CIRCULAR
Regulations on the List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the Nation and Localities
Decree No. 132/2013/NĐ-CP dated October 16, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Decree No. Decision No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services;
Article 1. Amending and supplementing some articles of Circular No. 19/2016/TT-BTTTT dated June 30, 2016 of the Minister of Information and Communications on forms for registration declaration, application for license, certificate, license, and business report as prescribed in Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services.
The Minister of Information and Communications issues this Circular to regulate the List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the Nation and Localities.
Article 1. Scope of Regulation
This Circular regulates the List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the Nation and Localities, including: criteria for determination; the List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination; responsibilities for implementation.
Article 2. Applicability
This Circular applies to news agencies with licenses for television operations; units providing radio and television services.
Article 3. Criteria for Determining Television Channels and Programs Serving Political Tasks and Essential Information Dissemination
Clause 1. Television channels and programs serving political tasks and essential information dissemination for the nation are those of news agencies with television operation licenses that meet the following Conditions:
Point a) Having the purpose and objectives of general current affairs-political or having specific purposes and contents ensuring service requirements for political information dissemination, national security, and defense;
Point b) Ensuring broadcasting time of the channel and program reaching at least 18 hours/day; self-produced program time reaching at least 40% of the total broadcasting time in one day of the channel (of which new self-produced program time must reach 50% of the total self-produced program time).
Clause 2. Television channels and programs serving political tasks and essential information dissemination for localities are those of news agencies under provinces and centrally-administered cities with television operation licenses that meet the following Conditions:
Point a) Having the purpose and objectives of general current affairs-political ensuring service requirements for political information dissemination, economic, and social tasks of the locality;
Point b) Ensuring broadcasting time of the channel and program reaching at least 15 hours/day; self-produced program time reaching at least 20% of the total broadcasting time in one day of the channel (of which new self-produced program time must reach 50% of the total self-produced program time).
Article 4. List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination
Clause 1. List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination:
Point a) The List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the nation as specified in Appendix I attached to this Circular;
Point b) The List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for localities as specified in Appendix II attached to this Circular.
Clause 2. Based on the requirements for serving political tasks and essential information dissemination in each period, the Ministry of Information and Communications will review and adjust the Lists mentioned in Points a and b, Clause 1 of this Article.
Article 5. Responsibilities for Implementation
Clause 1. Responsibilities of Units Providing Radio and Television Services:
Point a) For units providing radio and television broadcasting services:
Provide the Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the nation and localities as stipulated in this Circular on the broadcasting radio and television service system according to Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services.
Point b) For units providing paid radio and television services:
Provide the Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the nation and localities as stipulated in this Circular on the paid radio and television service system according to Decree No. 06/2016/NĐ-CP dated January 18, 2016 of the Government on management, provision, and use of radio and television services.
Clause 2. Responsibilities of News Agencies with Channels and Programs Included in the List of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the Nation and Localities:
Point a) Ensuring the continuous operation of the channel and program meeting the criteria stipulated in Article 3 of this Circular;
Point b) Ensuring the signal source for broadcasting the Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for transmission, relay, distribution, and provision to users or subscribers to achieve quality standards.
Clause 3. Responsibilities of Provincial Departments of Information and Communications under centrally-administered cities:
Point a) Implement state management functions over the transmission and broadcasting of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for the nation on the broadcasting radio and television service system; paid radio and television services provided in their areas;
Point b) Implement state management functions over the content, transmission, and broadcasting of Television Channels and Programs Serving Political Tasks and Essential Information Dissemination for localities on the broadcasting radio and television service system; paid radio and television services provided in their areas.
Article 6. Implementation Provisions
Clause 1. This Circular takes effect from August 12, 2016 and replaces Circular No. 09/2012/TT-BTTTT dated July 6, 2012 of the Ministry of Information and Communications promulgating the List of Domestic Television Channels and Programs Serving Political Tasks and Essential Information Dissemination.
2. The Director of the Office; the Heads of the Legal Affairs Department; the Heads of the Planning and Finance Department; the Director of the Radio, Television, and Electronic Information Bureau; the Heads of the agencies and units under the Ministry of Information and Communications; the Directors of the Provincial Departments of Information and Communications; the General Directors and Directors of press agencies with television operation licenses; the units providing broadcasting services; organizations and individuals related to this Circular shall be responsible for its implementation./.
