Amending and supplementing some articles of Circular No. 88/2008/TT-BVHTTDLCircular No. 17/2010/TT-BVHTTDL Circular No. 03/2013/TT-BVHTTDL

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;
Pursuant to Decree No. 79/2007/NĐ-CP dated May 18, 2007 of the Government on issuing certified true copies from original books, certifying true copies from original documents, and certifying signatures;
Pursuant to Decree No. 79/2014/NĐ-CP dated July 31, 2014 of the Government detailing implementation of certain provisions of the Law on Fire Prevention and Fighting and the Law amending and supplementing certain provisions of the Law on Fire Prevention and Fighting;
Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
At the request of the Director of the Legal Department,
The Minister of Culture, Sports and Tourism promulgates this Circular amending and supplementing some articles of Circular No. 88/2008/TT-BVHTTDL Circular No. 17/2010/TT-BVHTTDL Circular No. 03/2013/TT-BVHTTDL.
Article 1. Amending and supplementing Circular No. 88/2008/TT-BVHTTDL dated December 30, 2008 of the Minister of Culture, Sports and Tourism guiding the implementation of Decree No. 92/2007/NĐ-CP dated June 1, 2007 of the Government detailing implementation of certain provisions of the Tourism Law regarding tourist accommodation establishments
1. Point d Clause 1.1 Section 1 Part III is amended as follows:
"d) A certified copy with legal effect:
- Certificate of business registration for the tourist accommodation establishment, decision on establishment of the enterprise (if any);
- Academic certificates, qualification certificates, training certificates in tourism management and work experience in the tourism sector;
- Certificate of compliance with security and public order conditions;
- Fire prevention and fighting inspection and acceptance documents issued by the fire prevention and fighting police authority for hotels and tourist guesthouses with five floors or more or with a volume of 5,000 cubic meters or more when newly constructed, renovated, or changed in use;
- Certificate of compliance with food safety conditions (for tourist accommodation establishments providing catering services)."
2. Clause 2.1 Section 2 Part III is amended as follows:
"2.1 Within three months from the date of commencing business operations, tourist accommodation establishments must submit a set of registration files for accommodation establishment classification to the Department of Culture, Sports and Tourism at the locality for assessment and ranking or to the competent authority for assessment and ranking according to regulations."
3. Clause 5.2 Section 5 Part VI is supplemented as follows:
"5.2 At least three months before the expiration date stated in the decision granting the standard service to tourists sign, the business operator must submit a registration file to the Department of Culture, Sports and Tourism for assessment and consideration to issue a new sign. The procedures and requirements for submitting the application for assessment and issuance of a new sign shall be carried out in accordance with the initial assessment and issuance process."
Article 2. Amending Circular No. 17/2010/TT-BVHTTDL dated December 31, 2010 of the Minister of Culture, Sports and Tourism stipulating the operating conditions for water sports facilities organizing water motorcycle activities on the sea
Clause 1 and Clause 2 Article 8 are amended as follows:
"1. The engine of the water motorcycle must have a power (measured in horsepower) suitable for the technical design of the vehicle, and during operation, it must not generate noise that affects resort areas, research institutes, schools, residential areas.
2. Water motorcycles must have a certificate of technical safety and environmental protection issued by the competent authority upon commencement of operation."
Article 3. Amend and supplement Circular No. 03/2013/TT-BVHTTDL dated January 28, 2013, issued by the Minister of Culture, Sports and Tourism detailing the implementation of certain provisions of Government Decree No. 79/2012/NĐ-CP dated October 5, 2012 on artistic performances, fashion shows; beauty pageants and model contests; circulation and business operations of audio and video recordings of music and theater.
1. Points b and c Clause 1 Article 2 shall be amended and supplemented as follows:
"b) A certified true copy of the Permit for organizing artistic performances or fashion shows, or the Decision allowing the organization of beauty pageants or model contests, or the Decision allowing foreign individuals or overseas Vietnamese to enter Vietnam for artistic performances or fashion shows, which have been issued by the competent authority.
c) A certified true copy of the Decision on establishment of a business or the Certificate of Business Registration."
2. Clause 2 Article 2 shall be amended as follows:
"2. Within four working days from the date of receiving complete and valid files, the Department of Culture, Sports and Tourism where the notification is received shall respond in writing. The Department of Culture, Sports and Tourism has the right not to agree with the organization in cases of national mourning, natural disasters, epidemics, security, and political issues that seriously affect the spirit, life, daily activities, and social safety in the locality."
3. Point d Clause 1 Article 12 shall be amended and supplemented as follows:
"d) Form 05: Decision allowing foreign organizations and individuals; overseas Vietnamese to enter Vietnam for artistic performances or fashion shows."
4. Amend and supplement Form 05 in the Appendix attached to this Circular.
Article 4. Effective date
1. This Circular takes effect from February 10, 2015.
2. During the implementation process, if any difficulties arise, it is requested that relevant agencies, organizations, and individuals promptly report to the Ministry of Culture, Sports and Tourism for research and amendment.
