DECREE
Detailed regulations on some provisions of the Construction Law
concerning quality management, construction works, and maintenance of construction projects
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Construction Law No. 135/2025/QH15;
Pursuant to the Labor Safety and Health Law No. 84/2015/QH13;
Pursuant to the Product Quality Law No. 05/2007/QH12 amended and supplemented by some articles according to Law No. 78/2025/QH15;
BASED ON THE INVESTMENT LAW NO. 143/2025/QH15;
Pursuant to the Public Investment Law No. 58/2024/QH15 amended and supplemented by some articles according to Law No. 90/2025/QH15;
Pursuant to the Public-Private Partnership Investment Law No. 64/2020/QH14 amended and supplemented by some articles according to Law No. 03/2022/QH15, Law No. 28/2023/QH15, Law No. 35/2024/QH15, Law No. 57/2024/QH15, and Law No. 90/2025/QH15;
At the proposal of the Minister of Construction;
The Government promulgates this Decree detailing some provisions of the Construction Law concerning quality management, construction works, and maintenance of construction projects.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
1. This Decree details some provisions of the Construction Law No. 135/2025/QH15 regarding:
a) Clause 1 of Article 6 on types of construction projects;
b) Clause 1, Clause 2 of Article 42 on completion documents for construction projects and documents serving management and use of construction projects;
c) Clause 1 of Article 48 on commencement of construction projects;
d) Article 49 on requirements for construction sites;
đ) Article 51 on safety during construction of construction projects;
e) Article 54 on demolition of construction projects;
g) Article 55 on incidents of construction projects;
h) Clause 6 of Article 57 on quality management and acceptance of construction projects; large-scale and technically complex projects; management of individual residential construction projects;
i) Article 58 on handover of construction projects; handover of construction projects in urban development investment projects;
k) Article 64 on warranty of construction projects;
l) Article 65 on maintenance of construction projects;
m) Article 67 on cessation of exploitation and use of construction projects.
2. This Decree applies to domestic agencies, organizations, individuals, and foreign organizations and individuals related to quality management of construction projects, construction of construction projects, and maintenance of construction projects within the territory of Vietnam.
Article 2. Interpretation of Terms
In this Decree, the following terms are understood as follows:
1. Quality management of construction projects is the management activity of subjects participating in construction activities as prescribed by this Decree and other relevant laws during the preparation, implementation of investment in construction projects, and operation and use of projects to ensure the quality and safety of the projects.
2. Construction project construction management is the management activity of subjects participating in construction activities as prescribed by this Decree and other relevant laws to ensure that construction activities comply with safety, quality, schedule, efficiency, design requirements, and set goals.
3. As-built drawings are drawings of completed construction projects showing the actual position, dimensions, materials, and equipment used.
4. Completion documents of construction projects are a collection of documents and materials related to the investment and construction process of the project that need to be retained when the project is put into operation and use.
5. Specialized construction testing is an activity of measurement to determine the characteristics of construction soil, construction materials, construction environment, construction products, parts of projects, or construction projects according to a specific procedure.
6. Project monitoring is an activity of tracking, measuring, and recording changes in geometry, deformation, displacement, and other technical parameters of projects and surrounding environments over time.
7. Project surveying is an activity of measurement to determine the location, shape, and size of terrain and construction projects serving construction, quality management, warranty, maintenance, operation, exploitation, and resolution of construction project incidents.
8. Construction inspection is an activity of checking and evaluating the quality or cause of damage and other technical parameters of materials, components, construction products, parts of projects, or construction projects through investigation, monitoring, testing combined with calculation and analysis.
9. Construction appraisal is an activity of construction inspection and evaluation of compliance with legal provisions on investment and construction, organized and implemented by competent state management agencies as prescribed by this Decree.
10. Maintenance of construction projects is a collection of tasks aimed at ensuring and maintaining normal operation and safety of projects according to design specifications during exploitation and use. The content of maintenance of construction projects may include one, several, or all of the following tasks: inspection, monitoring, quality inspection, safety assessment of projects, maintenance, and repair of projects; adjustment, supplementation, replacement of project components and equipment to ensure safe exploitation and use of projects but does not include activities that change the function or scale of the project.
11. Maintenance procedures for construction projects are documents specifying the sequence, content, and guidance for implementing maintenance tasks of construction projects.
12. Design service life of projects is the period during which projects are expected to be used, ensuring safety and functional requirements. The design service life of projects is specified in relevant technical standards, applicable standards, and project design tasks.
13. Actual service life of projects is the period during which projects are actually used, ensuring safety and functional requirements.
14. Warranty of construction projects is the contractor's commitment to responsibility for rectifying and repairing defects that may occur during the exploitation and use of construction projects within a certain period.
15. Owner of the project is an individual or organization having ownership rights to the project as stipulated by law.
16. Manager and user of the project is the owner of the project directly managing and using the project or an organization or individual authorized by the owner to manage and use the project when the owner does not directly manage and use the project or is the manager and user of the project as prescribed by relevant laws.
17. Safety in construction of works is a solution to prevent and mitigate the impact of dangerous factors and harmful elements with the aim of ensuring that no injury or death occurs, no health deterioration happens to people, and preventing accidents that cause loss of labor safety according to the laws on safety and hygiene at work, and other safety assurance measures during the construction process of works as stipulated in Clause 3, Article 49, Clause 2 and Clause 3, Article 50, and Article 51 of the Construction Law No. 135/2025/QH15.
18. Measures to ensure safety in construction of works are a set of solutions prescribed in Appendix III of this Decree aimed at ensuring labor safety and hygiene; protecting the environment; fire prevention and firefighting; ensuring safety for construction works, assets, equipment, means, and adjacent areas during the construction process of works, warranty, and maintenance of construction works, and relocation of works.
19. Management of safety in construction of works is the management activity of subjects participating in construction works in accordance with this Decree and related laws to ensure safety in the construction of works.
Article 3. Classification of construction works
1. Based on structural characteristics and functional purposes, construction works are classified as follows:
a) According to structural characteristics, works are divided into types including: houses, house-like structures; bridges, roads, tunnels, ports, wharves; poles, towers, tanks, silos, retaining walls, dikes, dams, revetments; pipeline-like structures; other structures;
b) According to functional purposes, works are divided into types including: works for civilian use; works for industrial production; works providing technical infrastructure facilities and utilities; works serving transportation; works serving agriculture and the environment; works serving national defense and security, detailed in Appendix I of this Decree.
The functional purpose of a work may be created by an independent work, a combination of works, or a technological chain consisting of several interrelated components forming a common function. An investment project may include one or more independent works or a main combination of works or a main technological chain. A work within a combination of works or a technological chain is a component of the combination of works or the technological chain.
2. Types of works serving national defense and security and the classification levels of works specified in Point a, Clause 2, Article 6 of the Construction Law No. 135/2025/QH15 in managing construction activities for works serving national defense and security shall be implemented according to the regulations of the Minister of National Defense and the Minister of Public Security.
Article 4. General principles in managing construction of construction works
1. Construction works must be managed in terms of quality, safety in construction, acceptance, handover for operation and use, warranty, and maintenance according to the Construction Law No. 135/2025/QH15, this Decree, and related laws from the start of construction until operation and use of the works to ensure the quality of the works, safety for people, assets, equipment, works, and adjacent works.
2. The investor is responsible for organizing the management of construction works in accordance with the form of investment, project management form, tendering form, scale, and investment capital during the implementation of construction investment works; organizing the management of construction works, supervising the construction works, accepting construction tasks, parts, components, and stages of construction works; organizing the handover for operation and use of works according to this Decree and related laws.
3. Contractors participating in construction activities bear direct and comprehensive responsibility for the quality and safety in construction of works for the tasks they undertake under the law, before the investor, and before the main contractor in the case of being a subcontractor. The main contractor is responsible to the investor for the tasks undertaken by the subcontractor. The investor's acceptance does not replace or reduce the responsibility of contractors participating in construction works for the tasks they undertake. For works carried out before the law, before the project owner, and before the main contractor in the case of being a sub-contractor, the main contractor shall be responsible to the project owner for the works performed by the sub-contractor. The acceptance by the project owner does not replace nor reduce the responsibility of the contractors participating in the construction work for the part of the work they have undertaken.
4. Specialized agencies in construction guide and inspect the management of quality and the management of safety in construction of works by organizations and individuals participating in construction works; inspect the acceptance of construction works; handle or recommend handling violations concerning quality and safety in construction of works according to relevant laws.
5. Management of construction of individual residential buildings is carried out in accordance with Article 10 of this Decree. Encouragement is given to owners of residential buildings to apply the provisions of this Decree to organize supervision, construction, and acceptance of individual residential buildings.
Article 5. Allocation of responsibilities among subjects in construction project management
1. In cases where the investor establishes a project management board under its direct supervision:
a) The investor shall assign tasks to the project management board to perform one or more tasks within the investor's responsibility for construction project management as stipulated in this Decree and such assignment must be documented in writing. The investor must direct, inspect, and bear responsibility for the tasks assigned to the project management board.
b) The project management board shall be responsible before the law and the investor for performing the tasks assigned as specified in point a of this clause.
2. In cases where the investor hires a consulting contractor for project management and a supervising contractor for construction work:
a) The investor has the right to assign these contractors to perform one or more tasks within the investor's responsibility for construction project management through a construction contract. The investor is responsible for monitoring the implementation of the construction contract, handling issues related to contractors involved in the construction project and with local authorities during the project implementation.
b) The consulting contractor for project management and the supervising contractor for construction work shall be responsible before the law and the investor for the tasks assigned according to the provisions of the construction contract and relevant laws.
3. For public-private partnership (PPP) projects:
a) The PPP project enterprise shall undertake the investor's responsibility for construction project management as stipulated in this Decree;
b) The agency signing the contract in accordance with the law on public-private partnerships shall be responsible for organizing the implementation of the provisions of Clause 6, Article 20 of this Decree. In cases where the competent authority delegates the signing of the contract to subordinate agencies or units, the competent authority must direct, inspect, and bear responsibility for the contents of the work carried out by the contracting agency; the contracting agency shall be responsible before the competent authority and the law for the implementation of the delegated contents.
4. In cases where the design-build-supply (EPC) contract form or the turnkey contract form is applied to the entire construction project, the allocation of responsibilities between the investor and the EPC contractor, the turnkey contractor (hereinafter referred to as the EPC contractor, turnkey contractor) is defined as follows:
a) The investor and the EPC contractor, turnkey contractor may agree and specify in the EPC contract or turnkey contract about assigning the EPC contractor, turnkey contractor to perform one or more or all aspects of construction site supervision within the investor's responsibility as stipulated in points b, c, d, đ, e, g, h, i, and l of Clause 1, Article 20 of this Decree;
b) The EPC contractor, turnkey contractor shall be responsible for organizing quality and safety management in construction, bearing responsibility for the portion of work performed by themselves and subcontractors (if any); fulfilling other responsibilities as stipulated in the contract with the investor.
5. In cases where the contract form prescribed in Clause 4 of this Article is applied, the investor shall be responsible for: inspecting and urging the implementation of construction project management contents agreed upon in the construction contract; organizing the acceptance of completed project components and construction projects, organizing the handover and operation of the project.
6. In cases where the joint venture form is applied, each contractor in the joint venture must establish a construction management system, bear responsibility for quality and safety in construction work for the work they undertake as defined in the joint venture agreement document; this document must clearly define the responsibilities of the lead member of the joint venture, common responsibilities, individual responsibilities of each member of the joint venture, and clearly define the scope and volume of work undertaken by each member of the joint venture; these contents must be stipulated in the construction contract with the investor.
7. The rights, obligations, and allocation of responsibilities of the subjects prescribed in this Article must be reflected in the construction contract and in accordance with the provisions of the law.
Article 6. Specialized construction experiments
1. Specialized construction experiments must be carried out by organizations and individuals with the capacity as prescribed by law.
2. Organizations and individuals conducting specialized construction experiment work, monitoring, and surveying construction projects shall have the responsibility to provide data truthfully and objectively and bear responsibility for the accuracy of the data they provide.
3. The construction contractor shall be responsible for organizing the implementation of specialized construction experiment activities during the construction process in accordance with the provisions of the construction contract, the approved experimental organization plan, and relevant technical standards and regulations.
4. Sampling and conducting experiments during the construction process must be supervised during implementation according to the approved experimental organization plan.
5. The establishment and adjustment of the experimental organization plan shall be in accordance with the regulations of the Minister of Construction.
Article 7. Monitoring construction projects during the construction process
1. Monitoring construction projects during the construction process shall be carried out in the following cases:
a) As stipulated in technical guidelines, approved construction design documents, accepted construction method designs, and construction contracts;
b) When the project shows signs of subsidence, sliding, settlement, tilting, cracking, or other abnormal conditions that require monitoring to assess and determine causes for measures to address or prevent accidents during the construction process.
2. The construction contractor shall be responsible for organizing the implementation of monitoring work, compiling monitoring results for each cycle according to the approved monitoring outline.
3. In cases where the project includes multiple contracts or is implemented by multiple construction contractors, the project owner and construction contractors may agree on one construction contractor to be responsible for implementing overall monitoring work or select an independent monitoring contractor to perform the monitoring work.
4. The preparation of the monitoring outline and the handling of monitoring results shall be in accordance with the regulations of the Minister of Construction.
Article 8. Control experiments, construction inspection, and structural load testing of construction projects
1. Control experiments during the construction process shall be carried out in the following cases:
a) Specified in technical guidelines, approved construction design documents, and construction contracts;
b) When construction materials, products, or equipment installed in the project show signs of not meeting quality requirements as specified in the design documents.
2. Construction inspection and structural load testing shall be carried out in the following cases:
a) Specified in technical guidelines, approved construction design documents, and construction contracts;
b) When parts of the project that have been constructed show signs of not meeting quality requirements as specified in the design or lack sufficient grounds for quality assessment and acceptance or an accident occurs;
c) At the request of the authority signing the PPP project contract;
d) To serve the renovation and upgrading of construction projects;
đ) To serve maintenance work on construction projects as provided for in Clause 5, Article 36 of this Decree.
3. Costs for control experiments, construction inspection, and structural load testing shall be determined by preparing a budget in accordance with the Government's regulations on construction investment cost management and other relevant laws, consistent with the content and volume of work stipulated in the contract signed between the parties or the approved outline.
4. During the construction process, the construction design contractor, construction contractor, construction product supply and production contractor, and other related contractors must bear the costs of construction inspection if the inspection results related to their work prove their fault. For other cases, the costs of construction inspection shall be included in the total construction investment ceiling.
5. The owner or manager/user of the project shall be responsible for paying the costs of construction inspection during operation and use. If the inspection results prove the fault of any related organization or individual, those organizations or individuals shall bear the corresponding inspection costs caused by their own actions.
6. The content, procedures, outline, and report of construction inspection results shall be in accordance with the regulations of the Minister of Construction.
Article 9. Construction Inspection
1. Contents of construction inspection:
a) Inspecting the quality of construction surveying, design, building materials, building components, construction products, parts of works, and construction works;
b) Inspecting the causes of accidents in construction works as prescribed in Chapter IV of this Decree;
c) Other inspection contents.
2. Authorities responsible for organizing construction inspections:
a) Provincial People's Committees organize construction inspections for works within their jurisdiction, except in cases stipulated in points b and c of this clause;
b) Sectoral ministries managing specialized construction works organize construction inspections for construction works when assigned by the Prime Minister;
c) Authority to organize the main inspection of the causes of accidents as prescribed in Clause 1, Article 47 of this Decree;
d) Authority to organize construction inspections for defense and security works shall be carried out in accordance with regulations issued by the Minister of National Defense and the Minister of Public Security.
3. Costs of construction inspection include some or all of the following costs:
a) Costs for conducting construction inspection by the inspection agency including travel expenses and other costs serving the inspection work;
b) Costs for hiring experts to participate in construction inspection including travel expenses, accommodation fees at the place of work, and expert fees;
c) Costs for hiring organizations to conduct testing services for construction inspection shall be determined by preparing a budget in accordance with the Government's regulations on construction investment cost management and relevant laws, consistent with the volume of work in the testing plan;
d) Necessary costs to serve construction inspection.
