BASED ON THE Construction Law number 16/2003/QH11 Pursuant to the Civil Aviation Law dated November 29,June 2024;energy 11 2003;

The Minister of Transport issues this Circular quto regulate reason 1. This Circular guides the implementation of certain contents regarding the management of railway infrastructure; organization of maintenance of railway works; specifies items of costs related to the maintenance of national railway works and dedicated railway works.

Chapter I

GENERAL PROVISIONS

Article 11. The following articles and clauses of the Law on Prevention and Combating Corruption:c) 确保支出符合国家预算规定的标准、定额。对于尚未制定标准、定额的支出,KBNN应根据已分配的国家预算和政府主管部门的规定进行控制。 This Circular applies to organizations and individuals involved in the management and maintenance of national railway works and dedicated railway works.

1. Railway works are construction works serving railway transportation, including: tracks, bridges, culverts, tunnels, retaining walls, guard walls, stations, drainage systems, communication and signaling systems, power supply systems, and other auxiliary facilities of railways.

2. The management and maintenance of urban railway works shall be carried out in accordance with the regulations of the provincial People's Committee.

Article 2. Applicability

3. The architectural system of railways includes: passenger waiting rooms, ticket offices, luggage warehouses, cargo warehouses, station squares, platforms, station area fences, wings, cargo yards, watchtowers, signal towers, bridge watchtowers, tunnel watchtowers, control houses, equipment installation houses, generator houses.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

4. The maintenance procedure for railway works is the regulation concerning the sequence, content, and guidance for performing maintenance work on railway works.

2. Railway infrastructure includes railway works, the protected area of railway works, and the traffic safety zone of railway works.

5. Maintenance of railway works is a set of activities aimed at ensuring and maintaining normal operation and safety of the works according to design specifications throughout their operational period.

6. Maintenance of railway works includes monitoring, caring, repairing minor damages, and regular maintenance of installed equipment to keep the works in a normal operating condition and limit the occurrence of damages.

7. Repairing railway works involves rectifying damages discovered during operation and use to ensure normal and safe operation of the works.

Repairing railway works includes scheduled repairs and emergency repairs:

a) Scheduled repair of railway works involves repairing damages or replacing parts of the works and equipment that have been damaged, carried out regularly according to the maintenance procedure for railway works;

b) Emergency repair of railway works is performed when parts of the works or the works themselves suffer damage due to sudden impacts such as storms, floods, earthquakes, collisions, fires, or other sudden natural disasters, or when there are signs indicating potential sudden damage affecting the safety of use and operation of the works or posing a risk of accidents leading to disasters.

8. The entity assigned to carry out maintenance of railway works (hereinafter referred to as the Railway Works Maintenance Entity) are organizations and individuals directly responsible for managing and maintaining railway infrastructure.

1. Railway works and equipment after completion of new construction, upgrading, renovation, and periodic repairs must be inspected, handed over, managed, and maintained. The time for managing and maintaining railway works starts from the date the project owner and the Railway Works Maintenance Entity sign the acceptance handover document putting the works into use.

Article 4. Requirements for railway infrastructure management workintention 2. Maintenance of railway works is carried out according to the maintenance procedures for railway works published and implemented by the competent authority, and organized according to Chapter II of this Circular.

3. The maintenance procedures for railway works are established in accordance with the components of the works, installed equipment, type, grade of the works, and purpose of use. The establishment, review, approval, and adjustment of maintenance procedures for railway works are carried out according to Chapter II of Decree number 114/2010/NĐ-CP of the Government.

1. Archiving and managing completion records of newly constructed, upgraded, renovated, and periodically repaired railway works.

2. Establishing management files for railway works

Article 5. Content of railway infrastructure management work

a) For railway bridges and culverts, including the following documents:

- Bridge and culvert history: recording technical characteristics, main conditions of the works; updating changes and developments through various repair cycles; major damages occurred during use; results of regular inspections and testing;

- Regular inspection logbook: recording results of inspections and observations of ongoing damages to the works;

- Design documents, construction documents, completion documents of the works, and related documents.

b) For railway tracks, including the following documents:

- Track inspection book (straight and curved sections), inspection record book, weekly inspection book, barrier inspection book, rail inspection report, track foundation monitoring chart; flood and storm prevention and aftermath handling documents;

- Updating land use changes for railway tracks; updating speed and load capacity data; number of trains passing through; updating results of inspection rounds, periodic repair projects, and emergency repair projects;

- Design documents, completion documents such as plans, longitudinal profiles, cross-sections, geological sections, drainage systems, land acquisition and compensation documents, boundary marker documents.

