Pursuant to the Railway Law dated June 16, 2017;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Department of Science, Technology, Environment, and Construction Materials and the Director of the Vietnam Maritime Administration;

The Minister of Construction issues this Circular amending and supplementing some articles of Circulars on the field of quality control, technical safety, and environmental protection for railway transportation equipment.

Article 1. Amend and supplement some articles and appendices of Circular No. 01/2024/TT-BGTVT dated January 26, 2024 of the Minister of Transport regarding the inspection of quality, technical safety, and environmental protection for railway transportation equipment (hereinafter referred to as Circular No. 01/2024/TT-BGTVT)

1. Amend and supplement Clause 4 of Article 11 as follows:

"4. The Inspection Authority conducts inspections of equipment and vehicles at the site according to the contents of the corresponding national technical standards. Upon completion of the on-site inspection, the Inspection Authority establishes the On-Site Inspection Confirmation Report according to the model specified in Appendix VIa attached hereto.

a) In case the equipment, vehicle, and registration file for inspection comply with the corresponding national technical standards, the Inspection Authority implements the certification process according to the provisions of point a, Clause 5 of this Article;

b) In case the equipment, vehicle, or registration file for inspection do not comply with the corresponding national technical standards.

Within no more than three (03) working days from the date of completing the inspection, the Inspection Authority sends a rectification notice according to the model specified in Appendix IX attached hereto. The production facility is allowed to rectify but not more than once.

If the production facility fails to complete the rectification within ten (10) working days from the date the Inspection Authority sends the rectification notice, it will be deemed non-compliant."

2. Amend and supplement Clause 4 of Article 12 as follows:

"4. The Inspection Authority conducts inspections of equipment and vehicles at the site according to the contents of the corresponding national technical standards. Upon completion of the on-site inspection, the Inspection Authority establishes the On-Site Inspection Confirmation Report according to the model specified in Appendix VIa attached hereto.

a) In case the equipment, vehicle, and registration file for inspection comply with the corresponding national technical standards, the Inspection Authority implements the certification process according to the provisions of point a, Clause 5 of this Article;

b) In case the equipment, vehicle, or registration file for inspection do not comply with the corresponding national technical standards.

Within no more than three (03) working days from the date of completing the inspection, the Inspection Authority sends a rectification notice according to the model specified in Appendix IX attached hereto. The importing enterprise is allowed to rectify but not more than once (except for urban rail carriages).

If the importing enterprise fails to complete the rectification within ten (10) working days from the date the Inspection Authority sends the rectification notice, it will be deemed non-compliant.

For urban rail carriages, if the importing enterprise has not completed the rectification within sixty (60) days from the date the Inspection Authority sends the rectification notice without providing a written explanation of the reasons for failing to complete the rectification and a commitment to a new rectification deadline, it will be deemed non-compliant."

3. Amend Point c of Clause 2 of Article 19 as follows:

"c) Return the original Certificate and inspection seal to the Inspection Authority when exporting temporarily imported and re-exported equipment or upon notification of revocation by the Inspection Authority (except in cases of loss)."

4. Replace the phrase "Ministry of Transport" with the phrase "Ministry of Construction" in Clause 9 of Article 3.

5. Supplement Appendix VIa, the model of the On-Site Inspection Confirmation Report, after Appendix VI issued together with Circular No. 01/2024/TT-BGTVT by Appendix I issued together with this Circular.

Article 2. Amend Article 10 of Circular No. 19/2018/TT-BGTVT dated April 19, 2018, issued by the Minister of Transport, concerning the standards for railway inspection officers and requirements for material and technical facilities of organizations conducting railway inspections (hereinafter referred to as Circular No. 19/2018/TT-BGTVT) which has been amended and supplemented by Clause 7, Article 1 of Circular No. 08/2024/TT-BGTVT dated April 4, 2024, issued by the Minister of Transport, amending and supplementing certain articles of Circular No. 19/2018/TT-BGTVT Article 10. Recognition, re-recognition, reissuance, and revocation of the Decision on recognition of inspection officers

1. The Vietnam Registration Agency shall organize the evaluation and recognition of inspection officers; re-recognize inspection officers when the Decision on recognition of inspection officers expires; reissue the Decision on recognition of inspection officers when there are errors in information on the Decision, when the Decision is lost or damaged, or when the Decision is revoked.

2. The Decision on recognition and re-recognition of inspection officers shall be valid for five (5) years. Three (3) months before the Decision on recognition of inspection officers expires or when the Decision on recognition of inspection officers is still valid but is lost, damaged, or contains errors in information, the inspection officer shall have the responsibility to report to the Vietnam Registration Agency to organize an evaluation for re-recognition of inspection officers or reissue the Decision on recognition of inspection officers in accordance with Clause 1 of this Article.

3. Inspection officers shall have their Decision on recognition of inspection officers revoked in any of the following cases:

a) Violating current regulations while performing official duties at a level subject to disciplinary action from a warning or higher;

b) Engaging in corrupt behavior, harassment, or intentionally causing difficulties for customers during the performance of tasks.

4. The Director of the Vietnam Registration Agency shall be responsible for revoking the Decision on recognition of inspection officers in the cases stipulated in Clause 3 of this Article, notify the inspection officers whose Decisions on recognition of inspection officers have been revoked, and relevant agencies to coordinate implementation and publish on the Vietnam Registration Agency's website. An inspection officer whose Decision on recognition of inspection officers has been revoked may only be reissued a Decision on recognition of inspection officers a minimum of six (6) months from the date of revocation.”

Article 3. Repeal certain points of national technical standards promulgated together with Circular No. 30/2023/TT-BGTVT dated November 3, 2023, issued by the Minister of Transport

promulgating three national technical standards on railway transport equipment 1. Repeal Point 1.3.9 of National Technical Standard QCVN 15:2023/BGTVT on safety technical requirements and environmental protection for railway transport equipment during operation and use.

2. Repeal Point 1.3.16 of National Technical Standard QCVN 16:2023/BGTVT on technical requirements and inspection regulations for diesel locomotives and self-propelled special-purpose vehicles during production, assembly, and import.

3. Repeal Point 1.3.9 of National Technical Standard QCVN 18:2023/BGTVT on inspection of carriages and non-self-propelled special-purpose vehicles during production, assembly, and import.

Article 4. Responsibility for implementation

The Head of the Ministry’s Office, Heads of Departments, Director of the Vietnam Registration Agency, Heads of agencies, units, and individuals related to this Circular shall be responsible for its enforcement.

This Circular takes effect from September 1, 2025./.
