Pursuant to the proposal of the Minister of Education and Training;
THE GOVERNMENT issues this Decree detailing conditions, procedures, and steps for educational programs, issuance of certificates and diplomas for implementing joint education programs, teaching integrated education programs for preschool education institutions, public general education institutions in Hanoi City.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree details conditions, procedures, and steps for educational programs, issuance of certificates and diplomas for implementing joint education programs, teaching integrated education programs for preschool education institutions, public general education institutions in Hanoi City.
Article 2. Applicability
1. Preschool education institutions, public general education institutions in Hanoi City, including kindergartens, primary schools, secondary schools, high schools, comprehensive schools with multiple levels, and related organizations and individuals implementing joint education with foreign educational institutions.
2. Foreign educational institutions implementing joint education with preschool education institutions, public general education institutions in Hanoi City.
Chapter II
EDUCATIONAL PROGRAMS FOR JOINT EDUCATION
Article 3. Educational programs for joint education
1. The educational program for joint education is an integrated educational program between the Vietnamese educational program and the foreign educational program (hereinafter referred to as the integrated educational program) as stipulated in Clause 2 of this Article.
2. Integrated educational program
a) The foreign educational program used in the integrated educational program must be a program that has been quality-assessed in the country of origin or recognized by the competent authority on education in the country of origin;
b) The integrated educational program must ensure the objectives of the Vietnamese educational program and meet the requirements for ensuring the quality of the foreign educational program; it shall not require students to repeat the same content of knowledge, ensuring the stability of the entire level and the continuity between levels, for the benefit of students, ensuring voluntary participation and not overloading students;
c) The integrated educational program must be approved by the competent authority in accordance with Clause 1 of Article 11 of this Decree.
Article 4. Principles for developing integrated educational programs
The integration of educational programs must be carried out in accordance with Clause 2 of Article 3 of this Decree and the following provisions:
1. Ensuring scientificity, rationality, feasibility, and suitability to the conditions of implementation in Vietnam.
2. The content and duration specified in the integrated educational program must be appropriate to the age characteristics, customs, traditions, and culture of Vietnam; there shall be no social prejudice regarding gender, ethnicity, religion, or social status; it must be consistent with the viewpoints and policies of the Communist Party of Vietnam; comply with the Constitution and laws of Vietnam; and not violate regulations on national defense and security of Vietnam.
3. The integrated educational program must have guidelines on teaching methods, forms of education, and evaluation methods, serving as a basis for school management and educational planning.
4. The integrated educational program must specify conditions for implementation, including organization and management of the program; management staff, teachers, and personnel; infrastructure and teaching equipment.
Article 5. Integration of preschool education programs
1. The integrated preschool education program is developed based on the Vietnamese preschool education program, supplemented with aspects of development or fields of development (hereinafter referred to collectively as fields of development), contents, and educational activities from foreign preschool education programs that are not included in the Vietnamese preschool education program; integrating fields of development present in both programs to ensure the objectives of the Vietnamese and foreign education programs.
2. The integration of preschool education programs is carried out according to the fields of development or groups of fields of development for children, based on taking the contents and educational activities of one of the two programs as the foundation, supplementing the contents and educational activities of the remaining program's fields of development that are not included in the other program to ensure the objectives of the fields of development of both programs.
Article 6. Integration of general education programs
1. The integrated general education program is developed based on the Vietnamese general education program, supplemented with subjects and educational activities (hereinafter referred to collectively as subjects) from foreign general education programs that are not included in the Vietnamese general education program; integrating subjects present in both programs to ensure the objectives of the Vietnamese and foreign general education programs.
2. The integration of general education programs is carried out according to subjects or groups of subjects, based on taking the program of one of the two programs as the foundation, supplementing the contents of the subjects or groups of subjects of the remaining program that are not included in the other program to ensure the objectives of the subjects or groups of subjects of both programs.
Article 7. Evaluation of educational outcomes, examinations, recognition of completion, and issuance of graduation certificates
1. The evaluation of educational outcomes, examinations, recognition of completion of educational programs, and recognition of graduation shall be conducted in accordance with the provisions of Vietnamese law and the laws of the host country providing the educational program.
