AMENDMENTS AND SUPPLEMENTS TO SOME ARTICLES OF CIRCULAR NO. 19/2016/TT-BNNPTNT DATED JUNE 27, 2016 GUIDING IN DETAIL ARTICLE 4 OF DECREE NO. 35/2015/NĐ-CP DATED APRIL 13, 2015 ON MANAGEMENT AND USE OF RICE FIELDS AND GUIDING TRANSFORMATION OF AGRICULTURAL STRUCTURE FROM RICE TO PERENNIAL CROPS IN ACCORDANCE WITH DECREE NO. 01/2017/NĐ-CP DATED JANUARY 6, 2017 OF THE GOVERNMENT ON AMENDMENTS AND SUPPLEMENTS TO SOME DECREES PROVIDING DETAILED REGULATIONS FOR IMPLEMENTATION OF THE LAND LAW

At the proposal of the Director of the Plant Cultivation Department;

The Minister of Agriculture and Rural Development issues this Circular to amend and supplement some articles of Circular No. 19/2016/TT-BNNPTNT dated June 27, 2016 on guiding in detail Article 4 of Decree No. 35/2015/NĐ-CP dated April 13, 2015 on management and use of rice fields and guiding transformation of agricultural structure from rice to perennial crops in accordance with Decree No. 01/2017/NĐ-CP dated January 6, 2017 of the Government on amendments and supplements to some decrees providing detailed regulations for implementation of the Land Lawdevelopmenta) Units base on the accounting account system issued in this Circular to apply appropriate accounting accounts suitable for their activities., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP1. Replace the phrase “conversion of crop structure from rice to annual crops or integrated rice-fish farming on rice fields” with the phrase “conversion of crop structure from rice to annual crops, perennial crops, or integrated rice-fish farming on rice fields” in Article 1.tr2. Supplement the applicability clause at the end of Article 2 as follows:of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs“Households and individuals implementing conversion of crop structure from rice to perennial crops on rice fields.”

Article 1. Amending and supplementing certain Articles of Circular No.3. Amend and supplement Clause 1 of Article 3 as follows:

“1. Organizations, households, and individuals legally using rice fields (land users) who have the need to convert the crop structure on rice fields shall submit one Application for Conversion of Crop Structure on Rice Fields to the People's Committee of the commune (commune, ward, town) according to the form set out in Appendix IA attached hereto.”

4. Amend Clause 4 of Article 3 as follows:

“4. In case of disagreement with the conversion, the People's Committee of the commune must respond in writing to the land user, stating the reasons, according to the form set out in Appendix IIA attached hereto.”

5. Supplement Article 3a as follows:

“Article 3a. Principles for conversion of crop structure from rice to perennial crops or integrated rice-fish farming:

1. Principles for conversion of crop structure from rice to perennial crops:

a) Conversion must be carried out by region to form concentrated production areas and ensure that the original surface level can be restored when reverting back to rice cultivation;

b) Conversion must make efficient use of existing infrastructure and be consistent with the local government’s plans to improve infrastructure for agricultural production;

c) Conversion must be conducted openly and transparently.n lFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.

2. Principles for conversion of crop structure from rice to integrated rice-fish farming: Allow the use of up to 20% of the area of rice fields to lower the ground level for fish farming, with the depth of lowering not exceeding 120 cm, but ensuring that the original surface level can be restored when reverting back to rice cultivation.”

"Article 4. Responsibilities of State Management Agencies

1. Crop Cultivation Department

a) Review planning, determine scale, and develop plans for converting crop structure on rice fields according to approved land use plans and submit them to the Ministry of Agriculture and Rural Development for issuance;

b) Guide, inspect, and supervise the implementation of crop structure conversion on rice fields in localities;

6. Amend and supplement Article 4 as follows:

c) Annually compile and report to the Ministry of Agriculture and Rural Development on the results of crop structure conversion on rice fields nationwide.  

2. Department of Agriculture and Rural Development

a) Develop and submit provincial plans for converting crop structure on rice fields based on the national plans of the Ministry of Agriculture and Rural Development for approval by the Provincial People's Committee;

b) Guide, inspect, and supervise the implementation of crop structure conversion on rice fields within their province;

c) Regularly before June 30 and December 31 each year, compile the results of crop structure conversion on rice fields according to the form set out in Appendix III attached hereto, and report to the Provincial People's Committee and the Ministry of Agriculture and Rural Development (through the Crop Cultivation Department).”

a) Develop and issue district plans for converting crop structure on rice fields based on provincial plans;

b) Guide, inspect, and supervise the implementation of crop structure conversion on rice fields within their district;

b) Regularly before June 15 and December 15 each year, compile the results of crop structure conversion on rice fields according to the form set out in Appendix III attached hereto, and report to the Department of Agriculture and Rural Development.”

4. People's Committee of Communes

3. People's Committee at the district level

a) Develop commune plans for converting crop structure on rice fields based on district plans according to the form set out in Appendix IV attached hereto; organize consultations with households and individuals related to the determination of conversion zones; publicly announce the plan for converting crop structure on rice fields at the commune People's Committee office in the fourth quarter of the previous year within 60 days;

b) Receive and process Applications for Conversion; establish a Register for Monitoring Conversion of Crop Structure on Rice Fields;

c) Promote, guide, inspect, and supervise the implementation of crop structure conversion on rice fields by organizations, households, and individuals within their jurisdiction;

d) Regularly before May 30 and November 30 each year, compile the results of crop structure conversion on rice fields according to the form set out in Appendix III attached hereto, and report to the People's Committee of the district.

7. Replace Appendix I with Appendix IA issued together with this Circular.

1. This Circular takes effect from December 25, 2017.

d) Annually before May 30 and November 30 of each year, compile the results of crop structure conversion on rice cultivation land according to the form in Appendix III issued with this Circular and report to the People's Committee at the district level.

8. Replace Appendix II with Appendix IIA issued with this Circular.

Article 2. Implementation clause

1. This Circular takes effect from December 25, 2017.

2. During implementation, if there are difficulties or obstacles, organizations and individuals shall report to the Ministry of Agriculture and Rural Development for study, amendment, and supplementation./.