The project investor, owner, or manager and user of the work shall be responsible for paying the costs of organizing construction inspection. In case the results of construction inspection prove that the fault belongs to the responsibility of any related organization or individual, such organization or individual must bear the corresponding construction inspection costs caused by their own fault and organize the handling and rectification.
5. Procedures and notification of construction inspection conclusions shall be in accordance with the provisions of the Minister of Construction.

Article 10. Management of Individual Residential Building Construction
1. The management of individual residential building construction shall be implemented based on ensuring safety for people, property, equipment, buildings, adjacent buildings, and surrounding environment. Design and construction of individual residential buildings must comply with technical standards and regulations and other relevant regulations issued by competent state agencies. For individual residential buildings belonging to construction projects or individual residences of organizations, the construction of individual residential buildings must comply with the Government's regulations on construction activities.
2. Design of individual residential building construction:
a) For individual residential buildings meeting the following criteria simultaneously: less than three floors, no basement, total floor area less than 250 m², height less than 12 meters, the owner may organize the design themselves;2b) For individual residential buildings under seven floors or with one basement, excluding the cases stipulated in point a of this clause, the design must be carried out by organizations or individuals with expertise and experience as prescribed by law;
c) For individual residential buildings seven floors or higher or with two basements or more, the design must be carried out by organizations or individuals with expertise and experience as prescribed by law; design documents must comply with fire prevention and firefighting technical standards and regulations.
c) For individual residential buildings with seven floors or more, or having two basement floors or more, the design must be carried out by organizations or individuals with expertise and experience as prescribed by law; the design documents must comply with the technical standards and regulations on fire prevention and firefighting.
3. Management of individual residential building construction:
a) The owner has the responsibility to install construction signs at the entrance gate of the construction site; the location and size of the sign must ensure easy observation and clearly display the name, contact address, and phone number of the owner, and the contents as prescribed in points a, b, and d of Clause 1, Article 13 of this Decree;
b) The owner organizes construction, supervises construction, and is responsible for safety during construction of the building and adjacent buildings and the environment during the construction process. It is encouraged for the owner to organize construction supervision, establish and retain individual residential building records in accordance with this Decree, except in cases stipulated in point c of this clause;
c) The owner must organize construction and supervise construction of individual residential buildings in accordance with this Decree for buildings specified in point c of Clause 2 of this Article.
4. Contents of construction supervision of individual residential buildings:
a) Construction methods, safety measures for the house and adjacent buildings;
b) Quality of building materials, components, and equipment before being put into construction;
c) Scaffolding systems, temporary support structures, and machinery and equipment for construction;
d) Safety measures during construction.
5. In case the owner changes the function of part or all of the individual residential building along with repair and renovation of the building, the design and construction of the building must comply with applicable technical standards and be consistent with the new function of the building.
6. In addition to the provisions of this Article, the construction of individual residential buildings and the change of function of part or all of the individual residential buildings must comply with laws on fire prevention and firefighting, environmental protection, and other relevant laws.
Article 11. Application of Information Technology in Construction Management
1. The project owner and contractors have the right to agree on implementing the following contents:
a) Selecting information technology solutions, building information modeling (BIM) models to manage construction works, quality management, acceptance and handover of construction projects;
b) Preparing documents within the scope of completion files for construction projects as stipulated in Appendix VII of this Decree in accordance with the laws on electronic transactions and bearing responsibility for the content, accuracy, truthfulness, compliance with regulations on confidentiality and secure storage of electronic files for the tasks they undertake.
2. When requested by competent state authorities, electronic file formats specified in Clause 1 of this Article must be extracted, printed on paper, and confirmed by the project owner.
Chapter II
CONSTRUCTION MANAGEMENT, HANDOVER OF PROJECTS AND CONSTRUCTION PROJECTS CONSTRUCTION PROJECTS, HANDOVER OF CONSTRUCTION PROJECTS IN URBAN DEVELOPMENT INVESTMENT PROJECTS
Section 1
CONSTRUCTION MANAGEMENT OF CONSTRUCTION PROJECTS
Article 12. Conditions for Commencing Construction of Projects
1. Commencing construction of projects must ensure the conditions prescribed in Clause 1 of Article 48 of the Construction Law No. 135/2025/QH15, except for projects prescribed in Clauses 2 and 3 of Article 48 of the Construction Law No. 135/2025/QH15.
2. Before commencing construction of projects, the project owners specified in Clause 1 of this Article must send a notice of commencement of construction directly, through postal services, or online to the local state management agency on construction in accordance with the model of notice of commencement prescribed in Appendix V of this Decree. After receiving the notice, the local state management agency on construction has the responsibility to update necessary data from the notice of commencement into the national database on construction activities.
3. Handing over the entire or part of the construction site before commencing construction of projects shall be carried out according to the agreement between the project owner and the construction contractor in the construction contract, except for individual residential buildings.
Article 13. Requirements for Construction Sites
1. Signage for construction projects must be installed at the entrance and exit of construction sites; the location and size of signage must ensure easy observation and clearly display the following contents:
a) Name and scale of the project;
b) Start date and completion date;
c) Name, address, and phone number of the project owner;
d) Rendered view of the project. In case of linear construction projects, typical cross-sectional views of project components or tenders should be displayed corresponding to the location of the construction site.
2. Contents of construction site management include:
a) Construction sites under construction must be fenced to prevent unauthorized entry. In cases where construction sites are located in remote areas, warning signs prohibiting entry may be used but personnel must be assigned for security, warning, and control of entry and exit;
b) Arrangement of construction sites within the construction area of the project must be consistent with approved construction methods and specific conditions of the construction site;
c) Materials and equipment awaiting installation must be neatly arranged within the construction site area according to approved construction methods;
d) Within the construction site area, there must be signage indicating the overall layout plan of the construction site, safety, fire prevention, and other necessary signage.
3. The project owner shall decide on installing surveillance equipment based on the specific circumstances of the project to serve construction site management and ensure safety for people, equipment, and property.
Article 14. Management of construction materials, products, components, and equipment used for construction projects
1. Responsibilities of contractors supplying construction products and building materials that are goods on the market:
a) Organize quality testing and provide to the tenderer (buyer of construction products and building materials) certificates, certifications, relevant information, and documents concerning construction products and building materials according to the construction contract and other related laws;
b) Inspect the quality, quantity, and type of construction products and building materials according to the contract requirements before transferring them to the tenderer;
c) Inform the tenderer about transportation, storage, and preservation requirements for construction products and building materials;
d) Repair or replace construction products that do not meet quality requirements according to the product warranty commitment and the construction contract provisions.
2. Responsibilities of contractors manufacturing and producing construction materials, components, and equipment according to specific design requirements:
a) Present to the tenderer (buyer) production processes, testing, and trial procedures according to design requirements and quality control processes during production and manufacturing of construction materials, components, and equipment;
b) Organize manufacturing, production, and testing according to the approved process by the tenderer, meeting design requirements; self-monitor quality and cooperate with the tenderer in quality control during manufacturing, production, transportation, and storage at the project site;
c) Organize inspection and acceptance before transferring to the tenderer;
d) Transport and transfer to the tenderer according to the contract provisions;
đ) Provide to the tenderer certificates, certifications, information, and documents according to the contract and related laws;
3. Contractors specified in Clause 1 and Clause 2 of this Article are responsible for the quality of construction materials, products, components, and equipment they supply, produce, and manufacture compared to the tenderer's requirements; provide documents as stipulated in point a of Clause 1 and point đ of Clause 2 of this Article along with operating procedures, exploitation procedures, maintenance procedures (if applicable) and bear responsibility for the accuracy and truthfulness of the provided documents to the tenderer. The tenderer's acceptance does not reduce the above responsibilities of these contractors.
4. Responsibilities of the tenderer:
a) Specify quantities, types, technical requirements for materials, products, components, and equipment in contracts with suppliers, manufacturers, and producers consistent with design requirements and applicable technical guidelines for the project;
b) Inspect quantities, types, and technical requirements for materials, products, components, and equipment according to contract provisions; require suppliers, manufacturers, and producers to fulfill the responsibilities stipulated in Clause 1 and Clause 2 of this Article before accepting and using materials, products, components, and equipment for the project;
c) Implement quality control during production and manufacturing according to the agreed process with the contractor;
d) Establish quality management files for materials, products, components, and equipment used for the project as stipulated in Clause 7 of this Article.
5. Requirements regarding types and origin of imported construction materials, products, components, and equipment used for construction projects (if applicable) must be reflected in the contract between the project owner and the construction contractor (or supplier, manufacturer, producer), including the following main information: name, type, construction project usage, key technical parameters consistent with design requirements, manufacturer, place of manufacture, and proof of origin documents.
6. Construction materials, products, components, and equipment must be inspected by the construction project supervisor of the project owner before being put into use. Inspection results must be recorded in a record. The content of the inspection record for construction materials, products, components, and equipment includes the following main items: name, type, quantity, serial number (if applicable) of each batch of inspected materials, products, components, and equipment; time, location, signatories, inspection conclusions; other requirements (if applicable); signatures, full names, positions of the signatories; attached appendices (if applicable).
7. Quality management files for construction materials, products, components, and equipment used for the project include:
a) Quality certification from the manufacturer according to the contract and laws on product quality;
b) Proof of origin documents must comply with the contract between the supplier and buyer and match the list of materials and supplies approved and approved by the project owner for imported cases according to laws on product origin;
c) Compliance certification according to technical standards and related laws for materials, products, components, and equipment subject to compliance certification and public announcement according to laws on product quality;
d) Information and documents related to construction materials, products, components, and equipment used for the project according to the construction contract;
đ) Testing, trial, and inspection results of construction materials, products, components, and equipment used for the project according to technical standards, applicable standards, and design requirements carried out during construction;
e) Inspection records for construction materials, products, components, and equipment used for the project as stipulated in Clause 6 of this Article;

8. Changing types and origins of construction materials, products, components, and equipment used for construction projects:
a) Materials, products, components, and equipment that are replaced must meet design requirements, comply with applicable technical standards and regulations, and be approved by the project owner in accordance with the provisions of the contract.
b) In cases where changes lead to adjustments in the project, they shall be implemented in accordance with the Government's regulations on construction activity management.
Article 15. Responsibilities of Construction Contractors
1. Accepting, managing the construction site, preserving positioning markers and boundary markers of the project, and managing the construction site in accordance with regulations.
2. Establishing and notifying the project owner and relevant subjects about the contractor’s construction management system. b) Measures for inspecting and controlling the quality of materials, products, components, and equipment used in the project; construction methods, specifying detailed measures to ensure safety during construction. In cases stipulated in Clause 3 of Article 50 and Clause 3 of Article 51 of the Construction Law No. 135/2025/QH15, the construction contractor may prepare separate safety measures during construction and submit them to the project owner for approval before organizing construction.
c) Progress of construction work.

Article 16. Responsibilities of the Project Owner

4. Check and approve the overall and detailed construction progress schedules for project components and construction works prepared by the contractor, ensuring they align with the approved construction schedule and the approved safety measures during construction work. Adjust the construction schedule when necessary in accordance with the provisions of the construction contract.
5. Verify and confirm the volume of work accepted according to regulations and any additional volume of work as stipulated in the construction contract (if applicable).

7. Fulfill the responsibilities of the tendering party as prescribed in Article 14 of this Decree for materials, equipment, products, and construction components provided by themselves for use in the project.
8. Fulfill the responsibilities stipulated in Clause 4 of Article 51 of the Construction Law No. 135/2025/QH15 by sending to the specialized construction authority as follows:
a) Industrial park management boards, export processing zone management boards, high-tech area management boards, and economic zones for construction projects built within their jurisdiction;
b) Specialized construction authorities under the People's Committee of the commune where the construction project is located, except in cases specified in point a of this clause.
9. Organize comparative testing and quality inspection of construction components, project components, and construction works as prescribed in Article 8 of this Decree.
10. Organize acceptance procedures as prescribed in Clause 6 of Article 14, Articles 22, 23, and 24 of this Decree.
11. Organize the preparation of completion documents for construction projects and documents for managing and using construction works as prescribed in Article 28 of this Decree.
12. 15. Send reports on the completion of construction work for project components and construction works to the competent authority for inspection of the acceptance process of construction works as prescribed in Clauses 4 and 5 of Article 27 of this Decree.
16. Be responsible for organizing construction management, quality control, and acceptance of technological equipment according to the approved technological design as prescribed in this Decree and related laws.
17. During the construction process, update information about the project and participating contractors into the national database on construction activities as prescribed.
18. For projects requiring monitoring for maintenance purposes during operation and use, the project owner is responsible for instructing related contractors to specify the contents that need to be implemented during construction to ensure the accuracy, synchronization, and continuity of monitoring work.
19. The investor has the right to perform or engage a consulting organization to perform one, several, or all of the contents prescribed from Clause 3 to Clause 8 of this Article; it is responsible for inspecting the performance of the contractor according to the requirements of the construction contract and relevant laws.
20. The person responsible for managing safety during construction work of the investor shall be responsible for:
a) Organizing supervision of the implementation of regulations on safety during construction work by contractors;
b) Organizing coordination among contractors to manage safety and resolve issues arising regarding safety during construction work;
c) Temporarily suspending or stopping construction when signs of violation of regulations on safety during construction work are detected.
Article 17. Responsibilities of workers in ensuring safety and hygiene at the workplace
1. Adhere to internal rules and safe working procedures at the construction site.
2. Report to the authorized person when discovering risks that may cause loss of safety during construction work.
3. Refuse to carry out assigned tasks if they are not safe and hygienic or if personal protective equipment is not provided as required.
4. Only accept tasks with strict safety and hygiene requirements after receiving training and obtaining a safety and hygiene certificate.
5. Participate in rescue and remediation of labor accidents and incidents causing loss of safety during construction work.
6. Implement other contents as prescribed by laws on safety and hygiene at the workplace.
Article 18. Management of Construction Work Volume
1. Construction work must be carried out according to approved design documents and the construction contract between the investor and the construction contractor.
2. The volume of construction work is calculated and confirmed between the investor's construction work supervisor and the construction contractor based on time or construction phase and is compared with the approved design volume to serve as the basis for acceptance and payment under the contract.
3. When there is additional volume outside the approved design, construction budget, or construction contract, the investor, the investor's construction work supervisor, the design consultant, and the construction contractor must consider and handle it. Additional volume approved by the investor or the investment decision-maker serves as the basis for payment and settlement of the construction contract.

Article 19. Management of Construction Work Schedule
1. Before commencing construction, the contractor must establish a construction schedule consistent with the contract execution period and the overall project schedule, which must be approved.
2. For large-scale construction projects with extended construction periods, the construction schedule is established for each phase monthly, quarterly, or annually.
3. The investor, the investor's construction work supervision department, the construction contractor, and related parties are responsible for monitoring and supervising the construction work schedule and adjusting the schedule if construction phases are delayed, but without affecting the overall project schedule.
4. In cases where the construction work schedule is found to be delayed, necessitating adjustment of the construction investment project, the provisions of the Government on construction activity management shall be followed.
