Issuing Regulations on Management and Use of Bull Breeding Stock
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Breeds of Livestock Ordinance No. 16/2004/PL-UBTVQH11 dated March 24, 2004 of the Standing Committee of the National Assembly, Session 11;
Pursuant to the Government Decree No. 86/2003/NĐ-CP dated July 18, 2003 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
AT THE REQUEST OF THE DIRECTOR OF THE AGRICULTURE DEPARTMENT,
DECISION:
Article 1. The attached to this Decision "Regulations on Management and Use of Bull Breeding Stock" are hereby promulgated.
Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 3. The Heads of the Ministry's Office, Directors of the Department of Agriculture, Heads of the Science and Technology Division, Directors of Provincial Departments of Agriculture and Rural Development under central cities and provinces, Heads of units and individuals concerned are responsible for implementing this Decision.
REGULATIONS
ON MANAGEMENT AND USE OF BULL BREEDING STOCK
(Attached to Decision No. 66/2005/QĐ-BNN dated October 31, 2005)

PART I
GENERAL PROVISIONS
Article 1. These regulations apply to organizations and individuals in Vietnam, foreign organizations and individuals breeding bull breeding stock in Vietnam for the production of frozen and liquid semen for artificial insemination or direct mating (hereinafter referred to as bull breeding stock breeding facilities).
Article 2. Bull breeding stock breeding facilities must comply with the Livestock Breeding Law and other relevant legal documents.
Article 3. The terms used in these regulations are understood as follows:
1. Bull breeding stock breeding facility is a place where bulls are raised for the production of semen for artificial insemination or direct mating, including:
a) Enterprises, research institutions, and livestock farms;
b) Artificial insemination stations for cattle;
c) Family livestock households.
2. Quality certification is a document issued by the agricultural management agency certifying the quality grade of bull breeding stock.
3. Frozen bull semen is semen preserved in liquid nitrogen at a temperature of -196°C.°4. Liquid bull semen
is diluted semen according to specified standards (with a concentration of 80-100 million sperm/ml) and stored at a temperature of 5°C. Bull breeding stock breeding facilities must comply with the regulations of the Ministry of Agriculture and Rural Development regarding the announcement of quality standards for agricultural products and goods; the list of livestock breeding materials that must have quality standards announced and other regulations on livestock breeding management.°4. Article 4. MANAGEMENT AND USE OF BULL BREEDING STOCK FOR PRODUCTION OF FROZEN SEMEN
Chapter II
Bull breeding stock breeding facilities producing frozen semen for artificial insemination must meet the conditions stipulated in points a, b, c, d, and e of Clause 1, Article 19 and Clause 1, Article 20 of the Livestock Breeding Law, while also meeting the following conditions:
1. Bulls raised for the production of frozen semen for artificial insemination must be individually tested for productivity. Bull breeding stock must have a three-generation pedigree, accompanied by a veterinary quarantine certificate and a quality certification issued by the competent state management agency in the agriculture sector (Department of Agriculture - Ministry of Agriculture and Rural Development). Each breeding bull must be numbered and recorded in the tracking book according to current regulations.
Article 5. 2. The number of bull breeding stock for the production of frozen semen in a bull breeding stock breeding facility must not be less than five for each breed.
3. Housing must meet technical standards, veterinary hygiene standards, and environmental protection standards as prescribed by laws on veterinary medicine and environmental protection. The minimum housing area is 10 m²/bull and the play area is 15-20 m²/bull.
4. There must be or hire technical staff with a degree in animal husbandry and veterinary science or higher, who have been trained and certified in the techniques of semen collection, dilution, production, and preservation.
5. There must be record books for monitoring semen quality, sufficient equipment and supplies for testing and evaluating semen quality, mixing, and preserving semen.2During the period of semen production, bull breeding stock must be monitored and tested monthly for the percentage of morphologically normal sperm (K). Each time semen is collected, tests must be conducted for color, smell, volume of ejaculation (V), sperm motility (A), and sperm concentration (C). Test results must be accurately recorded in the record books and forms as prescribed.2The production, mixing, quality testing, conservation, distribution, and transportation of bull semen must be carried out in accordance with the Artificial Insemination Techniques for Cattle Procedures issued by the Ministry of Agriculture and Rural Development.
Bull breeding stock breeding facilities must conduct annual selection and evaluation of bull breeding stock according to the standards issued by the Ministry of Agriculture and Rural Development and eliminate those that do not meet the breeding standards. Bull breeding stock breeding facilities must report every six months to the Department of Agriculture on the quality of breeding stock, semen quality, production results, and consumption of bull semen.
Semen collection must not exceed three times per week, the age for starting semen collection and use must not be less than 24 months, and the usage period must not exceed five years.
Article 6. Bull breeding stock must be vaccinated regularly and tested periodically for infectious diseases. It is strictly prohibited to collect, circulate, and use semen from bull breeding stock that are sick, in the incubation period, or in an epidemic area.
Article 7. Dilution media, newly produced domestic frozen bull semen, or imported frozen bull semen for the first time can only be put into use and circulated in the market after being tested and approved for application in production based on the acceptance and evaluation results of the Scientific Council established by the Department. Testing costs are the responsibility of the organization or individual producing or importing.
Article 8. Organizations and individuals importing bull breeding stock listed in the Importable Livestock Breeding Materials Catalogue; bull breeding stock semen; and bull semen dilution media must submit import applications to the Department of Agriculture. The application includes:
Article 9. a) An import application form as prescribed;
Article 10. b) Documentation on the origin and quality of the imported bull breeding stock, semen; and dilution media or preservation media for bull semen.
Article 11. When importing semen for the first time, there must be: A certified copy of the Business Registration Certificate (for entities required to register business operations) or Investment License (for foreign-invested enterprises).
