Guidelines for the use of funds for land inventory activities and the creation of current land use maps in 2014编制2014年土地利用现状图

The Government issues this Decree on management and development of industrial clusters.
The Minister of Finance issues this Circular regulating the preparation of budgets, management, use, and settlement of funds supported by the State budget for organizations assigned or authorized by the Ministry of Foreign Affairs to perform tasks of selecting, introducing, and managing Vietnamese workers working for foreign organizations and individuals in Vietnam.
Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Implementing Directive No. 21/CT-TTg dated August 1, 2014 of the Prime Minister on land inventory and the creation of current land use maps in 2014;
The Minister of Finance and the Minister of Natural Resources and Environment issue this Joint Circular guiding the use of funds for land inventory activities and the creation of current land use maps in 2014.
Article 1. Scope of Regulation and Applicability
Article 1. Scope of Regulation: This Circular guides the use of funds for land inventory activities and the creation of current land use maps in 2014.

a) The Ministry of Natural Resources and Environment, the Ministry of Public Security, the Ministry of National Defense, People's Committees of provinces and centrally governed cities (provincial level), People's Committees of districts, towns, and centrally governed towns within provinces (district level); People's Committees of communes, wards, and towns (commune level);
b) Other agencies and units related to the use of funds for land inventory and the creation of current land use maps in 2014.
Article 2. Content of Land Inventory and Creation of Current Land Use Maps
The content of land inventory and creation of current land use maps shall be carried out in accordance with point 2 of Directive No. 21/CT-TTg dated August 1, 2014 of the Prime Minister on land inventory and the creation of current land use maps in 2014.
Specifically, for forestry land in localities where forest inventory completion by 2015 is required under Decision No. 594/QĐ-TTg dated April 15, 2013 of the Prime Minister approving the "National Forest Inventory Project for the period 2013-2016," must utilize the results of the project to review, supplement, and adjust changes in area and management and usage objects (if any); no re-inventory will be conducted.
Article 3. Budget for Implementation of Land Inventory and Creation of Current Land Use Maps in 2014
Clause 1. The budget for land inventory and creation of current land use maps of the Ministry of Natural Resources and Environment, the Ministry of National Defense, and the Ministry of Public Security shall be allocated from the central government's state budget for economic expenses in 2015.
Clause 2. The budget for land inventory and creation of current land use maps at the local level (provincial, district, commune levels) shall be allocated from the local government's state budget for economic expenses in 2015 according to the current budget decentralization.
For localities facing difficulties in funding sources, the Ministry of Finance, in coordination with the Ministry of Natural Resources and Environment, shall submit to the Prime Minister for consideration to provide partial support from the central government's budget to the local government's budget to implement.
Clause 3. The Ministry of Natural Resources and Environment shall prepare the budget estimate for implementing the land inventory work and creation of current land use maps in accordance with the content stipulated in point a, Clause 1 of Article 4 of this Circular; coordinate with the Ministry of Finance to propose principles and levels of support for localities facing difficulties in funding sources for consolidation and submission. consideration and decision by the Prime Minister.
Clause 4. The Ministry of Public Security and the Ministry of National Defense shall compile the budget requirements for implementing the land inventory work of their ministries and submit them to the Ministry of Finance for consolidation and reporting. the Prime Minister.
Clause 5. Agencies and units using the budget for land inventory and creation of current land use maps must comply with the approved content by the competent authority; manage and use the budget in accordance with regulations, economically, and effectively; be subject to inspection and supervision by authorized functional agencies; and settle accounts for the land inventory budget in accordance with current regulations.