2. Students who complete the integrated secondary general education program and meet all conditions as prescribed shall be issued a Vietnamese secondary general education graduation certificate and diplomas or certificates from abroad in accordance with Article 15 of this Decree.
Chapter III
CONDITIONS, PROCEDURES
APPROVAL AND IMPLEMENTATION OF EDUCATIONAL LINKAGES
Article 8. Conditions for implementing educational linkages
1. There must be an integrated education program approved by the competent authority in accordance with Clause 1, Article 11 of this Decree.
2. The class size and physical facilities must meet the requirements of the integrated education program and not affect the common teaching activities of public preschool education and general education institutions in Hanoi participating in educational linkages.
3. Teaching staff
a) Vietnamese teachers teaching the integrated education program must meet the training standards for their level as prescribed by Vietnamese law;
b) Foreign teachers teaching the integrated education program must have a bachelor's degree relevant to their teaching subject and a teaching qualification certificate or equivalent;
c) Teachers teaching the integrated education program in a foreign language must have a language proficiency level meeting the requirements of the integrated education program and not lower than Level 5 of the Vietnamese National Foreign Language Proficiency Framework or equivalent.
4. Foreign educational institutions participating in educational linkages must be legally established and operating abroad, having at least five years of operation abroad as of the date when the public preschool education and general education institutions in Hanoi submit the application for approval of educational linkage; they must not violate the laws of the host country during their operation, have direct teaching organizations, hold valid quality assurance certificates or be recognized by competent authorities regarding educational quality in foreign countries.
5. Foreign educational organizations providing preschool or general education programs participating in educational linkages must be legally established and operating abroad, having at least five years of experience in providing preschool or general education programs as of the date when the public preschool education and general education institutions in Hanoi submit the application for approval of educational linkage.
Article 9. Documents for Approval of Educational Cooperation Agreements
1. Application for approval of educational cooperation agreements with foreign countries according to Model No. 01 attached as an appendix to this Decree.
2. Agreement or cooperation contract between the cooperating parties, including detailed information about the cooperating parties, responsibilities of each party regarding specific commitments on programs, study materials and teaching, teachers, facilities, teaching equipment, examination, evaluation, diplomas, certificates, financial information, and other contents.
3. Documents proving the legal status of the cooperating parties: decisions on establishment or permission to establish organizations or educational institutions or equivalent documents.
4. Documents for approval of integrated education programs:
a) Foreign education program with content, subjects, and educational activities included in the integrated education program and the proposed integrated education program.
b) Description of the integration of the education program according to Model No. 02 attached as an appendix to this Decree, including: education plan, specifying the names of development areas or groups of development areas, educational activities (for preschool education); subjects or groups of subjects (for general education); duration; language of instruction and comparison of development areas or groups of development areas, content, and educational activities (for preschool education), subject programs or groups of subjects (for general education) of the two education programs used for integration.
c) Certificate of quality assessment of the foreign education program or approval documents of the foreign education program from authorized agencies or organizations.
5. Project to implement educational cooperation with foreign countries built by the cooperating parties according to Model No. 03 attached as an appendix to this Decree.
6. The documents for approval of educational cooperation consist of one set sent directly or through postal services to the Hanoi City Public Service Center or online on the National Public Service Portal.
In case of direct submission or through postal services, the components of the documents as stipulated in Clause 3 and Point c Clause 4 of this Article shall be submitted in copies accompanied by original documents for verification or certified copies or apostilled or notarized translations for foreign language documents. In case of online submission, the components of the documents as stipulated in Clause 3 and Point c Clause 4 of this Article shall be submitted in electronic copies from the original or certified electronic copies from original documents.
