Regarding the establishment and provision of functions and tasks for
The Law Drafting Board under the Government Office
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Law on Legislative Regulatory Documents issued in 1996 and the Law Amending and Supplementing Certain Provisions of the Law on Legislative Regulatory Documents dated December 16, 2002;
Pursuant to Decree No. 18/2003/NĐ-CP dated February 20, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Office;
Pursuant to Decree No. 122/2004/NĐ-CP dated May 18, 2004 of the Government stipulating the functions, tasks, authorities, and organization of legal affairs departments of Ministries, ministerial-level agencies, government agencies, specialized agencies under provincial people's councils, and state-owned enterprises;
Pursuant to Decision No. 933/QĐ-TTg dated August 27, 2004 of the Prime Minister approving the Project to Enhance the Quality of Legal Drafting Work of the Government;
Considering the proposal of the Minister, Head of the Government Office,
DECISION:
Article 1. Establish the Law Drafting Board under the Government Office based on restructuring the Legal Affairs Department of the Government Office.
Article 2. The Law Drafting Board is an organization under the Government Office with the function of assisting the Minister and Head of the Government Office (hereinafter referred to as the Minister and Head) in advising the Government and the Prime Minister in directing the drafting of legislative projects to be submitted to the National Assembly and the Standing Committee of the National Assembly, and draft regulatory documents within the authority of the Government and the Prime Minister; organizing the review of draft regulatory documents according to the law.
Article 3. The Law Drafting Board has the task of assisting the Minister and Head in:
1. Advising and recommending to the Prime Minister to direct on the orientation and objectives of the Legislative Drafting Program; reviewing the report on the preparation of the Legislative Drafting Program for the entire term of the Government and annually to be submitted to the Government for consideration and approval, and to the Standing Committee of the National Assembly and the National Assembly for decision.
2. Advising and recommending to the Prime Minister to decide on the assignment of Ministries, ministerial-level agencies, and government agencies to take the lead in drafting legislative projects according to the Resolution of the National Assembly on the Legislative Drafting Program of the National Assembly for the entire term and annually.
3. Urging the Drafting Boards to implement the Legislative Drafting Program and the Government's Work Program (the part concerning the drafting of regulatory documents); coordinating with the Drafting Boards to draft legislative projects detailing and guiding the implementation of laws and ordinances.
4. Taking the lead and coordinating with relevant agencies to study and advise the Prime Minister to direct the Drafting Boards on viewpoints, contents, and opinions on important legislative projects related to many sectors and fields.
5. Coordinating with the Drafting Boards of legislative projects to organize the introduction of the contents of legislative projects to Ministries, sectors, social organizations, research institutes, universities, and experts to provide opinions for the absorption and completion of reports and drafts before submission to the Government.
6. Coordinating with the leading drafting agency, the Ministry of Justice, and related agencies to propose solutions to issues still having different opinions in legislative projects to be discussed and decided by the Government. Summarizing and proposing solutions to issues still having different opinions from members of the Government in the draft legislative projects for the Minister and Head to report at the Government meeting and prepare important contents in the draft legislative projects for the Prime Minister to guide the discussion and conclusion at the Government meeting.
7. Taking the lead and coordinating with units within the Government Office and Drafting Boards to review legislative projects regarding procedural requirements, documentation, legality, consistency with Party and State policies; analyzing, summarizing, and providing independent opinions on the contents of legislative projects for the Minister and Head to submit to the Government for consideration and approval, and to the National Assembly and the Standing Committee of the National Assembly.
Participating in providing opinions on legislative projects sent by other agencies, organizations, or National Assembly deputies requesting the Government's opinion before submitting them to the National Assembly and the Standing Committee of the National Assembly.
8. Coordinating with the Drafting Boards of legislative projects and related agencies to complete reports and legislative projects after the Government provides comments or approves them to report to the Prime Minister for consideration and signature to submit to the National Assembly and the Standing Committee of the National Assembly.
9. Monitoring the National Assembly and the Standing Committee of the National Assembly's comments and approval of legislative projects to report to the Prime Minister. Taking the lead or coordinating with Drafting Boards and related agencies to assist the Government in preparing reports on the absorption of comments, explanations, and amendments to draft legislative projects to be submitted to the National Assembly and the Standing Committee of the National Assembly for consideration and approval.
10. Coordinating with related agencies and Drafting Boards to absorb and complete legislative projects during the National Assembly and the Standing Committee of the National Assembly's consideration, comments, or approval of legislative projects submitted by the Government. If there are differing opinions on the legislative projects that the Government has submitted, reporting to the Prime Minister.
11. Taking the lead and coordinating with units of the Government Office in establishing the Program for Drafting Regulatory Documents within the authority of the Government and the Prime Minister (including the Program for Drafting Documents Guiding the Implementation of Laws and Ordinances Already in Force); urging the implementation of this program to ensure timely progress and quality of draft documents submitted to the Government and the Prime Minister.
12. Conducting the final legal review of draft regulatory documents of the Government and the Prime Minister before the Minister and Head signs off and submits to the Prime Minister for issuance.
13. Advising the Prime Minister to direct judicial reform work (related to the tasks of the Government when assigned by the Prime Minister).
14. Taking the lead in drafting legislative projects assigned to the Government Office; performing other tasks assigned by the Prime Minister or the Minister and Head.
Article 4. The Legislation Drafting Board shall have a Director and several Deputy Directors. The Director shall be at the level of a Deputy Minister, appointed and relieved from duty by the Prime Minister upon the proposal of the Minister and Head of the Agency.
The Deputy Directors shall be appointed and relieved from duty by the Minister and Head of the Agency.
The Minister and Head of the Agency shall decide on the organizational structure, staffing, and operational regulations of the Legislation Drafting Board.
Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
The Ministers, Heads of agencies at the ministerial level, Heads of government-affiliated agencies, the Director of the Legislation Drafting Board, and the Chairpersons of provincial and municipal People's Committees directly under the Central Government shall be responsible for implementing this Decision.
