MINISTER OF TRANSPORT
Pursuant to the Vietnam Maritime Code dated June 14, 2005;
Pursuant to the Law on Inland Waterway Transport dated June 15, 2004;
Pursuant to Decree No. 51/2008/ND-CP dated April 22, 2008 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Upon the proposal of the Director of the Transport Department, the Director of the Vietnam Maritime Administration, and the Director of the Vietnam Inland Waterways Administration,
DECISION:
Article 1.
1. The Vietnam Maritime Administration shall organize management in accordance with applicable laws for inland waterway transport routes from the mainland to islands within Vietnam's territorial waters (hereinafter referred to as routes from the mainland to islands) as specified in the Appendix attached to this Decision.
2. The Vietnam Inland Waterways Administration shall organize management or inspection and guidance for provincial Departments of Transport under the People's Committees of centrally governed cities and provinces to manage other inland waterway transport routes from the mainland to islands not covered by Clause 1 of Article 1 of this Decision in accordance with applicable laws.
3. The Vietnam Maritime Administration shall take the lead and coordinate with relevant agencies to study and propose new regulations or amendments and supplements to existing regulations related to conditions and standards concerning certificates and qualifications of crew members, ports, and terminals at both ends of the routes from the mainland to islands as specified in Clause 1 of Article 1 of this Decision, and submit them to competent authorities for issuance in the fourth quarter of 2009.
4. The Vietnam Ship Registry shall study and propose new regulations or amendments and supplements to existing regulations related to conditions and standards concerning technical quality and safety, environmental protection of vessels operating on the routes from the mainland to islands as specified in Clause 1 of Article 1 of this Decision, and submit them to competent authorities for issuance in the fourth quarter of 2009.
Article 2.
As of January 1, 2012, ports, terminals, and vessels participating in operations on the routes from the mainland to islands as specified in Clause 1 of Article 1 of this Decision must comply with requirements set forth in the documents to be issued pursuant to Clauses 3 and 4 of Article 1 of this Decision.
Article 3.
1. This Decision takes effect from the date of signature. The Decision No. 268/QD-BGTVT dated February 1, 2007 of the Minister of Transport on delineating responsibilities for managing inland waterway transport routes from the mainland to islands within Vietnam's internal waters is hereby repealed.
2. The Heads of the Office, the Directors of the Vietnam Maritime Administration, the Vietnam Inland Waterways Administration, the Vietnam Ship Registry, the Departments of Transport under the People's Committees of centrally governed cities and provinces concerned, the Heads of Departments, the Heads of the Inspectorate of the Ministry, and the Heads of organizations and individuals concerned shall be responsible for implementing this Decision./.