Article 10. Authority and Procedure for Approval of Educational Cooperation
1. The People's Committee of Hanoi City approves educational cooperation.
2. Procedure for approval of educational cooperation:
a) If the documents do not comply with the provisions of Article 9 of this Decree, within five working days from the date of receiving the documents, the Department of Education and Training of Hanoi City will notify in writing via direct delivery or postal service or through the National Public Service Portal or email to the cooperating parties (through public preschool education or general education institutions proposing approval of educational cooperation with Hanoi City).
b) Within fifteen working days from the date of receiving all documents as stipulated in Article 9 of this Decree, the Department of Education and Training of Hanoi City is responsible for assessing the integrated education program according to Article 11 of this Decree and assessing the educational cooperation documents; submitting to the People's Committee of Hanoi City for approval of the integrated education program and approval of educational cooperation.
c) Within five working days from the date of receiving the results of the assessment of the integrated education program and educational cooperation by the Department of Education and Training of Hanoi City, the People's Committee of Hanoi City decides to approve the integrated education program according to Model No. 04 attached as an appendix to this Decree and decides to approve the educational cooperation according to Model No. 05 attached as an appendix to this Decree.
d) The total time for approving educational cooperation is twenty working days.
đ) In case educational cooperation is not approved, the Department of Education and Training of Hanoi City will issue a reply letter clearly stating the reasons. If the documents for approval of educational cooperation only include the integrated education program approved by the People's Committee of Hanoi City, the educational cooperation parties must complete the remaining components of the documents according to Clause 1, Clause 2, Clause 3, and Clause 5 of Article 9 of this Decree based on the reply letter of the Department of Education and Training of Hanoi City; submit the documents for approval of educational cooperation according to Clause 6 of Article 9 of this Decree to obtain approval of educational cooperation. The total time for approving educational cooperation in this case is seven working days.
Article 11. Review and Approval of Integrated Education Programs
1. The People's Committee of Hanoi City shall approve integrated education programs; issue specific regulations on the review process of integrated education programs to ensure compliance with point d, clause 2, Article 10 of this Decree; guide the Review Board to implement the purposes and requirements of the review; instruct on the storage of minutes from Review Board meetings and related documents during the organization of the review process after the Review Board has completed its tasks as prescribed.
2. The Review Board:
a) The Review Board for integrated education programs shall be established by the decision of the People's Committee of Hanoi City. The Review Board is responsible for the content and quality of the review and shall propose the Department of Education and Training of Hanoi City to submit the integrated education program for approval by the People's Committee of Hanoi City;
b) The Review Board consists of: Chairperson, Vice-Chairperson, Secretary, and Members.
The number of Review Board members must be odd, at least seven people, of which at least one-third of the members have experience in teaching or developing integrated education programs or international education programs.
3. Criteria for Review Board members:
a) Possess good moral character, ethics, and ideology, ensuring independence and objectivity during the review process;
b) Hold a bachelor's degree or higher, with relevant expertise, understanding of educational science and corresponding preschool and general education programs; possess language proficiency sufficient to understand foreign education programs incorporated. Review Board members must have at least five years of experience in teaching, management, or research on integrated education programs, international education, or educational quality assessment;
c) Individuals directly involved in building integrated education programs currently under approval consideration or having interests related to organizations or individuals proposing the program shall not participate in the Review Board. In cases where conflicts of interest related to the reviewed program are discovered, the People's Committee of Hanoi City will consider, decide, and handle to ensure fairness, transparency, and impartiality during the review process.
4. Tasks of the Review Board:
Organize the review of integrated education programs according to Articles 3, 4, 5, 6, and 7 of this Decree; report the results of the review and propose the Department of Education and Training of Hanoi City to submit the integrated education program for approval by the People's Committee of Hanoi City.
Article 12. Duration of Educational Collaboration
The duration of educational collaboration shall not exceed five years from the date of approval and may be extended, each extension not exceeding five years.
Article 13. Extension or Adjustment of Educational Collaboration
1. The extension of educational collaboration must be carried out six months before the end of the collaboration period.
2. Conditions for extension:
a) All parties involved comply with the provisions in the decision approving the educational collaboration;
b) No violation of Vietnamese laws and laws of the host country.