Article 20. Supervision of Construction Works
1. Construction works must be supervised throughout the construction process in accordance with Clause 1 of Article 56 of the Construction Law No. 135/2025/QH15. The contents of construction work supervision include:
a) Checking the suitability of the contractor's construction capacity compared to the bidding documents and construction contracts, including: human resources, construction equipment, quality management systems of the construction contractor;
b) Reviewing and approving the contents stipulated in Clause 3 of Article 15 of this Decree submitted by the contractor and requiring the contractor to amend these contents during the construction process to align with reality and the provisions of the construction contract. If necessary, the project owner may agree in the construction contract with the contractors on entrusting the construction supervision unit to establish and require the construction contractor to implement the contents stipulated in Points a, b, and d of Clause 3 of Article 15 of this Decree;
c) Inspecting the organization of construction work by the construction contractor against approved construction methods and safety measures during construction;
d) Inspecting and approving materials, components, construction products, and equipment used for the construction work in accordance with Clause 5 of Article 14 of this Decree;
đ) Inspecting and urging the construction contractor and other contractors to perform construction work at the site according to the design requirements and the construction schedule of the project;
e) Supervising the implementation of regulations on construction safety management; supervising safety measures for adjacent projects and construction monitoring activities;
g) Requesting the project owner to organize design adjustments when discovering errors or unreasonable aspects in the design;
h) Requiring the contractor to temporarily halt construction if it is deemed that the construction quality does not meet technical requirements, construction methods do not ensure safety, or there are violations of construction safety management regulations causing or posing a risk of labor accidents or occupational safety incidents. The supervisor shall take the lead and coordinate with relevant parties to resolve issues arising during the construction process and handle and rectify incidents in accordance with this Decree;
i) Inspecting specialized construction laboratories, sampling, sample storage, and testing procedures appropriate to the construction phase of the project. Evaluating test results of materials, components, construction products, monitoring results during construction, and other related documents serving acceptance purposes;
k) Organizing comparative tests and quality inspections of construction parts, sub-projects, and construction works in accordance with Article 8 of this Decree (if applicable);
l) Implementing acceptance procedures as prescribed in Clause 6 of Article 14, Articles 22, 23, and 24 of this Decree; inspecting and confirming completed construction volumes; inspecting and confirming completion drawings;
m) Performing other tasks as stipulated in the construction contract.
2. The construction supervision organization must establish a quality management system and a construction safety management system, and have sufficient personnel to supervise on-site in accordance with the scale and requirements of the supervision work. Depending on the scale, nature, and technology of the project, the personnel structure of the construction supervision organization includes a chief supervisor and other supervisors. Personnel performing construction supervision must have the required qualifications.
3. Organizations and individuals conducting construction supervision must prepare reports on construction supervision work for the contents they supervise in accordance with Appendix IV of this Decree, submit them to the project owner, and bear responsibility for the accuracy, honesty, and objectivity of the contents in these reports. Reports are prepared in the following cases: a) Periodic reports or reports by construction phases as specified in Appendix IVa of this Decree. The project owner specifies in the construction contract or decides on the preparation of periodic reports or reports by construction phases and the reporting deadlines;
b) Reports when organizing acceptance of construction phases, completion of tender packages, sub-projects, and construction works.
4. In cases where the project owner, EPC contractor, or turnkey contractor simultaneously performs both supervision and construction work, the project owner, EPC contractor, or turnkey contractor must establish an independent supervision department separate from the direct construction department.
5. For construction projects funded by public investment capital, regular government budget funds, or other state budgets:
a) The construction supervision organization must be independent from the construction contractors and manufacturers, producers, suppliers of materials, products, components, and equipment for the project;
b) The construction supervision organization may not participate in quality inspections of construction works they supervise;
c) Manufacturers, producers, and suppliers of materials, products, components, and equipment for the project may not participate in quality inspections of products related to materials and equipment they supply.
6. For PPP projects, the contracting agency is responsible for:
a) Verifying the capacity and experience requirements of contractors in the tender documents or request for proposals and reviewing the selection results of contractors for project tenders (if applicable);
b) Inspecting the implementation of construction supervision work according to the supervision outline, tasks, and provisions of this Decree; verifying compliance with technical standards, specifications applicable to the project, and technical provisions of the design documents during construction.
b) Inspect the implementation of construction supervision activities according to the outline, tasks of supervision, and the provisions of this Decree; check the compliance with technical standards and regulations applicable to the project, and technical requirements of the design documents during the construction process.
The contracting authority shall organize the preparation and approval of the inspection outline including the scope of inspection, contents of inspection, number of inspection rounds, and other requirements appropriate to the work to be carried out and agreed upon in the project contract.
c) Request the PPP project enterprise to require the supervisory consultant and construction contractor to replace personnel in cases where they fail to meet the capacity requirements stipulated in the tender documents, request for proposal, and construction laws.
d) Request the PPP project enterprise to suspend or halt construction works when discovering incidents that cause loss of safety of the works, signs of violations of regulations on load-bearing safety, fire prevention and fighting, environmental protection affecting human lives, community safety, and safety of adjacent works, and require the contractor to organize remediation before resuming construction works.
đ) Organize quality testing of parts of the works, sub-works, and the entire construction works when there is doubt about their quality or when requested by state management agencies. The contracting authority shall organize the selection and approval of the results of selecting the testing contractor according to the provisions of the bidding law; inspect the implementation of testing as prescribed.
e) Participate in the final acceptance of sub-works and construction works according to the provisions of Article 24 of this Decree.
g) Organize quality testing of the works to serve as the basis for transfer according to the provisions of the project contract for BOT and BLT contracts at the end of the business operation period or service lease period.
Article 21. Supervision of the designer's authorship during construction of works
1. The construction design contractor shall be responsible for implementing authorship supervision according to the construction contract for the tasks it undertakes. When sub-works and construction works complete construction tasks, this contractor shall be responsible for preparing a report evaluating the implementation of authorship supervision as stipulated in Clause 2 of this Article.
2. Contents of authorship supervision:
a) Explain and clarify construction design documents when requested by the project owner, construction contractor, and construction site supervision contractor.
b) Coordinate with the project owner when required to resolve issues, unreasonable matters, and arising problems regarding design during construction; adjust designs to suit actual construction conditions.
c) Promptly notify the project owner and recommend measures to address construction activities that deviate from approved design drawings by the construction contractor.
d) Participate in the acceptance of construction works according to the construction contract with the project owner. In case of discovering sub-works and construction works not meeting acceptance conditions, timely written opinions must be sent to the project owner.
Article 22. Acceptance of Construction Works
1. Based on the plan for organizing tests and inspections of construction works and the actual progress of construction on-site, the person directly supervising construction works and the person directly responsible for technical construction of the construction contractor shall carry out on-site acceptance of construction works and bear responsibility for the quality assessment results of the completed and accepted construction works; the acceptance results shall be confirmed by a record.
2. The construction site supervisor must base on the approved construction drawing design documents, technical instructions, technical standards, and standards applied, as well as the results of material and equipment quality inspections and monitoring conducted during construction related to the acceptance object to check the construction works required for acceptance.

6. Signatories of the acceptance record in the case of applying an EPC contract:
a) The person directly supervising construction work for the EPC contractor or the person directly supervising construction work for the project owner for the portion supervised by them as stipulated in the contract;
b) The person directly responsible for technical construction work for the EPC contractor.
In the case where the EPC contractor hires a sub-contractor, the person directly responsible for technical construction work for the EPC contractor and the person directly responsible for technical construction work for the sub-contractor shall sign the acceptance record.
c) Representative of the project owner as agreed upon in the EPC contract (if any).
7. Signatories of the acceptance record in the case of applying a turnkey contract:
a) The person directly supervising construction work for the turnkey contractor;
b) The person directly responsible for technical construction work for the turnkey contractor.
8. In the case where the contractor is a consortium, the person directly responsible for technical construction work and the person directly supervising construction work for each member of the consortium shall sign the acceptance record for the construction work they have undertaken.
Article 23. Acceptance of Construction Phase or Part of a Construction Project
1. Based on the specific conditions of each project, the investor and related contractors may negotiate and organize the acceptance of construction phases or parts of a construction project in the following cases:
a) When completing a construction phase or part of a project that requires inspection and acceptance to assess quality before moving on to the next construction phase;
b) Upon completion of a construction tender package.
2. The acceptance of construction phases or parts of a construction project shall be based on reviewing the results of works already accepted according to Article 22 of this Decree, experimental results, inspections, tests, trials, and trial runs ensuring technical requirements stipulated in the design and relevant legal documents as prescribed by laws during the construction phase to evaluate acceptance conditions agreed upon by the parties.
3. The investor and related contractors may negotiate the timing, procedures, contents, and conditions for acceptance; the participants in the acceptance process include the supervising engineer and other components agreed upon by the investor and related contractors; the acceptance results are confirmed by a minutes record.
Article 24. Completion Acceptance of Construction Project Components and Projects
1. Before putting into use, the investor is responsible for organizing and directly participating in the completion acceptance of all construction project components and projects when meeting the following conditions:
a) All construction works have been fully carried out according to the approved construction design documents;
b) The acceptance of construction works, parts, and phases during the construction process has been fully implemented according to Articles 22 and 23 of this Decree;
c) Experimental, monitoring, inspection, testing, trial run results ensure technical requirements stipulated in the construction design;
d) Compliance with fire prevention, firefighting, rescue, and environmental protection regulations during construction and other relevant specialized laws.
2. In cases where a portion of a construction project has been completed and meets the conditions specified in Clause 1 of this Article, the investor may decide to organize the acceptance of this portion of the construction project for operation. The acceptance results are confirmed by a minutes record according to the contents specified in Clause 5 of this Article, clearly stating the portion of the project being accepted. The investor is responsible for continuing to organize construction and acceptance for remaining portions of the construction project components according to the design; the continued construction process must ensure safety and not affect normal operation of the accepted portion of the construction project.
3. The investor may decide to organize conditional acceptance of construction project components and projects in cases where basic construction has been completed according to design requirements but there are some issues that do not affect the load-bearing capacity, service life, or functionality of the project. The acceptance results are confirmed by a minutes record according to the contents specified in Clause 5 of this Article, clearly stating the issues needing rectification or additional construction works and their completion deadlines, and usage limitations if applicable. Based on the conditional acceptance results, safe operating conditions, and other relevant specialized laws, the investor decides to put the construction project components and projects into conditional operation. The investor organizes the final acceptance of the project after rectifying the issues or completing the remaining construction works according to the comments of the competent authority on the conditional acceptance result notification of the investor (if any).
4. The investor and related contractors agree on the timing, procedures, and contents of acceptance; the acceptance results are confirmed by a minutes record. The contents of the minutes and the signatories of the acceptance minutes are regulated in Clauses 5 and 6 of this Article.
5. The minutes of the completion acceptance of construction project components and projects include the following contents:
a) Name of the construction project component or project being accepted;
b) Time and location of acceptance;
c) Signatories of the acceptance record;
d) Evaluation of compliance with acceptance conditions as stipulated in Clause 1 of this Article and the conformity of the constructed project component or project with design requirements, technical guidelines, and other requirements of the construction contract;
đ) Evaluation of the conformity of the construction project implementation according to the reviewed fire prevention and firefighting design, including contents about fire prevention and firefighting distances; roadways, parking areas, open spaces for fire prevention and firefighting activities, rescue operations; escape solutions; fire resistance levels, fire prevention and spread control solutions; smoke control solutions, and other fire prevention and firefighting regulations;
e) Acceptance conclusion (approval or non-approval of completion acceptance of the construction project component or project; requests for repairs, supplementary improvements, and other opinions if any);
g) Warranty period start date and duration for the construction project component or project;
h) Signature, full name, position, and corporate seal of the minutes signatory;
i) Attached annexes (if any).
6. Signatories of the acceptance minutes:
a) Legal representative of the investor or authorized person;
b) Legal representative of the construction supervision contractor or authorized person, supervising engineer; in case the contractor is a consortium, representatives from the legal entities or authorized persons and supervising engineers of each member of the consortium must be present.
c) The legal representative or authorized person, and the construction site manager of the main contractors; in cases where the contractor is a consortium, there must be a full presence of the legal representatives or authorized persons and the construction site managers of each member of the consortium.
d) The legal representative or authorized person and the design project leader of the design contractor as stipulated in the contract with the project owner.
đ) The legal representative of the authority that signs the project contract or the authorized person in cases of implementing investment under the public-private partnership model.
Article 25. Inspection of Construction Project Acceptance Work
1. Construction projects must be inspected for acceptance work during construction and upon completion of construction works according to Clause 4, Article 57 of the Construction Law No. 135/2025/QH15 (excluding construction projects under special construction investment projects as specified in Point a, Clause 1, Article 69, Articles 70, 71, and 72 of the Construction Law No. 135/2025/QH15), including:
a) Projects of national importance, large-scale projects with complex technology as specified in Appendix IX of this Decree;
b) Projects significantly impacting safety and community interests as prescribed by the Government's regulations on construction activities; except for those projects mentioned in Point a of this clause;
c) In cases where an investment project includes multiple construction works, a complex of construction works, or a production line consisting of several construction components as specified in Point b, Clause 1, Article 3 of this Decree, the competent state agency as stipulated in Clause 4, Article 57 of the Construction Law No. 135/2025/QH15 shall only inspect the construction components and construction works as specified in Points a and b of this clause.
2. Authority, procedures, contents, and costs for inspecting construction works serving defense and security; construction works as specified in Point b, Clause 1, Article 69 of the Construction Law No. 135/2025/QH15 shall be carried out according to the regulations of the Minister of National Defense and the Minister of Public Security.
3. Procedures, contents, and costs for inspecting construction project acceptance work during construction and upon completion of construction works by the State Inspection Council for Construction Project Acceptance Work as specified in Point a, Clause 1 of this Article shall be implemented according to the Decision of the Prime Minister as stipulated in Clause 5, Article 57 of the Construction Law No. 135/2025/QH15.
4. Rights and responsibilities of the competent authority as stipulated in Clause 4, Article 57 of the Construction Law No. 135/2025/QH15 in inspecting construction project acceptance work:
a) During the inspection process, the competent authority has the right to request the project owner and related parties to explain and rectify any existing issues (if any) and to require the implementation of comparative testing, construction inspection, and structural load testing of the construction project according to Article 8 of this Decree;
b) The competent authority may invite individuals with appropriate qualifications to participate in the inspection of construction project acceptance work;
c) The competent authority is responsible for the content and results of inspections within its scope and authority as prescribed by law; it does not bear responsibility for the implementation procedures, content, and results of related legal documents approved, reviewed, or resolved by other authorities or persons with authority; it does not bear responsibility for the project owner or related agencies failing to follow subsequent steps as required by the inspection results;
d) The inspection of construction project acceptance work by the competent authority does not replace or reduce the responsibility of the project owner and participating construction contractors as stipulated by laws on construction and related laws.
5. Costs for inspecting construction project acceptance work during construction and upon completion of construction works shall be budgeted, reviewed, and approved by the project owner and included in the total investment cost of the construction project according to the Government's regulations on managing construction investment costs.
Article 26. Competence to inspect the acceptance work of construction projects
1. The competence to inspect as prescribed in Clause 4, Article 57 of the Construction Law No. 135/2025/QH15 shall be defined as follows:
a) The State Council for inspection of the acceptance work of construction projects shall inspect construction projects as stipulated in Point a, Clause 1, Article 25 of this Decree;
b) The specialized agency on construction under the ministry managing the construction projects of a specific industry shall inspect construction projects assigned by the Prime Minister, special-level construction projects within the management scope of that specific industry; construction projects built in administrative areas of two provinces or cities or more;
c) The specialized agency on construction under the provincial People's Committee shall inspect all types of construction projects within its management scope, except those specified in Points a and b of this Clause.
