DECREE

Detailed regulations on certain provisions of the Urban and Rural Planning Law

_____________

Pursuant to the Government Organization Law on February 18, 2025;

Pursuant to the Urban and Rural Planning Law dated November 26, 2024;

Pursuant to Decree No. 145/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the division of authority of local governments at two levels, decentralization, and deconcentration in urban and rural planning;

At the proposal of the Minister of Construction;

The Government promulgates this Decree detailing certain provisions of the Urban and Rural Planning Law.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree details certain provisions of the Urban and Rural Planning Law No. 47/2024/QH15, including:

a) Clause 4, Article 3 on the preparation of general urban plans;

b) Point a, Clause 5, Article 3 on cases for preparing district-level plans according to management and development requirements in centrally-administered cities;

c) Point b, Clause 5, Article 3 on cases for preparing district-level plans according to area scale, management, and development requirements for functional zones that are not economic zones or national tourist areas;

d) Point a, Clause 6, Article 3 on cases for preparing detailed plans according to area scale, management, and development requirements;

đ) Point c, Clause 2, Article 8 on the procedures for reporting and deciding on planning when there is a conflict between urban and rural plans at the same level;

e) Clause 4, Article 10 on managing funds for urban and rural planning activities;

g) Clause 3, Article 11 on receiving, managing, and using resources to support urban and rural planning activities;

h) Clause 3, Article 16 on the procedures for preparing, reviewing, and approving planning tasks, urban and rural plans;

i) Article 18 on the conditions for organizations and individuals participating in preparing planning tasks, urban and rural plans;

l) Clause 4, Article 25 on the deadline for completing the preparation and approval of district-level plans;

Clause 4, Article 49 on the management according to urban and rural planning;

Clause 3, Article 54 on constructing, managing, operating, and exploiting databases for urban and rural planning;

Clause 8, Article 59 on continuing to prepare, review, approve, and adjust district-level plans according to laws on planning and construction for third and fourth-tier cities, economic zones, and national tourist areas that have been approved before the Urban and Rural Planning Law comes into effect;

k) Clause 5, Article 19 on selecting consulting organizations to prepare planning tasks and plans for urban and rural areas through competitive bidding;

Article 2. Applicability

This Decree applies to state administrative agencies, domestic organizations and individuals, and foreign organizations and individuals related to urban and rural planning activities.

Article 3. Definitions

In this Decree, the following terms are understood as follows:

1. The organization responsible for preparing plans is the agency or organization tasked with preparing planning tasks and urban and rural plans as stipulated in Article 17 of the Urban and Rural Planning Law, consistent with the two-level local government structure.

2. The organization reviewing plans is the agency reviewing planning tasks and urban and rural plans as stipulated in Article 38 of the Urban and Rural Planning Law, consistent with the two-level local government structure.

3. The approving body is the agency, organization, or individual with the authority to approve planning tasks and urban and rural plans as stipulated in Article 41 of the Urban and Rural Planning Law.

4. The time for preparing planning tasks is the period from the start of preparing planning tasks until they are submitted to the plan review organization.

5. The time for preparing plans is the period from the selection of the consulting organization to prepare plans until they are submitted to the plan review organization.

Article 4. Time for preparing planning tasks and urban and rural planning

1. Time for preparing general planning tasks

a) For general urban planning under the approval authority of the Prime Minister, the time for preparing planning tasks shall not exceed three months; the time for preparing the plan shall not exceed fifteen months;

b) For general urban planning not falling within the cases stipulated in point a, Clause 1 of this Article and general economic zone planning, national tourism area planning, the time for preparing planning tasks shall not exceed two months; the time for preparing the plan shall not exceed twelve months;

c) For general village planning, general special district planning without urban development orientation, the time for preparing planning tasks shall not exceed one month; the time for preparing the plan shall not exceed nine months.

2. For sectoral planning, the time for preparing planning tasks shall not exceed one month; the time for preparing the plan shall not exceed nine months.

3. For detailed planning, the time for preparing planning tasks shall not exceed one month; the time for preparing the plan shall not exceed six months.

4. For underground space planning, specialized technical infrastructure planning of centrally governed cities, the time for preparing planning tasks shall not exceed one month; the time for preparing the plan shall not exceed nine months.

5. Prior to preparing planning tasks and urban and rural planning, the agency organizing the planning must be responsible for building specific plans and schedules including the time for selecting consulting organizations, reporting, seeking opinions on the planning, and the time for preparing planning tasks and urban and rural planning ensuring compliance with management requirements, development needs, and feasibility. Adjustments to plans and schedules must ensure sufficient grounds for reasons, necessity, and factors affecting the organization of urban and rural planning.

6. For sectoral planning prepared to detail the contents of general planning, the agency responsible for organizing and promulgating the implementation plan of the general planning must clearly define the completion deadlines for sectoral planning within the content of the general planning implementation plan, ensuring that the completion and approval of sectoral planning meet investment and development requirements and feasibility in implementation.

Article 5. Conditions for consulting organizations and individuals participating in preparing planning tasks and urban and rural planningof organizations and individuals participating in preparing the planning assignment, urban planning, and rural planning

1. Individuals participating in preparing planning tasks and urban and rural planning must have appropriate educational certificates issued by legitimate training institutions.

2. Positions and individuals participating in urban and rural planning activities must hold construction practice certificates according to the laws on construction, including the head of planning task preparation, the head of planning preparation, and the lead in specialized fields of urban and rural planning preparation. The construction practice certificate of individuals is divided into Class I, Class II, and Class III and is issued according to the laws on construction.

3. Individuals leading architectural design and landscape architectural design, separate urban design within urban and rural planning must have relevant professional degrees and be issued urban and rural planning practice certificates or architectural practice certificates according to the laws on architecture.

4. Consulting organizations participating in urban and rural planning must hold construction activity capability certificates according to the laws on construction, including consulting for planning task preparation and planning preparation. The consulting organization's capability certificate is divided into Class I, Class II, and Class III and is issued according to the laws on construction.

