Article 1. Scope of Regulation and Applicability

Thông tư này quy định chi tiết khoản 4 Điều 38 Luật Thủy sản số 18/2017/QH14 đã được sửa đổi, bổ sung tại điểm c khoản 21 Điều 14 Luật số 146/2025/QH15.

Article 2. Postal Public Utility Services

Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.

Postal public utility services are those provided according to the requirements of the State, including:

1. Universal postal services are basic letter services with an address, weighing up to 02 kilograms (kg), including:

a) Domestic basic letter service;

b) Basic letter service from Vietnam to other countries;

c) Basic letter service from other countries to Vietnam.

2. Postal services for national defense, security, and other special tasks in the postal sector, provided through the public postal network as decided by competent authorities.

Article 3. Public Utility Services in Newspaper Distribution Activities

Public utility services in newspaper distribution activities are the distribution of types of People's Army Newspaper, People's Armed Forces Newspaper, Communist Review, and Party Newspapers of provinces and centrally-administered cities through the public postal network.

Article 4. Quality and Tariffs

Postal public utility services as stipulated in Article 2 and public utility services in newspaper distribution activities as stipulated in Article 3 shall be provided according to the quality standards set out in the National Technical Regulations on the quality of postal public utility services and public utility services in newspaper distribution activities, and the tariffs for these services shall be determined by the Ministry of Information and Communications.

Article 5. Content of State Management over the Provision of Postal Public Utility Services and Public Utility Services in Newspaper Distribution Activities

1. The public postal network must meet the minimum requirements as specified in Article 6 of this Circular;

2. Service provision plans as specified in Article 7 of this Circular;

3. Inspection, supervision of implementation, and assessment of completion levels in the provision of postal public utility services and public utility services in newspaper distribution activities, as specified in Articles 8 and 11 of this Circular.

1. The public postal network must meet the minimum requirements as stipulated in Article 6 of this Circular;

2. The service supply plan as prescribed in Article 7 of this Circular;

3. Inspection, supervision of implementation, evaluation of completion level in the supply of postal public service and public service in press distribution activities as prescribed in Articles 8 and 11 of this Circular.

Article 6. Public postal network and responsibilities of enterprises designated to maintain and manage the public postal network

1. The public postal network includes the following components:

a) A system of service points including post offices, rural post and culture stations, public mailboxes, and other forms used to accept basic mail.

b) Operating facilities including international, inter-provincial, and intra-provincial post offices connected by transportation routes and distribution routes.

2. The scale of the public postal network must meet the requirements of the national technical standards on the quality of public postal services and public services in the press distribution activities issued by the Ministry of Information and Communications.

3. Enterprises designated by the State to maintain and manage the public postal network shall be responsible for ensuring the maintenance of the system of service points and operating facilities of the public postal network in accordance with the national technical standards on the quality of public postal services and public services in the press distribution activities to provide services as prescribed by law.

Article 7. Plan for Providing Public Services

1. Annually, before December 25, the Ministry of Information and Communications assigns the plan for providing public postal services and public services in press distribution activities. The content of the plan includes:

a) Volume of public postal services specified in Clause 1, Article 2 of this Circular. The unit of measurement for the plan target is piece (letter).

b) Volume of each type of newspaper and magazine as stipulated in Article 3 of this Circular. The unit of measurement for the plan target is sheet (newspaper), volume (magazine).

c) Service quality according to the national technical standards on the quality of public postal services and public services in press distribution activities; service rates according to regulations of the Ministry of Information and Communications.

d) Time frame for implementing the service provision plan: from January 1 to December 31 of the planning year.

2. Responsibilities of enterprises managing and maintaining the public postal network:

Annually, before October 30 of the reporting year, enterprises designated by the State to maintain and manage the public postal network submit reports on the service provision plans mentioned in Clause 1 of this Article to the Ministry of Information and Communications at 18 Nguyen Du Street, Hanoi. The content of the report includes:

a) Implementation situation of the plan in the reporting year:

- Market conditions and organization of implementation of assigned plans;

- Estimated completion of service volume according to the service provision plan in the reporting year:

In which, the implementation of the plan for nine months and estimated completion for the whole year are clearly stated. For public postal services mentioned in Clause 1, Article 2, specific data reported down to each level of mail volume. For services mentioned in Article 3, specific data reported down to each type of newspaper and magazine.

- Estimated revenue from providing public postal services and public services in press distribution activities achieved;

- Compliance with state regulations on service quality and service rates;

- Violations and their handling (if any);

- Difficulties, shortcomings, and causes thereof.

b) Proposal for the service provision plan in the planning year:

- Assessment of demand for using public postal services and public services in press distribution activities through the public postal network;

- Proposal for service volume plan in the planning year: by each level of volume for each type of service mentioned in Clause 1, Article 2 of this Circular; each type of newspaper and magazine distributed as mentioned in Article 3 of this Circular;

- Organization and management plan to implement the plan after being assigned. In which, measures to ensure compliance with state regulations on the quality of public postal services and public services in press distribution activities are clearly stated;

- Projected revenue from providing services according to the planned volume and service rates prescribed by the Ministry of Information and Communications;

- Other solutions to ensure the implementation of the plan.

The service provision plan report follows the reporting form specified in Appendix 01 attached to this Circular, including a description of the registration needs of press agencies for press distribution through the public postal network in the planning year.

c) Proposals and recommendations.

3. The plan for providing public postal services and public services in press distribution activities assigned by the Ministry of Information and Communications according to Clause 1 of this Article is sent to the press agencies mentioned in Article 3; to provincial party committees, municipal party committees, provincial people's committees, and city people's committees directly under the central government, and sent to the Ministry of Finance.