c) For railway tunnels, including the following documents:

- Design files, completion files such as plan views, longitudinal sections, cross sections, geological sections, drainage systems, compensation and land clearance files, boundary marker files.

c) For railway tunnels, the following documents shall be included:

- Daily duty log: record patrol schedule for tunnel protection; manage telephones at both ends of the tunnel; monitor the status of the tunnel (including measurements when necessary), cracks on the tunnel shell, wing walls, main walls, tunnel doors, drainage ditches, water seepage into the tunnel; repair cracks, broken areas, mow grass, clear drainage ditches, fix crown ditches, repair lighting, communication, and simple ventilation equipment; observe and ensure safety maintenance of the road section within the tunnel;

- Tunnel report: record a brief history of the tunnel including the tunnel name, length, railway route, gauge, and clearance; characteristics of the tunnel such as length, number of chambers, cross-sectional dimensions, door orientation and main airflow direction, plan and longitudinal profile data, construction materials; cross-section, longitudinal section, and plan drawings of the tunnel;

- Construction design and completion files, including geological and hydrological documentation;

d) For retaining wall systems and railway architecture: design and completion files for works; update results from inspection rounds, regular and emergency repair projects, and related changes to the works;

đ) For railway information and signaling systems: technical system design files, completion files, applied technical standards, installed equipment, equipment commissioning date, warranty period; inspection, maintenance, and upkeep logs for equipment; statistical charts tracking technical standards of equipment and systems;

3. Establish management records for railway traffic safety zones;

a) Railway traffic safety zone management records include: land use status within the railway traffic safety zone; structures affecting railway traffic safety; violations, violation times, and violation resolution processes;

b) Separate records must be established for level crossings and pedestrian paths to serve management and monitoring purposes, ensuring railway and road traffic safety;

c) Management records for access roads within railway traffic safety zones include: completion files, design files, construction permits, and other relevant documents;

4. Organize implementation of management and protection of railway works; coordinate with People's Committees at all levels to manage and protect railway infrastructure;

5. Monitor damage conditions of railway works; organize regular patrols and inspections to promptly identify damages and encroachments on railway infrastructure; take action within authority or request People's Committees at all levels to handle according to regulations;

6. Conduct regular and periodic technical condition checks; conduct emergency inspections of railway works after each flood, storm, or other unusual impacts;

7. Create accident tracking forms to determine initial causes of railway accidents; cooperate with police agencies and local authorities to resolve railway traffic accidents within authority;

8. Establish records to track potential or frequent railway traffic accident locations, locations with small radii reducing train passage capacity;

9. Report periodically and urgently as prescribed;

Article 6. Contents of railway works maintenance work

Railway work maintenance tasks may include one, several, or all of the following: inspection, database management and updates, monitoring, quality testing, maintenance, and repairs.

Article 7. Responsibilities of organizations and individuals for the maintenance of railway works

1. Vietnam Railway Corporation shall be responsible for maintaining national railway works invested by the State; shall bear legal responsibility for accidents or deterioration of works due to failure to maintain the works in accordance with regulations.

2. For dedicated railways or railways invested by other owners, the owner or the person authorized shall be responsible for maintaining the railway works they have invested in; shall bear legal responsibility for accidents or deterioration of works due to failure to maintain the works in accordance with regulations.

Chapter II

IMPLEMENTATION OF RAILWAY INFRASTRUCTURE MAINTENANCE

Article 8. Establishment and approval of maintenance plans for railway worksì 1. Establishment of maintenance plan||| meteorological and hydrological works pursuant to the Ordinance on Meteorology and Hydrology dated December 2, 1994;a) Based on the technical condition, transportation needs on each operational railway line, maintenance procedures, economic-technical norms, current regulations of the State, the unit responsible for maintaining railway works shall establish the maintenance plan and budget for railway works maintenance and submit one copy of the report to Vietnam Railway Corporation before June 15th each year;

b) Within seven working days from the date of receiving the reports from units responsible for maintaining railway works, Vietnam Railway Corporation shall be responsible for reviewing and consolidating the maintenance plan for railway works (in accordance with the form specified in Appendix 1 of this Circular) and submitting it to the Ministry of Transport. The maintenance plan for railway works shall be established in two copies (one copy sent to the Ministry of Transport, one copy sent to the Vietnam Railway Administration). At the same time, Vietnam Railway Corporation shall prepare the budget for revenue and expenditure from state funds for economic activities and send it to the Ministry of Transport and the Ministry of Finance;

c) The contents of the annual maintenance plan for railway works include: maintenance plan, repair plan for each line (section), and other tasks (if any). The maintenance plan for railway works must fully provide the following information: name of the work, main items of the work; unit, quantity, budget for implementation costs; implementation time; method of implementation and priority level.

