The Constitution of the Socialist Republic of Vietnam
OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
Pursuant to Resolution No. 194/2025/QH15 dated May 5, 2025 of the National Assembly on amending and supplementing certain articles of the Constitution of 2013;
RESOLUTION:
Article 1
Amending and supplementing certain articles of the Constitution of the Socialist Republic of Vietnam as follows:
1. Amending and supplementing Article 9 as follows:
"Article 9
1. The Vietnam Fatherland Front is an organization of political alliance and voluntary union of political organizations, political-social organizations, social organizations, and outstanding individuals from various classes, strata, ethnic groups, religions, and overseas Vietnamese communities.
The Vietnam Fatherland Front is part of the political system of the Socialist Republic of Vietnam, led by the Communist Party of Vietnam; it is the political foundation of the people's administration; it gathers and mobilizes the strength of national solidarity; it reflects the will and aspirations and exercises the rights of the people; it represents and protects the legitimate rights and interests of the people; it implements democracy, strengthens social consensus; it monitors and provides social feedback; it reflects the opinions and petitions of the people to state agencies; it participates in building the Party and State, engages in people's diplomacy, and contributes to building and defending the country.
2. The Vietnam General Confederation of Labor, the Vietnam Farmers' Union, the Ho Chi Minh Communist Youth Union, the Vietnam Women's Union, and the Vietnam Veterans' Association are political-social organizations directly under the Vietnam Fatherland Front, established voluntarily, representing and protecting the legitimate rights and interests of their members and affiliates; they operate and function uniformly within the Vietnam Fatherland Front; together with other member organizations of the Front, they engage in democratic consultation, coordination, and unified action under the leadership of the Vietnam Fatherland Front.
3. The Vietnam Fatherland Front, its member organizations, and other social organizations operate within the framework of the Constitution and laws. The State creates conditions for the Vietnam Fatherland Front, its member organizations, and other social organizations to carry out their activities.";
2. Amend and supplement Article 10 as follows:
"Article 10
The Vietnam General Confederation of Labor is a political-social organization of the working class and workers; it represents, cares for, and protects the legitimate rights and interests of trade union members and workers; it is the sole representative of workers at the national level in labor relations and international relations regarding trade unions; it participates in state management, economic and social management; it participates in inspection, audit, and supervision of the activities of state agencies, organizations, units, and enterprises concerning issues related to the rights and obligations of workers; it propagandizes and mobilizes workers to study, improve their skills and professional qualifications, comply with the law, and build and defend the country.";
3. Amending and supplementing Clause 1 of Article 84 as follows:
"1. The President of the State, the Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, the Central Committee of the Vietnam Fatherland Front, and central agencies of political-social organizations have the right to submit draft laws to the National Assembly and draft ordinances to the Standing Committee of the National Assembly.";
4. Amending and supplementing Article 110 as follows:
"Article 110
1. Administrative units of the Socialist Republic of Vietnam are organized into two levels, comprising provinces and centrally-administered cities, and administrative units below the provincial and centrally-administered city levels as prescribed by law.
2. Special administrative-economic zones are established by the National Assembly.
3. The establishment, dissolution, merger, division, and adjustment of administrative boundaries must take into account the opinions of local residents and follow procedures and formalities prescribed by the National Assembly.";
5. Amending and supplementing Article 111 as follows:
"Article 111
1. Local authorities are organized in the administrative units of the Socialist Republic of Vietnam.
2. Local authority levels include People's Councils and People's Committees organized in administrative units suitable for rural, urban, and island areas as prescribed by the National Assembly.
3. Local authorities in special administrative-economic zones are prescribed by the National Assembly when establishing such zones.";
Article 2
This Resolution takes effect from the date it is adopted.
2. Ceasing the operation of district-level administrative units nationwide from July 1, 2025.
3. When reorganizing the organizational structure of the following agencies after implementing administrative unit restructuring and ceasing the operation of district-level administrative units in 2025, there shall be no election of positions of Chairperson, Deputy Chairperson of the People's Council, Heads of Committees of the People's Council, Chairperson, Deputy Chairperson, and Members of the People's Committee in newly formed administrative units; no election of Deputies and Deputy Leaders of the National Assembly Delegation of provinces and centrally-administered cities newly formed after restructuring. Based on notifications from competent party bodies managing cadres, the Standing Committee of the National Assembly shall appoint Chairpersons, Deputy Chairpersons of the People's Council, Heads of Committees of the People's Council, Deputies and Deputy Leaders of the National Assembly Delegation in newly formed provinces and centrally-administered cities; The Prime Minister shall appoint Chairpersons and Deputy Chairpersons of the People's Committee in newly formed provinces and centrally-administered cities; the Standing Committee of the People's Council at the provincial and centrally-administered city levels shall appoint Members of the People's Committee at the same level and appoint Chairpersons, Deputy Chairpersons of the People's Council, Heads of Committees of the People's Council, Chairpersons, and Deputy Chairpersons of the People's Committee in newly formed lower-level administrative units; the Standing Committee of the People's Council in lower-level administrative units newly formed after restructuring shall appoint Members of the People's Committee at the same level. In exceptional cases, allowing the appointment of personnel who are not representatives of the People's Council to hold positions of Chairperson, Deputy Chairperson, and Heads of Committees of the People's Council in newly formed administrative units or serving as representatives of the People's Council to form a temporary People's Council in the wards that are implementing the urban governance model without organizing a People's Council.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, Session 9 of the 15th term, on June 16, 2025.