5. Foreign consulting organizations participating in preparing planning tasks and urban and rural planning must comply with the provisions of this law, the laws on bidding, and obtain operation permits from the competent state construction management agency according to the laws on construction.

Article 6. Provisions on the procedure and process for reporting and deciding on planning schemes when there is a conflict between urban and rural planning schemes at the same level to ensure the compatibility of investment construction projects with urban and rural planning.1. In cases where urban and rural planning schemes have been approved at the same level and by the same approving authority:

a) The agency organizing the planning scheme or the investor implementing the investment construction project shall report to the approving authority on the implementation status of the investment construction project according to the approved urban and rural planning schemes.

b) Requirements for the content of the report: Scientific basis, practical basis, and legal basis related to the implementation of the investment construction project; identification of conflicting contents among the planning schemes that need to be considered; recommendations on the content of the planning scheme or the implemented planning scheme; proposals for measures to address newly arising issues; assessment of the impact and effectiveness of the implementation according to the proposed plan, ensuring compliance with national technical standards for urban and rural planning and related standards and criteria.

c) The approving authority shall consider and approve in writing the content of the planning scheme that has been approved based on the opinions of the planning review agency.

2. In cases where urban and rural planning schemes have been approved at the same level but by different approving authorities:

a) The agency organizing the planning scheme or the investor implementing the investment construction project shall submit a written report to the lower-level approving authority on the implementation status of the investment construction project according to the approved urban and rural planning schemes.

c) The higher-level approving authority shall decide on the implementation of the planning scheme based on the opinions of the lower-level approving authority and the opinions of the agencies reviewing the planning schemes. The decision document from the higher-level approving authority serves as the legal basis for proceeding with subsequent steps.

c) The approving authority shall consider and approve in writing the content of the planning scheme that has been approved based on the opinions of the planning review agency.

3. The agency organizing the planning scheme or the investor implementing the investment construction project must update the contents decided by the approving authority into the urban and rural planning dossier and submit it to the specialized agency under the approving authority responsible for managing urban and rural planning.

PROCEDURE AND PROCESS FOR ESTABLISHING, REVIEWING, AND APPROVING PLANNING TASKS, URBAN AND RURAL PLANNING

Chapter II

PROVISIONS ON THE ESTABLISHMENT OF URBAN OVERALL PLANNING AND ZONING PLANNING, DETAIL PLANNING

Section 1

Article 7. Cases for establishing overall urban planning

1. Overall urban planning as stipulated in Clause 4, Article 3 of the Urban and Rural Planning Law shall be established for the following planning scopes:

a) Central city directly under the central government;

b) Special zones within the urban system according to the orientation in the overall system planning of urban and rural areas or regional planning or provincial planning;

c) Existing urban areas comprising one independent ward or several adjacent wards, within the urban system according to the orientation in the overall system planning of urban and rural areas or regional planning or provincial planning, with the planning scope determined in the decision approving the planning task of urban and rural areas;

d) Expanded urban areas comprising existing urban areas and adjacent communes, within the urban system according to the orientation in the overall system planning of urban and rural areas or regional planning or provincial planning, with the planning scope determined in the decision approving the planning task of urban and rural areas and meeting the minimum area requirement of 50 km², population density of at least 500 people/km², and non-agricultural labor ratio of at least 30%;

đ) New urban areas within the urban system according to the orientation in the overall system planning of urban and rural areas or regional planning or provincial planning; with a minimum planning scope of 30 km² and determined in the decision approving the planning task of urban and rural areas.22. The boundary range for urban development included in the approved overall urban planning serves as the basis and management foundation for urban development.2 and a minimum proportion of non-agricultural labor of 30%;

d) New urban areas belonging to the urban system according to the orientation in the overall planning of the urban and rural system or regional planning or provincial planning; with a minimum planning scope of 30 km2 and determined in the decision approving the planning assignment for urban and rural planning.

2. The boundary range for urban development within the content of the approved general urban planning serves as the basis and foundation for managing urban development.

Article 8. Cases for Establishing Zoning Plans

1. Urban areas as stipulated at point a, Clause 5, Article 3 of the Law on Urban and Rural Planning shall be determined based on the spatial structure in the general urban plan and decided by the People's Committee of the province in the implementation plan of the general urban plan.

2. Functional zones as stipulated at point b, Clause 5, Article 3 of the Law on Urban and Rural Planning with a minimum area of 200 hectares or areas identified by the People's Committee of the province to have investment construction infrastructure development objectives according to laws on construction and project management.

Article 9. Cases for Establishing Detailed Plans

1. Detailed plans as stipulated at point a, Clause 6, Article 3 of the Law on Urban and Rural Planning shall be established in the following cases:

a) Areas that have been established zoning plans as provided for in Article 8 of this Decree;

b) Areas within the approved general plan where zoning plans are not required to be established;

c) Functional zones with an area less than 200 hectares except in cases provided for in Clause 2 of this Article.

2. For land plots meeting the provisions of Clauses 3 and 5 of Article 10 of this Decree, detailed plans shall be established through a simplified process (referred to as the "overall site planning" process), without having to establish and approve planning tasks or organize reviews and approvals of plans.

Article 10. Overall Site Planning

1. Overall site planning shall be established during the project preparation phase and must be approved by the authority responsible for approving detailed plans or the agency authorized to approve it in writing.

2. Adjustments to overall site planning must comply with conditions for adjusting planning as prescribed in the Law on Urban and Rural Planning.

3. Land plots implementing investment construction projects that meet the following conditions simultaneously shall carry out the establishment and approval of overall site planning:

a) The land use scale is less than 0.2 hectares for residential building or housing complex construction projects; or less than 10 hectares for factory, enterprise, industrial production facility, non-linear infrastructure construction projects determined according to the general plan or specialized infrastructure planning or provincial planning or technical and specialized planning already approved; or less than 0.5 hectares for other cases;

b) Within areas that have approved zoning plans or within areas that have approved general plans for cases where zoning plans are not required to be established;

c) Implemented by a single investor or by a state agency assigned to establish overall site planning.