3. Documents for requesting extension or adjustment:
a) Request for extension or adjustment of educational collaboration according to Model No. 06 attached to this Decree. Educational collaboration is adjusted when there is a change in information of at least one component of the dossier specified in clauses 2, 3, 4, and 5 of Article 9 of this Decree;
b) Summary report or evaluation of the operation of educational collaboration during the permitted period according to the reporting system on foreign cooperation and investment in the field of education;
c) Valid agreement or contract between the collaborating parties, including information as stipulated in clause 2 of Article 9 of this Decree;
d) The dossier includes one set sent directly or through postal service to the Center for Administrative Services of Hanoi City or online on the National Public Service Portal.
4. Authority and Procedure for Approval of Extension or Adjustment:
a) The People's Committee of Hanoi City has the authority to approve the extension or adjustment of educational collaboration;
b) Within three working days from the date of receiving the dossier, if the dossier does not meet the requirements stipulated in Article 3 of this Decree, the Department of Education and Training of Hanoi City shall notify in writing about the non-receipt of the dossier submitted directly or through postal service or the National Public Service Portal or email to the collaborating parties (through public preschool and general education institutions proposing the approval of educational collaboration in Hanoi City);
c) Within six working days from the date of receiving the complete dossier, the Department of Education and Training of Hanoi City shall be responsible for reviewing the dossier and submitting it to the People's Committee of Hanoi City for a decision on the approval of the extension or adjustment of educational collaboration; if the educational collaboration is not extended or adjusted, the Department of Education and Training of Hanoi City shall provide a written response and specify the reasons;
d) In cases where the adjustment of educational collaboration involves the adjustment of integrated education programs, it shall be implemented according to the provisions of Article 11 of this Decree;
đ) The total time for approving the extension of educational collaboration or the adjustment of educational collaboration is six working days.
Article 14. Suspension or Termination of Educational Linkage Activities
1. The People's Committee of Hanoi City has the authority to suspend or terminate educational linkage activities.
2. Educational linkage shall be suspended when the preschool education institution or general education institution:
a) Does not meet one of the conditions for implementing educational linkage as prescribed in Articles 3, 4, 5, 6, 7, and 8 of this Decree;
b) Organizes teaching of the integrated education program incorrectly according to the content approved by the People's Committee of Hanoi City.
3. Responsibilities of the parties involved when educational linkage activities are suspended.
a) Rectify violations leading to the suspension of educational linkage activities;
b) Ensure students enrolled in the integrated education program continue their studies under the Preschool Education Program or General Education Program issued by the Minister of Education and Training;
c) Report to the People's Committee of Hanoi City on the results of rectifying violations leading to the suspension of educational linkage to allow resumption of activities in accordance with the reporting system for foreign cooperation and investment in the field of education.
4. Educational linkage shall be terminated in the following cases:
a) Upon expiration of the term specified in the decision approving or extending or adjusting the educational linkage;
b) At the request of the parties involved;
c) Upon expiration of the suspension period but the violation leading to the suspension has not been rectified.
5. Responsibilities of the parties involved when educational linkage activities are terminated prematurely.
a) Ensure students enrolled in the integrated education program continue their studies under the Preschool Education Program or General Education Program issued by the Minister of Education and Training;
b) Refund to students any fees they have paid in the event that the educational linkage is terminated;
c) Pay teachers and workers their wages, remuneration, teaching fees, and other benefits as stipulated in the labor contracts signed or collective labor agreements in compliance with labor laws;
d) Pay any outstanding taxes (if any) and other debts.
6. Procedures for terminating educational linkage at the request of the parties involved:
a) The application for termination of educational linkage includes: Application for Termination of Educational Linkage Form No. 07 attached to this Decree;
b) The application for termination of educational linkage consists of one set submitted directly or through postal services to the Hanoi City Public Service Center or online on the National Public Service Portal;
c) Within ten working days from the date of receipt of the application as prescribed, the Department of Education and Training of Hanoi City is responsible for reviewing the application, submitting it to the People's Committee of Hanoi City for a decision to terminate the linkage and announcing it through mass media; if the educational linkage has not been terminated, the Department of Education and Training of Hanoi City will issue a response letter detailing the reasons.