Article 4. Contents of expenditures for land inventory activities and creation of land use status maps in 2014
1. Contents of expenditures at the central level:
a) Contents of expenditures for activities implemented by the Ministry of Natural Resources and Environment:
- Developing plans for land inventory and creation of land use status maps nationwide in 2014; developing guidance materials for land inventory;
- Providing remote sensing images and topographic maps using remote sensing images to serve land inventory and creation of land use status maps in 2014 for 241 communes without cadastral maps in the concentrated rice-growing areas of six provinces and cities in the Mekong Delta region and in the coastal alluvial areas of 215 communes in 13 provinces and cities;
- Printing guidance materials on land inventory and training on land inventory and creation of land use status maps up to the provincial level;
- Publicizing land inventory and creation of land use status maps through mass media;
- Directing, guiding, and inspecting the implementation of land inventory and creation of land use status maps at local levels;
- Reviewing results of land inventory and creation of land use status maps at the provincial and city levels;
- Compiling data from land inventory across the country;
- Creating land use status maps at regional and national levels;
- Analyzing and evaluating changes in land use and preparing reports on the current status and changes in land use at regional and national levels;
- Preparing reports on the results of land inventory and land use status maps in 2014 nationwide;
- Upgrading software for compiling results of land inventory;
- Printing, duplicating, and archiving products of land inventory;
- Summarizing and announcing data from land inventory and creation of land use status maps in 2014 nationwide.
b) Contents of expenditures implemented by the Ministry of Public Security and the Ministry of National Defense:
- Developing technical plans and schedules for security and defense land inventory;
- Printing guidance materials on land inventory and providing land inventory forms;
- Organizing meetings to deploy and train on land inventory for subordinate units;
- Conducting reviews, corrections, and supplements to unify data on the current status of land use by defense and security units;
- Directing and inspecting the implementation at subordinate units under the Ministry of National Defense and the Ministry of Public Security;
- Compiling data; reporting results; summarizing the implementation.
2. Contents of expenditures at the local level:
a) Contents of work carried out at the provincial level:
- Developing plans for land inventory and creation of land use status maps at the provincial level (including district and commune levels);
- Organizing meetings to deploy and train on specialized tasks (including district and commune levels);
- Printing, duplicating, and distributing land inventory forms and maps (including district and commune levels);
- Publicizing through mass media; compiling data from land inventory at the provincial level;
- Creating land use status maps for 2014 at the provincial level;
- Analyzing and evaluating changes in land use and preparing reports on the current status and changes in land use at the provincial level; reviewing results of land inventory at the district level;
- Preparing reports on the results of land inventory and creation of land use status maps at the provincial level;
- Printing, duplicating, archiving, and submitting products of land inventory;
- Directing, guiding, urging, and inspecting districts to implement land inventory and creation of land use status maps in 2014.
b) Contents of work carried out at the district level:
- Directing, guiding, urging, and inspecting communes to implement land inventory and creation of land use status maps within their jurisdiction;
- Reviewing results of land inventory at the commune level; compiling data from land inventory within the district;
- Creating land use status maps for 2014 at the district level;
- Analyzing and evaluating changes in land use and preparing reports on the current status and changes in land use at the district level;
- Preparing reports on the results of land inventory and creation of land use status maps within the district;
- Printing, duplicating, archiving, and submitting products of land inventory.
c) Contents of work carried out at the commune level:
- Preparation work to support land inventory;
- Popularizing policies on land inventory;
- Surveying, delineating, and correcting supplementary information on maps;
- Compiling land area data and establishing land inventory systems according to forms prescribed in Circular No. 28/2014/TT-BTNMT dated June 2, 2014 of the Ministry of Natural Resources and Environment on statistics, land inventory, and creation of land use status maps and some forms according to guidelines of the Ministry of Natural Resources and Environment;
- Creating land use status maps for 2014 at the commune level; analyzing and evaluating changes in land use at the commune level;
- Inspecting and confirming the results of compiling land inventory data throughout the commune;
- Preparing reports on the results of land inventory and creation of land use status maps at the commune level;
- Printing, duplicating, archiving, and submitting products of land inventory.
Article 5. Funding Levels
The expenditure levels for implementing land inventory and creation of land use status maps in 2014 shall be carried out in accordance with the current financial expenditure regulations and the following documents:
1. Circular No. 42/2014/TT-BTNMT dated July 29, 2014 of the Minister of Natural Resources and Environment on economic and technical norms for statistics, land inventory, and creation of land use status maps.
2. Joint Circular No. 04/2007/TTLT-BTNMT-BTC dated February 27, 2007 of the Ministry of Natural Resources and Environment and the Ministry of Finance on guidelines for budget preparation for surveying and mapping and land management. During the implementation process, if the regulatory documents cited for application in this Circular are amended, supplemented, or replaced by new regulatory documents, they shall be applied according to the new documents.