4. Content of overall site planning:

a) Determining requirements for spatial organization, architectural landscape, and technical infrastructure based on compatibility with approved zoning plans or general plans for cases where zoning plans are not required to be established; economic and technical indicators, land use planning indicators compatible with urban and rural planning standards and compatible with specialized standards for construction projects of factories, enterprises, industrial production facilities, and non-linear infrastructure works;

b) Showing the scale and category of works within the plot; proposing architectural forms suitable to the surrounding architectural landscape space; design solutions for technical infrastructure ensuring synchronous connection with the regional infrastructure system and compatible with the surrounding architectural space;

c) The Minister of Construction shall provide guidance on the overall site planning dossier.

5. For defense and security projects requiring national secrecy, the application of overall site planning shall be carried out according to regulations and guidelines of agencies, organizations, or individuals responsible for managing and implementing projects requiring national secrecy.

6. Approval of overall site planning:

a) The agency organizing overall site planning shall submit a document along with the overall site planning dossier to the authority responsible for approving detailed plans or the authorized agency to request approval;

b) Before submitting the dossier requesting approval of overall site planning, the agency organizing overall site planning must seek opinions from relevant communities (if applicable) on the planning content according to Article 37 of the Law on Urban and Rural Planning;

c) The authority responsible for approving detailed plans or the authorized agency shall examine and approve overall site planning, ensuring the requirements of Clause 5 of this Article. The time for the authority responsible for approving detailed plans or the authorized agency to examine and approve overall site planning shall not exceed 15 days from the date of receiving complete dossiers from the organizing agency.

Section 2
PROCEDURE FOR ESTABLISHING, REVIEWING AND APPROVING URBAN AND RURAL PLANNING TASKS

Article 11. Establishing the planning assignment for urban and rural areas

1. The agency organizing the planning shall directly establish the planning assignment for urban and rural areas or select consulting organizations meeting the conditions stipulated in Article 5 of this Decree to carry out the establishment; during the process of establishing the planning assignment for urban and rural areas, opinions must be solicited according to the provisions of Article 36 of the Urban and Rural Planning Law.

2. The agency organizing the planning must fully incorporate and explain all participating opinions during the establishment of the planning assignment and complete the planning assignment dossier for urban and rural areas before submitting it for review.

3. The planning assignment for lower-level urban and rural areas shall be decided upon by the agency organizing the planning simultaneously during the time of establishing higher-level urban and rural planning but must be approved after the higher-level urban and rural planning has been reviewed, submitted for approval, and must ensure that the content of the lower-level urban and rural planning assignment is consistent and specific to the higher-level urban and rural planning.

4. In cases where district zoning planning is established or adjusted according to special regulations of the Government, the provisions of Clause 3 of this Article shall not apply.

Article 12. Submitting for Review and Conducting the Review of the Planning Assignment for Urban and Rural Areas

1. The agency organizing the planning submits the planning assignment dossier for urban and rural areas to the agency conducting the planning review.

2. The agency conducting the planning review checks the components and contents of the planning assignment dossier in accordance with the laws on urban and rural planning; establishes or advises the competent authority to establish the Review Board; organizes the solicitation of opinions from members of the Review Board before convening the review board meeting for the planning assignment.

3. The agency conducting the planning review is responsible for compiling the opinions of the Review Board members, relevant state management agencies, and sending them to the agency organizing the planning for study, incorporation, explanation, and completion of the planning assignment dossier before the planning assignment for urban and rural areas is submitted for approval.

4. The agency organizing the planning must fully incorporate and explain all review opinions compiled by the reviewing agency; complete the planning assignment dossier for urban and rural areas, resubmit it for the agency conducting the planning review to check, and serve as the basis for completing and issuing the review report before the agency organizing the planning submits it for approval.

5. The review conducted by the reviewing agency according to the Urban and Rural Planning Law and this Article does not replace or reduce the responsibility of the agency organizing the planning assignment and the consulting organization for the tasks they undertake according to the law.

Article 13. Submitting for Approval and Approving the Planning Assignment for Urban and Rural Areas

1. The agency organizing the planning submits the planning assignment dossier for urban and rural areas to the approving authority for approval.

2. The approving authority bases its decision on the Petition, accompanied by the completed planning assignment dossier of the agency organizing the planning and the review report of the reviewing agency to consider and approve the planning assignment for urban and rural areas.

3. The explanations and drawings in the planning assignment dossier for urban and rural areas, after being approved, must be checked and stamped with confirmation by the agency conducting the planning review according to the regulations of the Minister of Construction.

Section 3
PROCEDURES FOR ESTABLISHING, REVIEWING, APPROVING, AND ADJUSTING URBAN AND RURAL PLANNING

Article 14. Preparing urban and rural planning

1. The agency organizing the preparation of the plan or the agency assigned according to Clause 10, Article 17 of the Urban and Rural Planning Law selects consulting organizations meeting the conditions stipulated in Article 5 of this Decree to implement the preparation of the plan; during the process of preparing urban and rural plans, opinions must be solicited in accordance with Article 37 of the Urban and Rural Planning Law.

2. The agency organizing the preparation of the plan must fully incorporate and explain all participating opinions during the planning process and complete the urban and rural planning dossier before submitting it for review.

Point 15. Submitting for review and reviewing urban and rural planning

1. The agency organizing the preparation of the plan submits the completed planning dossier for approval to the competent authority after completing it based on the review report of the reviewing agency.

2. The reviewing agency for planning examines the components and contents of the urban and rural planning dossier in accordance with the laws on urban and rural planning; establishes or advises the competent authority to establish a Review Board; organizes the collection of opinions from Review Board members, and the critical opinions of experts who are Review Board members before convening the Review Board meeting for urban and rural planning.

3. The reviewing agency for planning is responsible for compiling the opinions of Review Board members, critical opinions, and sending them to the agency organizing the preparation of the plan for study, incorporation, explanation, and completion of the urban and rural planning dossier before submitting it for approval. For content that still has differing opinions and has not reached consensus with the agency organizing the preparation of the plan, the reviewing agency for planning reports and clearly states its position in the review report on urban and rural planning for the approving authority to consider and decide.

