CIRCULAR
Amending and supplementing certain contents of the Economic and Technical Standards for Operating Costs of Specialized Vessels for Management and Maintenance of Inland Waterways issued together with Circular No. 12/2019/TT-BGTVT dated March 11, 2019 of the Minister of Transport

Pursuant to the Law on Inland Waterway Transport dated June 15, 2004; the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Transport dated June 17, 2014;
BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;
At the proposal of the Director of the Department of Science and Technology and Environment and the Director of the Directorate of Inland Waterway Transport,
The Minister of Transport issues this Circular amending and supplementing certain contents of the Economic and Technical Standards for Operating Costs of Specialized Vessels for Management and Maintenance of Inland Waterways issued together with Circular No. 12/2019/TT-BGTVT dated March 11, 2019 of the Minister of Transport.
Article 1. Amending and supplementing certain contents of the Economic and Technical Standards for Operating Costs of Specialized Vessels for Management and Maintenance of Inland Waterways issued together with Circular No. 12/2019/TT-BGTVT dated March 11, 2019 of the Minister of Transport
1. Amending and supplementing Section I as follows:
“Section I. Scope of Application
These Economic and Technical Standards for Operating Costs apply to vessels performing tasks of Inland Waterway Port Control Units, Inland Waterway Inspection Units, management and maintenance of inland waterways, search and rescue operations (hereinafter referred to collectively as management and maintenance of inland waterways), and preventing drifting on inland waterways.”
2. Amend and supplement Section II as follows:
“Section II. Applicability
These Economic and Technical Standards apply to agencies, organizations, and individuals related to the implementation of management and maintenance tasks of inland waterways and preventing drifting on inland waterways using state budget funds.”
3. Amending and supplementing Section III as follows:
“Section III. Application of Standards
1. The Economic and Technical Standards for Operating Costs are applied to calculate costs, establish unit prices, and prepare budgets as the basis for determining budgets and managing costs for implementing management and maintenance tasks of inland waterways and preventing drifting on inland waterways.
2. In cases where vessels are not specified in these Standards, they shall be applied according to other current standards or regulations (except for fuel consumption standards calculated according to formula II-1).”
4. Amending and supplementing Section IV as follows:
“Section IV. Basis for Establishing Standards
- Law on Inland Waterway Traffic No. 23/2004/QH11; Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic No. 48/2014/QH13;
- Construction Law No. 50/2014/QH13; Law Amending and Supplementing Certain Provisions of the Construction Law No. 62/2020/QH14;
- Decree No. 56/2022/NĐ-CP dated August 24, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
- Decree No. 10/2021/NĐ-CP dated February 9, 2021 of the Government on management of construction investment costs;
- Decree No. 06/2021/NĐ-CP dated January 26, 2021 of the Government detailing certain provisions on quality management, construction, and maintenance of construction projects.”
5. Amending and supplementing the first bullet point of Clause 1. Common Basis, Section V. Standards for Operating Costs as follows:
“- Work vessels for management and maintenance of inland waterways are specialized inland waterway vessels equipped with cranes for maintenance work (including route inspection), traffic regulation, ensuring safety, and restricting inland waterway traffic...
- Work vessels for preventing drifting are inland waterway vessels (tugs or pushers) to ensure traffic safety, provide support to prevent collisions with structures and between vessels.
The operating cost standards for work vessels for preventing drifting are implemented according to the table of operating cost standards for basic data and original value as the basis for determining the operating cost and equipment construction price in Circular No. 13/2021/TT-BXD dated August 31, 2021 of the Minister of Construction on guiding methods for determining economic and technical indicators and measuring quantities of works. Labor costs for preventing drifting operations are applied according to labor costs in management and maintenance of inland waterways.
- The operating cost standards for standby vessels include depreciation, operator labor costs, and other expenses, which are calculated at 100% of the operating cost standards for traffic regulation and drift prevention on inland waterways.”
Article 2. Effective Date
1. This Circular takes effect from August 15, 2023.
2. For contracts for preventing drifting on inland waterways that have been signed by competent authorities before the effective date of this Circular, they shall continue to be implemented according to the existing regulations until their expiration. Any amendments or supplements to contracts signed after the effective date of this Circular must comply with the provisions of this Circular.
3. In cases where the legal documents cited in this Circular are amended, supplemented, or replaced, the provisions of the amended, supplemented, or replaced legal documents shall apply.
Article 3. Implementation Organization
The Head of the Ministry's Office, the Inspector General, the Directors of Departments, the Director of the Vietnam Inland Waterway Administration, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular./.