2. Approval of maintenance plan

b) Based on the maintenance plan for railway works submitted by Vietnam Railway Corporation, the review report of the Vietnam Railway Administration, the Ministry of Transport shall examine and approve the maintenance plan and budget for railway works maintenance; consolidate the maintenance plan and budget for railway works maintenance into the annual revenue and expenditure budget of the Ministry of Transport and send it to the Ministry of Finance before July 20th each year;

c) After receiving the notification from the Ministry of Finance regarding the annual revenue and expenditure budget, the Ministry of Transport will allocate to Vietnam Railway Corporation. Vietnam Railway Corporation will review and adjust the maintenance plan and budget for railway works to be consistent with the allocated funds; prepare the dossier and submit it to relevant units for review and examination according to point b, Clause 1, Article 10 of this Decree. The Vietnam Railway Administration will conduct the review and prepare the report according to regulations and send it to the Ministry of Transport;

a) Within ten working days from the date of receiving complete files, the Vietnam Railway Administration shall be responsible for reviewing and preparing a report to submit to the Ministry of Transport.

d) The Ministry of Transport will examine and approve the annual maintenance plan and budget for railway works after receiving all maintenance plan dossier, submission letter, review report, and comments from relevant units (if any).

3. The maintenance plan for railway works may be adjusted and supplemented during implementation to suit actual conditions. The Ministry of Transport decides on adjustments to the maintenance plan.

4. Maintenance of railway works and equipment using state budget funds shall be carried out according to the following procedures depending on the cost:

a) For repairs of works and equipment costing less than VND 500 million, Vietnam Railway Corporation shall decide according to point a, Clause 4, Article 10 of Government Decree No. 114/2010/NĐ-CP;

b) For repairs of railway works and equipment costing VND 500 million or more, Vietnam Railway Corporation shall organize the preparation, submission for examination and approval of the economic-technical report or investment project according to laws on construction project investment.

5. The establishment and approval of maintenance plans for dedicated railway works and railway works invested by other owners shall be carried out according to the regulations of the owner or the authorized person.

b) In cases where railway works and equipment repairs cost 500 million VND or more, Vietnam Railway Corporation shall organize the preparation, review, and approval of economic-technical reports or investment construction projects in accordance with the laws on construction project investment.

5. The establishment and approval of maintenance plans for dedicated railway works and railways invested in by other owners shall be carried out in accordance with the regulations of the owner or the authorized representative.

Article 9. Implementation of Railway Infrastructure Maintenance Plan

1. For state-owned national railways invested by the State, based on the annual railway infrastructure maintenance plan approved, Vietnam Railway Corporation shall organize and implement according to regulations.

The Ministry of Transport shall organize inspections and supervision of the implementation of the national railway infrastructure maintenance plan.

2. For dedicated railways or railways invested by other owners, the owner or the authorized person shall organize the implementation of the railway infrastructure maintenance plan for their own investment.

Article 10. Inspection, Maintenance, Repair, and Evaluationitself railway works within the assigned route and area.

1. The railway infrastructure maintenance unit shall carry out inspection, maintenance, and repair of railway infrastructure according to the approved maintenance procedures; organize safety evaluation when necessary.

2. Inspection, maintenance, and repair of railway infrastructure shall be carried out in accordance with the provisions of Clauses 2, 3, 4, and Clause 5 of Article 11 of Decree No. 114/2010/ND-CP of the Government.

3. Safety evaluation of railway infrastructure shall be conducted through quality inspection of the infrastructure according to the provisions of Article 12 of Decree No. 114/2010/ND-CP of the Government.

4. The outline of quality inspection of railway infrastructure includes the following main contents:

a) Purpose of inspection, requirements for inspection, content of inspection implementation, inspection process and methods;

b) Technical standards applied in the implementation of inspection;

c) List of personnel and individuals assigned to lead the inspection, information about the capabilities of individuals participating in the implementation;

d) Main equipment and laboratories used for inspection;

đ) Sequence of inspection steps;

e) Costs incurred, estimated completion time for inspection work;

g) Other conditions for conducting inspection.

5. Inspection, maintenance, and repair results must be recorded and documented for management and monitoring; they must be updated into the railway infrastructure database system.

