Amending, supplementing, and abolishing certain provisions on administrative procedures in the livestock sector
pursuant to Resolution No. 57/NQ-CP dated December 15, 2010

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/ND-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Resolution No. 57/NQ-CP dated December 15, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of Agriculture and Rural Development;
The Ministry of Agriculture and Rural Development amends, supplements, and abolishes certain provisions on administrative procedures in the livestock sector pursuant to Resolution No. 57/NQ-CP dated December 15, 2010 as follows:

Article 1. Amending and supplementing some articles of Decision No. 07/2005/QĐ-BNN dated January 31, 2005 of the Minister of Agriculture and Rural Development on the issuance of regulations on the management and use of boar semen.

1. Clause 12 shall be amended and supplemented as follows:

"Article 12 A new diluent and preservation medium for pig semen produced domestically or imported for the first time may only be put into use and circulated in the market after being tested and approved for application in production based on the results of acceptance and evaluation by the Scientific Council established by the Department. The testing fee shall be borne by the organization or individual importing the medium.

Organizations and individuals importing diluents and preservation media for pig semen for testing must submit one set of import registration files to the Livestock Production Department. The file includes:

a) An import registration form (Annex 1 issued together with this Circular);
b) Technical specifications of the diluent and preservation medium. The file consists of the original document accompanied by a Vietnamese translation by a certified translation agency;
c) A copy of the Business Registration Certificate (for units required to register business operations) or Investment License (for foreign-invested enterprises) confirmed by the organization registering the import for the first-time import. Processing time for the file: within five working days from the date of receipt of a valid file".

2. Clause 13 shall be amended and supplemented as follows:

"Article 13

Organizations and individuals importing pig semen for breeding purposes must submit an import registration file to the Livestock Production Department. For pig semen not included in the list of permitted animal breeds for production and business in Vietnam, it can only be put into use and circulated in the market (Vietnam) after being tested and approved for application in production based on the results of acceptance and evaluation by the Scientific Council established by the Livestock Production Department. The testing fee shall be borne by the organization or individual importing the semen. The import registration file includes:
a) An import registration form (Annex 2 issued together with this Circular);
b) A pedigree file of the semen confirmed by the competent authority of the exporting country. The file consists of the original document accompanied by a Vietnamese translation by a certified translation agency;
c) A copy of the Business Registration Certificate (for units required to register business operations) or Investment License (for foreign-invested enterprises) confirmed by the organization registering the import for the first-time import.

Processing time for the file: within five working days from the date of receipt of a valid file".

Article 2. Amend and supplement Article 12 of Decision No. 66/2005/QD-BNN dated October 31, 2005 of the Minister of Agriculture and Rural Development on the management and use of male cattle breeding stock.

Article 12 shall be amended and supplemented as follows:

"Article 12

Organizations and individuals importing male cattle breeding stock listed in the Catalogue of Breeding Animals permitted for production and business; bull semen; dilution and conservation environments for bull semen must submit one set of import registration files to the Livestock Production Department. The file includes:
a) An import registration form (Annex 1 issued together with this Circular for cases of importing dilution and conservation environments; Annex 2 issued together with this Circular for cases of importing semen).
b) Information on technical specifications of the dilution and conservation environments (for cases of importing dilution and conservation environments) or pedigree records of semen confirmed by the competent authority of the exporting country (for cases of importing semen). The file must include the original document along with a Vietnamese translation by a certified translation agency.
c) A copy of the Business Registration Certificate (for units required to register business operations) or Investment License (for foreign-invested enterprises) confirmed by the organization registering the import for the first-time import.

Processing time for the file: within five working days from the date of receipt of a valid file".

Article 3. Amend and supplement some articles of Decision No. 13/2007/QD-BNN dated February 9, 2007 of the Minister of Agriculture and Rural Development on the management and use of male buffalo breeding stock.

1. Article 11 shall be amended and supplemented as follows:

"Article 11

New dilution and conservation environments for buffalo semen produced domestically or imported for the first time can only be put into use and circulated in the market after being tested and approved for application in production based on the acceptance and evaluation results of the Scientific Council established by the Department. Testing fees are the responsibility of the organizations and individuals producing or importing. Organizations and individuals importing dilution and conservation environments for buffalo semen for testing must submit one set of import registration files to the Livestock Production Department. The file includes:
a) An import registration form (Annex 1 issued together with this Circular);
b) Technical specifications of the diluent and preservation medium. The file consists of the original document accompanied by a Vietnamese translation by a certified translation agency;
c) A copy of the Business Registration Certificate (for units required to register business operations) or Investment License (for foreign-invested enterprises) confirmed by the organization registering the import for the first-time import.

