On the operation regulations of the Military Command Board of agencies and organizations

MINISTER OF NATIONAL DEFENSE

Based on the Law on Legislative Acts of Legal Normative Documents dated November 12, 1996; amended and supplemented on December 16, 2002;

Based on the People's Militia Self-Defense Ordinance dated April 29, 2004;

Based on Decree No. 184/2004/NĐ-CP dated November 2, 2004 of the Government detailing the implementation of the People's Militia Self-Defense Ordinance;

Based on Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government on defense work in Ministries, agencies at the level of ministries, government agencies, and localities;

Based on Decree No. 30/2004/NĐ-CP dated January 16, 2004 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of National Defense;

Article 2. This Circular applies to academies, universities, military officer schools, vocational colleges, secondary technical schools, and military schools (hereinafter referred to collectively as military schools) that organize training in accordance with the law, and related agencies, units, organizations, and individuals; it does not apply to teachers teaching at kindergartens, general education schools, national defense education centers, and security education centers.

DECISION:

PART I

GENERAL PROVISIONS

Article 1. Scope of regulation and applicable subjects

1. This Resolution sets forth the principles of operation; functions, tasks, and powers; working systems and working relationships of the Military Command Board of agencies and organizations, including state agencies, public service units, economic organizations, political organizations, and socio-political organizations (hereinafter referred to collectively as agencies and organizations).

2. This Resolution shall be implemented during peacetime. In wartime, in cases of national defense and security emergencies, the Ministry of National Defense will have separate regulations.

Article 2. Principles of Operation of the Military Command Board of Agencies and Organizations

1. The activities of the Military Command Board of agencies and organizations are directly led by the Party Committee of the same level; directed and managed by the head of the agency or organization; and directed and commanded regarding defense and military work by the competent military authority.

2. All activities of the Military Command Board of agencies and organizations must comply with the provisions of the People's Militia Self-Defense Ordinance, Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government on defense work in Ministries, agencies at the level of ministries, government agencies, and localities, Decree No. 184/2004/NĐ-CP dated November 2, 2004 of the Government detailing the implementation of the People's Militia Self-Defense Ordinance, and other laws on national defense.

Article 3. Functions, Tasks, and Powers of the Military Command Board of Agencies and Organizations

The Military Command Board of agencies and organizations performs its functions and tasks according to Article 12 of Decree No. 184/2004/NĐ-CP dated November 2, 2004 of the Government detailing the implementation of the People's Militia Self-Defense Ordinance, and the following specific duties and powers:

1. Studying and implementing resolutions, directives, and orders concerning national defense and military tasks from superiors; taking the lead in drafting and submitting to the Party Committee and the head of the agency or organization leadership and guidance documents and plans for implementing national defense and military work of the agency or organization; organizing the implementation of the plan after approval.

2. Taking the lead in proposing to the Party Committee and the head of the agency or organization to lead and direct the implementation of nationwide defense education, national defense and security knowledge training for cadres, civil servants, employees, and workers under the management of the agency or organization, in accordance with the law.

3. Participating in proposing to the Party Committee and the head of the agency or organization on combining economic and social development with ensuring national defense and security in planning and development plans within the fields managed by the agency or organization; coordinating with the locality where the headquarters is located to build a comprehensive national defense and people's security foundation; taking the lead or participating in building and implementing Plan B and civilian defense plans as assigned by the head of the agency or organization.

4. Building and implementing plans for organizing, training, and activities of self-defense forces after approval by the competent authority; improving the quantity and quality of the Military Command Board and self-defense command cadre.

5. Taking the lead in assisting the head of the agency or organization in implementing conscription orders; registering and managing citizens of self-defense age, male citizens of conscription age, reserve military personnel, and executing mobilization orders for reserve military personnel and technical equipment for the military as ordered by the competent authority.

6. Taking the lead in assisting the Party Committee and the head of the agency or organization in implementing Party and political work in the construction and operation of self-defense forces, reserve mobilization forces, and in performing national defense and military tasks of the agency or organization.