Article 12. Organizations and individuals importing male breeding bulls listed in the Catalogue of Breeding Animals Allowed for Importation; bull semen; and dilution or storage media for imported bull semen shall submit an import application to the Department of Agriculture. The application package includes:
a) An import application form as prescribed;
b) Documentation on the origin and quality of the male breeding bulls, semen; dilution or preservation media for imported bull semen;
c) For the first import of semen, there must be: A notarized copy of the Business Registration Certificate (for entities required to register business operations) or Investment License (for foreign-invested enterprises);
Article 13. For bull breeding stock semen not yet included in the list of permitted livestock breeds for production and business in Vietnam, an application for testing must be submitted. Frozen bull semen can only be put into use and circulated in the market after the Director of the Department of Agriculture issues a decision to apply it in production based on the acceptance and evaluation results of the Scientific Council established by the Department. The testing fee shall be borne by the organization or individual importing such semen.
Chapter III
MANAGEMENT AND USE OF BULL BREEDING STOCK FOR ARTIFICIAL INSEMINATION
LIQUID SEMEN USED FOR ARTIFICIAL INSEMINATION
Article 14. A facility raising bull breeding stock for producing liquid semen for artificial insemination must comply with the conditions stipulated in Article 5 of this regulation, and the number of bull breeding stock for producing liquid semen in one facility must not be less than three heads.
Article 15. During the period of producing liquid semen, bull breeding stock must be monitored and inspected every three months for the percentage of morphologically normal spermatozoa (K). Each time semen is collected, the following indicators must be checked: color, smell, volume of ejaculation (V), motility of spermatozoa (A), concentration of spermatozoa (C). The results of semen quality inspection must be accurately recorded in books and forms as prescribed.
Article 16. The production, preparation, quality control, preservation, distribution, transportation, and veterinary hygiene of bull semen must comply with the technical procedures for artificial insemination of cattle issued by the Ministry of Agriculture and Rural Development. Containers holding liquid semen must be labeled with clear information about the breed; bull breeding stock identification number; production facility; date of production.
Article 17. Facilities raising bull breeding stock must implement Articles 8, 9, 10, 11, 12, and 13 of this regulation.
Chapter IV
MANAGEMENT AND USE OF BULL BREEDING STOCK FOR DIRECT MATING
BREEDING STOCK FOR DIRECT MATING
Article 18. A facility raising bull breeding stock for direct mating must comply with the conditions stipulated in Article 5 of this regulation.
Article 19. Bull breeding stock used for direct mating must be produced from a breeding facility and meet the conditions stipulated in Article 19 of the Livestock Breed Ordinance. The breeder must register with the People's Committee of the commune.
Article 20. Bull breeding stock used for direct mating must be vaccinated regularly and tested for infectious diseases according to the regulations of the Veterinary Service. It is strictly prohibited to use bull breeding stock that is sick, in the incubation period of disease, or within an epidemic area for direct mating.
Article 21. Bull breeding stock used for direct mating should not exceed three times per week. The age at which bull breeding stock begins direct mating must not be younger than 16 months for crossbred bulls and 18 months for exotic bulls, and their usage period must not exceed five years.
Article 22. Bull breeding stock used for direct mating must undergo annual selection and certification by the local state management agency at the district level according to the standards set by the agricultural sector. Bulls that do not meet the standards must be promptly culled and reported to the People's Committee of the commune where they were registered for breeding.
Chapter V
STATE MANAGEMENT RESPONSIBILITIES
REGARDING THE RAISING OF BULL BREEDING STOCK
Article 23. State management levels for raising bull breeding stock are as follows:
1. The Department of Agriculture is responsible for:
a) Managing the national quality of bull breeding stock, managing and issuing quality certificates for facilities producing frozen bull semen;
b) Organizing the development and issuance of monitoring and evaluation forms for breeding stock quality, management software, and unified numbering systems for bull breeding stock nationwide;
c) Reviewing applications, organizing scientific councils to evaluate testing results, and granting import permits for bull breeding stock, bull semen, dilution environments, and bull semen preservation media;
d) Organizing inspections and evaluations of the implementation of management and use regulations for bull breeding stock by breeding facilities.
2. Provincial Departments of Agriculture and Rural Development and municipal departments under the central government are responsible for:
a) Managing the provincial or municipal quality of bull breeding stock used for producing liquid semen, and issuing quality certificates for breeding facilities managed by the province or municipality;
b) Annually developing plans for evaluating and selecting bull breeding stock within their jurisdiction; directing county-level state management agencies to organize the implementation of selection and evaluation of bull breeding stock herds managed by the province or municipality;
c) Organizing inspections and audits of the implementation of management and use regulations for bull breeding stock by breeding facilities managed by the province or municipality;
d) Regularly reporting to the Department of Agriculture on the provincial or municipal state management work regarding the quality of bull breeding stock once a year in November.
3. County-level state management agencies for agriculture are responsible for:
a) Managing the quality of bull breeding stock used for direct mating at breeding facilities within their jurisdiction;
b) Cooperating with commune people's committees to organize and guide registration and issuance of quality certificates for bull breeding stock used for direct mating at breeding facilities;
c) Organizing the implementation of evaluations and selections of bull breeding stock used for direct mating within the county;
d) Regularly reporting to the Provincial Department of Agriculture and Rural Development on the state management work regarding the quality of bull breeding stock within the county in November each year.
Chapter VI
IMPLEMENTING PROVISIONS
Article 24. The Director of the Department of Agriculture and the Directors of Provincial Departments of Agriculture and Rural Development under the central government, within their respective functions, duties, and authorities, are responsible for guiding the implementation of this Regulation.
Any difficulties encountered during the implementation of this Regulation should be reported to the Ministry of Agriculture and Rural Development for consideration and resolution./.