Processing time for the file: within five working days from the date of receipt of a valid file".

3. Article 16 shall be amended and supplemented as follows:

"Article 12.

Organizations and individuals exporting/importing male buffalo breeding stock listed in the Catalogue of Breeding Animals permitted for production and business, buffalo breeding stock semen must submit one set of export/import registration files to the Livestock Production Department. The file includes:
a) An import registration form (Annex 2 issued together with this Circular);
b) A pedigree file of the semen confirmed by the competent authority of the exporting country. The file consists of the original document accompanied by a Vietnamese translation by a certified translation agency;
c) A copy of the Business Registration Certificate (for units required to register business operations) or Investment License (for foreign-invested enterprises) confirmed by the organization registering the import for the first-time import.

Processing time for the file: within five working days from the date of receipt of a valid file".

Article 4. Amend and supplement some articles of Decision No. 108/2007/QD-BNN dated December 31, 2007 of the Minister of Agriculture and Rural Development on the management and use of male goat breeding stock.

1. Article 10 shall be amended and supplemented as follows:

"Article 10.

New dilution and conservation environments for goat semen produced domestically or imported for the first time can only be put into use and circulated in the market after being tested and approved for application in production based on the acceptance and evaluation results of the Scientific Council established by the Department. c) A copy of the Business Registration Certificate (for units required to register business operations) or Investment License (for foreign-invested enterprises) confirmed by the organization registering the import for the first-time import.

Article 5. Amend and supplement Clause 2 of Article 5 of Decision No. 43/2006/QĐ-BNN dated June 1, 2006 of the Minister of Agriculture and Rural Development on international exchange of genetic resources of rare livestock.

Clause 2 of Article 5 shall be amended and supplemented as follows:

"Article 5.
2. Organizations and individuals wishing to engage in international exchange of genetic resources of rare livestock must submit one set of application documents for international exchange of genetic resources of rare livestock to the Livestock Service. The Livestock Service shall be responsible for submitting these documents to the Ministry of Agriculture and Rural Development for examination and approval. The documents include:
a) Application form for export and import of genetic resources of rare livestock (Annex 3 issued together with this Circular);
b) Genetic history of rare livestock intended for international exchange (Annex 4 issued together with this Circular);
c) Relevant documents related to export or import of genetic resources of rare livestock (Cooperative Research Project, Research Contract). Processing time for the application: within five working days from the date the Livestock Service receives a valid application file".

Article 6. Amend and supplement some articles of Circular No. 92/2007/TT-BNN dated November 19, 2007 of the Ministry of Agriculture and Rural Development guiding the implementation of certain provisions of Decision No. 1405/QĐ-TTg dated October 16, 2007 of the Prime Minister on conditions for hatching chicken eggs and raising waterfowl.

1. Supplement Clause 3b as follows:

"3b. Procedure for issuing duck farming registration book. Individuals and households raising free-range ducks must submit one set of application documents for issuance of the Duck Farming Registration Book to the People's Committee of the commune. The documents include:

Documents to be submitted: Application form for issuance of the Duck Farming Registration Book (Annex 5 issued together with this Circular).

Documents to be presented: Identity card or Household Registration Book.

Processing time for the application: within one working day from the date of receipt of the application form from individuals and households".

2. Point a of Clause 4 shall be amended and supplemented as follows:

"4.

a) Department of Agriculture and Rural Development

- Advise the People's Committee of the province to approve the plan for implementing Decision No. 1405/QĐ-TTg of the Prime Minister on conditions for hatching chicken eggs and raising waterfowl and this Circular.

- Coordinate with the information and communication sector and mass organizations to disseminate and publicize Decision No. 1405/QĐ-TTg of the Prime Minister and this Circular to organizations and individuals involved in hatching chicken eggs and raising waterfowl.

- Print the Duck Farming Registration Book and hand it over to the People's Committee of the commune for distribution to households raising free-range ducks.

- Supervise and urge districts and communes to effectively manage and monitor hatcheries and waterfowl farms in their areas.

- Take the lead in coordinating with relevant departments and agencies to conduct regular and spot checks on hatcheries and waterfowl farms. Firmly handle violations and those who refuse to comply with the provisions of this Circular.

- For localities that have planned breeding and hatching zones, develop plans to relocate hatcheries not meeting the conditions to designated locations. For localities that have not completed planning work, urgently develop plans for breeding and hatching zones ensuring biosafety".

Article 7. Procedures for Issuing Certificates to Feed Sampling Personnel and Raw Material Sampling Personnel for Animal Feeds

Individuals wishing to obtain certificates as feed sampling personnel and raw material sampling personnel for animal feeds must attend training courses on feed sampling organized by the Livestock Production Department.