7. Implementing regulations on combat readiness and weapons management, participating in exercises as ordered by the competent authority; directing and commanding self-defense forces to cooperate with other forces in the area to protect production, maintain public order and safety, prevent and mitigate the consequences of natural disasters, fire, and explosion in the agency or organization and the locality where the headquarters is located.

8. Preparing the annual budget, implementing, and settling the budget to ensure the performance of national defense and military work of the agency or organization.

9. Taking the lead and coordinating with relevant agencies in proposing to the Party Committee and the head of the agency or organization to implement policies for self-defense forces, reserve military personnel, and military rear support policies.

10. Directing and guiding subordinate agencies and organizations under their management to perform national defense and military tasks.

11. Implementing reporting, briefing, inspection, interim review, and final evaluation systems for national defense and military work as prescribed.

12. Initiating and maintaining a movement of excellence in self-defense forces and reserve mobilization forces; proposing to the Party Committee, the head of the agency or organization, and the competent authority to commend and reward outstanding collectives and individuals in the performance of national defense and military tasks of the agency or organization.

Article 4. Responsibilities, Tasks, and Working Relationships of the Commander, Political Commissar, and Deputy Commander of the Military Command Board of Agencies and Organizations.

The Commander, Political Commissar, and Deputy Commander of the Military Command Board of agencies and organizations perform their responsibilities, tasks, and working relationships as stipulated in Decision No. 189/2006/QĐ-BQP dated November 11, 2006 of the Minister of National Defense on the responsibilities, tasks, and working relationships of Military Command Board cadres, village teams, and militia self-defense unit commanders; related duties, powers, and working relationships as set forth in this Decision.

Chapter II

WORKING SYSTEMS

Article 5. Situation Awareness System

1. The Military Command Board of the agency or organization shall organize and assign personnel to directly monitor the implementation of national defense work of the agency or organization; compile and report to the Party committee, head of the agency or organization, and the superior military authority in accordance with regulations.

2. Continuously grasp the organization, staffing, equipment, and capability to perform tasks of the self-defense force and the reserve mobilization force, and report to superiors as prescribed.

Article 6. System for drafting leadership and guidance documents and organizing the implementation of national defense work

1. Annually, based on directives, orders, and plans for national defense work from the superior military authority, the Military Command Board of the agency or organization shall advise the Party committee, head of the agency or organization to issue resolutions and directives on national defense work or incorporate the implementation of national defense and military work into resolutions and directives leading and guiding the implementation of the agency or organization's annual tasks. At the same time, they shall directly draft the annual plan for national defense work of the agency or organization, submit it to the head of the agency or organization for approval in the first quarter of the year.

2. Annually and during each period, based on the guidance of the competent military authority and the division of labor by the head of the agency or organization, the Military Command Board of the agency or organization shall take the lead or participate in drafting the following plans:

a) For the Military Command Boards of ministries, agencies equivalent to ministries, agencies under the Government; the Central Office and various Departments of the Party; the Office of the President; the Office of the National Assembly; central agencies of mass organizations, State-owned corporations, and State-owned joint-stock companies with controlling shares established by the Prime Minister's decision; and Military Command Boards of other agencies and organizations established by the Ministry of Defense's decision (hereinafter referred to collectively as the Military Command Boards of agencies and organizations at the Central level):

- Plan for building and mobilizing the reserve force;

- Plan for ensuring national defense needs in the first year of war;

- Plan for mobilizing the national economy to meet national defense needs and social activities;

- Plan for transitioning agencies and organizations to various states of defense.

b) For the Military Command Boards of specialized agencies under provincial People's Committees directly under the Central Government (referred to collectively as provinces); Party Departments and equivalent agencies under Provincial Party Committees; public service organizations under Provincial Party Committees and Provincial People's Committees; state-owned enterprises and joint-stock companies with state-controlled shares located in the province that have self-defense forces at company level or higher; provincial-level political and social organizations; organizations under central agencies set up vertically in localities; and Military Command Boards of other agencies and organizations established and directly managed by the Provincial Military Command (referred to collectively as the Military Command Boards of agencies and organizations at the provincial level):