Article 11. Railway Infrastructure Projects and Components That Must Be Monitored During Operation and Use

1. During operation and use, railway infrastructure projects showing signs of subsidence, cracking, tilting, or other abnormal signs that may cause collapse, and the following projects must be monitored:

a) Bridges: Special grade, Grade 1;

b) Tunnels: Special grade, Grade 1;

c) Stations: Special grade, Grade 1.

2. Parts of railway works that need to be monitored are the main load-bearing structures of the works, which, if damaged, could lead to collapse.

3. Content of railway infrastructure monitoring includes: monitoring location, monitoring parameters (deformation, tilt, subsidence, cracking, sagging...), monitoring time, number of measurement cycles, and other necessary contents established by the monitoring unit and approved by the competent state authority.

4. General requirements for railway infrastructure monitoring during operation and use:

a) Monitoring must be carried out according to the plan established by the monitoring unit and approved by the competent state authority;

b) The monitoring plan must specify the measurement method, measuring equipment, layout and structure of markers; organization of monitoring implementation; data processing method and other necessary contents;

c) The monitoring unit must establish and report monitoring results, including monitoring data which must be compared with the limit values specified in the maintenance procedure, technical standards; recommendations and advice to the infrastructure owner if monitoring data exceeds the allowable limit values in the maintenance procedure or show abnormal signs to take timely measures; conduct safety evaluation of the infrastructure according to current regulations;

d) The monitoring unit must have sufficient capacity and experience in infrastructure monitoring, experience in handling infrastructure incidents as prescribed by law.

Article 12. Quality Management of Railwaysngmaintenance work of railway construction projects

1. The Vietnam Railway Corporation (for state-owned national railways) and owners or authorized persons (for dedicated railways or railways invested by other owners) shall be responsible for implementing quality management of railway projects in accordance with the provisions of Government Decree No. 15/2013/NĐ-CP and Government Decree No. 114/2010/NĐ-CP, and other relevant laws.

2. Maintenance files of railway projects shall be established in accordance with Clause 2, Article 14 of Government Decree No. 114/2010/NĐ-CP.

3. Warranty period for railway project repair work shall be in accordance with Clause 3, Article 14 of Government Decree No. 114/2010/NĐ-CP.

Article 13. Consideration and Decision on Continued Use of Railway Projects at End of Design LifecouncillORS1. A railway project at end of design life is a project that has been in operation and use for a longer time than its design life. The design life of the project is determined according to the design documentation.- Size of the stamp: 1 specialized agency under the People's Committee of the province/city.ngIn cases where the design documentation is lost or does not specify the design life, the design life of the project will be determined according to technical standards or the results of quality inspection.

2. Before the railway project reaches the end of its design life, if there is a need to continue using it, the Vietnam Railway Corporation (for state-owned national railways) and owners or authorized persons (for dedicated railways or railways invested by other owners) must carry out the following tasks:

b) Repair the project (if damaged) to ensure functionality and safe use, and decide on continued use of the project from Class II downwards but without causing disaster when accidents occur, in accordance with the law on construction project quality management;

c) Report to the Ministry of Transport for projects from Class I upwards, and projects that may cause disasters when accidents occur, in accordance with the law on construction project quality management.

a) Organize inspections, tests, and evaluations of the current quality of the work.

a) Results of current quality assessment of the project;

b) Proposals for handling the project in one of the following situations: continuing to use the project, changing the purpose of use, repairing the project if necessary; limited use of part of the project; limiting use or completely stopping use of the project. The proposal for handling the project should have priority order and be consistent with allocated funds.

3. The contents of the report include:

4. Reports shall be sent to the Ministry of Transport and the Vietnam Railway Administration for consideration and handling of railway projects reaching their design life.

5. Responsibilities of State Management Agencies

a) The Vietnam Railway Administration shall be responsible for inspecting and preparing reports, proposing solutions for railway projects reaching their design life, and sending them to the Ministry of Transport;

b) The Ministry of Transport shall consider and decide on measures to handle railway projects reaching their design life in accordance with regulations.

Article 14. Reporting System for Maintenance Work of Railway Projects

a) The Vietnam Railway Corporation shall implement regular and ad hoc reporting systems on the results of maintenance plans for state-owned national railways, sending these reports to the Ministry of Transport and the Vietnam Railway Administration six months before July 15 each year and annually before January 15 of the following year; simultaneously, reports shall be made in accordance with Clause 1, Article 17 of Government Decree No. 114/2010/NĐ-CP;

b) Owners or authorized persons managing and maintaining dedicated railways or railways invested by other owners shall implement regular and ad hoc reporting systems on the results of maintenance plans, sending these reports to the Vietnam Railway Administration annually before January 15 of the following year;

c) The Vietnam Railway Administration shall implement regular reporting systems on the results of maintenance plans for railway projects (including state-owned national railways, dedicated railways, and railways invested by other owners), sending these reports to the Ministry of Transport annually before January 25 of the following year.

