Circular No. 18/2017/TT-BLDTBXH guides the adjustment of pensions, social insurance benefits, and monthly allowances as stipulated in Clauses 1, 2, 3, and Clause 8 of Article 1 of Decree No. 76/2017/NĐ-CP dated June 30, 2017 of the Government.

Guidelines for adjusting pensions, social insurance benefits, and monthly allowances, and the time of receiving pensions for cases without original records

and monthly allowances prescribed in Clauses 1, 2, 3, and Clause 8, Article 1

Based on Decree No. 89/2020/NĐ-CP dated August 4, 2020 of the Government stipulating the functions, tasks, powers, and organizational structure of the Vietnam Social Security.

Pursuant to Decree No. 76/2017/ND-CP dated June 30, 2017 of the Government adjusting pensionsпенсия退休金, social insurance allowances, and monthly allowances (hereinafter referred to as Decree No. 76/2017/ND-CP);

THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS ISSUES THIS CIRCULAR TO SUPPLEMENT PROFESSIONS AND TRADES TO THE LIST OF PROFESSIONS AND TRADES AT THE FOURTH LEVEL WITH A DIPLOMA IN VOCATIONAL COLLEGE AND HIGHER VOCATIONAL COLLEGE ISSUED TOGETHER WITH CIRCULAR NO. 04/2017/TT-BLDTBX ON MARCH 2, 2017, ISSUED BY THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS.Ministry of Labor, Invalids, and Social Affairs issues this Circular guiding the adjustment of pensions, social insurance allowances, and monthly allowances prescribed in Clauses 1, 2, 3, and Clause 8, Article 1 of Decree No. 76/2017/ND-CP dated June 30, 2017 of the Government.

Article 1. Scope of application

The subjects to which this Circular applies are those specified in Clauses 1, 2, 3, and Clause 8, Article 1 of Decree No. 76/2017/ND-CP.

As of July 1, 2019, the level of pensions, social insurance benefits, and monthly allowances of the subjects specified in Article 1 of this Circular shall be increased by 7.19% compared to the level of pensions, social insurance benefits, and monthly allowances in June 2019. Specifically:

As of July 1, 2017, the pension, social insurance allowance, and monthly allowance of the subjects specified in Article 1 of this Circular shall be increased by 7.44% compared to the pension, social insurance allowance, and monthly allowance in June 2017. Specifically:    

Example 1: Mr. A has a pension of 4,500,000 VND/month in June 2017.

Mr. A's pension from July 2017 will be adjusted as follows:

4,500,000 VND/month x 1.0744 = 4,834,800 VND/month

Example 2: Mr. B, a retired village cadre receiving monthly allowance under Decree No. 09/1998/ND-CP, has a monthly allowance of 1,970,000 VND/month in June 2017.

Mr. B's monthly allowance from July 2017 will be adjusted as follows:

1,970,000 VND/month x 1.0744 = 2,116,568 VND/month

Example 3: Ms. C, who retired due to loss of working capacity and receives monthly allowance, has a monthly allowance of 2,000,000 VND/month in June 2017.

Ms. C's monthly allowance for loss of working capacity from July 2017 will be adjusted as follows:

2,000,000 VND/month x 1.0744 = 2,148,800 VND/month

Example 4: Ms. D, who suffered a work-related accident and receives monthly work injury allowance, has a work injury allowance of 960,000 VND/month in June 2017.

Ms. D's work injury allowance from July 2017 will be adjusted as follows:

960,000 VND/month x 1.0744 = 1,031,424 VND/month

Article 3. Implementation Organization

1. Provincial People's Committees directly under the Central Government are responsible for directing the Department of Labor, Invalids, and Social Affairs and relevant agencies to disseminate, publicize, inspect, and urge the implementation of the provisions of this Circular.

2. Vietnam Social Security is responsible for implementing the adjustment of pensions, social insurance allowances, and monthly allowances prescribed in Decree No. 76/2017/ND-CP and guided in this Circular; prepare and submit reports according to the attached form to the Ministry of Labor, Invalids, and Social Affairs and the Ministry of Finance before January 15, 2018.

Article 4. Effective date

This Circular takes effect from August 15, 2017. The regimes prescribed in this Circular shall be implemented from July 1, 2017. 

Any difficulties encountered during implementation should be reported to the Ministry of Labor, Invalids, and Social Affairs for study and resolution./.
