THE MINISTER OF TRANSPORTATION
Based on Decree No. 22/CP dated March 22, 1994 of the Government, stipulating the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;
Based on Point 3, Article 3 and Point 4, Article 4 of Decree No. 86/CP dated December 8, 1995 of the Government, stipulating the division of responsibilities for state management regarding product quality;
Based on Decision No. 75/TTg dated February 3, 1997 of the Prime Minister, stipulating the tasks, powers, and organizational structure of the Vietnam Vehicle Inspection Agency;
Based on Circular No. 1192/KCM-GTVT dated June 12, 1996 of the Joint Ministry of Science, Technology, and Environment and Transport, guiding the implementation of Decree No. 86/CP dated December 8, 1995 on the division of responsibilities for state management regarding product quality; management ofproducts;
Considering the proposal of the Director of the Department of Science and Technology, the Director of the Legal Affairs and Transportation Department;
DECISION:
Article 1:Now hereby promulgating together with this Decision "Regulations onthe quality inspection and technical safety of various types of motor vehicles produced and assembled according to domestic designs".
Article 2:This Decision shall take effect 15 days from the date of signature and replace Decision No. 1774/QĐ/KHKT-PCVT dated July 16, 1997 of the Minister of Transport.
Article 3: The Heads of the Ministry's Office, Directors of the Departments of Science and Technology, Legal Affairs and Transportation, the Directors of the Vietnam Vehicle Inspection Agency, the Vietnam Highway Administration, the Directors of Provincial and Municipal Transport Departments directly under the Central Government, and the Heads of related units are responsible for implementing this Decision.
REGULATIONS
ON THE QUALITY INSPECTION AND TECHNICAL SAFETY
OF VARIOUS TYPES OF MOTOR VEHICLES PRODUCED,
ASSEMBLED ACCORDING TO DOMESTIC DESIGNS

1. GENERAL PROVISIONS:
1.1.Production and assembly of motor vehicles (MV) as prescribed herein means using all new parts, assemblies, and systems at 100% from imported sources or domestically produced, including the use of complete assemblies and systems of semi-finished automobiles or unused MVs without registration plates to produce and assemble MVs according to domestic designs.
1.2.Terms used in these provisions are understood as follows:
Motor vehicle includes types of vehicles defined in TCVN 6211:1996 "Road Traffic Vehicles - Types - Terminology and Definitions".
OSemi-finished automobile refers to automobiles in semi-finished form that can move independently, with or without a driver's cabin, cargo box, passenger compartment, or specialized equipment.
Assembly is understood as: engine, transmission, chassis, driver's cabin, and body or cargo box or specialized equipment installed on the vehicle.
System is understood as: power transmission system, motion system, suspension system, braking system, steering system, electrical system, lighting, and signaling.
Product is understood as: parts, assemblies, systems, or MVs produced and assembled at production facilities.
Similar products are: products having the same industrial property owner, design, technical specifications, identification code (excluding characters indicating the steering position, place of manufacture).
Industrial property owner is understood as provided for in Article 33, Chapter 4 of Decree No. 63/CP dated October 24, 1996 of the Government detailing industrial property rights.
1.3.Applicability:
These provisions apply to the design, production, and assembly of MVs as specified in Clause 1.1, including the design and production of parts, assemblies, and systems for assembling such MVs. the design, production of parts, assemblies, and systems for the assembly of such motor vehicles.
These provisions do not apply to MVs produced and assembled for military purposes of the Ministry of Defense and for maintaining public security of the Ministry of Public Security.
1.4.Designing entity:
The designing entity is a legal person organization registered for the business of MV design in accordance with current laws, having sufficient capacity and conditions to fulfill design tasks.
1.5.Production facility:
The production facility is a legal person enterprise registered for the business of MV production and assembly in accordance with current laws, having sufficient technical infrastructure to ensure product quality during production and assembly.
