CIRCULAR

Regulations on working conditions for lecturers in the arts, music education, and fine arts education fields

Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decree No. 31/2011/NĐ-CP dated May 11, 2011 of the Government amending and supplementing certain articles of Decree No. 75/2006/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain provisions of the Education Law;

Pursuant to Decision No. 188/1999/QĐ-TTg dated September 17, 1999 of the Prime Minister regarding the 40-hour work schedule;

Pursuant to Decision No. 38/2009/QĐ-TTg dated March 9, 2009, issued by the Prime Minister to promulgate the List of Education and Training in the National Education System;

After receiving comments from the Ministry of Culture, Sports and Tourism in Circular No. 3625/VHTTDL-ĐT dated October 28, 2011; and comments from the Ministry of Home Affairs in Circular No. 1519/BNV-CCVC dated April 19, 2012 on the draft circular regulating working conditions for lecturers in the arts, music education, and fine arts education fields;

At the proposal of the Director of the Teacher and School Management Officer Department,

The Minister of Education and Training issues this Circular regulating working conditions for lecturers in the arts, music education, and fine arts education fields:

Article 1. Scope of regulation and applicable subjects

1. This document regulates working conditions for lecturers in the arts, music education, and fine arts education fields including: duties of lecturers; standard working time quotas; teaching hours; management, utilization, and application of working hours.

2. This document applies to lecturers teaching professional knowledge blocks in the arts training field, and music and fine arts courses in music education and fine arts education majors.

Article 2. Regulations on Working Conditions

Lecturers in the arts, music education, and fine arts education fields shall implement the Working Conditions Regulation for Lecturers issued together with Decision No. 64/2008/QĐ-BGDĐT dated November 28, 2008 of the Minister of Education and Training, which has been amended and supplemented with certain articles in Circular No. 36/2010/TT-BGDĐT dated December 15, 2010 (hereinafter referred to as the Regulation accompanying Decision 64), and the following specific regulations:

1. Teaching duties:

a) Guide students in final internship, practical work in their major, build outlines and complete graduation projects and theses.

b) Participate in building experimental programs, specialized practice programs, and experimental and practical bases.

2. Research duties:

Compose, design, perform, direct, and adapt works related to the lecturer's field of training.

3. Standard teaching hour quota and conversion to standard teaching hours:

a) The framework of standard teaching hour quotas for lecturers in the arts, music education, and fine arts education fields to fulfill specific tasks as stipulated in Article 4 of the Regulation accompanying Decision 64 and the provisions at point a and point b, Clause 1, Article 2 of this Circular is specified as follows:

b) One class session guiding exercises and practical work for students is counted as 1 standard hour.

c) Guidance for internships and practical work in the major: 1 day of work is counted as not more than 3 standard hours.

4. Management and utilization of working hours:

Lecturers with higher salaries have more standard hours, but not exceeding 460 standard hours.

Article 3. Heads of educational institutions are responsible for detailing the working conditions for lecturers.

Article 4. This Circular takes effect from July 16, 2012, abolishing previous regulations on working conditions for lecturers in the arts, music education, and fine arts education fields that conflict with the provisions of this Circular.

Article 5. The Director of the Office, the Director of the Department of Teachers and Educational Institution Managers under the Ministry of Education and Training, and the heads of relevant units under the Ministry of Education and Training and the heads of higher education institutions are responsible for implementing this Circular./.
