.

2. This Decision replaces Decisions: Number 193/2006/QĐ-TTg dated August 24, 2006 of the Prime Minister approving the "Population Resettlement Program for areas affected by natural disasters, extremely difficult conditions, border regions, islands, spontaneous migration, critical and very critical protective forest zones, and strictly protected special-use forest zones for the period 2006-2010 and orientation until 2015"; number 78/2008/QĐ-TTg dated June 10, 2008 of the Prime Minister on "Certain policies for implementing the Population Resettlement Program according to Decision No. 193/2006/QĐ-TTg dated August 24, 2006 of the Prime Minister."

3. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for enforcing this Decision./.