1.6.Quality Management Authority:
The Vietnam Vehicle Inspection Agency is the specialized state authority for quality management of various types of transportation vehicles (hereinafter referred to as the Quality Management Authority), organizing and conducting design reviews, quality inspections, and technical safety checks for the products mentioned in these provisions.
2. REGULATIONS ON DESIGN DOCUMENTATION AND DESIGN REVIEW.
2.1. Design documentation.
2.1.1.Design documentation for parts, assemblies, and systems includes:
Drawings and technical specifications of the product;
General layout drawings for products that are assemblies and systems.
2.1.2.Design documentation for vehicles includes:
Technical drawings:
General layout drawing of the product;
Assembly and system installation drawings;
Drawings and technical specifications of domestically produced parts, assemblies, and systems;
Technical specifications and performance of imported assemblies and systems;
Technical drawings must be presented in accordance with current Vietnamese standards.
Calculation explanation includes the following contents:
Explanation of product characteristics;
Calculations of dynamic and kinematic characteristics;
Durability test calculations.
2.1.3.Each type of design documentation mentioned above shall be prepared in three sets and submitted to the Quality Management Authorityfor review.
2.2.Design Review.
2.2.1.Design review is the examination, verification, and comparison of the contents of the product design documentation with current standards and regulations on MVs to ensure that the produced and assembled MVs meet requirements for quality, technical safety, and environmental protection.
2.2.2.The results of the design file review must be notified within fifteen days fromthe date of receiving complete valid design files. In cases where the review periodneeds to be extended due to requests for supplementary or amended design files, theQuality Control Authority shall notify the design unit in writing.
2.2.3.After the review, the files shall be transferred to: the design unit, the productionfacility, and stored at the Quality Control Authority.
3. PROVISIONS ON PRODUCTION AND ASSEMBLY
3.1.Production and assembly of products must be carried out strictly according to theapproved design, ensuring quality and technical safety requirements.
Based on the approved design, the production facility is responsible for establishingproduction technology procedures, quality inspection procedures, and technical safetymeasures, and must equip necessary testing devices for each production stageaccordingly. These devices must be tested and calibrated in accordance with currentregulations.
3.2.For types of products that have been certified for mass production, the productionfacility is responsible for maintaining product quality in accordance with thecertified standards and must bear responsibility for the quality of its products.
4. PROVISIONS ON QUALITY INSPECTION AND TECHNICAL SAFETY
4.1.Inspection files
4.1.1.Inspection files for components, assemblies, and systems include:
Theapproved design file of the product;
Anexplanation of symbols used on the product;
Adescription of production technology procedures and quality inspection proceduresfor the product;
Atest report of the product by the production facility;
Acopy of the quality certificate (if applicable) distinguished for the followingcases:
Qualitycertification by the authorized agency forproducts produced according to domestic designs;
Adocument confirming equivalent quality by the foreign industrial property owner ofthe product for products manufactured using technology transferred from abroad;
Qualitycertificate by the authorized agency of the exporting country for importedproducts.
4.1.2.Inspection files for means of transport include:
Designfiles, photographs of the appearance of the means of transport;
Astatistical record of domestically produced and imported components, assemblies, andsystems;
Productionand assembly technology procedures, standards, and quality inspection procedures formeans of transport;
Qualitycertificates of related assemblies and systems concerning technical safety of themeans of transport;
Aregistration and explanation of the method of engine number and frame numbermarking;
Technicalmanual introducing the features and technical characteristics of the means oftransport for operation and use;
Qualityinspection results of the production facility for sample products at variousproduction and assembly stages.
Eachof the above files shall be prepared into one set and sent to the Quality ControlAuthority to serve as the basis for quality and technical safety inspections.
4.2.Quality inspection and technical safety inspection
4.2.1.Quality inspection and technical safety inspection involves examining, testing, andevaluating the quality of components, assemblies, systems, as well as the entire meansof transport produced and assembled according to the approved design files andcurrent standards and regulations regarding quality, technical safety, andenvironmental protection.