Chapter IV
CERTIFICATES AND DEGREES IN EDUCATIONAL LINKAGE
Article 15. Issuance of Certificates and Degrees
1. The issuance of certificates and degrees for students under the integrated education program shall be carried out according to the principle:
a) Certificates and degrees issued by Vietnam must comply with Vietnamese law;
b) Certificates and degrees issued by foreign educational institutions (including completion certificates or diplomas) must comply with the laws of the country where the foreign educational institution is headquartered;
c) In cases where both Vietnamese and foreign certificates and degrees are issued simultaneously, the provisions of points a and b of this clause shall apply.
2. Students who complete the integrated education program at each level and meet the required conditions shall be recognized or certified as having completed the education program and issued certificates and degrees in accordance with Vietnamese law and foreign certificates and degrees as prescribed in point b of Clause 1.
3. During the implementation of educational linkage, the parties involved are responsible for evaluating and recognizing partial or full completion of the integrated education program for learners who wish to be recognized to transfer to another educational institution within the country or abroad.
4. Foreign language proficiency certificates used during educational linkage must be legally recognized in the home country and have widespread global usage value, or be recognized as equivalent to levels of the Vietnamese Six-Level Foreign Language Proficiency Framework.
5. Vietnamese educational institutions are responsible for establishing and retaining management files for certificates and degrees in educational linkage, and implementing the public disclosure of authentic certificate information in accordance with regulations.
Article 16. Recognition of Diplomas and Certificates
Diplomas and certificates issued by foreign countries in accordance with Clause 1 of Article 15 of this Decree shall be recognized for use in Vietnam without the need to go through the recognition procedures for diplomas and certificates.
Chapter V
IMPLEMENTATION
Article 17. Responsibilities of the Ministry of Education and Training
1. Direct and inspect the implementation of educational cooperation and the integrated education program at public preschool and general education institutions in Hanoi under the scope of the State management responsibility of the Ministry of Education and Training.
2. Summarize and report to the Prime Minister on the implementation of educational cooperation and the integrated education program within the content of the report on the situation of foreign cooperation and investment in the field of education as prescribed.
Article 18. Responsibilities of Ministries, Agencies Equivalent to Ministries, and Government Agencies
Within the scope of their assigned tasks and authorities, ministries, agencies equivalent to ministries, and government agencies have the responsibility to manage and coordinate with the Ministry of Education and Training and the People's Committee of Hanoi to manage the educational cooperation activities of public preschool and general education institutions in Hanoi.
Article 19. Responsibilities of the People's Committee of Hanoi
1. Issue regulations on the review of the integrated education program as stipulated in Clause 1 of Article 11 of this Decree, including detailed provisions on time, procedure, content, organization of implementation, responsibilities of the Review Council, reporting duties of Review Council members, model decision on establishing the Review Council, model minutes of meetings, and model reports on the results of the Review Council's review.
2. Approve the integrated education program and educational cooperation of public preschool and general education institutions in Hanoi as stipulated in Clause 1 of Article 11 and Clause 1 of Article 10 of this Decree; approve extension or adjustment of educational cooperation of public preschool and general education institutions in Hanoi as stipulated in point a of Clause 4 of Article 13 of this Decree; suspend or terminate educational cooperation of public preschool and general education institutions in Hanoi as stipulated in Clause 1 of Article 14 of this Decree.
3. Organize inspections, audits, supervision, evaluation of activity outcomes, handling complaints and accusations, rewarding and punishing violations related to educational cooperation of public preschool and general education institutions in Hanoi with foreign educational institutions within the scope and authority granted for management.
Article 20. Responsibilities of Educational Cooperation Parties
1. Implement decisions approving, extending, or adjusting educational cooperation of the People's Committee of Hanoi.
2. Publicly disclose all accurate and clear information about the education program and accreditation results, number of foreign teachers, number of foreign students, methods of assessing learning and discipline outcomes, and other relevant contents as required by law on the student portal and to students, parents, and on the website of the educational institution; bear responsibility for the accuracy of these pieces of information.
3. Be responsible for the legal validity of foreign diplomas and certificates awarded to students.
4. Fulfill other obligations as prescribed by law.

IMPLEMENTING PROVISIONS
Article 21. Effective Date