- Plan for building and mobilizing the reserve force;

- Plan for ensuring national defense needs in the first year of war;

- Plan for transitioning agencies and organizations to various states of defense;

- Plan for building and training the activities of the self-defense force;

- Plan for protecting offices;

- Plan for flood prevention and disaster mitigation;

- Civil air defense plan;

c) For the Military Command Boards of agencies and organizations at the district, urban district, town, and city levels within the province (referred to collectively as districts):

- Plan for building, training, and activities of the self-defense force;

- Plan for protecting offices;

- Plan for flood prevention and disaster mitigation;

- Civil air defense plan;

d) The drafting or supplementation and adjustment of the plans mentioned in points a, b, and c of this clause and other plans (if any) shall be carried out according to the instructions of the direct superior military authority of the Military Command Board of the agency or organization.

Article 7. System for registering and managing the self-defense force, reserve mobilization force, and weapons and technical equipment

1. In April each year, the Military Command Board of the agency or organization shall cooperate with the local military authority where the headquarters is located to register citizens within the age range for militia self-defense in accordance with the Militia Self-Defense Law.

2. The Military Command Board of the agency or organization shall cooperate with the local military authority where the headquarters is located to implement the registration and management of the reserve mobilization force in accordance with the Reserve Mobilization Law.

3. Military weapons, auxiliary tools, and other technical equipment necessary to ensure the performance of national defense and military tasks of the agency or organization must be fully registered in terms of quantity, quality, serial number, type, and kept concentrated at the workplace of the Military Command Board, and inspected, cleaned, and maintained in accordance with regulations.

Article 8. System for training and enhancing knowledge on national defense work

1. For the Military Command Boards of agencies and organizations at the Central level:

a) Duration: seven days annually;

b) Location: National Defense Academy or military units;

c) Content and program: implemented in accordance with Decision No. 3309/2004/QĐ-BQP dated December 16, 2004, issued by the Minister of National Defense on the issuance of the training program for militia self-defense (hereinafter referred to as Decision No. 3309/2004/QĐ-BQP).

2. For the Military Command Boards of agencies and organizations at the provincial level:

a) Duration: seven days annually;

b) Location: at the Military Training School of the Military Region or the provincial Military Training School;

c) Content and program: implemented in accordance with Decision No. 3309/2004/QĐ-BQP.

3. For the Military Command Boards of agencies and organizations at the district level:

a) Duration: seven days annually;

b) Location: at the provincial Military Training School or the District Military Command Board;

c) Content: implemented in accordance with Decision No. 3309/2004/QĐ-BQP.

4. For cadres of the Military Command Boards of member agencies and organizations at the Central level:

a) Cadres of the Military Command Boards of member agencies and organizations at the Central level managed by the Provincial Military Command shall implement in accordance with Clause 2 of this Article;

b) Cadres of the Military Command Boards of member agencies and organizations at the Central level managed by the District Military Command shall implement in accordance with Clause 3 of this Article.

Article 9. System for briefing on national defense work

The Military Command Board of the agency or organization shall implement the system for briefing on national defense work in accordance with Decision No. 38/2005/QĐ-BQP dated April 6, 2005, issued by the Minister of National Defense on the Regulations for Briefing, Reporting, Inspection, Mid-Term Review, and Final Summary of National Defense Work, Militia Self-Defense, and National Defense Education (hereinafter referred to as Decision No. 38/2005/QĐ-BQP) and the following specific provisions:

1. For the Military Command Boards of agencies and organizations at the Central level:

a) When attending joint meetings with the Ministry of National Defense, the Military Command of agencies and organizations must send officials in accordance with the composition called for by the Ministry of National Defense; if sending a substitute official, it must be agreed upon by the head of the agency or organization and the Ministry of National Defense;

b) When organizing their own level joint meetings, the Commander of the Military Command of central agencies and organizations shall chair such meetings once every quarter; however, for Military Commands with multiple constituent agencies and organizations located in different regions, joint meetings may be held less frequently if agreed upon by the head of the agency or organization and the Office of the Central Defense Work Department of the Ministry of National Defense, but they must still hold joint meetings semi-annually and annually;

- The composition of the joint meeting includes the Commanders of the Military Commands of member agencies and organizations within the scope of management of the sector or field; specialized and part-time officials responsible for defense work within the agency or organization. In special cases, if agreed upon by the head of the agency or organization, those mentioned above may be absent but must submit a written report as required by the Commander of the Military Command of the agency or organization. When necessary, representatives from the Ministry of National Defense; the Military Region Command; the Provincial Military Command; the District Military Command where the headquarters is located and related units may be invited to attend the joint meeting;

- The venue for the joint meeting is determined by the Commander of the Military Command;

c) When attending joint meetings with the local military agency where the headquarters is located, the Commander of the Military Command shall dispatch officials based on the nature and content of the joint meeting;

2. For the Military Command Boards of agencies and organizations at the provincial level:

a) When attending joint meetings with the Provincial Military Command, the Military Command of agencies and organizations must send officials in accordance with the composition called for by the Provincial Military Command; if sending a substitute official, it must be agreed upon by the head of the agency or organization and the Provincial Military Command;

b) When organizing their own level joint meetings, the Commander of the Military Command of agencies and organizations shall chair such meetings once every quarter; in special cases, joint meetings may be held less frequently if agreed upon by the head of the agency or organization and the Provincial Military Command, but they must still hold joint meetings semi-annually and annually;

- The composition of the joint meeting includes the Commanders of the Military Commands of member agencies and organizations within the scope of management of the sector or field; specialized and part-time officials responsible for defense work within the agency or organization;

Invite representatives from the Provincial Military Command; the Military Command of the superior vertical agency (if applicable); the District Military Command where the headquarters is located and related units to attend the joint meeting;

- The venue for the joint meeting is determined by the Commander of the Military Command;

c) When attending joint meetings with the local military agency where the headquarters is located, the Commander of the Military Command shall dispatch officials based on the nature and content of the joint meeting;

3. For the Military Command Boards of agencies and organizations at the district level:

a) The participation in joint meetings by the Military Command of the superior vertical agency (if applicable) shall be carried out according to the call-up of the Military Command of the superior vertical agency;

b) When attending joint meetings with the District Military Command, it shall be carried out according to the call-up of the District Military Command;

c) When organizing their own level joint meetings, it shall be carried out according to the requirements of the District Military Command or the Military Command of the superior vertical agency (if applicable);

4. For the Military Commands of member agencies and organizations of central agencies and organizations:

a) Participation in joint meetings by the Military Command of the superior agency shall be carried out according to the call-up of the Military Command of the superior agency;

b) Attending joint meetings with the Provincial Military Command or the District Military Command when designated by the Provincial Military Command as under the jurisdiction of the District Military Command;

c) When organizing their own level joint meetings, it shall be carried out according to the directives of the superior military agency;

5. Military Commands of agencies and organizations at all levels shall regularly conduct joint meetings as stipulated in Clauses 1, 2, 3, and 4 of this Article, while also conducting joint meetings as required by the head of the agency or organization or the superior military commander when there are urgent tasks;

Article 10. Reporting system for national defense, self-defense militia, and national defense education;

The Military Command of agencies and organizations shall implement the reporting system for national defense, self-defense militia, and national defense education in accordance with Decision 38/2005/QĐ-BQP and the following specific provisions:

1. For the Military Command Boards of agencies and organizations at the Central level:

a) Quarterly, semi-annually, and annually, report in writing to the head of the agency or organization; the Ministry of National Defense (through the Office of the Central Defense Work Department of the Ministry of National Defense); specifically, semi-annual and annual reports to the Ministry of National Defense must be reviewed and signed by the head of the agency or organization;

b) Annually, report in writing to the Provincial Military Command and the District Military Command where the agency or organization is headquartered regarding the construction of self-defense forces, reserve mobilization work, and recruitment, as well as combat and public security activities within the local defense area;

c) Urgent reporting shall be conducted as required by the Ministry of National Defense or the head of the agency or organization when there are urgent tasks concerning national defense and security, and as required by the local military command where the headquarters is located regarding the contents specified in Point b, Clause 1 of this Article;

2. For the Military Command Boards of agencies and organizations at the provincial level:

a) Quarterly, semi-annually, and annually, the Military Command of agencies and organizations has the responsibility to report in writing to the Military Command of the superior vertical agency (if applicable) and the Provincial Military Command;

b) Annually, report in writing to the District Military Command where the agency or organization is headquartered regarding the construction of self-defense forces, reserve mobilization work, and recruitment, as well as combat and public security activities within the local defense area;

c) Urgent reporting shall be conducted as required by the Provincial Military Command or the Military Command of the superior vertical agency when there are urgent tasks concerning national defense and security, and as required by the District Military Command where the headquarters is located regarding the contents specified in Point b, Clause 2 of this Article;

3. For the Military Command Boards of agencies and organizations at the district level:

a) Quarterly, semi-annually, and annually, report in writing to the District Military Command and the Military Command of the superior vertical agency (if applicable);

b) Monthly or urgent reporting as required by the District Military Command or the Military Command of the superior vertical agency (if applicable).

4. For military command offices of agencies and organizations under central bodies:

a) Military command offices of agencies and organizations under central bodies managed by provincial military commands shall implement in accordance with the provisions of Clause 2 of this Article;

b) Military command offices of agencies and organizations under central bodies managed by district military commands shall implement in accordance with the provisions of Clause 3 of this Article.

Article 11. Inspection regime for national defense work, self-defense militia, and national defense education

Military command offices of agencies and organizations shall implement the inspection regime for national defense work, self-defense militia, and national defense education in accordance with Decision No. 38/2005/QĐ-BQP and the following specific provisions:

1. For the Military Command Boards of agencies and organizations at the Central level:

a) Shall be subject to inspection of the implementation of national defense work, self-defense militia, and national defense education by the Minister of National Defense and the permanent body for national defense work of the Ministry of National Defense when authorized by the Minister of National Defense;

b) Shall assist the head of the agency or organization or directly organize inspections of the implementation of national defense and military work when authorized by the head of the agency or organization;

c) The content, objects, time of inspection; organization, structure, and composition of the inspection team for national defense work of agencies and organizations at the central level must be included in the annual national defense work plan of the military command office of the agency or organization, except in cases of surprise inspections upon request of the Ministry of National Defense or the head of the agency or organization.

When conducting inspections, it is necessary to notify the local authorities and invite representatives from the local military authority where the agency or organization is located to participate and cooperate in the implementation. The number of agencies and organizations inspected annually shall be determined by the head of the agency or organization or the Ministry of National Defense.

2. For the Military Command Boards of agencies and organizations at the provincial level:

a) Shall be subject to inspection of the implementation of national defense work, self-defense militia, and national defense education by the provincial military command; military command office of the higher-level vertical agency (if applicable); regional military command, and the Ministry of National Defense (in special cases);

b) Shall assist the head of the agency or organization or directly organize inspections of the implementation of national defense and military work when authorized by the head of the agency or organization;

c) The content, objects, time of inspection; organization, structure, and composition of the inspection team for national defense work of agencies and organizations must be included in the annual national defense work plan of the military command office of the agency or organization, except in cases of surprise inspections upon request of the head of the agency or organization or the competent military authority.

When conducting inspections, it is necessary to notify the local authorities and invite representatives from the local military authority where the agency or organization is located to participate and cooperate in the implementation. The number of agencies and organizations inspected annually shall be determined by the head of the agency or organization or the Commander of the provincial military command.