2. In particular cases as prescribed in this Clause, the competence to inspect of the specialized agency on construction shall not be implemented according to Clause 1 of this Article but shall be defined as follows:
a) The specialized agency on construction under the ministry managing the construction projects of a specific industry shall inspect construction projects decided to invest in by the ministry managing the construction projects of that specific industry within its management scope;
b) The specialized agency on construction under the Ministry of Construction shall inspect construction projects in the aviation, national railway, and maritime sectors; except for construction projects as stipulated in Point d of this Clause;
c) The specialized agency on construction under the Ministry of Agriculture and Environment shall inspect water conservancy and dike projects with investment objectives and operational and protection scopes involving two or more provinces;
d) The specialized agency on construction under the Ministry of Industry and Trade shall inspect construction projects built at sea according to laws on the sea and specific industries outside the management scope of the provincial People's Committee;
đ) The specialized agency on construction under the Ministry of National Defense and the Ministry of Public Security shall inspect construction projects serving national defense and security and construction projects as stipulated in Point b, Clause 1, Article 69 of the Construction Law No. 135/2025/QH15;
e) The specialized agency on construction under the provincial People's Committee shall inspect construction projects in projects managed by the provincial People's Committee as the main authority according to laws on public investment or as the competent authority according to laws on public-private partnership investment; except for construction projects assigned by the Prime Minister to the specialized agency on construction under the ministry managing the construction projects of a specific industry to inspect and construction projects as stipulated in Points b, c, and d of this Clause;
g) The specialized agency on construction under the People's Committee of Hanoi City and Ho Chi Minh City shall inspect construction projects invested and constructed in their administrative areas, except for construction projects as stipulated in Points a, b, c, and d of this Clause and special-level construction projects decided to invest in by the heads of central agencies of political organizations, the Supreme People's Procuracy, the Supreme People's Court, the State Audit Office, the President's Office, the National Assembly's Office, ministries, ministerial-level agencies, central agencies of the Vietnam Fatherland Front, and political-social organizations;
h) The competence to inspect coastal land reclamation project works or components thereof shall be carried out in accordance with the provisions of the Land Law. The competence to inspect remaining components or construction projects of coastal land reclamation projects shall be carried out in accordance with the provisions of this Decree.
3. For investment projects constructing construction projects or investment projects constructing construction projects divided into component sub-projects of different types and levels, the competent authority to inspect the construction projects within the investment project is the competent authority to inspect the highest-level main construction project of the construction investment project or the highest-level main construction project of the component sub-project; in case there are multiple main construction projects of the same highest level, the competent authority to inspect the construction projects within the investment project is the competent authority to inspect the selected main construction project to determine the leading authority to review the feasibility study report for investment construction.
4. In the case where construction projects built in administrative areas of two or more provinces do not fall within the inspection competence of the specialized agency on construction under the ministry managing the construction projects of a specific industry, the investor shall notify the commencement of construction of the project and submit the completion report of the construction project component to the specialized agency on construction under the provincial People's Committee which has reviewed the feasibility study report for investment construction so that this agency can carry out the inspection.
Article 27. Content and Procedure for Inspecting the Acceptance Work of Construction Projects
1. The inspection of the acceptance work includes the following contents:
a) Inspect the compliance with regulations on quality management and safety management by the project owner and participating contractors during construction from the start of construction until the completion acceptance of the project in accordance with this Decree. Specifically, for construction equipment, the specialized construction agency shall inspect the compliance with the installation and trial operation acceptance of construction equipment by the project owner and related contractors.
b) Inspect the conditions for completing the acceptance of construction projects.
2. The specialized agency on construction does not conduct inspections on production lines and technological equipment according to the technological design.
3. Procedure for inspecting the acceptance work during the construction process of the specialized agency on construction:
a) The specialized construction agency shall conduct inspections not more than three times for special-grade and first-grade projects, and not more than two times for other projects during the period from the start of construction to the completion of the project, except in cases where there are quality issues during construction or when the project owner organizes acceptance according to Articles 24(2) and 24(3) of this Decree.
b) Based on information about the commencement of construction in the national database on construction activities, the specialized construction agency decides the inspection date and notifies the project owner of the inspection plan; implements inspections according to the content stipulated in Article 27(a)(1) of this Decree and issues a notification of the inspection results during the construction process to the project owner; the issuance deadline for the notification does not exceed ten working days from the date of the inspection.
4. Procedure for inspecting the completion acceptance work of construction projects by the specialized agency on construction:
a) The project owner must submit one report on the completion of construction works and projects in accordance with Appendix VI of this Decree to the specialized construction agency for inspection of the completion acceptance work of construction projects as stipulated in Article 24 of this Decree.
b) The specialized construction agency conducts inspections according to the content stipulated in Article 27(b)(1) of this Decree; if the project has not been inspected during construction as required by Article 27(3) of this Decree, it shall conduct inspections according to the contents stipulated in Article 27(1) of this Decree; issues a notification of the inspection results on the completion acceptance of construction works and projects in accordance with Appendix VIII of this Decree, clearly stating whether to approve or disapprove the acceptance results of the project owner, the necessary corrections or ongoing tasks (if any); the issuance deadline for the notification by the specialized construction agency does not exceed sixteen working days for first-grade and special-grade projects and twelve working days for other projects from the date of receiving the inspection request documents.
5. In cases where the project has been conditionally approved for acceptance results, the project owner must submit reports from related contractors on the implementation of the contents stipulated in Article 24(3) of this Decree to the specialized construction agency for review and inspection of the completion acceptance work of construction projects.
Article 28. Completion Documents of Construction Projects
1. The project owner must organize the preparation of completion documents of construction projects after organizing the completion acceptance of construction works and projects in accordance with Appendix VII of this Decree and bear responsibility for the accuracy and truthfulness of these documents. Contractors participating in construction activities must be responsible for the accuracy and truthfulness of the parts of the documents they prepare.
2. All documents, materials, and components of the completion documents of construction projects must be prepared in Vietnamese. If the project owner or participants in construction activities have foreign elements, the language used may be agreed upon additionally in the documents and materials as English or another foreign language.
3. Completion documents of construction projects should be prepared once for the entire investment project if all works and projects under the project are put into operation at the same time. If works and projects under the project are put into operation at different times, separate completion documents can be prepared for each work and project.
4. The project owner must organize the preparation and storage of a set of completion documents of construction projects; participants in investment construction activities must store relevant documents related to their own work. Completion documents of construction projects must be stored in original paper form and electronic copies in accordance with government regulations on administrative procedures in an electronic environment; if there is no original, it can be replaced by an original copy or a legal copy. For components of documents that must be updated in the national database on construction activities, the format of these documents must comply with government regulations on construction activity capacity conditions, information systems, and the national database on construction activities.
Section 2
HANDOVER OF CONSTRUCTION WORKS,
CONSTRUCTION PROJECTS, HANDOVER OF CONSTRUCTION PROJECTS IN URBAN DEVELOPMENT INVESTMENT PROJECTS
Article 29. Conditions for putting works and sub-works into operation and use
1. Works and sub-works must be accepted in accordance with the provisions of Article 24 of this Decree.
2. The works specified in Clause 1 of Article 25 of this Decree must be inspected by the competent authority prescribed in Clause 4 of Article 57 of the Construction Law No. 135/2025/QH15 to check the acceptance work and issue a document approving the acceptance results of the project investor before being put into operation and use. For works under PPP projects, the approval document mentioned above serves as the basis for the PPP project enterprise to prepare the application for confirmation of completion of the works in accordance with the laws on investment under the public-private partnership method;
3. As for works under urban development investment projects, the project investor must complete the construction of works belonging to the technical infrastructure system, social infrastructure, and other works (if any) in the project according to the construction plan stated in the Feasibility Study Report for Investment Construction of the project or the component project that has been reviewed and approved.
4. Obtaining an environmental permit from the competent authority or registering the environment for cases required to have an environmental permit or environmental registration in accordance with the laws on environmental protection and implementing other relevant specialized laws' provisions (if any).
5. In cases where conditional acceptance is provided for in Clause 3 of Article 24 of this Decree, the project investor decides to operate and use sub-works and construction works with conditions after meeting the provisions of this Article. The project investor continues to rectify existing issues or complete remaining construction tasks according to the contents of the conditional completion acceptance record, deciding to officially put sub-works and construction works into operation and use after organizing the final acceptance of the works.
6. In cases where construction works have been completed but some key technical indicators do not meet design requirements and do not satisfy the conditions for acceptance as stipulated in Clauses 1, 2, and 3 of Article 24 of this Decree, the handling shall be carried out as follows:
a) The project investor together with contractors must clarify the technical indicators that do not meet design requirements, warranty period responsibilities and time, determine the responsibility of related organizations and individuals, and handle violations according to the construction contract (if any);
b) The operation and use of works in this case can only be considered for transportation works, works belonging to the technical infrastructure system, essential water conservancy and dike works serving community interests based on redefined allowable operational technical parameters, conditions for operation and use, and must be approved by the investment decision-maker and opinions from relevant state authorities in accordance with related laws.
Article 30. Handover of Sub-Works and Construction Works
1. The handover of sub-works and construction works shall be carried out in accordance with the provisions of Article 58 of the Construction Law No. 135/2025/QH15.
2. Before handing over construction works, the construction contractor and equipment supplier must hand over to the project investor documents including as-built drawings, operating procedures (if any), maintenance procedures for works, lists of spare parts, replacement materials, and other necessary documents related to the works.
3. The project investor organizes the handover of construction works, receives the works from the contractor, and hands them over to the owner or manager/user of the works.
4. The management and use unit is responsible for receiving, managing, operating, and maintaining the works in accordance with their functions and the maintenance procedures handed over.
5. The project investor organizes the preparation of one set of documents for the management and use of construction works in accordance with Appendix X of this Decree, and hands them over to the owner or manager/user of the works when organizing the handover of sub-works and construction works; the retention period for these documents is as stipulated in Clause 2 of Article 42 of the Construction Law No. 135/2025/QH15.
6. In cases where sub-works and construction works are put into partial use, the project investor is responsible for organizing the preparation of construction management documents, preparing and handing over documents for the management and use of construction works for the part of the works put into operation and use.
7. In cases where transportation works, works belonging to the technical infrastructure system, essential water conservancy and dike works serving community interests are put into operation and use but cannot be handed over to the owner or manager/user of the works, the project investor is responsible for organizing the management, operation, and maintenance of the construction works; costs for these activities are implemented in accordance with the laws on construction contracts and costs in construction activities.
Article 31. Transfer of construction works in urban development investment projects
1. Principles for transferring construction works in urban development investment projects:
a) The transfer of technical infrastructure works, social infrastructure works, and other works within urban development investment projects (hereinafter referred to collectively as the transfer of construction works within urban development areas) as stipulated in this Article shall apply to cases where the project investor transfers such works to the recipient as specified in point c, Clause 5 of this Article.
b) Construction works within urban development areas that are subject to transfer must be determined in the content of the approved investment project in accordance with the laws on construction; if the investment policy requires the construction and transfer of construction works within urban development areas, the content of the investment project must be consistent with the investment policy.
c) The transfer of construction works within urban development areas must comply with the provisions of this Decree, the Law on Housing, and other relevant laws.
2. Construction works within urban development areas shall be transferred when they meet the following requirements:
a) Compliance with the provisions of Clause 1, Article 58 of the Law on Construction No. 135/2025/QH15;
b) Having complete transfer documents as stipulated in point b, Clause 3 of this Article;
c) Technical infrastructure works within urban development areas subject to transfer must have been tested in operation in accordance with the laws on environmental protection (if applicable);
d) In cases of transferring technical infrastructure works, it must ensure connection with the technical infrastructure system inside and outside the project. In cases of transferring some construction works within urban development areas, it must ensure that the remaining construction works of the project do not affect the management and operation of the transferred construction works.
3. Contents of the transfer of construction works within urban development areas include:
a) Construction works within urban development areas subject to transfer; rights and responsibilities in managing, operating, and exploiting the works; provision of urban services after transfer, and other related contents;
b) Relevant documents concerning construction works that the project investor proposes to transfer to the recipient for post-transfer management, operation, and exploitation purposes, including detailed planning drawings of the project, land-related documents for land allocation, land lease, land use change, recognition of land use rights attached to the works (if applicable), documents determining asset value as prescribed, maintenance records of construction works (if applicable), and documents serving the management and use of construction works as prescribed in Appendix X of this Decree. For documents related to land allocation, land lease, land use change, recognition of land use rights, and other documents already available in the national database or specialized databases, they should be accessed using existing data without having to transfer paper documents.
4. The transfer of construction works within urban development areas shall be carried out as follows:
a) The project investor must transfer construction works within urban development areas to the recipient when meeting the requirements stipulated in Clause 2 of this Article. If the investment policy or approved project content specifies a transfer time after meeting the requirements stipulated in Clause 2 of this Article, it shall be implemented according to the investment policy or project content;
b) The recipient must organize the inspection of transfer documents and construction works subject to transfer. The transfer must be recorded in a protocol with participants signing the protocol, including representatives of the project investor, authorities with jurisdiction to accept the transfer according to the level of authority, representatives of the receiving entity, and the entity expected to directly manage, operate, and exploit the works (if applicable);
c) In cases where the actual construction works do not match the transfer documents or do not meet the transfer requirements, or where force majeure events such as natural disasters, war, fire, epidemics occur, or there are changes in the law, the recipient may issue a refusal letter for the transfer. When the transfer requirements are met or the force majeure event ends, the parties shall carry out the transfer in accordance with the provisions of this Article.
5. Rights and responsibilities of the parties in the transfer of construction works within urban development areas:
a) The project investor has the right and responsibility to transfer in accordance with this Article; implement the responsibilities stipulated in Clause 4, Article 58 of the Law on Construction No. 135/2025/QH15; appoint authorized representatives to participate in the transfer; continue to manage, operate, and exploit the works after meeting the transfer requirements if necessary; ensure the accuracy of information in the transfer documents; and perform other rights and responsibilities as prescribed by law;
b) The recipient of the construction works transfer has the right and responsibility to organize the receipt of the transfer of construction works; refuse to accept the transfer as stipulated in point c, Clause 4 of this Article; appoint representatives to participate in the receipt of the transfer; exercise the rights of the owner or manager/user of the construction works after receiving the transfer; refund management, operation, and maintenance costs of the construction works to the project investor if the acceptance requirements are met but the transfer is not carried out; individuals responsible for accepting the transfer who fail to carry out the transfer must compensate according to the law on state compensation; and perform other rights and responsibilities as prescribed by law.
c) Responsibilities of the People's Committee at the provincial level: assign responsibilities to the People's Committee at the commune level, specialized agencies under its jurisdiction, public service units, or local specialized units to receive and take over construction works according to the provisions of the law and the local delegation; decide whether the project investor can continue to manage, operate, and exploit the construction work after meeting the handover requirements; based on the scale and nature of the construction work, make decisions on the handover acceptance period and publicly announce this period on the provincial People's Committee's electronic portal; direct and inspect the implementation of the rights and responsibilities of the parties involved in the handover of construction works within their jurisdiction; perform other rights and responsibilities as prescribed by law.
In cases where specialized laws provide for the agency or unit receiving the handover of construction works in urban areas, such provisions shall be implemented according to the specialized laws.
Chapter III
WARRANTY, MAINTENANCE, DEMOLITION OF CONSTRUCTION WORKS
Section 1
WARRANTY OF CONSTRUCTION WORKS
Article 32. Requirements for warranty of construction works
1. The construction contractor and equipment supplier shall be responsible to the investor for the warranty of the part of the work they have undertaken.
2. The investor must agree in the construction contract with participating contractors about the rights and responsibilities of each party in the warranty of construction works; the warranty period for construction works, equipment, and technology; warranty measures and forms; warranty value; retention, use, and refund of warranty money, security assets, warranty guarantees, or other equivalent guarantee forms. The aforementioned contractors may only be refunded warranty money, security assets, warranty guarantees, or other equivalent guarantee forms after the end of the warranty period and upon confirmation by the investor that they have fulfilled their warranty obligations. For construction works using state budget capital, regular expenditure funds from the state budget, or other state budget funds, the warranty form shall be specified in monetary terms or bank warranty guarantees; the warranty period and value shall be stipulated in Clauses 5, 6, and 7 of this Article.
3. Depending on the specific conditions of the construction work, the investor may agree with the contractor on a separate warranty period for one or more sub-projects or construction contracts outside the general warranty period for the construction work as stipulated in Clause 5 of this Article.
4. For sub-projects with quality defects or incidents during construction that have been repaired or rectified by the contractor, the warranty period for these sub-projects may be extended based on an agreement between the investor and the construction contractor before final acceptance.
5. The warranty period for sub-projects, new construction works, or renovation and upgrading works shall be calculated from the date of acceptance by the investor according to regulations and shall be defined as follows:
a) Not less than 24 months for special-grade and grade I construction works using state investment capital, regular expenditure funds from the state budget, or other state budget funds;
b) Not less than 12 months for remaining grades of construction works using state investment capital, regular expenditure funds from the state budget, or other state budget funds;
c) The warranty period for construction works using other capital may refer to the provisions of points a and b of this clause for application.