4. The agency organizing the preparation of the plan must fully incorporate and explain all review opinions and critical opinions compiled by the reviewing agency; complete the urban and rural planning dossier, resubmit it to the reviewing agency for planning to check and finalize, issue the review report before the agency organizing the preparation of the plan submits it for approval.

5. The review conducted by the reviewing agency in accordance with the Urban and Rural Planning Law and this Article does not replace or reduce the responsibility of the agency organizing the preparation of the plan and the responsibility of the consulting organization for urban and rural planning for the tasks they perform under the law.

Article 16. Submitting for approval and approving urban and rural planning

1. The agency organizing the preparation of the plan submits the completed urban and rural planning dossier for approval after completing it based on the review report of the reviewing agency.

2. The approving authority bases its decision on the submission letter accompanied by the completed planning dossier of the agency organizing the preparation of the plan and the review report of the reviewing agency for urban and rural planning to consider and approve the urban and rural planning.

3. The explanatory notes and drawings in the urban and rural planning dossier, after being approved, must be reviewed and stamped with confirmation by the Ministry of Construction as prescribed.

Article 17. Procedure for Approving the Proposal to Adjust the Overall Urban and Rural Planning

1. The approval procedure for the proposal to adjust the overall urban and rural planning as stipulated in point a, Clause 1, Article 47 of the Urban and Rural Planning Law shall apply to the general planning level.

2. The procedure for approving the proposal to adjust the overall urban and rural planning:

a) The agency organizing the planning prepares a written report to submit to the authority approving the planning and the reviewing agency, proposing the implementation of the overall adjustment of the urban and rural planning. The content of the report is based on the results of reviewing and evaluating the implementation of the general planning; clearly stating the reasons and necessity for implementing the overall adjustment of the planning; the start and completion time for preparing the overall adjustment of the general planning.

b) The reviewing agency studies the content of the report and proposals from the planning organization agency, evaluates according to the regulations on conditions for adjusting the planning, and submits a written report to the authority approving the planning to obtain approval for implementing the overall adjustment of the general planning.

c) The authority approving the planning approves the overall adjustment of the general planning in writing.

3. The procedures for organizing the preparation, review, approval, and publication of the overall adjustment of the general planning as provided herein shall be carried out in accordance with the laws on urban and rural planning.

Chapter III
PROVISIONS TO ENSURE THE QUALITY AND EFFECTIVENESS OF URBAN AND RURAL PLANNING ACTIVITIES

Article 18. Maps for Preparing Planning Tasks, Urban and Rural Planning

1. Topographic maps for preparing planning tasks and planning must be issued by state management agencies for maps or prepared by specialized surveying and mapping agencies, ensuring quality and technical requirements according to regulations on surveying and mapping activities; and also conforming to regulations on establishing urban and rural planning database.

2. Information and data on topographic maps must meet the requirements for preparing planning tasks and planning, suitable for each type and level of planning. In cases where the topographic map does not match the current situation at the time of planning, the competent authority approving the planning task, urban and rural planning will decide to conduct additional topographic surveys according to the procedures and formalities prescribed in the laws on surveying and mapping.

Article 19. Urban and Rural Planning Idea Competition

1. For cases determined to implement an idea competition for urban and rural planning in accordance with Clause 3, Article 19 of the Urban and Rural Planning Law, based on the approved planning task, the agency organizing the planning shall carry out the following tasks:

a) Prepare and approve the competition plan and budget;

b) Prepare and issue the competition rules along with information materials about the area for planning serving the competition;

c) Establish the Competition Committee and Technical Team; define the responsibilities of the Competition Committee and Technical Team;

d) Announce and invite a minimum of three consulting organizations meeting the conditions to participate in the idea competition for urban and rural planning;

đ) Receive and hand over competition entries to the Competition Committee;

e) Decide and announce the competition results.

2. The competition rules include the following basic contents:

a) Form, scale, nature, purpose, requirements of the competition;

b) Regulations on participation conditions; criteria, content, organization procedures; time and place of the competition; entry forms; validity of entry forms;

c) Composition of the Competition Committee and basic information about the expertise and experience of its members;

d) Costs for organizing the competition; basis for determining planning preparation costs;

đ) Structure and value of awards (if any);

e) Rights and responsibilities of related parties, copyright;

g) Sample registration form for participating in the competition;

h) Other contents as required by each competition (regulations on rounds if applicable and situations where the round ends without an optimal solution; principles for determining planning preparation costs...);

i) Information materials about the planning area:

Information materials about the planning area for the competition, issued together with the competition rules, include legal information about the planning area; current drawings and data; development goals and requirements, and planned investment attraction and investment plans; spatial layout, architectural landscape requirements, and other related requirements.

3. Competition entries include explanatory documents, drawings expressing planning ideas, technical solutions, films, photos, models (if any), financial proposals, and planning preparation costs. Entries must be uniformly specified regarding language (Vietnamese or bilingual), measurement units, currency, and anonymity rules, not including the name or logo of the consulting organization or author in the entry.

4. Competition Committee:

a) The Competition Committee has an odd number of members, a minimum of nine people, including one Chairperson and other members;

b) The committee structure includes representatives from state management agencies, relevant social professional organizations, experts in urban and rural planning, and representatives from the planning organizing agency; among which, at least one-third of the members are experienced experts in urban and rural planning. The Chairperson must be an experienced and reputable urban and rural planning expert elected by the committee or invited by the planning organizing agency;

c) The Competition Committee unifies the working regulations for the Chairperson to sign and issue. The Competition Committee is responsible for analyzing planning ideas based on the competition rules; the scientific and practical aspects of the proposals and evaluating and ranking consulting organizations. It compiles and reports the results of the urban and rural planning idea competition.