3. For military command offices of agencies and organizations under districts and military command offices of member agencies and organizations under central bodies:

a) Shall be subject to inspection by the competent military authority and the military command office of the higher-level agency (if applicable);

b) Shall organize inspections of self-defense forces under their jurisdiction and subordinate agencies and organizations (if applicable).

Article 12. Inspection regime for preliminary summary and final summary of national defense work, self-defense militia, and national defense education

Military command offices of agencies and organizations shall implement the inspection regime for preliminary summary and final summary of national defense work, self-defense militia, and national defense education in accordance with Decision No. 38/2005/QĐ-BQP and the following specific provisions:

1. Military command offices of agencies and organizations shall advise the head of the agency or organization to take the lead in implementing preliminary summaries and final summaries of national defense work, self-defense militia, and national defense education.

2. Preliminary summaries and final summaries of national defense work, self-defense militia, and national defense education shall be conducted according to the decision of the head of the agency or organization, including:

a) Preliminary summary of national defense work, self-defense militia, and national defense education for the first six months of the year may be combined with the second quarter meeting and combined with the preliminary summary of the overall tasks of the agency or organization;

b) Final summary of national defense work, self-defense militia, and national defense education for the year may be combined with the fourth quarter meeting, lasting at least half a day, and may be combined with the final summary of the overall tasks of the agency or organization if approved by the superior military authority.

Article 13. Budget preparation and settlement system

1. Annually, military command offices of agencies and organizations shall base on the expenditure tasks for national defense and military work to prepare a budget estimate to ensure funding for national defense and military work in accordance with Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law and current legal documents; submit for approval, execution, and settlement of the budget for national defense and military work according to the approved plan.

2. Expenditure tasks for national defense work of agencies and organizations shall be implemented in accordance with Item 3, Article 5, Chapter II of Decree No. 10/2004/NĐ-CP dated January 7, 2004 of the Government on management and use of state budget and assets for certain activities in the field of national defense and security; Article 30, Chapter III of Decree No. 184/2004/NĐ-CP dated November 2, 2004 of the Government detailing the implementation of the Self-Defense Militia Ordinance and current legal documents.

Chapter III

RELATIONSHIPS IN WORK

Article 14. Working relationship of military command offices of agencies and organizations under central bodies

1. With the same-level Party committee, it is a relationship between leadership and being led. Under the leadership of the same-level Party committee, the military command office is responsible for organizing the implementation of resolutions on national defense and military work and reporting on the implementation of national defense and military tasks to the same-level Party committee as prescribed.

2. With the head of agencies and organizations under central bodies, it is a relationship between guidance and management and being guided and managed. The military command office shall comply with the guidance, management, and direction of the head of the agency or organization, while proposing measures to organize the implementation of assigned national defense and military tasks.

3. With the Ministry of National Defense: The Military Command of agencies and organizations at the central level shall be directly directed and commanded by the Minister of National Defense on defense and military work in accordance with Decree No. 119/2004/NĐ-CP dated May 11, 2004 of the Government; they shall be uniformly commanded by the Minister of National Defense over the self-defense forces and reserve mobilization forces belonging to the agencies and organizations through the direct command of local military authorities at all levels; they shall be guided within the scope of functions and powers of the General Staff and the General Departments under the Ministry of National Defense.

4. With the Military Region, Provincial Military Command, and the Military Command of agencies and organizations at the central level, they shall cooperate with local military authorities to direct, guide, urge, and inspect the implementation of general defense work and specific self-defense work of the Military Command and self-defense forces of member units of central agencies and organizations according to their respective authorities.

5. With the Military Command of the district where the headquarters is located: The Military Command of agencies and organizations at the central level shall be directly directed and commanded by the Military Command of the district regarding the construction of self-defense forces, reserve mobilization work, recruitment, and combat-security activities of the agency or organization's administrative sector.

