REGARDING AMENDMENTS AND SUPPLEMENTS TO CERTAIN ARTICLES OF THE REGULATIONS ON STANDARDS, LIMITS, AND MANAGEMENT REGIMES FOR MEANS OF TRANSPORTATION IN STATE ORGANIZATIONS, PUBLIC SERVICE UNITS, AND STATE ENTERPRISES ISSUED UNDER DECISION NO. 59/2007/QĐ-TTg OF THE GOVERNMENT ON MAY 7, 2007

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on State Budget dated December 16, 2002;
Pursuant to the Law on Thrift and Prevention of Waste dated November 29, 2005;
Pursuant to Decree No. 14/1998/NĐ-CP of the Government dated March 6, 1998 on state asset management;
Pursuant to Decree No. 137/2006/NĐ-CP of the Government dated November 14, 2006 on the delegation of state management authority over state assets at administrative agencies, public service units, and state-owned assets;
Considering the proposal of the Minister of Finance

DECISION:

Article 1. Amend and supplement certain articles of the Regulations on Standards, Limits, and Management Regimes for Means of Transportation in State Organizations, Public Service Units, and State Enterprises issued under Decision No. 59/2007/QĐ-TTg of the Prime Minister dated May 7, 2007 as follows:

1. Clause 5 of Article 2 shall be amended and supplemented as follows:

“5. Cars equipped for positions with car usage standards shall be replaced according to work requirements for positions specified in Articles 3 and 4; when they have been used for at least 200,000 kilometers for positions specified in Articles 5 and 6. In mountainous areas, remote regions, islands, and particularly difficult regions, this distance is 160,000 kilometers. Cars to be replaced must be sold through public auction, and the net proceeds from the sale, after deducting reasonable related expenses, must be handled in accordance with the provisions of the law.”

2. Clause 3 of Article 8 shall be amended and supplemented as follows:

“3. Based on the conditions of transportation infrastructure and the market's ability to provide means of transportation services, the Minister, the Heads of Ministries equivalent to Ministries, and the Heads of government agencies shall specify the specific distance from the agency’s headquarters when traveling on official business for positions specified in clause 1; the Chairman of the People's Committee of the province shall specify for positions in clause 2 of this Article after obtaining written agreement from the Standing Committee of the People's Council at the same level. In cases where the subject provides their own means of transportation, they shall be allocated funds according to the regulations.”

3. Clause 2 of Article 12 shall be amended and supplemented as follows:

“2. For administrative agencies and public service units operating in mountainous areas, remote regions, islands, and particularly difficult regions, the provision of cars for official business shall be carried out as follows:

a) For newly established agencies, one car shall be provided from the pool of transferred cars; if there are no transferred cars, one new car may be purchased with a maximum purchase price of 550 million VND per car, and if it is a four-wheel drive car, the maximum purchase price is 800 million VND per car.

b) For agencies and units whose existing cars meet the conditions for liquidation or are damaged and cannot be repaired effectively and safely, liquidation shall be carried out; if renting a car for official business is not possible and transferring a car is not feasible, a new car may be purchased to replace the liquidated car according to the provisions of point a of this clause.”

Article 2. This Decision shall take effect fifteen days after its publication in the Official Gazette.