6. The warranty period for construction equipment and technology equipment shall be determined according to the construction contract but shall not be shorter than the manufacturer's warranty period and shall be calculated from the completion acceptance of installation and operation of the equipment.
7. For construction works using state investment capital, regular expenditure funds from the state budget, or other state budget funds, the minimum warranty amount shall be defined as follows:
a) 3% of the contract value for special-grade and grade I construction works;
b) 5% of the contract value for remaining grades of construction works;
c) The warranty amount for construction works using other capital may refer to the minimum levels stipulated in points a and b of this clause for application.
8. The minimum warranty amount stipulated in Clause 7 of this Article shall apply during the minimum warranty period stipulated in Clause 5 of this Article. If the warranty period exceeds the provisions of Clause 5 of this Article, the investor must agree with relevant contractors in the construction contract regarding the warranty amount, refund of warranty money, or replacement with security assets, warranty guarantees, or other agreed forms to apply to the excess warranty period beyond the provisions of Clause 5 of this Article.
Article 33. Responsibilities of Subjects in Warranty of Construction Projects
1. During the warranty period of construction projects, when discovering defects or damages to the project, the project investor, owner, or manager/user shall notify the project investor to request the construction contractor and equipment supplier to perform the warranty.
2. The construction contractor and equipment supplier shall carry out the warranty for their respective work after receiving the warranty request notification from the project investor, owner, or manager/user regarding defects arising during the warranty period and shall bear all costs related to performing the warranty.
3. The construction contractor and equipment supplier have the right to refuse warranty in cases where defects or damages arise not due to the fault of the contractor or due to force majeure stipulated in the construction contract. In cases where defects or damages arise due to the fault of the contractor and the contractor does not perform the warranty, the project investor has the right to use the warranty money to hire other organizations or individuals to perform the warranty. The project investor, owner, or manager/user of the project shall be responsible for implementing regulations on operation and maintenance of construction projects during the exploitation and use of the project.
4. The project investor shall be responsible for inspecting and accepting the performance of warranty by the construction contractor and equipment supplier.
5. Confirmation of completion of warranty of construction projects:
a) Upon the end of the warranty period, the construction contractor and equipment supplier shall prepare a report on the completion of warranty work and submit it to the project investor. The project investor shall be responsible for confirming in writing the completion of warranty work for the contractor and returning the warranty money (or releasing the bank guarantee equivalent in value) to the contractors if the inspection and acceptance results of the construction contractor and equipment supplier's warranty performance at Clause 4 of this Article meet the requirements;
b) The owner or manager/user of the project shall be responsible for participating in confirming the completion of warranty work for the construction contractor and equipment supplier upon the request of the project investor.
6. For residential construction projects, the contents, requirements, responsibilities, and duration of warranty shall be implemented according to the laws on housing.
Section 2
MAINTENANCE OF CONSTRUCTION PROJECTS
Article 34. Procedure for Maintenance of Construction Projects
1. The main contents of the procedure for maintenance of construction projects include:
a) Technical and technological parameters of the project, parts of the project, and project equipment;
b) Regulations on objects, methods, and frequency of inspections of the project;
c) Regulations on the content and guidance for maintenance of the project suitable for each part of the project, type of project, and equipment installed in the project;
d) Regulations on the timing and guidance for periodic replacement of equipment installed in the project;
đ) Guidance on methods for repairing defects of the project and handling cases where the project deteriorates;
e) Regulations on the service life of the project, parts, and items of the project, and equipment installed in the project;
g) Regulations on the content, methods, and timing of initial assessment and frequency of assessment for projects that must be assessed for safety during exploitation and use according to technical standards, applicable standards, and relevant laws;
h) Determination of timing, objects, and content required for periodic inspection;
i) Regulations on timing, methods, and cycles of monitoring for projects requiring monitoring;
k) Regulations on maintenance records of construction projects and updating information into maintenance records of construction projects;
l) Other guidance related to maintenance of construction projects and regulations on conditions to ensure safety, labor hygiene, environmental protection, and fire prevention and control during the implementation of maintenance of construction projects.
2. Responsibilities for establishing and approving the procedure for maintenance of construction projects:
a) The construction design contractor shall establish and hand over to the project investor the maintenance procedure for construction projects and parts of the project together with the design implementation after the project is approved; update the maintenance procedure to be consistent with changes in design during construction (if any) before the acceptance of the project item or the construction project put into use;
b) The equipment supplier shall establish and hand over to the project investor the maintenance procedure for equipment supplied by itself before installation in the project;
c) In cases where the construction design contractor or equipment supplier cannot establish the maintenance procedure, the project investor may hire another consulting unit to establish the maintenance procedure for the subjects specified in point a and point b of this clause and shall be responsible for paying the consulting fees;
d) The project investor shall organize the establishment and approval of the maintenance procedure in accordance with point b of Clause 1 of Article 65 of the Construction Law No. 135/2025/QH15. The project investor, owner, or manager/user of the project may hire a consulting unit to review part or all of the maintenance procedure for construction projects established by the design contractor as the basis for approval.
3. For construction projects already put into exploitation and use but without a maintenance procedure, the owner or manager/user of the project shall organize the establishment and approval of the maintenance procedure for construction projects, and may organize quality inspection of construction projects as the basis for establishing the maintenance procedure for construction projects if necessary. In the maintenance procedure, the remaining service life of the project, parts, and items of the project, and equipment installed in the project must be clearly determined.
4. It is not mandatory to establish a separate maintenance procedure for each Class III or lower construction project, individual residential buildings, and temporary constructions, except where otherwise provided by law. The owners or managers/users of these projects must still carry out construction project maintenance in accordance with the maintenance regulations for construction projects set forth in this Decree.
5. In cases where there are maintenance standards or maintenance procedures for similar projects that are applicable, the owners or managers/users of the projects may apply such standards or procedures to their projects without having to establish a separate maintenance procedure.
6. Adjustment of the construction project maintenance procedure:
a) The owners or managers/users of the projects have the right to adjust the maintenance procedure when they identify unreasonable factors that may affect the quality of the project, impacting its operation and use, and shall be responsible for their decisions.
b) Contractors who establish the maintenance procedure have the obligation to amend, supplement, or change unreasonable contents within the maintenance procedure if caused by their own fault, and have the right to refuse unreasonable requests to adjust the maintenance procedure from the owners or managers/users of the projects.
c) The owners or managers/users of the projects have the right to hire another contractor to implement amendments, supplements, or changes to the maintenance procedure in cases where the initial maintenance procedure contractor does not perform these tasks. The contractor implementing the amendment or supplementation of the construction project maintenance procedure shall be responsible for the quality of the work performed by themselves.
d) For projects using technical maintenance standards to conduct maintenance, when these standards are amended or replaced, the owners or managers/users of the projects shall be responsible for conducting maintenance according to the amended content.
đ) The owners or managers/users of the projects shall be responsible for approving the adjusted contents of the maintenance procedure, except where otherwise provided by law.
Article 35. Maintenance Plan for Construction Projects
1. The owners or managers/users of the projects shall establish an annual maintenance plan for construction projects based on the approved maintenance procedure and the current condition of the project.
2. The main contents of the maintenance plan for construction projects include:
a) Name of the work to be carried out;
b) Implementation time;
c) Method of implementation;
d) Implementation costs.
3. The maintenance plan may be amended or supplemented during the implementation process. The owners or managers/users of the projects shall decide on the amendment or supplementation of the maintenance plan for construction projects.
Article 36. Execution of Maintenance for Construction Projects
1. The owners or managers/users of the projects shall organize the execution themselves or hire organizations to carry out inspections, maintenance, and repairs of the projects according to the approved maintenance procedure for the projects.
2. Regular, periodic, and sudden inspections of the projects shall be conducted to promptly detect signs of deterioration and damages to the projects and installed equipment, serving as a basis for project maintenance.
3. Project maintenance shall be carried out according to the annual maintenance plan and the approved maintenance procedure for construction projects.
4. Repairing projects includes:
a) Periodic repair of projects including repairing damages or replacing parts of the projects, components, and equipment damaged, carried out periodically as prescribed in the maintenance procedure;
b) Emergency repair of projects carried out when parts of the projects, components, and equipment are damaged due to sudden impacts such as wind, storms, floods, earthquakes, collisions, fires, and other sudden impacts, or when parts of the projects, components, and equipment show signs of deterioration affecting the safety of use, operation, and exploitation of the projects.
5. Construction inspection for maintenance work on construction projects shall be carried out in the following cases:
a) According to the approved maintenance procedure for the projects;
b) When discovering that the projects or parts of the projects have damages or dangerous signs, not ensuring safety for exploitation and use;
c) When there is a need to assess the current quality of the projects to serve the establishment of a maintenance procedure for projects that have been put into use but do not yet have a maintenance procedure;
d) When it is necessary to have a basis for deciding to extend the service life of the projects for projects that have exceeded their design service life;
đ) When requested by competent state management agencies.
6. Monitoring of projects for maintenance work on construction projects shall be carried out in accordance with Article 37 of this Decree.
7. Conducting safety assessment of projects in accordance with Article 40 of this Decree.
8. In cases where projects have multiple owners, in addition to being responsible for maintaining the portion of the project under their ownership, the owners shall also be responsible for maintaining the common portion of the project in accordance with relevant laws.
9. For projects that have not yet been handed over to the owners or managers/users of the projects, the investors shall be responsible for establishing a maintenance plan for construction projects and carrying out maintenance of construction projects in accordance with the provisions of this Article and Article 34 of this Decree.
10. In addition to the regulations on maintenance of construction projects in this Decree, maintenance of construction projects shall be carried out in accordance with the provisions of related specialized laws.
Article 37. Monitoring of construction works for maintenance work
1. Monitoring of construction works for maintenance work must be carried out in the following cases:
a) When the construction work shows signs of settlement, tilting, cracking, and other abnormal signs that may cause collapse of the construction work;
b) At the request of the project owner, the owner, or the management and user;
c) When the construction work belongs to the list of specialized construction works required to be monitored for maintenance work.
2. General requirements for monitoring of construction works for maintenance work:
a) The monitoring contractor shall prepare a monitoring plan and submit it for approval by the owner or the management and user of the construction work;
b) The monitoring contractor shall carry out monitoring according to the approved monitoring plan;
c) Monitoring data must be analyzed and evaluated; the monitoring results must be compared with the design allowable values and relevant technical standards and regulations. In case the monitoring data exceeds the design allowable values or show abnormal signs, the owner or the management and user of the construction work must organize an evaluation of the causes, conduct inspection (if necessary), and take timely measures to address the issues.
3. The scope, objects, contents, and costs of monitoring for maintenance work as stipulated in point c, Clause 1 of this Article shall be implemented in accordance with the regulations of the specialized construction work management agency.
Article 38. Quality Management of Maintenance Work on Construction Works
1. The owner or the management and user of the construction work shall be responsible for establishing and retaining maintenance records throughout the operation and use of the construction work. The maintenance record of construction works is part of the documentation serving the management and use of construction works as prescribed in Clause 2, Article 42 of the Construction Law No. 135/2025/QH15, including the following documents:
a) Documents serving maintenance work include: maintenance procedures for construction works, completion drawings, equipment installation history, and other necessary documents for maintenance work;
b) Maintenance plans;
c) Results of regular and periodic inspections;
d) Results and records of maintenance and repair work;
đ) Monitoring results, quality inspection reports (if any);
e) Safety assessment results during operation and use (if any);
g) Other related documents.
2. Regular, periodic, and spot inspections shall be conducted by the owner or the management and user of the construction work through visual inspection, monitoring data (if any), or specialized inspection equipment when necessary.
3. Maintenance work shall be carried out step-by-step according to the maintenance procedure for construction works. The results of maintenance work shall be recorded and documented; the owner or the management and user of the construction work shall be responsible for confirming the completion of maintenance work and managing it in the maintenance record of construction works.
4. The owner or the management and user of the construction work shall be responsible for organizing supervision and acceptance of repair construction work; establishing, managing, and retaining repair work records in accordance with the Construction Law and other related laws.
5. Repair work shall be subject to warranty for at least six months for construction works from Class II downwards and at least twelve months for construction works from Class I upwards. The warranty amount shall not be less than five percent of the contract value.
6. The owner or the management and user of the construction work shall agree with the repair contractor on warranty rights and responsibilities, warranty period, and warranty amount for repair work during the implementation of maintenance work on construction works.
7. In case the construction work requires monitoring or quality inspection, the owner or the management and user of the construction work shall hire organizations with expertise and experience to carry out such tasks. If necessary, the owner or the management and user of the construction work may hire independent organizations with expertise and experience to evaluate inspection reports and monitoring results.
8. In case of applying PPP project investment:
a) The contracting authority shall be responsible for inspecting the organization's implementation of maintenance work on construction works by the PPP project enterprise in accordance with this Decree;
b) The PPP project enterprise shall be responsible for organizing the transfer of technology, delivery of documents serving maintenance, and maintenance records of construction works to the contracting authority before transferring the construction works as stipulated in the project contract.
Article 39. Maintenance Costs for Construction Projects
1. Maintenance costs for construction projects are the total anticipated costs for maintenance work as stipulated in Clause 10, Article 2 of this Decree to implement maintenance of construction projects as prescribed in Article 36 of this Decree.
2. Maintenance costs for construction projects include:
a) Maintenance costs according to the annual maintenance plan of the project;
b) Periodic repair costs of the project according to the annual maintenance plan, and emergency repair costs of the project;
c) Other costs in the maintenance plan including some or all costs for the following tasks: inspection, monitoring, quality testing, safety assessment of the project; preparation of the annual maintenance plan; establishment, review (if there is no maintenance procedure yet) or adjustment of the maintenance procedure for construction projects; other related costs as prescribed by specialized laws (if applicable) and management costs of the owner or user of the project.
3. The management and use of maintenance costs for construction projects shall be carried out in accordance with the State budget law, construction law, and other relevant laws.
4. Maintenance costs for construction projects are determined based on the budget estimate according to the guidelines of the Ministry of Construction, specialized construction management agency, and provincial People's Committee as prescribed in point d, Clause 1, point c, Clause 2, and point c, Clause 4 of Article 51 of this Decree.
Section 3
SAFETY ASSESSMENT OF CONSTRUCTION PROJECTS
Article 40. Safety Assessment of Construction Projects
1. The content of periodic safety assessment of construction projects (hereinafter referred to as safety assessment of construction projects) includes: inspection and evaluation of the working capacity of main load-bearing structures and parts of the project that pose a risk of safety loss.
2. The safety assessment of construction projects must apply technical standards and regulations currently in effect at the time of assessment, using natural condition data used in construction in Vietnam.
3. The initial assessment time, frequency of assessment; standards, procedures, and documentation for safety assessment of construction projects for specialized construction projects as prescribed by the specialized construction management agency.
4. The safety assessment of construction projects for dams and water reservoirs shall be carried out in accordance with the provisions of relevant specialized laws.
Article 41. Responsibility for Organizing Safety Assessment of Construction Projects
1. Responsibilities of the owner or manager/user of the project:
a) Organize the implementation of safety assessment of construction projects as prescribed in Article 40 of this Decree. The owner or manager/user of the project has the right to carry out the safety assessment themselves or hire a construction inspection organization to conduct the safety assessment;
b) Hand over documents and materials serving the safety assessment work to the inspection organization as the basis for preparing the safety assessment plan, including: maintenance files of the project, design drawings, completion drawings, equipment installation records, and other necessary documents and materials for the safety assessment work. In cases where there are no documents or the project documents do not contain sufficient information for the safety assessment work, the owner or manager/user of the project is responsible for hiring an organization to conduct surveys and prepare current status files of the project to serve the safety assessment work;
c) Approve the safety assessment plan. The owner or manager/user of the project may hire a consulting unit to review the safety assessment plan before approval;
d) Supervise the implementation of the safety assessment work;
e) The owner or manager/user of the project checks the volume of safety assessment work completed, examines the suitability of the safety assessment report compared to the approved safety assessment plan and the contract provisions to confirm the safety assessment result report.