4. At the end of the implementation year, no later than February 28 of the following year, enterprises designated by the State to maintain and manage the public postal network shall be responsible for reporting to the Ministry of Information and Communications the formal results of the implementation of the previous year's plan according to the reporting forms specified in Appendix 02 attached to this Circular.

Article 8. Inspection and supervision of the implementation of legal provisions in the provision of universal postal services and public-interest services in the distribution of press publications.

The Ministry of Information and Communications assigns tasks to its subordinate units to organize regular and spot inspections and supervision of the provision of universal postal services and public-interest services in the distribution of press publications, as well as compliance with state regulations on service tariffs and service quality.

Article 9. Responsibilities of press agencies using public-interest services in the distribution of press publications.

Press agencies referred to in Article 3 of this Decision shall have the responsibility to:

1. Register annual plans for the distribution of newspapers and magazines through the public postal network with the enterprise designated by the State to maintain and manage the public postal network.

2. Based on the distribution plans for newspapers and magazines registered with the enterprise designated by the State to maintain and manage the public postal network, and based on the distribution tariffs prescribed by the Ministry of Information and Communications, annually prepare financial plans for the use of distribution services for newspapers and magazines and propose sources of funding, reporting to the competent authority as prescribed.

3. Agree and sign contracts with the enterprise designated by the State to maintain and manage the public postal network regarding the provision of distribution services for newspapers and magazines as prescribed; supervise the implementation of the contract; promptly make advance payments and settle accounts with the enterprise designated by the State to maintain and manage the public postal network according to the signed service supply contract.

Article 10. Rights and responsibilities of organizations and individuals using services.

1. Use universal postal services and public-interest services in the distribution of press publications through the public postal network according to the quality and tariffs prescribed by the Ministry of Information and Communications.

2. Supervise, reflect, and lodge complaints about enterprises designated by the State to maintain and manage the public postal network providing the services mentioned in Articles 2 and 3 of this Circular to local Departments of Information and Communications and the Ministry of Information and Communications when discovering that such enterprises provide services in violation of legal provisions.

Article 11. Evaluation of the completion level of tasks in providing universal postal services and public-interest services in the press sector.

1. Basis for evaluation:

a) Reports from service-providing enterprises;

b) Reports on inspection and supervision of service quality;

c) Audit conclusion reports (if any);

d) Relevant documents from competent state authorities concerning the process and results of providing universal postal services and/or public-interest services in the distribution of press publications; regarding the handling of violations in the field of tariffs for universal postal services and public-interest services in the distribution of press publications (if any).

2. Evaluation criteria:

a) Completion level of production volume plan;

b) Completion level of service quality requirements;

3. Determination of the completion level of each criterion:

a) Completion level of production volume service plan: An enterprise is considered to have completed the production volume target when the actual performance reaches 100% of the assigned target:

- Total volume of universal postal services;

- Total volume of newspapers/magazines specified in Article 3 of this Circular.

In cases where market fluctuations and changes in demand for distribution by press agencies affect the completion of the production volume target, the enterprise must clearly explain the reasons when reporting the results of the annual service supply plan and must be reviewed and approved by the Ministry of Information and Communications.

b) Completion level of service quality requirements:

An enterprise is considered to have completed the quality target when the actual performance meets the requirements of the national technical standards for the quality of universal postal services and public-interest services in the distribution of press publications.

4. Completion level of public-interest services according to the state plan:

- Completing or exceeding the plan for production volume with product or service quality meeting the prescribed standards: classified as A;

- Completing at least 90% of the plan for production volume with product or service quality meeting the prescribed standards: classified as B;

- Completing less than 90% of the plan for production volume or product or service quality not meeting the prescribed standards: classified as C.

5. The Ministry of Information and Communications assigns subordinate units with advisory functions to inspect, supervise, and evaluate the implementation of business plans and tasks for enterprises under the Ministry's main responsibility to assess the completion level of tasks in providing universal postal services and public-interest services in the distribution of press publications through the public postal network for enterprises assigned plans by the State.

Article 12. Responsibilities of the People's Committees of Provinces and Central Cities

1. Organize and direct the Department of Information and Communications to implement state management within their jurisdiction over the provision of universal postal services and public services in the distribution of press publications at the local level, including:

a) Supervise and inspect compliance with the quality and rates of universal postal services and public services in the distribution of press publications;

b) Receive and handle complaints from service users related to the provision of universal postal services and public services in the distribution of press publications within their authority;

c) Carry out reporting tasks and coordinate management according to the requirements of the Ministry of Information and Communications and other management tasks within their authority regarding the provision of universal postal services and public services in the distribution of press publications at the local level.

2. Assign and direct specialized agencies to advise and coordinate in considering and deciding on funding to ensure that local Party newspapers can use public services in the distribution of press publications as stipulated in Article 3 of this Circular, within their authority or submit to competent authorities for approval.

Article 13. Effective Date

This Circular takes effect from October 15, 2016, and applies to the management of the provision of universal postal services and public services in the distribution of press publications starting from 2017.

Circular No. 08/2012/TT-BTTTT dated June 25, 2012, of the Ministry of Information and Communications guiding detailed implementation of Decision No. 65/2008/QD-TTg dated May 22, 2008, of the Prime Minister on the provision of universal postal services and Decision No. 72/2011/QD-TTg dated December 22, 2011, of the Prime Minister amending and supplementing certain provisions of Decision No. 65/2008/QD-TTg on the provision of universal postal services for the period 2011-2013, ceases to be effective.
