JOINT CIRCULAR
Regulations on job code, occupational standards support staff for
persons with disabilities in public educational institutions
Pursuant to the Civil Servant Law No. 58/2010/QH12 dated November 15, 2010;
Pursuant to the Persons with Disabilities Law No. 51/2010/QH12 dated June 17, 2010;
Pursuant to Decree No. 28/2012/NĐ-CP dated April 10, 2012 of the Government detailing and guiding the implementation of certain provisions of the Persons with Disabilities Law; of Law on Persons with Disabilities;
Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;
Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, civil employees, and armed forces; and Decree No. 17/2013/NĐ-CP dated December 19, 2013 of the Government amending and supplementing certain provisions of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, civil employees, and armed forces;
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 58/2014/NĐ-CP dated June 16, 2014 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
The Ministers of the Ministry of Education and Training and the Ministry of Home Affairs hereby issue this Joint Circular to prescribe the code number, standards, appointment, and classification of pay grades for support staff for persons with disabilities in public educational institutions. support staff for persons with disabilities in public educational institutions.
PART I
GENERAL PROVISIONS
Article 1. Scope of regulation and applicable subjects
This Joint Circular prescribes the code number, standards, appointment, and classification of pay grades for support staff for persons with disabilities in public educational institutions.
This Joint Circular applies to support staff for persons with disabilities working in public educational institutions that provide education to persons with disabilities, including preschool education facilities, general education facilities, specialized education facilities, and integration development support centers where persons with disabilities participate in learning.
The occupational ranks for civil servants teaching at public teacher training colleges include: support staff for persons with disabilities in public educational institutions
Support staff for persons with disabilities (Class IV) - Code: V.07.06.16.
Chapter II
STANDARDS FOR THE OCCUPATIONAL TITLE,
APPOINTMENT AND SALARY GRADING ACCORDING TO PROFESSIONAL TITLES
Article 3. Standards for the occupational title of support staff for persons with disabilities in public educational institutions
1. Tasks
a) Implement programs and plans to support the education of persons with disabilities according to the requirements and regulations of the unit;
b) Participate in developing individual education plans for persons with disabilities;
c) Assist persons with disabilities in their studies and develop specific skills and life skills appropriate to their abilities and needs;
d) Assist teachers in activities related to caring for and educating persons with disabilities;
d) Participate in mobilizing persons with disabilities to attend school;
e) Provide advice and support to families of persons with disabilities and the community regarding knowledge and skills for caring for and educating persons with disabilities.
- Professional ethics standards
a) Demonstrate a sense of responsibility, dedication to work, actively improve and draw lessons from experience in performing assigned tasks;
b) Show love, respect, and fair treatment towards persons with disabilities; support and protect their legitimate rights and interests;
c) Have a sense of responsibility for cooperation with colleagues, families of persons with disabilities, and other organizations and individuals in supporting the education of persons with disabilities;
d) Lead a healthy and civilized lifestyle appropriate to the educational environment.
3. Educational and Training Standards
a) Hold a diploma in a vocational training program for support staff for persons with disabilities or higher; or hold a diploma in one of the following fields: education, health, social work, psychology, and have a certificate in vocational training for support staff for persons with disabilities according to the program issued by the Ministry of Education and Training;
b) Possess a level 1 (A1) foreign language proficiency as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Minister of Education and Training on the six-level foreign language proficiency framework for Vietnam, or possess a certificate in ethnic languages for positions requiring the use of ethnic languages;
c) Possess basic computer skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Minister of Information and Communications on the standard for information technology skills.
4. Standards for professional and vocational competence
a) Possess knowledge and understanding of laws, law enforcement in schools, and school culture;
b) Understand the characteristics and needs of persons with disabilities; support education for persons with disabilities and state policies related to support education for persons with disabilities at the national, sectoral, and local levels;
c) Be able to implement or coordinate in implementing the support education program for persons with disabilities according to grade level;
d) Apply basic professional knowledge and skills to practical support education for persons with disabilities;
e) Possess skills in advising, participating, and coordinating with teachers, families, and communities in the education of persons with disabilities.
Article 4Principles for appointment and classification of pay grades for support staff for persons with disabilities
1. The appointment to the occupational title of support staff for persons with disabilities as prescribed in this Joint Circular must be based on the occupational standards, job positions, and professional and vocational responsibilities undertaken by civil servants.
2. When appointing from the current rank or occupational title of civil servant to the occupational title of support staff for persons with disabilities, there shall be no simultaneous promotion in pay grade.
Article 5. Appointment to the occupational title of educational support staff for persons with disabilities in public educational institutions
Appointment to the occupational title of educational support staff for persons with disabilities, grade IV (code V.07.06.16), shall be made for officials currently working in public educational institutions that provide education for persons with disabilities, who meet the criteria specified in Article 3 of this Joint Circular, and who are currently classified at the equivalent rank of administrative officer.
Article 6Wages classification
The occupational title of educational support staff for persons with disabilities, grade IV (code V.07.06.16), as stipulated in this Joint Circular, shall apply the salary coefficient of category B officials (from salary coefficient 1.86 to 4.06) according to the Table of Salaries for Professional and Technical Staff in State Units (Table 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the wage system for civil servants, public employees, and members of the armed forces.
Chapter III
IMPLEMENTING PROVISIONS
Article 7. Implementation Organization
1. This Joint Circular serves as the basis for implementing recruitment, utilization, and management of educational support staff for persons with disabilities in public educational institutions that provide education for persons with disabilities.
2. Private educational institutions that provide education for persons with disabilities may apply the provisions of this Joint Circular to implement recruitment, utilization, and management of educational support staff for persons with disabilities within their institutions.
3. The heads of public educational institutions that provide education for persons with disabilities directly manage and utilize officials and are responsible for:
a) Reviewing job positions within the unit, developing plans for appointment to the occupational title of educational support staff for persons with disabilities within their authority, submitting them for review and decision by competent authorities or deciding according to delegated authority;
b) Appointing to the occupational title of educational support staff for persons with disabilities within public educational institutions that provide education for persons with disabilities according to their authority or delegated authority after the plan for appointment has been approved by competent authorities;
c) Creating conditions for officials appointed to the occupational title of educational support staff for persons with disabilities to meet any remaining criteria required under this Joint Circular.
4. Ministries, agencies at the ministerial level, government agencies, provincial People's Committees, and centrally governed cities are responsible for:
a) Directing subordinate units under their management to implement appointments to the occupational title and wages for educational support staff for persons with disabilities;
b) Approving plans for appointment to the occupational title and wages for officials under their management transitioning from their current occupational titles or ranks to the occupational title of educational support staff for persons with disabilities as stipulated in this Joint Circular; resolving issues within their authority during the process of appointing to the occupational title and wages;
c) Appointing to the occupational title and wages for officials under their management to the occupational title of educational support staff for persons with disabilities according to their authority;
d) Reporting the results of appointments to the occupational title and wages for educational support staff for persons with disabilities under their management to the Ministry of Education and Training and the Ministry of Home Affairs.
Article 8. Effective date
This Joint Circular takes effect from August 15, 2016.
Article 9. Responsibility for implementation
1. Ministers, Heads of agencies at the ministerial level, Heads of government agencies; Chairpersons of provincial People's Committees and centrally governed cities, and related organizations and individuals are responsible for implementing this Joint Circular.
2. In the course of implementation, if there are any difficulties, organizations and individuals are requested to report to the Ministry of Education and Training for consolidation and coordination with the Ministry of Home Affairs to examine and resolve such issues.