5. The competition results are reported in writing by the Competition Committee to the planning organizing agency, signed by the Chairperson; the report content of the Competition Committee must include the following:

a) The process of receiving competition entries;

b) The number of participating organizations, received entries, valid and invalid entries according to the criteria in the competition rules;

c) Rank the examination results by the Examination Board according to the criteria set out in the Examination Regulation, corresponding to the awards.

d) Propose the unit selected to provide urban and rural planning advisory services.

Article 20. Selection of Consulting Organizations for Planning Tasks, Urban and Rural Planning

1. The selection of consulting organizations for planning tasks, urban and rural planning shall be regulated as follows:

a) In accordance with the laws on bidding, ensuring compliance with the legal requirements regarding the qualifications of the organization under the laws on urban and rural planning.

b) In cases where the anticipated cost of preparing planning tasks for urban and rural areas does not fall within the scope of mandatory implementation under the laws on bidding, the agency organizing the planning may prepare the planning tasks for urban and rural areas through self-execution or designate a consulting organization to prepare such tasks in accordance with the laws on bidding.

2. Consulting organizations for urban and rural planning shall be selected through the following forms:

a) Bidding in accordance with the laws on bidding, ensuring compliance with the legal requirements regarding the qualifications of the organization under the laws on urban and rural planning.

b) Competition for urban and rural planning ideas; the agency organizing the planning shall organize the competition for planning ideas in accordance with Article 19 of this Law.

Article 21. Management of Funds for Urban and Rural Planning Activities

1. The head of the agency organizing the planning shall be responsible for managing funds from the state budget for urban and rural planning activities; implement control over advance payments, settlements, and final accounts based on volume, in accordance with the laws on the state budget and through the State Treasury. Relevant agencies shall have the responsibility to coordinate in inspection and supervision.

2. The Ministry of Construction shall establish and issue a list of planning projects and annual funding plans from the state budget for urban and rural planning organized by the Ministry of Construction and other planning organized by the Prime Minister; approve the project cost estimates, adjusted cost estimates (if any) for urban and rural planning activities.

3. People's Committees at all levels with authority shall approve planning tasks, establish and issue lists of planning projects and annual funding plans from the state budget for urban and rural planning within their administrative jurisdiction, except for those organized by the Ministry of Construction; approve the project cost estimates, adjusted cost estimates (if any) for urban and rural planning activities.

Article 22. Acceptance, Management, and Utilization of Resources Supporting Urban and Rural Planning Activities

1. Agencies accepting and managing resources supporting urban and rural planning activities:

a) For planning tasks, urban and rural planning under the approval authority of the Prime Minister, the provincial People's Committee decides on the acceptance of support resources in the form of funds.

b) For planning tasks, urban and rural planning not falling under the case stipulated in point a of this clause, the approving authority decides on the acceptance of support resources in the form of funds.

c) The agency organizing the planning accepts support resources in the form of research outcomes and awards for competition results of urban and rural planning ideas; sponsors conferences, seminars, training, research, surveys, and domestic and foreign training.

2. Management and utilization of resources supporting urban and rural planning activities:

a) For support resources in the form of funds: Deposit into the local budget and manage and utilize in accordance with the laws on the state budget.

b) For support resources in the form of research outcomes and awards for competition results of urban and rural planning ideas; sponsors conferences, seminars, training, research, surveys, and domestic and foreign training: The sponsor directly manages and decides on the costs of implementation.

3. The establishment, review, approval, adjustment, and publication of urban and rural planning in cases using sponsored funding shall be carried out in accordance with the laws on urban and rural planning.

Article 23. Provisions on management according to urban and rural planning

1. Provisions on management according to general planning must be consistent with approved planning and specify the following contents:

a) Boundaries, scope, and nature of the area for planning;

b) Economic and technical standards, regulations on spatial control, architectural landscape, and controlled construction elevations for each area;

c) Red line boundaries, construction limits up to each city-level or regional road for cases of general planning for cities that are not centrally governed cities, general planning for economic zones, and general planning for national tourist areas;

d) Identification of prohibited construction areas; protection ranges, safety corridors for technical infrastructure works, special-purpose works, underground works; conservation areas for architectural works, historical, cultural, scenic spots, and landscape topography;

đ) Environmental protection requirements and measures;

e) Responsibilities for implementation organization; principles for organizing and implementing according to the approved general planning;

2. Provisions on management according to zoning planning must be consistent with approved planning and specify the following contents:

a) Scope and scale of the planning area; location, boundaries, nature, and scale of functional zones within the planning area;

b) Economic and technical standards and land use planning standards, construction elevations for each plot;

c) Red line boundaries, construction limits up to each regional road, construction elevations, and specific technical requirements for each road and area;

d) Protection ranges, safety corridors for technical infrastructure works, special-purpose works, underground works; conservation and renovation ranges for historical, cultural, scenic spots, and landscape topography;

đ) Environmental protection requirements and measures;

e) Responsibilities for implementation organization; principles for organizing and implementing according to the approved zoning planning;

3. Provisions on management according to detailed planning must be consistent with approved planning and specify the following contents:

a) Boundaries, scope, and nature, function of the planning area;

b) Economic and technical standards and land use planning standards, construction elevations for each lot;

c) Regulations on building height, floor level, and height of the first floor or base of high-rise buildings, architectural form and fence of buildings, construction materials of buildings;

d) Red line boundaries, construction limits, and specific technical requirements up to each internal road; protection ranges, safety corridors for technical infrastructure works, special-purpose works, underground works;

đ) List and regulations on conservation, renovation, and refurbishment of architectural works, historical, cultural, scenic spots, and landscape topography;

e) Environmental protection requirements and measures;

g) Responsibilities for implementation organization; principles for organizing and implementing according to the approved detailed planning;

4. Provisions on management according to underground space planning for centrally governed cities must be consistent with approved planning and specify the following contents:

a) Boundaries, scope of underground space planning;

b) Regulations on planning elevation; relationship with related works and areas;

c) Construction limits and specific technical requirements for each underground work route and area; protection ranges, safety corridors for underground works;

d) Environmental protection requirements and measures;

đ) Responsibilities for implementation organization; principles for organizing and implementing according to the approved underground space planning;

5. Provisions on management according to specialized technical infrastructure planning for centrally governed cities must be consistent with approved planning and specify the following contents:

a) Boundaries, scope of specialized technical infrastructure planning;

b) Regulations on planning elevation; relationship with related works and areas;

c) Construction limits and specific technical requirements for each technical infrastructure work route and area; protection ranges, safety corridors for technical infrastructure works;

d) Environmental protection requirements and measures;

đ) Responsibilities for implementation organization; principles for organizing and implementing according to the approved specialized technical infrastructure planning.

