Based on Decree No. 221/2013/NĐ-CP dated December 30, 2013 of the Government stipulating the system of applying administrative handling measures for placement in compulsory drug rehabilitation facilities (hereinafter referred to as Decree No. 221/2013/NĐ-CP);
Pursuant to Decision No. 142/2009/QĐ-TTg dated December 31, 2009 of the Prime Minister on mechanisms and policies to support plant seeds, livestock breeds, and aquaculture breeds for restoring production in areas damaged by natural disasters and epidemics;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
After reaching consensus with the Ministry of Agriculture and Rural Development, the Ministry of Finance hereby provides guidance as follows:
Article 1. Scope of application:
1. The state budget shall provide support for plant seeds, livestock breeds, and aquaculture breeds to farmers, fishermen, farm owners, cooperative groups, and cooperatives engaged in crop cultivation, animal husbandry, and aquaculture that have been damaged by natural disasters and dangerous epidemics, in accordance with the guidelines of the Ministry of Agriculture and Rural Development set forth in Circular No. 39/2010/TT-BNNPTNT dated June 28, 2010 regarding types of natural disasters and dangerous epidemics eligible for support under Decision No. 142/2009/QĐ-TTg dated December 31, 2009 of the
2. Damage caused by natural disasters and dangerous epidemics shall be determined as the basis for support, including:
a) For natural disasters: the number of livestock and poultry killed; the area of aquaculture and marine products destroyed by natural disasters; the area of crops destroyed or completely lost due to natural disasters.
b) For dangerous epidemics: the number of livestock and poultry destroyed; the area of aquaculture and marine products killed; the area of crops required to be destroyed according to regulations of the Ministry of Agriculture and Rural Development.
3. Time period for support:
a) For natural disasters: from the date the natural disaster occurs in specific localities as decided by the Chairman of the People's Committee of provinces and centrally-administered cities.
b) For dangerous epidemics: from the date the epidemic is declared in the locality until the decision declaring the end of the epidemic is made by the competent authority responsible for plant protection, veterinary services, and aquaculture.
1. Support for crop areas:
a) Damage caused by natural disasters and dangerous epidemics:
- For paddy fields damaged by more than 70%, support is provided at a rate of 1,000,000 VND/ha; for damage between 30-70%, support is provided at a rate of 500,000 VND/ha;
- For hybrid rice fields damaged by more than 70%, support is provided at a rate of 1,500,000 VND/ha; for damage between 30-70%, support is provided at a rate of 750,000 VND/ha;
- For corn and vegetable fields damaged by more than 70%, support is provided at a rate of 1,000,000 VND/ha; for damage between 30-70%, support is provided at a rate of 500,000 VND/ha;
- For perennial industrial crops and fruit trees damaged by more than 70%, support is provided at a rate of 2,000,000 VND/ha; for damage between 30-70%, support is provided at a rate of 1,000,000 VND/ha.
Based on the support rates specified above and the extent of damage to each type of crop, the Chairman of the People's Committee of provinces and centrally-administered cities shall decide specifically on direct support amounts for farmers, farm owners, cooperative groups, and cooperatives engaged in crop cultivation that have been damaged by natural disasters and dangerous epidemics, in line with the actual situation of the locality.
b) Damage caused by yellow dwarf disease, leaf curl disease, and black streaked dwarf disease affecting rice: The level of support shall be implemented in accordance with Circular No. 53/2010/TT-BTC dated April 14, 2010 of the Ministry of Finance concerning financial provisions for the prevention and control of yellow dwarf disease, leaf curl disease, and black streaked dwarf disease affecting rice.
2. Support for livestock:
a) Damage caused by natural disasters: for each livestock animal (including both commercial animals and breeding stock) damaged, support funds will be provided to purchase one breeding stock to restore production at the following levels:
- Poultry: support ranging from 7,000 to 15,000 VND per breeding stock;
- Pigs: support at 500,000 VND per breeding stock; - Cattle, buffalo, horses: support at 2,000,000 VND per breeding stock;
- Deer, antelope, sheep, goats: support at 1,000,000 VND per breeding stock.
Based on the support levels specified above and the number of each type of livestock and poultry damaged, the Chairman of the People's Committee of provinces and centrally-administered cities shall decide specifically on direct support amounts for farmers, fishermen, farm owners, cooperative groups, and cooperatives engaged in animal husbandry that have been damaged by natural disasters, in line with the actual situation of the locality.
b) Damage caused by dangerous epidemics: the level of support shall be implemented in accordance with Circular No. 80/2008/TT-BTC dated September 18, 2008 of the Ministry of Finance providing guidance on financial provisions for preventing and controlling animal and poultry diseases.
3. Support for aquaculture:
a) For areas damaged by more than 70%, support ranges from 3,000,000 to 5,000,000 VND/ha; for damage between 30-70%, support ranges from 1,000,000 to 3,000,000 VND/ha;
b) For cages and rafts damaged by more than 70%, support ranges from 3,000,000 to 5,000,000 VND/100m3 cage; for damage between 30-70%, support ranges from 1,000,000 to 3,000,000 VND/100m3 cage.
Based on the support levels specified above and the extent of damage to each type of aquaculture breed, the Chairman of the People's Committee of provinces and centrally-administered cities shall decide specifically on direct support amounts for farmers, fishermen, farm owners, cooperative groups, and cooperatives engaged in aquaculture that have been damaged by natural disasters and dangerous epidemics, in line with the actual situation of the locality.