2. The report content must include the following information: name of the project, project components implemented; quantity and cost of implementation; completion time; adjustments and changes compared to approved plans; evaluation of implementation results (according to approved plans); proposals and recommendations during the implementation of railway project maintenance work (in accordance with the Reporting Form specified in Appendix 2 of this Circular).

c) Vietnam Railway Administration shall implement the reporting system to report the results of implementing the railway works maintenance plan (including state-invested national railways, dedicated railways, and railways invested in by other owners) to the Ministry of Transport annually before January 25 of the following year.

The content of the report must include all of the following information: name of the work, implemented work items; volume and implementation costs; completion time; adjustments and occurrences compared to the approved plan; assessment of implementation results (according to the approved plan); proposals and recommendations during the implementation of railway works maintenance tasks (in accordance with the Reporting Form specified in Appendix 2 of this Circular).

Article 15. Handling of railway works and parts thereof that do not ensure safety for operation and use

1. Railway works and parts thereof that do not ensure safety for operation and use are those that are severely damaged, seriously deteriorated, at risk of collapse, as indicated by signs such as cracks, sagging, subsidence, tilting beyond the permissible values specified in the railway work maintenance procedures or in relevant technical standards and regulations.

2. When discovering railway works that do not ensure safety for operation and use, Vietnam Railway Corporation (for state-invested national railways) and owners or authorized persons (for dedicated railways and railways invested in by other owners) shall immediately report to the Ministry of Transport; and simultaneously implement the provisions set out in Clause 1, Article 18 of Government Decree No. 114/2010/NĐ-CP.

3. When discovering or receiving information about signs of deterioration in the quality of railway works, which do not ensure safety for operation and use, the Ministry of Transport shall handle according to the provisions set out in Clause 3, Article 18 of Government Decree No. 114/2010/NĐ-CP.

4. In cases where railway works experience incidents during operation and use, the resolution of such incidents shall be carried out in accordance with the laws on construction project quality management.

Article 16. Application of technical standards, economic norms3.2.5. Medical examination and treatment establishments, laboratories, and vaccination centers at the provincial levelb) For components of railway projects without economic-technical norms, apply corresponding norms of relevant sectors or localities issued by competent authorities.concerning the classification and determination of state management authority in the field of crop productionrailway

1. For railway infrastructure maintenance work:

a) Apply according to technical standards, economic-technical norms issued by competent authorities;

b) For items of works without economic-technical norms, apply corresponding norms of other sectors or localities that have been issued by competent authorities.

2. For regular repair and emergency repair of railway works: apply according to the provisions for basic construction works and current regulations of competent authorities.

Chapter III

COSTS FOR MAINTAINING RAILWAY WORKS

2. The organization or individual receiving a limited-term transfer of the right to operate and conduct business on national railway infrastructure invested by the State shall be responsible for allocating funds for maintaining the transferred railway projects according to the contract with the competent state management agency.

1. Funds for maintaining railway works invested by the state are formed from the following sources:

a) State budget;

b) Other lawful revenues as prescribed by law.

2. The management and use of funds for railway work maintenance shall be carried out in accordance with current legal provisions.

4. Management and use of funds for maintaining railway projects shall be carried out in accordance with current laws.

Article 18. Maintenance costs for railway works

1. Contents of cost items related to the implementation of railway work maintenance include:

a) Costs for preparing, reviewing, and verifying maintenance procedures for works and economic-technical norms serving the maintenance of railway works;

c) Costs for regular, periodic, and emergency inspections of projects;

d) Costs for monitoring railway projects where monitoring is required;

e) Maintenance costs for railway projects;

f) Quality inspection costs for projects;

e) Costs for quality inspection of construction works when necessary;

h) Costs for preparing, managing maintenance records of railway projects and updating the database of railway infrastructure.

2. Determination of costs for managing and maintaining railway projects shall follow the guidelines of the Ministry of Construction, the Ministry of Finance, and related legal provisions.

Chapter IV

IMPLEMENTING PROVISIONS

1. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments under the Ministry of Transport, the Director of the Vietnam Railway Administration, the General Director of Vietnam Railway Corporation, Heads of agencies, organizations, and individuals related shall be responsible for implementing this Circular.

2. During implementation, if any difficulties arise, organizations and individuals shall promptly reflect them in writing and send to the Ministry of Transport for consideration and resolution./.