Article 24. Construction, management, operation, and exploitation of urban and rural planning database

1. Principles for constructing, updating, managing, exploiting, and using the urban and rural planning database:

a) The urban and rural planning database shall be constructed throughout the entire process of surveying, measuring, preparing planning tasks, drafting plans, and organizing implementation.

b) The urban and rural planning database shall be centrally managed, uniformly, and synchronously from central to local levels.

c) The urban and rural planning database shall be constructed and updated to provide comprehensive, accurate, timely, and synchronized information within the national construction activity information system, meeting state management requirements for investment in construction.

d) The urban and rural planning database shall maintain continuous, stable, and unimpeded operations and be stored long-term, meeting the exploitation and usage needs of agencies, organizations, and individuals as prescribed by law.

đ) Digitized planning files in electronic format must be published on the Ministry of Construction's Planning Portal by the provincial People's Committee in accordance with regulations for publication and transparency.

2. The construction, updating, management, exploitation, and use of the urban and rural planning database shall comply with the Government's regulations on the national information system and database on construction activities, as well as legal provisions on information technology, electronic transactions, network security, cyber security, access to information; regulations on management, connection, and sharing of digital data by state agencies.

3. Responsibilities and operating costs for managing and operating the urban and rural planning database system:

a) The agency responsible for drafting the plan has the responsibility to construct and update the urban and rural planning database through the work of drafting, reviewing, approving, and adjusting urban and rural plans; the specialized agencies for urban and rural planning at provincial and communal levels have the responsibility to manage, exploit, and use the urban and rural planning database system.

b) The costs for constructing, updating, managing, exploiting, and using the urban and rural planning database shall be sourced from regular budget funds of the state and determined according to the guidelines of the Minister of Construction.

Chapter IV
TRANSITION PROVISIONS

Article 25. Transitional provisions under Clause 8, Article 59 of the Urban and Rural Planning Law

1. The agency responsible for drafting the comprehensive plan shall consolidate the results of drafting and approving the sectoral plan after the general plan has been approved; develop a plan identifying areas requiring the drafting or adjustment of sectoral plans based on the approved general plan, and report to the authority that approved the general plan for implementation within two years as stipulated in the Urban and Rural Planning Law.

2. If the sectoral plans have not been completed within the two-year period following the issuance of the plan, the agency responsible for drafting the plan must adjust the general plan in accordance with the Urban and Rural Planning Law.

Article 26. Transfer after this Decree takes effect

1. Detailed planning approved through the simplified procedure shall continue to be valid during the implementation of the project after this Decree takes effect until it is adjusted according to the provisions of this Decree on overall land use planning. In cases where detailed planning through the simplified procedure is still under preparation and has not yet been approved, it shall be implemented according to the provisions of this Decree on the establishment and approval of overall land use planning.

2. Rural areas that have rural planning approved and still in effect, if they meet the conditions for partial adjustment of planning, shall implement partial adjustment of planning in accordance with the laws on urban and rural planning.

3. Regional construction planning across districts and regional construction planning within a district shall be transferred in accordance with the provisions of Clause 1, Article 59 of the Urban and Rural Planning Law; in cases where there is no other planning to replace them, certain contents regarding technical infrastructure of regional construction planning across districts or regional construction planning within a district, if meeting the conditions for partial adjustment of planning, may be partially adjusted according to the laws on urban and rural planning.

4. Areas that were townships or new urban areas approved for urban planning before the date this Decree takes effect, now belonging to communes, shall continue to be managed and implemented according to the approved urban planning, and when establishing and approving the commune's general planning after reorganization, the content of the approved urban planning must be inherited.

5. Decisions on classification of urban areas issued by competent authorities before July 1, 2025 based on the results of urban quality assessment based on approved urban and rural planning shall continue to be valid until they are replaced, amended, or revoked according to the law.

Chapter V
IMPLEMENTING PROVISIONS

Article 27. Implementation Organization

1. Ministers, heads of ministerial-level agencies, heads of government agencies, Chairpersons of People's Committees of centrally governed cities and provinces, heads of political organizations, political-social organizations, occupational-political-social organizations, and related organizations and individuals shall be responsible for implementing this Decree.

2. The Ministry of Construction:

a) Take the lead in coordinating with ministries, sectors, and provincial People's Committees in organizing state management of urban and rural planning;

b) Regularly inspect, urge, and guide localities in organizing implementation according to the laws on urban and rural planning; promptly identify issues and difficulties in urban and rural planning activities to study and propose solutions to the Government, Prime Minister, and relevant ministries and sectors;

c) Review, adjust, supplement, and issue new national technical standards on urban and rural planning.

3. People's Committees at all levels:

a) Allocate funds from the state budget allocated to the locality to implement urban and rural planning activities in accordance with the law and guidance of the Ministry of Construction;

b) Organize inspections of the implementation of laws on urban and rural planning; promptly identify, compile, and report difficulties and issues to competent authorities to serve as a basis for further improving the legal system.

