Pursuant to the Cinema Law No. 62/2006/QH11 dated June 29, 2006, and the Law Amending and Supplementing Certain Provisions of the Cinema Law No. 31/2009/QH12 dated June 18, 2009;

Pursuant to Decree No. 54/2010/NĐ-CP dated May 21, 2010 of the Government detailing the implementation of certain provisions of the Cinema Law No. 62/2006/QH11 and the Law Amending and Supplementing Certain Provisions of the Cinema Law No. 31/2009/QH12;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Cinema Department,

The Minister of Culture, Sports and Tourism issues this Circular regulating certain management contents for film dissemination activities using special effects that impact viewers.

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular regulates certain management contents for film screening rooms, authority, procedures for issuing permits for disseminating films using special effects that impact viewers.

This Circular applies to organizations and individuals participating in film dissemination activities using special effects that impact viewers.

Article 2. Interpretation of Terms

In this Circular, the following terms shall be understood as follows:

1. "Films using special effects that impact viewers" are films produced based on the effective combination of 3D film with special effects in the screening room, created in accordance with the context of the film, directly impacting viewers, creating a feeling for viewers as if they were present at the scene of the film.

2. "3D Film" is a film where images in the film are presented in three-dimensional space: length, width, and depth, recorded on film plastic material, magnetic tape, hard disk of computers, and other recording materials.

3. "Special Effects" are effects obtained through the application of scientific, technological, and technical achievements to simulate phenomena such as rain, wind, snow, thunder, lightning, or other natural phenomena; sound, light, smoke fire, taste, shaking, or other artificial impacts, affecting viewers.

Article 3. Regulations for film screening rooms using special effects that impact viewers

1. Film screening room:

a) Must have soundproofing systems, not allowing sound to leak out beyond the permitted noise level according to the law;

b) Must have fire prevention and firefighting equipment according to the law;

c) Must have medical supplies and appropriate first aid kits to provide emergency care when necessary;

d) Must have a health warning board for children under six years old, pregnant women, people with cardiovascular diseases, joint diseases, people who are drunk, and people with neurological disorders when watching films;

e) Must have a place to store and secure audience belongings during the film screening.

2. Seating and equipment:

a) Seating and equipment creating special effects that impact viewers must have clear origin and meet quality management requirements according to the law;

b) Shall not use damaged or substandard seating and equipment.

3. Special effects:

a) When using special effects that impact viewers, safety for viewer health, fire and explosion safety, and environmental hygiene must be ensured;

b) Shall not use harmful chemicals to create special effects that affect viewer health.

Article 4. Competence and Procedures for Issuing Film Exhibition Licenses Involving Special Effects Affecting Viewers

1. The issuance of film exhibition licenses involving special effects affecting viewers must be based on the type of film, as prescribed by laws on cinema.

2. In cases where films using special effects that affect viewers have incomplete content, the authority to issue film exhibition licenses shall be as follows:

a) The Cinema Department, authorized by the Ministry of Culture, Sports and Tourism, shall issue and revoke film exhibition licenses involving special effects affecting viewers for films produced or imported by central cinema establishments.

b) Departments of Culture, Sports and Tourism (authorized by provincial People's Committees) shall issue and revoke film exhibition licenses involving special effects affecting viewers for films produced or imported by local cinema establishments.

3. The procedures for reviewing and issuing film exhibition licenses shall be carried out in accordance with the Regulations on Reviewing and Issuing Film Exhibition Licenses issued together with Decision No. 49/2008/QĐ-BVHTTDL dated July 9, 2008 of the Minister of Culture, Sports and Tourism and Circular No. 11/2011/TT-BVHTTDL dated September 19, 2011 of the Ministry of Culture, Sports and Tourism guiding the implementation of certain provisions related to administrative procedures in the field of cinema.

Article 5. Film Review Board for Films Involving Special Effects Affecting Viewers

Based on the content of the film, the Film Review Board for films involving special effects affecting viewers must include members who are experts in the fields of healthcare, science and technology, or environment.

Article 6. Responsibilities of Cinemas Using Special Effects Affecting Viewers

1. Only screen films that have been issued exhibition permits by the competent authorities as stipulated in Article 4 of this Circular.

2. Regularly organize inspections and maintenance of seating systems and technical equipment in screening rooms according to regulations.

3. Implement the provisions of this Circular and other relevant laws.

Article 7. Transitional Provisions

Existing cinemas operating with films involving special effects affecting viewers that do not comply with the screening room requirements set forth in Article 3 of this Circular must supplement and complete within ninety days from the date this Circular takes effect.

Article 8. Implementation organization

1. The Cinema Department shall be responsible for directing, guiding, and organizing the implementation of this Circular.

2. Departments of Culture, Sports and Tourism of provinces and centrally-administered cities shall be responsible for:

a) Inspecting, supervising, and implementing this Circular at the local level;

b) Reporting annually to the Ministry of Culture, Sports and Tourism (through the Cinema Department) on activities related to the exhibition of films involving special effects affecting viewers.

Article 9. Effective Date

1. This Circular takes effect from April 1, 2014.

2. Attach to this Circular the following forms:

a) Application form for issuing film exhibition licenses involving special effects affecting viewers (Form No. 01);

b) Film review form involving special effects affecting viewers (Form No. 02);

c) Minutes of film review involving special effects affecting viewers (Form No. 03);

d) Film exhibition license involving special effects affecting viewers (Form No. 04);

đ) Decision not to allow or prohibit the exhibition of films involving special effects affecting viewers (Form No. 05);

e) Decision to temporarily suspend or terminate the exhibition of films involving special effects affecting viewers (Form No. 06).

3. During the implementation process, if there are difficulties or obstacles, organizations and individuals are requested to promptly report to the Ministry of Culture, Sports and Tourism (through the Cinema Department) for consideration, supplementation, and amendment./.
