NUMBER: 194 DATE: May 28, 1948
OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
CHAIRMAN OF THE VIETNAM DEMOCRATIC REPUBLIC GOVERNMENT
- Pursuant to Decree No. 70 dated May 22, 1946,
- Pursuant to Decree No. 120-SL dated January 25, 1948;
- Pursuant to Decree No. 157-SL dated April 14, 1948;
- At the proposal of the Minister of Public Works;
- The Standing Committee of the National Assembly has agreed,
ISSUES THE DECREE:
Article 1
This Decree abolishes and replaces the above-mentioned Decree No. 157-SL dated April 14, 1948.
Article 2
The Central Flood Control Committee is abolished.
Article 3
In each inter-provincial region, a Regional Flood Control Committee shall be established comprising:
- Chairman of the Inter-Provincial Region Committee or his representative: Chairman
- Director of Public Works in the inter-provincial region: Vice-Chairman
- Director of Finance in the inter-provincial region
- Two citizens representing the people, appointed by the new and old Inter-Provincial Region Committees: Member
Article 4
In each province, a Provincial Flood Control Committee shall be established comprising:
- Chairman of the Provincial Committee or his representative: Chairman
- Director of Public Works in the province: Vice-Chairman
- Director of Treasury
- Two citizens representing the people, appointed by the new and old Provincial Committees: Member
according to local needs.
Article 5
In each district, a District Flood Control Committee shall be established comprising:
- Chairman of the District Committee: Chairman
- One Public Works staff member, appointed by the Provincial Director of Public Works: Vice-Chairman
- One member of the District Flood Control Committee: Financial Member
appointed by the new and old District Committees according to local needs.
Article 6
- Chairman of the Commune Committee: Chairman
- One Public Works staff member, appointed by the Provincial Director of Public Works: Vice-Chairman
In each district, a District Flood Control Committee shall be established comprising:
- One member of the Commune Flood Control Committee: Financial Member
appointed by the new and old Commune Committees according to the proposal of the Commune Flood Control Committee.
- One member of the District Flood Control Committee: Financial Member
Article 7
Article 6
The general tasks of the Flood Control Committee in each locality are:
- To study and propose flood control works.
- To implement and settle these works.
- To manage the flood control system from June 15 to October 15 each year.
- To coordinate with local administrative and relief agencies.
- And to organize all relief work to prevent and respond to flood breaches.
- To report all activities carried out after each flood season.
The Flood Control Committees at all levels shall operate vertically and in accordance with the budget of the Ministry of Public Works.
The Flood Control Committees shall not be responsible for implementing large and new flood control works defined by the Ministry of Public Works.
Article 8
The specific duties of each member of the Flood Control Committee are:
- The Chairman oversees the work administratively and politically.
- The Vice-Chairman oversees the technical work according to the directives of the superior technical agency.
- The financial member is responsible for accounting, managing the financial fund, and settling accounts according to the directives of the superior financial agency.
- Other members mobilize the people and supervise work on site.
All members of the Flood Control Committee are jointly liable.
Article 9
Previous regulations concerning flood control that conflict with this Decree are repealed.
Article 10
The Ministers of Interior, Finance, and Public Works shall enforce this Decree.
Article 10
The Ministers of Interior, Finance, and Public Works shall promulgate the decree for implementation.