Article 28. Amending and supplementing the contents of certain Articles and Clauses in related Decrees

1. Amending and supplementing some Articles, Clauses, and Points of Decree No. 175/2024/NĐ-CP dated December 30, 2024, of the Government detailing certain provisions and measures for implementing the Law on Construction regarding construction activity management as follows:

a) Replacing the phrase "urban planning" at Clause 3, Article 1, Point g, Clause 2, Article 17, Clause 1, Article 61, Point c, Clause 4 and Point c, Clause 5, Article 70, Point c, Clause 2, Article 71, Point a, Clause 2, Article 119, Clause 5 and Clause 6, Article 121, Clause 5, Article 122 with the phrase "urban and rural planning";

b) Replacing the phrase "urban planning or underground space planning" at Clause 4, Article 3 with the phrase "urban and rural planning";

c) Replacing the phrase "urban planning design" at Clause 13 and Clause 14, Article 3 with the phrase "urban and rural planning";

d) Amending and supplementing Clause 21, Article 3 as follows: "21. Urban and rural planning in this Decree refers to all types and levels of planning according to the Law on Urban and Rural Planning and other urban planning laws and construction laws that have been established, approved, and remain valid under the regulations of the Law on Urban and Rural Planning.";

đ) Replacing the phrase "urban planning" at Point a, Clause 1, Article 4 with the phrase "planning according to the Law on Urban and Rural Planning";

e) Amending and supplementing Point a, Clause 2, Article 13 as follows: "a) For infrastructure investment projects in inter-district and district areas: urban and rural planning that remains valid under the regulations of the Law on Urban and Rural Planning serves as the basis for establishing investment projects;";

g) Replacing the phrase "urban planning or technical sector planning" at Point g, Clause 2, Article 13 with the phrase "urban and rural planning";

h) Amending and supplementing Point a, Clause 3, Article 13 as follows: "a) Adjusting the layout, form, and technical parameters of the project when ensuring land use indicators in the urban and rural planning approved for the project area according to the Law on Urban and Rural Planning, spatial management regulations, urban design regulations, architectural management regulations (if applicable), and urban planning standards;";

i) Amending and supplementing Point a, Clause 2, Article 18 as follows: "a) For urban and rural planning: evaluating the compatibility of the basic design with land use indicators determined in the urban and rural planning used as the basis for establishing the project according to Clause 2, Article 13 of this Decree; checking the compatibility of land use functions in the general planning; the compatibility of land use functions, population control indicators in the detailed planning (if applicable) of the project area;";

k) Replacing the phrase "urban planning, functional area planning, or detailed rural settlement planning" at Point d, Clause 1, Article 44 with the phrase "urban and rural planning";

l) Replacing the phrase "urban planning" at Clause 1 and Clause 2, Article 65 with the phrase "planning";

m) Replacing the phrase "Urban planning design" at Point b, Clause 1, Article 74, Point b, Clause 1, Article 94, and Point h, Clause 1, Article 99 with the phrase "Establishing urban and rural planning";

n) Amending and supplementing Article 81 as follows:

"Article 81. Professional experience conditions for obtaining a certificate to practice urban and rural planning

An individual will be considered for issuance of a certificate to practice urban and rural planning if they meet the general conditions stipulated in Article 79 of this Decree and the corresponding professional experience conditions for each level of the certificate as follows:

1. Level I: Has served as the head or main planner of urban and rural planning in their specialized field for at least one urban and rural planning approved by the Prime Minister or two urban and rural planning (including one general plan or detailed plan) approved by the provincial People's Committee.

2. Level II: Has served as the head or main planner of urban and rural planning in their specialized field for at least one urban and rural planning approved by the provincial People's Committee or two urban and rural planning approved by the commune People's Committee.

3. Level III: Has participated in the establishment of urban and rural planning in their specialized field for at least two urban and rural planning that have been approved.";

o) Amending and supplementing Point b, Clause 5, Article 98 as follows:

"b) For organizations engaged in urban and rural planning: individuals responsible for the position of head or main planner in the specialized fields of urban and rural planning, architecture, transportation, electricity, water supply and drainage must hold the corresponding professional practice certificates as stipulated in Section 2 of Appendix VII of this Decree, consistent with the level of the certificate requested by the organization;";

p) Amending and supplementing Article 103 as follows:

"Article 103. Qualification Conditions for Organizations Engaged in Urban and Rural Planning

Organizations engaged in urban and rural planning must meet the corresponding qualification conditions for each level as follows:

1. Level I:

a) Having at least two individuals responsible for the positions of head or main planner in the specialized fields of urban and rural planning, architecture, transportation, electricity, water supply and drainage who hold Level I professional practice certificates consistent with the specialized fields they undertake;

b) Having successfully established at least one urban and rural planning within their jurisdiction and approved by the Prime Minister or two urban and rural planning (including at least one general plan) within their jurisdiction and approved by the provincial People's Committee.

2. Level II:

a) Individuals responsible for the positions of head or main planner in the specialized fields of urban and rural planning, architecture, transportation, electricity, water supply and drainage must hold professional practice certificates from Level II or above consistent with the specialized fields they undertake;

b) Having successfully established at least one urban and rural planning within their jurisdiction and approved by the provincial People's Committee.

3. Level III:

Individuals holding the position of head of urban and rural planning, leading professional fields such as urban and rural planning, architecture, transportation, electricity, water supply and drainage must have a practice certificate from level III or higher, appropriate to their field of expertise.

q) Replace the phrase "urban planning, construction planning" in Clause 13, Article 122 with the phrase "urban and rural planning".

r) Amend and supplement Item 2 of Appendix VIII attached to Decree No. 175/2024/NĐ-CP dated December 30, 2024 of the Government as follows:

a) Replace the phrase "construction planning" in Clause 2, Article 1, Clause 3, Article 3, Point b, Clause 1, Article 7, Clause 4, Article 8, Name of Clause 5 and Point b, Clause 5, Article 10, Clause 5, Article 12 with the phrase "urban and rural planning";

b) Amend and supplement Article 6 as follows:

"Article 6. Database on urban and rural planning

1. Information and data in the database on urban and rural planning are classified as follows:

a) Urban planning;

b) Rural planning;

c) Functional area planning;

d) Underground space planning for centrally-administered cities;

đ) Specialized technical infrastructure planning for centrally-administered cities.

