CIRCULAR

On the management of motor oil quality in circulation

Pursuant to the Commercial Law dated May 10, 1997.

Pursuant to Decree No. 95/CP dated December 4, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Trade.

To strengthen state management over the quality of motor oils, the Ministry of Trade guides the management of motor oil quality in circulation as follows:

1. SCOPE AND APPLICABILITY

a. Organizations and individuals, including foreign organizations and individuals (referred to as traders), engaged in motor oil business activities in Vietnam include: importation, wholesale, and retail.

b. Types of motor oils used for piston engines (excluding those used for marine vessels) include: four-stroke and two-stroke internal combustion engines using gasoline or diesel fuel (DO - Diesel Oil) or natural gas.

This Circular does not apply to aircraft engine lubricating oils.

2. Labeling regulations for motor oils:

Motor oils circulating in the Vietnamese market must comply with labeling requirements under current laws and Circular No. 486/BTM-QLCL dated July 21, 2000 of the Ministry of Trade.

3. Quality regulations

3.1 Viscosity grading and quality grading:

a. Viscosity grading: The viscosity grade of motor oils mentioned in Clause b, Section 1 shall be used according to the viscosity grading system of the Society of Automotive Engineers (SAE) in Table 1.

b. Quality grading: The quality grade of motor oils mentioned in Clause b, Section 1 shall be used according to the quality grading system of the American Petroleum Institute (API) in Table 2.

3.2 Mandatory criteria and minimum quality level:

The mandatory criteria and minimum quality level of motor oils mentioned in Clause b, Section 1 permitted to circulate in the Vietnamese market are specified in Table 3 (corresponding to quality grade SC/CB).

3.3 Traders are only allowed to trade in motor oils with a quality grade equal to or higher than the quality grade specified in Table 3.

3.4 Traders who are enterprises of all economic sectors having a business registration certificate for appropriate business activities, registered for export and import enterprise codes, are permitted to import raw materials and finished motor oils for production and circulation in accordance with this Circular.

3.5 The actual quality grade, quality criteria published on product labels, purchase and sale contracts, and provisions in this Circular serve as the legal basis for state authorities to inspect, audit quality, and control the motor oil market.

4. Implementation Clause

4.1 This Circular replaces Circular No. 06/2000/TT-BTM dated March 20, 2000 of the Ministry of Trade. All provisions contrary to this Circular are abolished.

4.2 This Circular takes effect 15 days from the date of issuance./.