If the safety assessment result report does not meet the requirements, the owner or manager/user of the project sends the inspection organization a written objection, specifying the non-compliant contents that the inspection organization must re-assess or supplement;
f) Store the safety assessment files in the maintenance file of the construction project to serve the next assessment.
2. Responsibilities of the organization conducting the safety assessment of construction projects:
a) Prepare a safety assessment plan in accordance with technical standards, applicable standards, and construction contract provisions, and submit it to the owner or manager/user of the project for approval;
b) Conduct the safety assessment of construction projects according to the approved plan;
c) Prepare a report on the results of the safety assessment and submit it to the owner or manager/user of the project as prescribed;
d) Bear responsibility for the quality of the safety assessment work they perform. The confirmation of the safety assessment result report by the owner or manager/user of the project does not replace and does not reduce the responsibility of the inspection organization for the safety assessment work.
3. Provincial People's Committees shall be responsible for:
a) Organize the review of construction projects within the scope required to undergo safety assessment in their jurisdiction and require the owner or manager/user of the project to organize the safety assessment of construction projects as prescribed in this Decree;
b) For construction projects specified in point a of this clause where the owner or manager/user of the project cannot be identified in their jurisdiction, the provincial People's Committee is responsible for organizing the safety assessment of construction projects as prescribed in this Decree.
4. Based on the specific conditions of each locality, the provincial People's Committee may delegate the competent authority under its jurisdiction or the People's Committee of the commune where the construction project is located to implement the provisions of Clause 3 of this Article.
Section 4
HANDLING OF CONSTRUCTION PROJECTS WITH DANGEROUS SIGNS,
CONSTRUCTION PROJECTS EXPIRING THE USE PERIOD,
DEMOLITION OF CONSTRUCTION PROJECTS
Article 42. Handling of construction works showing signs of danger, not ensuring safety for operation and use
1. When discovering parts of construction works or construction works that pose a risk of causing safety hazards, leading to construction accidents affecting the safety of users, the safety of adjacent construction works, the environment, and the community, the owner or manager/user of the construction work shall be responsible for:
a) Rechecking the current status of the construction work;
b) Organizing quality inspection of the construction work (if necessary);
c) Deciding to implement emergency measures such as limiting the use of the construction work, ceasing its use, delineating hazardous areas, relocating people and property to ensure safety if there is a risk of collapse;
d) Reporting immediately to the nearest local authority;
e) Repairing damages that may affect the safe use and operation of the construction work or demolishing the construction work when necessary.
2. When discovering or receiving information about parts of construction works or construction works showing signs of danger, not ensuring safety for operation and use, the competent state agency specified in Clause 6 of this Article shall be responsible for:
a) Organizing inspections, notifications, requiring and guiding the owner or manager/user of the construction work to organize surveys, quality inspections, assess the level of danger, and carry out repairs or demolition of parts of the construction work or the entire construction work (if necessary);
b) Yêu cầu chủ sở hữu hoặc chủ quản lý, sử dụng công trình thực hiện các biện pháp khẩn cấp quy định tại điểm c khoản 1 Điều này và thời gian thực hiện các biện pháp khẩn cấp trong trường hợp chủ sở hữu hoặc chủ quản lý, sử dụng công trình không chủ động thực hiện để bảo đảm an toàn;
c) Trường hợp hạng mục công trình, công trình xây dựng có dấu hiệu nguy hiểm có thể dẫn tới nguy cơ sập đổ thì cơ quan quản lý nhà nước có thẩm quyền có trách nhiệm chủ trì, phối hợp với chủ sở hữu hoặc chủ quản lý, sử dụng công trình thực hiện ngay các biện pháp an toàn, bao gồm hạn chế sử dụng công trình, ngừng sử dụng công trình, di chuyển người và tài sản để bảo đảm an toàn (nếu cần thiết);
d) Xử lý trách nhiệm của chủ sở hữu hoặc chủ quản lý, sử dụng công trình theo quy định của pháp luật khi không thực hiện theo các yêu cầu của cơ quan quản lý nhà nước có thẩm quyền.
3. Đối với chung cư cũ, chung cư có dấu hiệu nguy hiểm, không bảo đảm an toàn cho việc khai thác, sử dụng, chủ sở hữu hoặc chủ quản lý, sử dụng công trình thực hiện các quy định của Nghị định này và các quy định khác của pháp luật về nhà ở.
4. Mọi công dân đều có quyền thông báo cho chủ sở hữu hoặc chủ quản lý, sử dụng công trình, cơ quan nhà nước có thẩm quyền khi phát hiện hạng mục công trình, công trình xảy ra sự cố hoặc có dấu hiệu nguy hiểm, không bảo đảm an toàn cho việc khai thác, sử dụng để xử lý kịp thời.
5. Chủ sở hữu hoặc chủ quản lý, sử dụng công trình, cơ quan nhà nước có thẩm quyền quy định tại khoản 6 Điều này khi tiếp nhận thông tin về hạng mục công trình, công trình xảy ra sự cố hoặc có dấu hiệu nguy hiểm, không bảo đảm an toàn cho việc khai thác, sử dụng có trách nhiệm áp dụng các biện pháp an toàn quy định tại điểm c khoản 1 Điều này. Trường hợp không xử lý kịp thời, gây thiệt hại về người và tài sản thì phải chịu trách nhiệm theo quy định của pháp luật.
6. Thẩm quyền tiếp nhận thông tin về hạng mục công trình, công trình xảy ra sự cố hoặc có dấu hiệu nguy hiểm, không bảo đảm an toàn cho việc khai thác, sử dụng được quy định như sau:
a) Ủy ban nhân dân cấp tỉnh đối với các công trình xây dựng nằm trên địa bàn tỉnh. Căn cứ vào điều kiện cụ thể của từng địa phương, Ủy ban nhân dân cấp tỉnh phân cấp cho cơ quan chuyên môn về xây dựng trực thuộc hoặc Ủy ban nhân dân cấp xã nơi xây dựng công trình tiếp nhận thông tin về hạng mục công trình, công trình xảy ra sự cố hoặc có dấu hiệu nguy hiểm, không bảo đảm an toàn cho việc khai thác, sử dụng;
b) Bộ Quốc phòng, Bộ Công an đối với công trình phục vụ quốc phòng, an ninh.
Điều 43. Xử lý đối với công trình hết thời hạn sử dụng theo thiết kế
1. Chủ sở hữu hoặc chủ quản lý, sử dụng công trình xác định thời hạn sử dụng của công trình theo hồ sơ thiết kế xây dựng công trình và quy chuẩn kỹ thuật, tiêu chuẩn áp dụng cho công trình.
2. Đối với công trình có ảnh hưởng lớn đến an toàn, lợi ích cộng đồng theo quy định của Chính phủ về quản lý hoạt động xây dựng, trong thời hạn tối thiểu 12 tháng trước khi công trình hết thời hạn sử dụng, chủ sở hữu hoặc chủ quản lý, sử dụng công trình phải báo cáo cơ quan nhà nước có thẩm quyền quy định tại khoản 9 Điều này về thời điểm hết thời hạn sử dụng công trình và dự kiến phương án xử lý đối với công trình sau khi hết thời hạn sử dụng.
3. Sau khi nhận được báo cáo quy định tại khoản 2 Điều này, cơ quan nhà nước có thẩm quyền quy định tại khoản 9 Điều này có trách nhiệm công bố công trình xây dựng hết thời hạn sử dụng trong danh mục trên trang thông tin điện tử của mình.
4. Đối với công trình hết thời hạn sử dụng nhưng có nhu cầu sử dụng tiếp trừ đối tượng công trình nhà ở riêng lẻ của hộ gia đình, cá nhân, chủ sở hữu hoặc chủ quản lý, sử dụng công trình có trách nhiệm:
a) Tổ chức kiểm tra, kiểm định để đánh giá chất lượng hiện trạng của công trình hoặc đánh giá an toàn công trình và đề xuất phương án gia cố, cải tạo, sửa chữa hư hỏng công trình (nếu có), xác định thời gian được tiếp tục sử dụng công trình sau khi sửa chữa, gia cố;
b) Tổ chức gia cố, cải tạo, sửa chữa hư hỏng công trình (nếu có) để bảo đảm công năng và an toàn sử dụng;
c) Gửi 01 bản báo cáo kết quả thực hiện công việc quy định tại điểm a, điểm b khoản này đến cơ quan nhà nước có thẩm quyền quy định tại khoản 9 Điều này và các cơ quan nhà nước có thẩm quyền khác theo quy định của pháp luật có liên quan để được xem xét và cho ý kiến về việc kéo dài thời hạn sử dụng của công trình, trừ trường hợp công trình nhà ở riêng lẻ. Báo cáo của chủ sở hữu hoặc chủ quản lý, sử dụng công trình theo quy định tại Phụ lục XIa Nghị định này; văn bản cho ý kiến về việc kéo dài thời hạn sử dụng công trình của cơ quan nhà nước có thẩm quyền theo quy định tại Phụ lục XIb Nghị định này. Thời hạn xem xét và cho ý kiến về việc kéo dài thời hạn sử dụng công trình của các cơ quan nhà nước có thẩm quyền là 10 ngày làm việc kể từ khi nhận được báo cáo;
d) Căn cứ kết quả thực hiện các công việc quy định tại điểm a, điểm b khoản này và ý kiến của các cơ quan nhà nước có thẩm quyền quy định tại điểm c khoản này, chủ sở hữu hoặc chủ quản lý, sử dụng công trình quyết định và chịu trách nhiệm về việc tiếp tục sử dụng công trình.
5. Các trường hợp không tiếp tục sử dụng đối với công trình hết thời hạn sử dụng:
a) Chủ sở hữu hoặc chủ quản lý, sử dụng công trình không có nhu cầu sử dụng tiếp;
b) Kết quả kiểm tra, kiểm định để đánh giá chất lượng hiện trạng của công trình cho thấy công trình không bảo đảm an toàn, không thể gia cố, cải tạo, sửa chữa;
c) Công trình không được cơ quan nhà nước có thẩm quyền cho phép tiếp tục khai thác, sử dụng.
6. Cơ quan nhà nước có thẩm quyền quy định tại khoản 9 Điều này có trách nhiệm:
a) Rà soát các công trình xây dựng không đủ cơ sở để xác định được thời hạn sử dụng theo quy định tại khoản 1 Điều này và yêu cầu chủ sở hữu hoặc chủ quản lý, sử dụng tổ chức thực hiện các nội dung quy định tại khoản 4 Điều này;
b) Tổ chức thực hiện việc xác định thời hạn sử dụng, công bố công trình hết thời hạn sử dụng và thực hiện các công việc tiếp theo quy định tại Điều này đối với các công trình chưa xác định được chủ sở hữu hoặc chủ quản lý, sử dụng công trình;
c) Thông báo cho chủ sở hữu hoặc chủ quản lý, sử dụng công trình về việc dừng sử dụng và yêu cầu chủ sở hữu hoặc chủ quản lý, sử dụng công trình có trách nhiệm phá dỡ công trình và thời gian thực hiện việc phá dỡ công trình đối với các công trình không tiếp tục sử dụng theo quy định tại khoản 5 Điều này.
7. Việc xử lý đối với nhà chung cư hết thời hạn sử dụng được thực hiện theo quy định của pháp luật về nhà ở.
8. Trường hợp công trình nhà ở riêng lẻ của hộ gia đình cá nhân hết thời hạn sử dụng nhưng có nhu cầu sử dụng tiếp, chủ sở hữu hoặc chủ quản lý, sử dụng công trình có trách nhiệm thực hiện các công việc quy định tại điểm a, điểm b khoản 4 Điều này và căn cứ vào kết quả thực hiện các công việc này để tự quyết định và chịu trách nhiệm về việc tiếp tục sử dụng công trình, trừ các trường hợp quy định tại khoản 5 Điều này.
9. Thẩm quyền xem xét và cho ý kiến về việc kéo dài thời hạn sử dụng của công trình được quy định như sau:
a) Ủy ban nhân dân cấp tỉnh đối với các công trình xây dựng nằm trên địa bàn tỉnh. Căn cứ vào điều kiện cụ thể của từng địa phương, Ủy ban nhân dân cấp tỉnh phân cấp cho cơ quan chuyên môn về xây dựng trực thuộc hoặc Ủy ban nhân dân cấp xã nơi xây dựng công trình xem xét và cho ý kiến về việc kéo dài thời hạn sử dụng của công trình;
b) Bộ Quốc phòng, Bộ Công an đối với công trình phục vụ quốc phòng, an ninh.
10. Nội dung báo cáo của chủ sở hữu, người quản lý sử dụng công trình
khi công trình hết thời hạn sử dụng và nội dung công bố công trình hết thời hạn
sử dụng theo thiết kế của cơ quan nhà nước có thẩm quyền theo quy định của
Bộ trưởng Bộ Xây dựng.
Điều 44. Phá dỡ công trình xây dựng
1. Việc phá dỡ công trình xây dựng thuộc các trường hợp quy định tại khoản 1 Điều 54 Luật Xây dựng số 135/2025/QH15 phải bảo đảm an toàn cho người, tài sản, công trình, các công trình lân cận, vệ sinh môi trường và thực hiện theo trình tự như sau:
a) Lập phương án, giải pháp phá dỡ công trình xây dựng. Trường hợp công trình thuộc diện phải có quyết định phá dỡ, cưỡng chế phá dỡ thì phải có quyết định phá dỡ hoặc quyết định cưỡng chế phá dỡ công trình xây dựng;
b) Thẩm tra, phê duyệt thiết kế phương án, giải pháp phá dỡ công trình xây dựng đối với công trình xây dựng ảnh hưởng lớn đến an toàn, lợi ích cộng đồng theo quy định của Chính phủ về quản lý hoạt động xây dựng;
c) Lập biện pháp thi công, biện pháp bảo đảm an toàn, tổ chức thi công phá dỡ công trình xây dựng;
d) Tổ chức giám sát, nghiệm thu công tác phá dỡ công trình xây dựng.
2. Trách nhiệm phá dỡ công trình xây dựng:
a) Chủ đầu tư, chủ sở hữu hoặc chủ quản lý, sử dụng công trình có trách nhiệm tổ chức thực hiện phá dỡ công trình theo quy định của pháp luật về xây dựng và quy định của pháp luật khác có liên quan;
b) Chủ tịch Ủy ban nhân dân cấp tỉnh, Chủ tịch Ủy ban nhân dân cấp xã theo phân cấp hoặc cơ quan quản lý nhà nước có thẩm quyền ban hành quyết định phá dỡ công trình xây dựng đối với trường hợp phải phá dỡ; quyết định cưỡng chế phá dỡ và tổ chức thực hiện phá dỡ công trình trong trường hợp chủ đầu tư, chủ sở hữu hoặc chủ quản lý, sử dụng công trình không thực hiện trách nhiệm của mình trong việc phá dỡ công trình xây dựng;
c) Cơ quan có thẩm quyền xử phạt vi phạm hành chính quyết định áp dụng biện pháp khắc phục hậu quả buộc phá dỡ công trình, phần công trình vi phạm theo quy định của pháp luật về xử lý vi phạm hành chính;
d) Cơ quan có thẩm quyền quyết định việc phá dỡ và cưỡng chế phá dỡ nhà ở theo quy định của pháp luật về nhà ở;
đ) Thẩm quyền phá dỡ công trình phục vụ quốc phòng, an ninh theo quy định của Bộ trưởng Bộ Quốc phòng, Bộ trưởng Bộ Công an;
3. Phương án, giải pháp phá dỡ công trình xây dựng bao gồm các nội dung chính sau:
a) Căn cứ lập phương án, giải pháp phá dỡ công trình xây dựng;
b) Thông tin chung về công trình, hạng mục công trình phải phá dỡ;
c) Danh mục các tiêu chuẩn, quy chuẩn kỹ thuật được áp dụng;
d) Thiết kế phương án phá dỡ;
đ) Tiến độ, kinh phí thực hiện phá dỡ;
e) Các nội dung khác để thực hiện phá dỡ (nếu có).