2. Information about urban and rural planning collected and updated in the database on urban and rural planning includes:

a) General information: Name of planning, type of planning; location, area of planning region; organization or entity preparing the planning; authority reviewing and approving the planning; year of approval of the planning;

b) Detailed information: Documents and texts related to urban and rural planning and certain or all information in these documents, including: Decision approving the planning task and urban and rural planning of the competent authority; drawings, comprehensive descriptions, urban design (if any), management regulations according to approved planning (if any); implementation plan for urban and rural planning; other related information (if any).

3. General information and certain detailed information in the database on urban and rural planning are open data published on the national data portal and the Ministry of Construction's electronic information portal.

4. Core data in the database on urban and rural planning include the information code specified at Point a, Clause 2, Article 8 of this Decree and the general information mentioned at Point a, Clause 2 of this Article."

c) Replace the phrase "construction planning project" in Name of Clause 2, Article 8, Clause 1, Article 10 with "urban and rural planning".

3. Amend and supplement some articles, clauses, and points of Decree No. 100/2024/NĐ-CP dated July 26, 2024 of the Government detailing some provisions of the Housing Law on social housing development and management as follows:

a) Replace the phrase "construction planning" in Article 5 and Point a, Clause 2, Article 27 with the phrase "urban and rural planning";

b) Replace the phrase "construction planning" in Clause 1, Article 58 with the phrase "planning".

4. Amend and supplement some articles, clauses, and points of Decree No. 98/2024/NĐ-CP dated July 25, 2024 of the Government detailing some provisions of the Housing Law on renovation and reconstruction of apartment buildings as follows:

a) Add "Based on the Urban and Rural Planning Law dated November 26, 2024" in the section on basis

b) Replace the phrase "construction planning" in Point c, Clause 2, Article 24 with the phrase "urban and rural planning".

c) Replace the phrase "urban planning" in Clause 5, Article 6 with the phrase "urban and rural planning".

5. Amend and supplement some articles, clauses, and points of Decree No. 96/2024/NĐ-CP dated July 24, 2024 of the Government detailing some provisions of the Real Estate Business Law as follows:

a) Replace the phrase "construction planning" in Clause 2, Article 37 and Appendix X, Appendix XII, and Appendix XIII with the phrase "urban and rural planning";

b) Replace the phrase "construction planning" in Point a, Clause 2, Article 4, Point b, Clause 2, Article 9, Point d, Clause 3, Article 10, and Clause 2, Article 35 with the phrase "urban and rural planning".

6. Amend and supplement some articles, clauses, and points of Decree No. 95/2024/NĐ-CP dated July 24, 2024 of the Government detailing some provisions of the Housing Law as follows:

a) Replace the phrase "construction planning, urban planning" in Article 14 and Appendix II with the phrase "urban and rural planning";

b) Replace the phrase "construction planning for public service housing, construction planning for projects of national importance" in Point a, Clause 1, Article 68 with the phrase "planning for construction of public service housing, projects of national importance";

c) Replace the phrase "construction planning" in Model Form 02, Appendix V with the phrase "urban and rural planning".

7. Amend and supplement some articles, clauses, and points of Decree No. 10/2024/NĐ-CP dated February 1, 2024 of the Government on high-tech zones as follows:

a) Replace the phrase "high-tech zone construction planning" in Clause 5, Article 4, Clause 2, Article 9, Clause 5, Article 10, Point c, Clause 3, Article 24, Clause 6, Article 45, Point d, Clause 4, Article 47 with the phrase "high-tech zone planning";

b) Remove the word "construction" in the phrase "construction planning" in Clause 1, Article 17, Clause 6, Article 44, Clause 7, Article 45;

c) Replace the phrase "construction planning" in Point a, Clause 4, Article 21, Clause 2, Article 40, Point b, Clause 6, and Point a, Clause 7, Article 47 with the phrase "urban and rural planning".

8. Amend and supplement some articles, clauses, and points of Decree No. 35/2022/NĐ-CP dated May 28, 2022 of the Government on industrial zones and economic zones as follows:

a) Remove the phrase "xây dựng" from the phrases "quy hoạch xây dựng khu công nghiệp", "quy hoạch xây dựng khu kinh tế", "quy hoạch chung xây dựng", "quy hoạch phân khu xây dựng", and "quy hoạch chi tiết xây dựng" in the provisions of Decree No. 35/2022/NĐ-CP dated May 28, 2022, of the Government on management of industrial zones and economic zones;

b) Amend and supplement the phrase "quy hoạch xây dựng nhà ở" at Point d Clause 4 Article 4, Clause 7 Article 9, Clause 5 Article 29 to the phrase "quy hoạch, xây dựng nhà ở";

c) Replace the phrase "quy hoạch xây dựng" at Clause 12 Article 7, Point a Clause 3 Article 27, Point a Clause 3 Article 29, Clause 1 Article 38, Point a Clause 2 Article 68 with the phrase "quy hoạch theo pháp luật về quy hoạch đô thị và nông thôn";

d) Replace the phrase "quy hoạch xây dựng" at Clause 2 Article 51, Point l Clause 3 Article 69 with the phrase "quy hoạch đô thị và nông thôn".

9. Amend and supplement some Articles, Clauses, and Points of Decree No. 85/2020/NĐ-CP dated July 17, 2020, of the Government detailing certain provisions of the Architecture Law as follows:

a) Amend and supplement Clause 1 Article 17 as follows: "1. Has the task of designing in accordance with urban and rural planning, architectural management regulations (if any), approved and issued by competent authorities.";

b) Replace the phrase "quy hoạch xây dựng nông thôn" at Point e Clause 1 Article 13 with the phrase "quy hoạch nông thôn".

Article 29. Effective Date

1. This Decree takes effect from July 1, 2025.

2. Repeal the following legal documents:

3. Repeal Article 1 and Article 2 on detailed planning according to the simplified procedure in Decree No. 35/2023/NĐ-CP dated June 20, 2023, of the Government amending and supplementing some Articles of Decrees under the Ministry of Construction's administrative management.