4.2.2.The inspection is conducted through sampling product testing. Sample productsused for quality certification must match the type, technical specifications, andorigin as specified in the inspection files under Section 4.1.
Basedon the testing methods according to current standards, the Quality Control Authorityshall specify the quantity of samples to be tested.
4.2.3.After the sample product passes the standard, the Quality Control Authority issues a Quality Certificate for that type of product according to one of thetemplates provided in Appendix 1 of this regulation.
4.2.4.For components, assemblies, and systems related to the technical safety of means oftransport which already possess one of the quality certificates mentioned inSection 4.1.1 of this regulation, the Quality Control Authority may exempt frominspection.
4.2.5.The quality inspection and certification process must be completed within fifteendays from the receipt of complete valid files. In cases where the time needs to beextended due to requests for supplementary or amended files or completion of sampleproducts, the Quality Control Authority must notify the production facility in writing. 4.2.6.For similar products that have already been issued a Quality Certificate by theQuality Control Authority, if the production facility meets the conditions stipulatedin Section 4.2.7, it will be authorized in writing by the Quality Control Authority
to self-inspect and issue a Quality Inspection Certificate for each subsequentproduct according to the provisions of Section 4.2.8 and bear responsibility for thequality of its products. 4.2.7.Conditions for the production facility to be authorized to inspect mass-producedproducts are as follows: Meetingthe technical infrastructure and equipment conditions stipulated in Sections 1.5 and3 of this regulation.
Havingqualified inspectors trained and certified by the Quality Control Authority forproduct quality inspection.
TheQuality Control Authority
shall conduct inspections and authorize in writing the production facilitiesmeeting the aforementioned conditions. 4.2.8.The Quality Inspection Certificate for finished products shall be preparedaccording to the templates provided in Appendix 2.
Finishedproduct certificates prepared according to template 2a shall be issued and managedby the production facility for assemblies and systems. Finishedproduct certificates prepared according to template 2b shall be uniformly issued,managed, and guided for use by the Quality Control Authority
for means of transport.
Theperson signing the Quality Inspection Certificate for finished products must be thedirector of the production facility or a person authorized in writing by the directorand approved by the Quality Control Authority.
4.3.Technical files issued to products Theproduction facility is responsible for issuing the following technical files foreach finished product:
4.3.1.For assemblies and systems: TheQuality Inspection Certificate for finished products as stipulated in Section 4.2.8;
Producttechnical specifications and features.
4.3.2.For means of transport:
TheQuality Inspection Certificate for finished products as stipulated in Section 4.2.8.
Aproduct warranty certificate.
4.3.3.The Quality Inspection Certificate for finished means of transport as stipulatedin Section 4.3.2 is used for registration procedures.
4.3.2. For the motor vehicles:
Quality inspection certificate upon factory release as stipulated in Section 4.2.8.
Technicalmanual introducing the features and technical characteristics of the means oftransport for operation and use;
Product warranty certificate.
4.3.3. Quality inspection certificate issued to the motor vehicle mentioned in Section 4.3.2., used for registration procedures. sign the means.
5. OTHER PROVISIONS
5.1. Every six months, the Regulatory Authority shall compile the situation of implementing product quality inspection work to report to the Ministry of Transport (through the Department of Science and Technology) and inform the Vietnam Highway Administration. The inspection files must be stored at the Regulatory Authority
and at the production facility for at least five years. 5.3 After granting authorization, the Regulatory Authority
also has the responsibility to inspect the production facility in ensuring the quality of produced and assembled products. In case of discovering violations related to product quality assurance by the production facility, the Regulatory Authority may revoke the Inspection Authorization Certificate. 5.4 The Regulatory Authority
is permitted to collect fees related to product quality inspection and certification according to current regulations. 5.5 Quality certificates, quality inspection certificates issued upon factory release, and quality inspection approval seals granted to products specified in Section 1.3 before this Decision takes effect shall remain valid for use.
5.6 Based on its functions and responsibilities, the Regulatory Authority