4. Người được giao quản lý, thực hiện phá dỡ khẩn cấp công trình được tự quyết định toàn bộ công việc trong quá trình tổ chức thực hiện phá dỡ khẩn cấp công trình bảo đảm tiến độ, an toàn, bảo vệ môi trường và phải chịu trách nhiệm về quyết định của mình.
5. Đối với việc phá dỡ công trình xây dựng là tài sản công, ngoài việc thực hiện theo quy định của Nghị định này còn phải thực hiện theo quy định của pháp luật về quản lý, sử dụng tài sản công.
6. Đối với việc phá dỡ công trình nhà ở riêng lẻ của hộ gia đình, cá nhân quy định tại điểm a khoản 2 Điều 10 Nghị định này, trình tự thực hiện phá dỡ thực hiện theo điểm a, điểm c khoản 1 Điều này.
7. Đối với công trình xây dựng thuộc khu vực có yêu cầu quản lý kiến trúc, khu vực bảo tồn, khu vực bảo vệ di tích, di sản thế giới, việc phá dỡ công trình theo nhu cầu của chủ đầu tư, chủ sở hữu hoặc chủ quản lý, sử dụng công trình còn phải tuân thủ quy định của pháp luật về kiến trúc, di sản văn hóa và quy định của pháp luật khác có liên quan.
Chương IV
SỰ CỐ TRONG THI CÔNG VÀ KHAI THÁC, SỬ DỤNG CÔNG TRÌNH
Mục 1
SỰ CỐ CÔNG TRÌNH XÂY DỰNG
Điều 45. Báo cáo sự cố công trình xây dựng
1. Ngay sau khi xảy ra sự cố, bằng biện pháp nhanh nhất chủ đầu tư phải thông báo về sự cố bao gồm thông tin về tên và vị trí xây dựng công trình, sơ bộ về sự cố và thiệt hại (nếu có) cho Ủy ban nhân dân cấp xã nơi xảy ra sự cố và cơ quan cấp trên của mình (nếu có). Ngay sau khi nhận được thông tin, Ủy ban nhân dân cấp xã phải báo cáo cho Ủy ban nhân dân cấp tỉnh về sự cố.
2. Trong vòng 24 giờ kể từ khi xảy ra sự cố, chủ đầu tư báo cáo về sự cố bằng văn bản tới Ủy ban nhân dân cấp tỉnh nơi xảy ra sự cố. Trong thời gian không quá 24 giờ kể từ khi nhận thông báo của chủ đầu tư về sự cố, Ủy ban nhân dân cấp tỉnh phải cập nhật thông tin về sự cố vào cơ sở dữ liệu quốc gia về hoạt động xây dựng. Đối với tất cả các sự cố có thiệt hại về người thì chủ đầu tư gửi báo cáo cho Bộ Xây dựng và các cơ quan quản lý nhà nước có thẩm quyền khác theo quy định của pháp luật có liên quan. Báo cáo bao gồm các nội dung chủ yếu sau:
a) Tên công trình, vị trí xây dựng, quy mô công trình;
b) Tên các tổ chức, cá nhân tham gia xây dựng công trình;
c) Mô tả về sự cố, tình trạng công trình xây dựng khi xảy ra sự cố, thời điểm xảy ra sự cố;
d) Thiệt hại về người và tài sản (nếu có).
3. Đối với các sự cố công trình đi qua địa bàn 02 tỉnh trở lên, sau khi nhận được báo cáo bằng văn bản hoặc nhận được thông tin về sự cố, Ủy ban nhân dân cấp tỉnh nơi xảy ra sự cố có trách nhiệm gửi báo cáo sự cố cho bộ quản lý công trình xây dựng chuyên ngành.
4. Cơ quan quản lý nhà nước có thẩm quyền được quyền yêu cầu chủ đầu tư và các bên liên quan cung cấp thông tin về sự cố.
5. Trường hợp sự cố công trình xảy ra trong quá trình khai thác, sử dụng, chủ sở hữu hoặc chủ quản lý, sử dụng công trình có trách nhiệm thực hiện theo quy định tại các khoản 1, 2 Điều này.
Điều 46. Giải quyết sự cố công trình xây dựng
1. Khi xảy ra sự cố, chủ đầu tư và nhà thầu thi công xây dựng công trình có trách nhiệm thực hiện các biện pháp kịp thời để tìm kiếm, cứu hộ, bảo đảm an toàn cho người và tài sản, hạn chế và ngăn ngừa các nguy hiểm có thể tiếp tục xảy ra; tổ chức bảo vệ hiện trường sự cố và thực hiện báo cáo theo quy định tại Điều 45 Nghị định này. Ủy ban nhân dân các cấp chỉ đạo, hỗ trợ các bên có liên quan tổ chức lực lượng tìm kiếm cứu nạn, bảo vệ hiện trường sự cố và thực hiện các công việc cần thiết khác trong quá trình giải quyết sự cố.
2. Cơ quan chủ trì giải quyết sự cố:
a) Bộ quản lý công trình xây dựng chuyên ngành chủ trì giải quyết sự cố công trình xây dựng đối với công trình do bộ quản lý công trình xây dựng chuyên ngành là cơ quan chủ quản theo pháp luật về đầu tư công hoặc cơ quan có thẩm quyền theo pháp luật về đầu tư theo phương thức đối tác công tư;
b) Ủy ban nhân dân cấp tỉnh chủ trì giải quyết sự cố công trình xây dựng trên địa bàn, trừ trường hợp quy định tại điểm a khoản này. Căn cứ điều kiện cụ thể của địa phương, Ủy ban nhân dân cấp tỉnh có thể phân cấp cho Ủy ban nhân dân cấp xã chủ trì giải quyết sự cố công trình xây dựng trên địa bàn.
3. Trách nhiệm của cơ quan chủ trì giải quyết sự cố:
a) Xem xét, quyết định dừng, tạm dừng thi công hoặc khai thác, sử dụng đối với hạng mục công trình, một phần hoặc toàn bộ công trình tùy theo tính chất, mức độ và phạm vi ảnh hưởng của sự cố;
b) Xem xét, quyết định việc phá dỡ, thu dọn hiện trường sự cố trên cơ sở đáp ứng các yêu cầu sau: Bảo đảm an toàn cho người, tài sản, công trình và các công trình lân cận. Hiện trường sự cố phải được các bên liên quan chụp ảnh, quay phim, thu thập chứng cứ, ghi chép các tư liệu cần thiết phục vụ công tác giám định nguyên nhân sự cố và lập hồ sơ sự cố trước khi phá dỡ, thu dọn;
c) Thông báo kết quả giám định nguyên nhân sự cố cho chủ đầu tư, các chủ thể khác có liên quan; các yêu cầu đối với chủ đầu tư, chủ sở hữu hoặc các bên có liên quan phải thực hiện để khắc phục sự cố;
d) Xử lý trách nhiệm của các bên có liên quan theo quy định của pháp luật.
4. Chủ đầu tư, nhà thầu thi công xây dựng trong quá trình thi công xây dựng hoặc chủ sở hữu công trình, chủ quản lý, sử dụng công trình trong quá trình khai thác, sử dụng có trách nhiệm khắc phục sự cố theo yêu cầu của cơ quan nhà nước có thẩm quyền. Sau khi khắc phục sự cố, cơ quan có thẩm quyền quy định tại khoản 2 Điều này quyết định việc tiếp tục thi công hoặc đưa công trình vào sử dụng.
5. Đối với công trình phục vụ lợi ích cộng đồng xảy ra sự cố nhưng cần phải khắc phục nhanh để kịp thời đáp ứng nhu cầu sử dụng, sau khi các bên liên quan thực hiện quy định tại điểm b khoản 3 Điều này, cơ quan chủ trì giải quyết sự cố xem xét, quyết định việc cho phép tiếp tục thi công, tiếp tục khai thác, sử dụng và khắc phục sự cố đồng thời với quá trình giải quyết sự cố.
6. Tổ chức, cá nhân gây ra sự cố có trách nhiệm bồi thường thiệt hại và chi phí cho việc khắc phục sự cố tùy theo tính chất, mức độ và phạm vi ảnh hưởng của sự cố.
7. Thẩm quyền chủ trì giải quyết sự cố đối với công trình phục vụ quốc phòng, an ninh theo quy định của Bộ trưởng Bộ Quốc phòng, Bộ trưởng Bộ Công an.
Điều 47. Giám định nguyên nhân sự cố công trình xây dựng
1. Thẩm quyền chủ trì tổ chức giám định nguyên nhân sự cố công trình xây dựng:
a) Bộ quản lý công trình xây dựng chuyên ngành chủ trì tổ chức giám định nguyên nhân sự cố công trình do bộ là cơ quan chủ quản theo pháp luật về đầu tư công hoặc cơ quan có thẩm quyền theo pháp luật về đầu tư theo phương thức đối tác công tư; công trình có quy mô lớn, kỹ thuật phức tạp thuộc chuyên ngành quản lý theo quy định của Nghị định này; công trình do Thủ tướng Chính phủ giao;
b) Ủy ban nhân dân cấp tỉnh chủ trì tổ chức giám định nguyên nhân các sự cố trên địa bàn trừ trường hợp quy định tại điểm a khoản này.
2. Cơ quan có thẩm quyền quy định tại khoản 1 Điều này thành lập Tổ điều tra sự cố để giám định nguyên nhân sự cố. Tổ điều tra sự cố bao gồm đại diện các đơn vị của cơ quan chủ trì giải quyết sự cố, các cơ quan có liên quan và các chuyên gia về những chuyên ngành kỹ thuật liên quan đến sự cố. Trường hợp cần thiết, cơ quan chủ trì tổ chức giám định nguyên nhân sự cố chỉ định tổ chức kiểm định thực hiện giám định chất lượng công trình phục vụ đánh giá nguyên nhân sự cố và đưa ra giải pháp khắc phục.
3. Nội dung thực hiện giám định nguyên nhân sự cố:
a) Thu thập hồ sơ, tài liệu, số liệu kỹ thuật có liên quan và thực hiện các công việc chuyên môn để xác định nguyên nhân sự cố;
b) Đánh giá mức độ an toàn của công trình sau sự cố;
c) Phân định trách nhiệm của các tổ chức và cá nhân có liên quan;
d) Lập hồ sơ giám định nguyên nhân sự cố, bao gồm: Báo cáo giám định nguyên nhân sự cố và các tài liệu liên quan trong quá trình thực hiện giám định nguyên nhân sự cố.
4. Chi phí tổ chức giám định nguyên nhân sự cố công trình xây dựng:
a) Trường hợp sự cố công trình xây dựng xảy ra trong quá trình thi công xây dựng công trình, chủ đầu tư có trách nhiệm chi trả chi phí tổ chức giám định nguyên nhân sự cố công trình xây dựng. Sau khi có kết quả giám định nguyên nhân sự cố công trình xây dựng và phân định trách nhiệm thì tổ chức, cá nhân gây ra sự cố công trình xây dựng phải có trách nhiệm chi trả chi phí tổ chức giám định nguyên nhân sự cố. Trường hợp sự cố công trình xảy ra do nguyên nhân bất khả kháng thì trách nhiệm chi trả chi phí tổ chức giám định nguyên nhân sự cố thực hiện theo quy định của hợp đồng xây dựng có liên quan;
b) Trường hợp sự cố công trình xây dựng xảy ra trong quá trình khai thác, sử dụng công trình, chủ sở hữu hoặc chủ quản lý, sử dụng công trình có trách nhiệm chi trả chi phí tổ chức giám định nguyên nhân sự cố công trình xây dựng. Sau khi có kết quả giám định nguyên nhân sự cố công trình xây dựng và phân định trách nhiệm thì tổ chức, cá nhân gây ra sự cố công trình xây dựng phải có trách nhiệm chi trả chi phí tổ chức giám định nguyên nhân sự cố. Trường hợp sự cố công trình xảy ra do nguyên nhân bất khả kháng thì trách nhiệm chi trả chi phí tổ chức giám định nguyên nhân sự cố do chủ sở hữu hoặc chủ quản lý, sử dụng công trình chi trả.
5. Việc giám định nguyên nhân sự cố đối với công trình phục vụ quốc phòng, an ninh theo quy định của Bộ trưởng Bộ Quốc phòng, Bộ trưởng Bộ Công an.
Điều 48. Hồ sơ sự cố công trình xây dựng
Chủ đầu tư, chủ sở hữu hoặc chủ quản lý, sử dụng có trách nhiệm lập hồ sơ sự cố bao gồm các nội dung sau:
1. Biên bản kiểm tra hiện trường sự cố với các nội dung: Tên công trình, hạng mục công trình xảy ra sự cố; địa điểm xây dựng công trình, thời điểm xảy ra sự cố, mô tả sơ bộ và diễn biến sự cố; tình trạng công trình khi xảy ra sự cố; sơ bộ về tình hình thiệt hại về người và tài sản; sơ bộ về nguyên nhân sự cố.
2. Các tài liệu về thiết kế và thi công xây dựng công trình liên quan đến sự cố.
3. Hồ sơ giám định nguyên nhân sự cố.
4. Các tài liệu liên quan đến quá trình giải quyết sự cố.
Mục 2
SỰ CỐ GÂY MẤT AN TOÀN LAO ĐỘNG
TRONG THI CÔNG XÂY DỰNG CÔNG TRÌNH
Điều 49. Sự cố gây mất an toàn lao động trong thi công xây dựng công trình
1. Sự cố gây mất an toàn lao động trong thi công xây dựng công trình bao gồm:
a) Sự cố do máy, thiết bị phục vụ công tác thi công xây dựng (sau đây gọi là sự cố do máy, thiết bị);
b) Sự cố tai nạn lao động xảy ra trong thi công xây dựng công trình.
2. Việc khai báo, điều tra, báo cáo và giải quyết sự cố gây mất an toàn lao động trong thi công xây dựng công trình được quy định như sau:
a) Đối với sự cố quy định tại điểm a khoản 1 Điều này, việc khai báo, điều tra, báo cáo và giải quyết sự cố thực hiện theo quy định tại Điều 50 Nghị định này; trường hợp sự cố do máy, thiết bị gây chết người hoặc làm bị thương nặng từ 2 người trở lên thì việc khai báo, điều tra, báo cáo và giải quyết sự cố thực hiện theo quy định của pháp luật về an toàn, vệ sinh lao động;
b) Đối với sự cố quy định tại điểm b khoản 1 Điều này thì việc khai báo, điều tra, báo cáo và giải quyết sự cố thực hiện theo quy định của pháp luật về an toàn, vệ sinh lao động.
Điều 50. Khai báo, báo cáo và giải quyết sự cố do máy, thiết bị
1. Ngay sau khi xảy ra sự cố do máy, thiết bị, bằng biện pháp nhanh nhất chủ đầu tư hoặc nhà thầu thi công xây dựng phải thông báo về sự cố bao gồm thông tin về tên và vị trí xây dựng công trình, sơ bộ về sự cố và thiệt hại (nếu có) cho cơ quan chuyên môn về xây dựng quy định tại khoản 8 Điều 16 Nghị định này.
2. Chủ đầu tư và nhà thầu thi công xây dựng công trình có trách nhiệm thực hiện các biện pháp kịp thời để bảo đảm an toàn cho người và tài sản, hạn chế và ngăn ngừa các nguy hiểm có thể tiếp tục xảy ra; tổ chức bảo vệ hiện trường sự cố đối với trường hợp quy định tại khoản 7 Điều này.
3. Chủ đầu tư có trách nhiệm tổ chức giải quyết sự cố; xem xét quyết định dừng, tạm dừng sử dụng đối với máy, thiết bị và việc phá dỡ, thu dọn hiện trường sự cố trên cơ sở bảo đảm an toàn cho người, tài sản, công trình và các công trình lân cận trừ trường hợp quy định tại khoản 7 Điều này; gửi báo cáo kết quả giải quyết sự cố cho cơ quan chuyên môn về xây dựng quy định tại khoản 8 Điều 16 Nghị định này.