4. In cases where support is provided in kind with seeds for crops, livestock, and aquaculture, the level of support is equivalent to the monetary support converted at the time of support.
Article 3. Principles for central budget support to local budgets:
The central budget will provide partial funding for seed support for crops, livestock, and aquaculture as stipulated in Article 2 of this Circular, based on the following principles:
1. For mountainous provinces and the Central Highlands, support at 80% of the seed support level for crops, livestock, and aquaculture;
2. Hanoi City and Ho Chi Minh City shall proactively use their local budget reserves to implement these measures;
3. For the remaining provinces and centrally-administered cities, support at 70% of the seed support level for crops, livestock, and aquaculture;
4. For areas with significant damage, if the local budget reserve exceeds 50%, the local budget will cover the excess;
5. For specific policies supporting disease prevention and control that have been issued through decisions, the principle of central budget support to local budgets shall be implemented according to the provisions of those decisions, not applying the support principles set out in this Circular.
Article 4. Conditions for state budget support for seeds of crops, livestock, and aquaculture to restore production in areas affected by natural disasters and dangerous diseases:
1. The area of crops, aquaculture, marine products, and the number of livestock and poultry damaged by natural disasters and dangerous diseases must be confirmed by the commune authorities, relevant state management agencies, and related units as the basis for payment of support.
a) For crops: Based on the damage inventory of villages and hamlets regarding the planting area (rice, corn, vegetables), the area of perennial industrial and fruit trees damaged (detailed by each category), the Chairman of the People's Committee of the commune establishes a verification board consisting of commune authorities and specialized state management agencies of the district to prepare a verification report; simultaneously, they compile the demand for seed support to restore production and report it to the District People's Committee for review as the basis for payment of support according to regulations.
b) For livestock: Based on the damage inventory of villages and hamlets regarding the number of livestock and poultry damaged (detailed by each category, cross-referenced with the initial registration of production by farmers, farm owners, cooperative groups, and production cooperatives in the livestock sector, by type of livestock and poultry), the Chairman of the People's Committee of the commune establishes a verification board consisting of commune authorities and specialized state management agencies of the district to prepare a verification report, compile the demand for seed support to restore production, and report it to the District People's Committee for review as the basis for payment of support according to regulations.
c) For aquaculture and marine products: Based on the damage inventory regarding the aquaculture and marine product cultivation area damaged (detailed by each category, cross-referenced with the initial registration of production by farmers, fishermen, farm owners, cooperative groups, and production cooperatives in the aquaculture and marine product sector), the Chairman of the People's Committee of the commune establishes a verification board consisting of commune authorities and specialized state management agencies of the district to prepare a verification report, compile the demand for seed support to restore production, and report it to the District People's Committee for review as the basis for payment of support according to regulations.
2. Damage caused by natural disasters and dangerous diseases occurring in specific areas must be included in the decision announcing the type of disaster issued by the competent authority.
3. The specific level of damage for each type of crop area, livestock, and aquaculture and marine product area shall be determined according to the guidelines of the provincial or centrally-administered city People's Committee.
4. Based on the guidelines of the Ministry of Agriculture and Rural Development and the actual situation in the locality, the Chairman of the provincial or centrally-administered city People's Committee shall specify the responsibilities of entities involved in confirming damage caused by natural disasters and dangerous diseases.
Article 5. Implementation:
1. The Chairperson of the People's Committees of provinces and centrally governed cities shall be responsible for:
a) Directing the Department of Finance to coordinate with the Department of Agriculture and Rural Development and relevant agencies to assess the extent of damage, the need for financial support for crop seeds, livestock breeds, and aquaculture breeds to restore production in areas affected by natural disasters and dangerous epidemics, and develop financial plans to implement such support. At the same time, report to the People's Committees of provinces and centrally governed cities to proactively utilize local government budgets and other lawful financial sources to promptly meet the needs for seed support to restore production in areas affected by natural disasters and dangerous epidemics as stipulated in this Circular.
b) Directing lower-level People's Committees to effectively carry out disaster aftermath recovery work; accurately determine the extent of damage, the need for seed support to restore production, and decide on seed support for each commune, ward, town area in a timely manner, in accordance with policy and regulations; ensure that seed support funds for restoring production are used efficiently, for their intended purpose, for the correct beneficiaries, without waste or corruption; direct the People's Committees at the commune level to cooperate with relevant agencies in the locality to publicly announce state support policies: areas of crops, areas of aquaculture; number of livestock and poultry damaged; levels of support for individual households, fishermen, farm owners, cooperative groups, and cooperatives engaged in crop cultivation, animal husbandry, and aquaculture affected by natural disasters and dangerous epidemics before and after the decision on support from competent authorities through mass media, posted at the offices of the People's Committees at the commune level, and in villages and hamlets according to Circular No. 54/2006/TT-BTC dated June 19, 2006, issued by the Ministry of Finance, guiding the implementation of public disclosure of direct budget support for individuals and residents.
2. Upon completion of the disaster period or end of the year; based on the results of expenditures for seed support to restore production caused by natural disasters and dangerous epidemics in the locality; the People's Committees of provinces and centrally governed cities shall compile and report to the Ministry of Finance for consideration of financial support from the central government's annual reserve budget for the locality and compile reports.
3. This Circular takes effect from the date of signature. Policies for supporting crop seeds, livestock breeds, and aquaculture breeds to restore production in areas affected by natural disasters and dangerous epidemics shall be implemented from February 15, 2010. During implementation, if there are difficulties, they should be reported to the Ministry of Finance for review and appropriate amendments.
