CIRCULAR NO. 19/2001/TT-BTC OF MARCH 30, 2001 ISSUED BY THE MINISTRY OF FINANCE GUIDING THE AMENDMENTS AND SUPPLEMENTS TO CIRCULAR NO. 128/1999/TT-BTC OF OCTOBER 26, 1999 ON THE CONTENTS AND EXPENSE LEVELS OF THE NATIONAL PROGRAM TO PREVENT AND CONTROL AIDS

Pursuant to Decree No. 34/CP dated June 1, 1996 of the Government guiding the implementation of the Ordinance on Prevention and Control of Infection with Human Immunodeficiency Virus (HIV) and Acquired Immune Deficiency Syndrome (AIDS);
Pursuant to Decision No. 531/TTg dated August 8, 1996 of the Prime Minister on the management of national programs;
Pursuant to Decision No. 38/2000/QĐ-TTg dated March 24, 2000 of the Prime Minister amending and supplementing Decision No. 531/TTg on the management of national target programs;
Pursuant to Decision No. 61/2000/QĐ-TTg dated June 5, 2000 of the Prime Minister on the establishment of the National Committee for HIV/AIDS Prevention and Control and the Prevention and Control of Drug Addiction and Prostitution;
Pursuant to Decision No. 146/2000/QĐ-TTg dated December 22, 2000 of the Prime Minister on the allocation of targets and budget estimates for the State budget for 2001;
After reaching agreement with the Ministry of Health, the Ministry of Finance hereby guides the amendments and supplements to Circular No. 128/1999/TT-BTC dated October 26, 1999 (guiding the contents and expense levels of the National Program to Prevent and Control HIV/AIDS) as follows:

1. Amend the following phrases:

1.1. Replace the phrase "National Committee for HIV/AIDS Prevention and Control" with the phrase "Ministry of Health".

1.2. Replace the phrase "National Program to Prevent and Control HIV/AIDS" with the phrase "National Target on HIV/AIDS Prevention and Control within the National Program to Prevent and Control Certain Social Diseases, Dangerous Epidemics, and HIV/AIDS"..

2. Amend the contents and expense levels at Point 2:

2.1. Amend the third bullet point as follows: Expenses for the peer education team of the province to intervene in harm reduction (for groups of people infected with HIV/AIDS to help each other, exchange experiences in preventing transmission to others), each province has one peer education team, receiving one (1) allowance. In cases where provinces and centrally-administered cities have a high rate of HIV/AIDS infection exceeding 40 people per 100,000 population, they will receive two (2) allowances. The expense level for each allowance is 80,000 VND/month.

2.2. Amend the seventh bullet point as follows: Expenses for awards according to the Decision of the Minister of Health. The award level applies according to current regulations of the State.

2.3. Amend the eighth bullet point as follows: Expenses for key communes and wards regulated by the State; Centers 05, 06, prisons, educational facilities, and juvenile detention centers (referred to as facilities) with 10 to 50 HIV/AIDS patients receive one (1) allowance/month/facility. In cases where these facilities have 50 or more HIV/AIDS patients, they will be calculated as two (2) allowances/month/facility to pay remuneration to specialized staff in HIV/AIDS prevention and control, healthcare staff, and direct supervisors caring for, examining, and treating HIV/AIDS patients in those facilities. The expense level for each allowance is 80,000 VND/month.

2.4. Amend the tenth, eleventh, and twelfth bullet points as follows:

Expenses for staff directly monitoring key areas, testing for detection, monitoring HIV/STDs, blood testing services for key area monitoring, screening blood for HIV/AIDS diagnosis during blood transfusion, and diagnosing HIV/AIDS (including organizational testing activities and other related costs, the number of samples for monitoring is assigned by the Ministry of Health to the implementing facility) with the following expense levels:

+ 5,000 VND/sample for key area monitoring and detection monitoring.

+ 3,000 VND/sample for blood screening during HIV/AIDS diagnosis in the approved program plan.

2.5. Amend the thirteenth bullet point as follows: Expenses for supporting healthcare staff directly treating and caring for HIV-infected patients who have progressed to AIDS at state medical facilities, prisons, educational facilities, juvenile detention centers, or at home based on actual treatment days. The expense level is 5,000 VND/day of actual treatment/AIDS patient.

2.6. Amend the eighteenth bullet point as follows: The management and operation mechanism of the National Target on HIV/AIDS Prevention and Control shall be implemented in accordance with Circular No. 41/2000/TT-BTC dated May 19, 2000, Circular No. 78/2000/TT-BTC dated July 27, 2000 of the Ministry of Finance, and Circular No. 06/2000/TT-BKH dated June 27, 2000 of the Ministry of Planning and Investment guiding the implementation of Decision No. 38/2000/QĐ-TTg dated March 24, 2000 of the Prime Minister amending and supplementing certain provisions of Decision No. 531/TTg dated August 8, 1996 of the Prime Minister on the management of national target programs.

3. The funds for implementing the above expenses shall be allocated within the scope of the budget estimate already assigned for 2001.

This Circular takes effect from the date of issuance. During its implementation, if there are difficulties or obstacles, please promptly report them to the Ministry of Finance for study and supplementary guidance.