Within no more than seven working days from the date of completion of the training on sampling, the Livestock Production Department will issue certificates for feed sampling personnel and raw material sampling personnel to such individuals.

Article 8. Amending and Supplementing Certain Provisions of Decision No. 121/2008/QĐ-BNN dated December 17, 2008, issued by the Minister of Agriculture and Rural Development on the Regulations on Certification of Facilities Implementing Good Animal Husbandry Practices (VietGAHP) for Dairy Cattle, Pigs, Poultry, and Bees

1. Clause 12 shall be amended and supplemented as follows:

Article 12. Conditions for Certification Organizations
1. They shall be state agencies; organizations of Vietnam; foreign organizations operating legally in Vietnam.
2. They shall meet all conditions to participate in VietGAHP certification activities in animal husbandry as prescribed by the Livestock Production Department:
a) Having legal personality, registered business, clearly defining the tasks of inspection, evaluation, and certification of VietGAHP.
b) Having evaluators with at least a bachelor's degree in livestock science or veterinary medicine and at least three years of professional experience in certification; holding VietGAHP training certificates for dairy cattle, pigs, poultry, and bees issued by the Livestock Production Department.
c) Having detailed provisions on procedures, processes, inspections, issuance, extension, warning, suspension, and revocation of VietGAHP certificates for specific products according to the Regulations on Certification of Facilities Implementing Good Animal Husbandry Practices (VietGAHP) for Dairy Cattle, Pigs, Poultry, and Bees issued together with Decision No. 121/2008/QĐ-BNN dated December 17, 2008, issued by the Minister of Agriculture and Rural Development on the Regulations on Certification of Facilities Implementing Good Animal Husbandry Practices (VietGAHP) for Dairy Cattle, Pigs, Poultry, and Bees.

Organizations certified to meet the standards of TCVN 7457-2004 or ISO/IEC Guide 65: 1996 are prioritized for designation as VietGAHP certification organizations for dairy cattle, pigs, poultry, and bees.

2. Clause 2 of Article 13 is amended and supplemented as follows:

Article 13.

2. Organizations meeting the conditions stipulated in Article 12 of these Regulations shall submit registration files to be evaluated and designated as VietGAHP certification organizations by the Designating Authority. The file includes:

a) A certificate of activity for VietGAHP certification according to Model 8 of these Regulations;

b) A copy with original for comparison if submitted directly or a notarized copy if submitted via postal service for the decision on establishment or business registration certificate or investment certificate;

c) Documents proving the management system and operational capacity in certification are in compliance with the conditions stipulated in Article 12 of these Regulations;

d) Sample of VietGAHP certificate.

Article 9. Amending and Supplementing Appendix I issued together with Circular No. 63/2010/TT-BNNPTNT dated November 1, 2011, guiding the issuance of free circulation certificates for export and import products under the responsibility of the Ministry of Agriculture and Rural Development

Amend the management authority for CFS products for export regarding Livestock Breeding Materials (including embryos, semen, livestock breeding materials); Animal Feeds; Mixing, Storage Environments for Semen and Embryos; Specialized Livestock Farming Equipment and Chemicals specified in Point 2 Section I and Points 3, 4, 7 Section II of Appendix I issued together with Circular No. 63/2010/TT-BNNPTNT to be the Department of Agriculture and Rural Development where the enterprise's headquarters is located.

Article 10. Repeal the following provisions:

1. Point a Clause 1, Point a Clause 2, Point b Clause 3, Article 19 Decision No. 07/2005/QĐ-BNN dated January 31, 2005 of the Minister of Agriculture and Rural Development on the issuance of Regulations on the management and use of male pig breeding stock.

2. Point a Clause 1, Point a Clause 2, Point b Clause 3, Article 23 Decision No. 66/2005/QĐ-BNN dated October 31, 2005 of the Minister of Agriculture and Rural Development on the issuance of Regulations on the management and use of male bull breeding stock.

3. Point a Clause 1, Point a Clause 2, Article 22 Decision No. 13/2007/QĐ-BNN dated February 9, 2007 of the Minister of Agriculture and Rural Development on the issuance of Regulations on the management and use of male buffalo breeding stock.

4. Point a Clause 2, Article 19 Decision No. 108/2007/QĐ-BNN dated December 31, 2007 of the Minister of Agriculture and Rural Development on the issuance of Regulations on the management and use of male goat breeding stock.

Article 11. Implementation Provisions

1. This Circular takes effect 45 days from the date of issuance.

2. The Director of the Livestock Production Department, the Head of the Ministry's Office, the Head of the Legal Department, the Heads of units under the Ministry, and related organizations and individuals shall be responsible for implementing this Circular./