4. Chủ sở hữu, chủ quản lý, sử dụng máy, thiết bị có trách nhiệm khắc phục sự cố do máy, thiết bị bảo đảm các yêu cầu về an toàn trước khi tiếp tục thi công. Tổ chức, cá nhân gây ra sự cố do máy, thiết bị có trách nhiệm bồi thường thiệt hại và chi phí cho việc khắc phục sự cố. Tùy theo tính chất, mức độ và phạm vi ảnh hưởng còn bị xử lý theo các quy định của pháp luật khác có liên quan.
5. Nhà thầu thi công xây dựng có trách nhiệm rà soát, điều chỉnh biện pháp bảo đảm an toàn trong thi công xây dựng đối với công việc xây dựng hoặc bộ phận, hạng mục công trình xảy ra sự cố và trình chủ đầu tư kiểm tra, chấp thuận theo quy định tại khoản 4 Điều 16 Nghị định này; thực hiện các biện pháp bảo đảm an toàn điều chỉnh đã được chấp thuận trước khi tiếp tục thi công.
6. Cơ quan chuyên môn về xây dựng quy định tại khoản 8 Điều 16 Nghị định này thực hiện kiểm tra việc khai báo, giải quyết sự cố của chủ đầu tư và các nhà thầu thi công xây dựng theo quy định tại các khoản 1, 2, 3, 4 và 5 Điều này (nếu cần thiết); có trách nhiệm tổng hợp báo cáo Ủy ban nhân dân cấp tỉnh về tình hình sự cố xảy ra trên địa bàn được giao quản lý trước ngày 15 tháng 12 hằng năm và báo cáo đột xuất khi có yêu cầu.
7. Riêng đối với trường hợp máy, thiết bị phục vụ công tác thi công xây dựng sập đổ ra ngoài phạm vi của công trường xây dựng, cơ quan chuyên môn về xây dựng quy định tại khoản 8 Điều 16 Nghị định này có trách nhiệm:
a) Kiểm tra hiện trường, kiểm tra việc khai báo, giải quyết sự cố của chủ đầu tư và các nhà thầu thi công xây dựng theo quy định tại Điều này; báo cáo cho Ủy ban nhân dân cấp tỉnh ngay sau khi nhận được thông tin về sự cố;
b) Xem xét, quyết định dừng, tạm dừng sử dụng đối với máy, thiết bị; dừng, tạm dừng thi công đối với các hạng mục công trình, một phần hoặc toàn bộ công trình tùy theo mức độ và phạm vi ảnh hưởng của sự cố;
c) Xem xét, quyết định việc phá dỡ, thu dọn hiện trường sự cố trên cơ sở bảo đảm an toàn cho người, tài sản, công trình và các công trình lân cận. Hiện trường sự cố phải được các bên liên quan chụp ảnh, quay phim, thu thập chứng cứ, ghi chép các tư liệu cần thiết phục vụ công tác điều tra, xác định nguyên nhân trước khi phá dỡ, thu dọn;
d) Yêu cầu chủ đầu tư tổ chức điều tra xác định nguyên nhân và trách nhiệm của các tổ chức, cá nhân có liên quan đến sự cố;
đ) Yêu cầu chủ đầu tư hoặc các bên có liên quan khắc phục và bồi thường thiệt hại do sự cố do máy, thiết bị gây ra;
e) Xử lý, kiến nghị xử lý trách nhiệm của các bên có liên quan theo quy định của pháp luật.
Chương V
ĐIỀU KHOẢN THI HÀNH
Điều 51. Trách nhiệm thi hành
1. Bộ Xây dựng:
a) Chịu trách nhiệm trước Chính phủ thực hiện thống nhất quản lý nhà nước về những nội dung thuộc phạm vi điều chỉnh của Nghị định này;
b) Ban hành và hướng dẫn, kiểm tra việc thực hiện các văn bản quy phạm pháp luật theo thẩm quyền về quản lý chất lượng công trình xây dựng, an toàn trong thi công xây dựng công trình, bảo trì công trình xây dựng và hướng dẫn thi hành Nghị định này;
c) Thực hiện quản lý nhà nước về những nội dung thuộc phạm vi điều chỉnh của Nghị định này đối với công trình xây dựng chuyên ngành thuộc thẩm quyền quản lý; tổ chức kiểm tra việc tuân thủ các quy định của Nghị định này đối với các bộ, ngành, địa phương và các chủ thể tham gia xây dựng, quản lý, khai thác, sử dụng công trình; kiểm tra chất lượng các công trình xây dựng và an toàn trong thi công xây dựng công trình khi cần thiết;
d) Yêu cầu, đôn đốc các bộ quản lý công trình xây dựng chuyên ngành, Ủy ban nhân dân cấp tỉnh thực hiện kiểm tra sự tuân thủ các quy định của Nghị định này theo thẩm quyền;
đ) Hướng dẫn xác định chi phí bảo trì công trình xây dựng; ban hành hướng dẫn xác định chi phí bảo trì công trình xây dựng chuyên ngành và định mức cho các công việc bảo trì công trình xây dựng chuyên ngành thuộc phạm vi quản lý.
2. Các bộ quản lý công trình xây dựng chuyên ngành khác:
a) Thực hiện quản lý nhà nước về những nội dung thuộc phạm vi điều chỉnh của Nghị định này đối với công trình xây dựng chuyên ngành; hướng dẫn thực hiện các văn bản quy phạm pháp luật về quản lý chất lượng công trình xây dựng, an toàn trong thi công xây dựng và bảo trì công trình xây dựng áp dụng cho các công trình xây dựng chuyên ngành;
b) Tổ chức kiểm tra việc tuân thủ các quy định của Nghị định này đối với các chủ thể tham gia xây dựng công trình xây dựng chuyên ngành thuộc phạm vi quản lý của bộ khi cần thiết hoặc khi được Bộ Xây dựng yêu cầu;
c) Căn cứ hướng dẫn xác định chi phí bảo trì công trình xây dựng của Bộ Xây dựng để xác định chi phí bảo trì công trình xây dựng hoặc ban hành hướng dẫn riêng theo đặc thù quản lý của chuyên ngành; ban hành định mức cho các công việc bảo trì công trình xây dựng theo đặc thù của chuyên ngành chưa được Bộ Xây dựng ban hành.
3. Các bộ quản lý công trình xây dựng chuyên ngành có trách nhiệm chỉ đạo và kiểm tra cơ quan chuyên môn trực thuộc trong việc tổ chức kiểm tra công tác nghiệm thu đối với các công trình xây dựng chuyên ngành thuộc thẩm quyền quản lý của bộ, bao gồm:
a) Bộ Xây dựng đối với các công trình thuộc dự án đầu tư xây dựng: công trình dân dụng, công trình hạ tầng kỹ thuật, công trình công nghiệp nhẹ, công trình sản xuất vật liệu xây dựng, sản phẩm xây dựng, công trình giao thông;
b) Bộ Nông nghiệp và Môi trường đối với các công trình thuộc dự án đầu tư xây dựng công trình phục vụ nông nghiệp và môi trường;
c) Bộ Công Thương đối với các công trình thuộc dự án đầu tư xây dựng công trình công nghiệp, trừ các công trình do Bộ Xây dựng quản lý theo quy định tại điểm a khoản này;
d) Bộ Quốc phòng, Bộ Công an đối với các công trình thuộc dự án đầu tư xây dựng công trình quốc phòng, an ninh.
4. Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương có trách nhiệm:
a) Thực hiện quản lý nhà nước về những nội dung thuộc phạm vi điều chỉnh của Nghị định này trên địa bàn hành chính của mình theo phân cấp; hướng dẫn thực hiện các văn bản quy phạm pháp luật về quản lý chất lượng công trình xây dựng, an toàn trong thi công xây dựng và bảo trì công trình xây dựng áp dụng cho các công trình xây dựng trên địa bàn quản lý;
b) Tổ chức kiểm tra việc tuân thủ các quy định của Nghị định này đối với các chủ thể tham gia xây dựng công trình trên địa bàn khi cần thiết hoặc khi được Bộ Xây dựng yêu cầu;
c) Căn cứ hướng dẫn xác định chi phí bảo trì công trình xây dựng của Bộ Xây dựng để xác định chi phí bảo trì công trình xây dựng hoặc ban hành hướng dẫn riêng theo đặc thù quản lý của địa phương; ban hành định mức cho các công việc bảo trì công trình xây dựng chưa được Bộ Xây dựng, bộ quản lý công trình xây dựng chuyên ngành khác ban hành; kết quả thực hiện gửi về Bộ Xây dựng, bộ quản lý công trình xây dựng chuyên ngành để tổng hợp, quản lý;
d) Chỉ đạo, kiểm tra các cơ quan chuyên môn trực thuộc trong việc kiểm tra công tác nghiệm thu công trình xây dựng thuộc dự án đầu tư xây dựng công trình xây dựng chuyên ngành trên địa bàn thuộc thẩm quyền quản lý.
5. Căn cứ điều kiện cụ thể của từng địa phương, Ủy ban nhân dân cấp tỉnh thực hiện phân cấp cho Ban quản lý khu công nghiệp, khu chế xuất, khu công nghệ cao, khu kinh tế, Ủy ban nhân dân cấp xã thực hiện các nội dung quản lý nhà nước thuộc thẩm quyền của Ủy ban nhân dân cấp tỉnh theo quy định của Nghị định này.
6. Ban quản lý khu công nghiệp, khu chế xuất, khu công nghệ cao, khu kinh tế, Ủy ban nhân dân cấp xã có trách nhiệm quản lý nhà nước về những nội dung thuộc phạm vi điều chỉnh của Nghị định này trên địa bàn theo phân cấp.
7. Các bộ quản lý công trình xây dựng chuyên ngành khác, Ủy ban nhân dân cấp tỉnh có trách nhiệm báo cáo Bộ Xây dựng về tình hình chất lượng, công tác quản lý chất lượng công trình xây dựng và công tác quản lý an toàn trong thi công xây dựng thuộc thẩm quyền quản lý theo hướng dẫn của Bộ trưởng Bộ Xây dựng trước ngày 15 tháng 12 hằng năm và báo cáo đột xuất khi có yêu cầu.
Điều 52. Hiệu lực thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2026.
2. Nghị định số 06/2021/NĐ-CP ngày 26 tháng 01 năm 2021 của Chính phủ quy định chi tiết một số nội dung về quản lý chất lượng, thi công xây dựng và bảo trì công trình xây dựng đã được sửa đổi, bổ sung một số điều theo Nghị định số 35/2023/NĐ-CP, Nghị định số 175/2024/NĐ-CP, Nghị định số 14/2026/NĐ-CP, Nghị định số 67/2026/NĐ-CP hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành.
3. Bãi bỏ Điều 8 Nghị định số 140/2025/NĐ-CP; Điều 13 Nghị định số 144/2025/NĐ-CP; khoản 4 Điều 9, Điều 38 của Nghị định số 11/2013/NĐ-CP ngày 14 tháng 01 năm 2013 của Chính phủ về quản lý đầu tư phát triển đô thị được sửa đổi, bổ sung tại Nghị định số 35/2023/NĐ-CP ngày 20 tháng 6 năm 2023 của Chính phủ sửa đổi, bổ sung một số điều của các Nghị định thuộc lĩnh vực quản lý nhà nước của Bộ Xây dựng.
Điều 53. Điều khoản chuyển tiếp
1. Công trình thuộc dự án đầu tư xây dựng đã được quyết định đầu tư trước ngày Nghị định này có hiệu lực thi hành thì loại và cấp của công trình được xác định theo quy định của pháp luật tại thời điểm quyết định đầu tư.
2. Các hồ sơ thủ tục hành chính đã được cơ quan có thẩm quyền tiếp nhận trước ngày Nghị định này có hiệu lực thi hành thì cơ quan có thẩm quyền đã tiếp nhận hồ sơ tiếp tục thực hiện theo quy định của văn bản quy phạm pháp luật tại thời điểm tiếp nhận hồ sơ.
3. Công trình xây dựng khởi công trước ngày Nghị định này có hiệu lực thi hành thuộc đối tượng kiểm tra công tác nghiệm thu theo quy định của Nghị định số 06/2021/NĐ-CP đã được sửa đổi, bổ sung một số điều theo Nghị định số 35/2023/NĐ-CP, Nghị định số 175/2024/NĐ-CP, Nghị định số 14/2026/NĐ-CP, Nghị định số 67/2026/NĐ-CP nhưng không thuộc đối tượng kiểm tra công tác nghiệm thu theo quy định của Nghị định này thì không tiếp tục thực hiện việc kiểm tra công tác nghiệm thu. Chủ đầu tư có trách nhiệm tổ chức quản lý chất lượng, quản lý thi công xây dựng, nghiệm thu hoàn thành công trình đưa vào khai thác, sử dụng theo quy định của Nghị định này và chịu trách nhiệm về kết quả nghiệm thu của mình.
4. Công trình xây dựng khởi công trước ngày Nghị định này có hiệu lực thi hành thuộc đối tượng kiểm tra công tác nghiệm thu theo quy định của Nghị định số 06/2021/NĐ-CP đã được sửa đổi, bổ sung một số điều theo Nghị định số 35/2023/NĐ-CP, Nghị định số 175/2024/NĐ-CP, Nghị định số 14/2026/NĐ-CP, Nghị định số 67/2026/NĐ-CP và Nghị định này, đã được cơ quan chuyên môn về xây dựng thuộc bộ quản lý công trình xây dựng chuyên ngành kiểm tra công tác nghiệm thu trước ngày Nghị định này có hiệu lực thi hành thì thực hiện như sau:
a) Cơ quan chuyên môn về xây dựng thuộc bộ quản lý công trình xây dựng chuyên ngành tiếp tục thực hiện kiểm tra công tác nghiệm thu hoàn thành đối với công trình này và các công trình đã khởi công xây dựng thuộc đối tượng kiểm tra còn lại của dự án có công trình được quy định chuyển tiếp tại khoản này, trừ trường hợp công trình đã được cơ quan chuyên môn về xây dựng thuộc Ủy ban nhân dân cấp tỉnh tổ chức kiểm tra;
b) Trong quá trình cơ quan chuyên môn về xây dựng thuộc bộ quản lý công trình xây dựng chuyên ngành tiếp tục thực hiện kiểm tra công tác nghiệm thu hoàn thành công trình xây dựng nếu phát hiện những vi phạm về chủ trương đầu tư, quy hoạch, đất đai, giấy phép xây dựng, phòng cháy, chữa cháy và các nội dung vi phạm khác thuộc thẩm quyền giải quyết của các cơ quan quản lý nhà nước tại địa phương thì cơ quan chuyên môn về xây dựng thuộc bộ quản lý công trình xây dựng chuyên ngành có trách nhiệm thông báo đến Ủy ban nhân dân cấp tỉnh để chỉ đạo xử lý và giao cơ quan chuyên môn về xây dựng tại địa phương tiếp tục thực hiện việc kiểm tra công tác nghiệm thu đối với các công trình này sau khi đã khắc phục các vi phạm.
5. Các công trình xây dựng thuộc danh mục các công trình Hội đồng kiểm tra nhà nước về công tác nghiệm thu công trình xây dựng tổ chức kiểm tra năm 2026 đã được Thủ tướng Chính phủ phê duyệt, đã khởi công xây dựng và đã được kiểm tra công tác nghiệm thu thì Hội đồng tiếp tục kiểm tra đối với các công trình này.
Điều 54. Tổ chức thực hiện
1. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân cấp tỉnh, người đứng đầu tổ chức chính trị - xã hội, tổ chức xã hội - nghề nghiệp và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này.
2. Bộ Xây dựng chủ trì, phối hợp với các bộ, ngành liên quan chịu trách nhiệm hướng dẫn và tổ chức thực hiện Nghị định này.