Article 6. Establishment, Implementation, and Settlement of the State Budget
The establishment, allocation, implementation, and settlement of funds for land inventory activities and the creation of land use status maps in 2014 shall be carried out in accordance with the provisions of the State Budget Law and other guiding documents. This Circular provides detailed guidance on the following additional matters:
1. On Budget Preparation:
a) Based on the assigned tasks for land inventory and the creation of land use status maps in 2014, units shall prepare budget estimates as follows:
- For expenditure items that have economic and technical norms: The budget estimate shall be determined based on the volume of work multiplied by the current unit price.
- For expenditure items without economic and technical norms: The budget estimate shall be prepared based on specific volumes of work, the current financial expenditure regulations of the State, and approved by the competent authority.
b) At the Central level:
- The Ministry of Natural Resources and Environment shall be responsible for preparing the budget estimates for land inventory and the creation of land use status maps for activities conducted by the Ministry of Natural Resources and Environment, to be submitted to the Ministry of Finance for consolidation and reporting. THEDeputy ministers of ministerial-level agencies, organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.ướharged with the task of approving the Prime Minister's proposal regarding the appointment of Ministers for the term 2021 - 2026 for the following gentlemen:ug.
- The Ministry of Defense and the Ministry of Public Security shall be responsible for preparing the budget estimates for land inventory for activities conducted by the Ministry of Defense and the Ministry of Public Security, to be submitted to the Ministry of Finance for consolidation and reporting to the Prime Minister.
c) At the Local level:
- The Department of Natural Resources and Environment, based on the content of the work, the required volume of work, shall develop plans and budget estimates for land inventory and the creation of land use status maps in 2014, detailing at the provincial, district, and commune levels, to be reviewed by the Department of Finance, submitted to the Provincial People's Council for approval, and presented to the Provincial People's Assembly for consideration and decision in accordance with current regulations.
- The People's Committee of provinces and centrally-administered cities shall submit the funding requirements for land inventory and the creation of land use status maps in 2014 to the Ministry of Natural Resources and Environment for consolidation and proposal of central government support levels for each locality as stipulated in Article 3 of this Circular, to be submitted to the Ministry of Finance before December 20, 2014 for consolidation and reporting.
2. Regarding the allocation of budget estimates:
a) At the Central level: The Ministry of Natural Resources and Environment, the Ministry of Defense, and the Ministry of Public Security, based on the allocated budget estimates, economic and technical norms issued by the competent authority, budget unit prices, and current financial expenditure regulations, shall approve and allocate detailed budget estimates to implementing units as a basis for withdrawing budget estimates.
b) At the Local level: The People's Committee of the province shall present to the Provincial People's Council for decision on the budget for land inventory and the creation of land use status maps in 2014 within the local budget allocation plan for 2015.
Based on the allocated budget estimates, economic and technical norms issued by the competent authority, budget unit prices, and current financial expenditure regulations, the People's Committee of the province shall approve and allocate budget estimates to the Department of Natural Resources and Environment (for provincial-level implementation of land inventory and the creation of land use status maps), to the People's Committee of the district (for district and commune-level implementation of land inventory and the creation of land use status maps), and the People's Committee of the district shall allocate budget estimates for land inventory and the creation of land use status maps to the People's Committee of the commune (for commune-level implementation).
3. Regarding the implementation of budget estimates: Units shall withdraw budget estimates from the State Treasury based on the allocated budget estimates. The State Treasury shall control expenditures according to current regulations.
4. Regarding the settlement of funds for land inventory and the creation of land use status maps, it shall be carried out in accordance with the provisions of the State Budget Law and other guiding documents.
Article 7. Implementation Organization
1. The Ministry of Natural Resources and Environment, the Ministry of Defense, the Ministry of Public Security, and the People's Committees of provinces and centrally-administered cities shall be responsible for directing and organizing the implementation of land inventory and the creation of land use status maps in 2014, including management, acceptance, auditing, and settlement of completed volumes in accordance with the State Budget Law and related guiding documents.
2. This Circular takes effect from January 15, 2015.
During the implementation process, if there are any difficulties, please report them to the Ministry of Finance and the Ministry of Natural Resources and Environment for research and resolution.