6. With the Military Command of member agencies and organizations under central agencies and organizations, it is a superior-subordinate relationship concerning defense and military work; the Military Command of central agencies and organizations shall be responsible for directing, guiding, inspecting, and urging the implementation of defense and military work for member agencies and organizations under central agencies and organizations.

Article 15. The working relationship of the Military Command of agencies and organizations at the provincial level

1. With the Party Committee at the same level, it is a relationship between leadership and being led; under the leadership of the Party Committee, the Military Command shall be responsible for organizing the implementation of resolutions on defense and military work and reporting on the implementation of defense and military tasks to the Party Committee in accordance with regulations.

2. With the head of the agency or organization, it is a relationship between direction and management and being directed and managed. The Military Command shall strictly comply with the direction, management, and operation of the head of the agency or organization regarding the implementation of defense and military work within its unit; at the same time, it shall propose measures to organize the implementation of assigned defense and military tasks.

3. With the Provincial Military Command: The Military Command of the agency or organization shall be directed by the Provincial Military Command on local defense and military work within the areas managed by the agency or organization; at the same time, there shall be a cooperative and coordinated relationship on certain aspects of work within the functions of the agency or organization related to defense such as: national defense education, building of defensive zones, civil defense; political potential building, economic potential building, and people's armed forces building.

4. With the Military Command of the district where the headquarters is located: The Military Command of the agency or organization shall be directed and commanded by the Military Command of the district regarding the construction of self-defense forces, reserve mobilization work, recruitment, and combat-security activities of the agency or organization's administrative sector.

5. With the Military Command of the higher-level vertical agency (if any), it is a subordinate-superior relationship, subject to direction and guidance on defense and military work and shall have the responsibility to report according to regulations.

6. With the self-defense unit under its authority, it is a relationship between direction and command and compliance with direction and command to perform tasks.

Article 16. The working relationship of the Military Command of agencies and organizations at the district level

1. With the Party Committee at the same level, it is a relationship between leadership and being led; under the leadership of the Party Committee, the Military Command shall be responsible for organizing the implementation of resolutions on defense and military work and reporting on the implementation of defense and military tasks to the Party Committee in accordance with regulations.

2. With the head of the agency or organization, it is a relationship between direction and management and being directed and managed.

The Military Command shall strictly comply with the direction, management, and operation of the head of the agency or organization regarding the implementation of defense and military work within its unit; at the same time, it shall propose measures to organize the implementation of assigned defense and military tasks.

3. With the District Military Command, it is a subordinate-superior relationship regarding the implementation of defense and military work.

The Military Command of the agency or organization shall be directly directed and commanded by the District Military Command on local defense and military work.

4. With the higher-level vertical Military Command (if any), it is a subordinate-superior relationship, subject to direction and guidance on defense and military work and shall have the responsibility to report on defense and military work according to regulations.

5. With the self-defense unit, it is a relationship between direction and command and compliance with direction and command to perform tasks.

Article 17. The working relationship of the Military Command of member agencies and organizations under central agencies and organizations

1. For the Military Command of member agencies and organizations under central agencies and organizations managed by the Provincial Military Command, it shall be implemented in accordance with Article 15 of this Regulation.

2. For the Military Command of member agencies and organizations under central agencies and organizations managed by the District Military Command, it shall be implemented in accordance with Article 16 of this Regulation.

Chapter IV

IMPLEMENTING PROVISIONS

Article 18. Effectiveness

1. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 19. Responsibility for Implementation

1. The Chief of the General Staff, Heads of General Departments, Commanders of Military Regions, Naval Forces, Military Commands of agencies and organizations at the central level, Provincial Military Commands, Military Commands of agencies and organizations at the provincial and district levels, and Heads of relevant agencies and units shall be responsible for implementing this Decision.

2. Based on the characteristics of the situation and requirements of defense work tasks, the head of the agency or organization shall issue decisions on the operational regulations of the Military Command at their own level, in accordance with the provisions of this Decision./.
