CIRCULAR
Guidelines for Implementing Certain Provisions on Science and Technology Policies for State-Owned Agricultural Farms and Forestry Companies as Specified in Decree No. 170/2004/NĐ-CP and Decree No. 200/2004/NĐ-CP of the Government
Pursuant to the Law on Science and Technology dated June 22, 2000;
Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain provisions of Decree No. 54/2003/NĐ-CP;
Pursuant to Decree No. 81/2002/NĐ-CP dated October 17, 2002 of the Government detailing the implementation of certain provisions of the Law on Science and Technology;
Pursuant to Decree No. 200/2004/NĐ-CP dated December 3, 2004 of the Government on the restructuring, reform, and development of state-owned forestry farms; the Ministry of Science and Technology issues guidelines for implementing certain provisions on science and technology policies for state-owned agricultural farms and forestry companies as follows:
I- GENERAL PROVISIONS
Pursuant to the Government Decree No. 170/2004/NĐ-CP dated September 22, 2004 on the restructuring, renovation, and development of state-owned farms;
These Circulars guide the implementation of certain provisions on science and technology policies for state-owned agricultural farms and forestry companies following their restructuring and reform according to Decree No. 170/2004/NĐ-CP dated September 22, 2004 of the Government on the restructuring, reform, and development of state-owned agricultural farms (hereinafter referred to as Decree No. 170/2004/NĐ-CP) and Decree No. 200/2004/NĐ-CP dated December 3, 2004 of the Government on the restructuring, reform, and development of state-owned forestry farms (hereinafter referred to as Decree No. 200/2004/NĐ-CP). These Circulars apply to state-owned agricultural farms and state-owned agricultural enterprises that have been restructured and reformed in terms of organizational structure, management mechanisms, and policies according to Decree No. 170/2004/NĐ-CP (hereinafter referred to as state-owned agricultural farms); forestry companies formed during the process of restructuring, reform, and development of state-owned forestry farms according to Decree No. 200/2004/NĐ-CP.
II- SUPPORT MEASURES FOR STATE-OWNED AGRICULTURAL FARMS AND FORESTRY COMPANIES IN THE FIELD OF SCIENCE AND TECHNOLOGY

1. Guidelines for Developing Scientific and Technological Tasks
Thông tư này áp dụng đối với tổ chức, cá nhân có liên quan đến hoạt động kinh doanh đối tượng thủy sản nuôi chủ lực trên lãnh thổ Việt Nam.
a) Each year, the competent state agencies at all levels responsible for science and technology (S&T) shall provide specific guidance to state-owned agricultural farms and forestry companies to identify S&T tasks aimed at addressing urgent S&T issues in production, business operations, and industry development.
b) The S&T tasks identified in accordance with Point a of this Clause shall be included in the annual national S&T plan, as well as in the plans of relevant ministries, sectors, and localities.
2. Support to Ensure Conditions for Receiving Advances in Science and Technology
a) Competent state agencies at all levels responsible for S&T shall develop specific plans to support the construction of technical infrastructure and training of human resources in S&T for state-owned agricultural farms and forestry companies to create conditions for these entities to effectively receive and apply advances in S&T.
b) The funds required to implement the tasks specified in Point a of this Clause shall be sourced from the following:
b.1. Funds invested by state-owned agricultural farms and forestry companies themselves (the main source).
b.2. Support funds provided by the state budget from the S&T public expenditure of ministries, sectors, and localities, or through projects funded by the state budget, including the Rural Development Program, the Fisheries Promotion Program, the Industry Promotion Program, and the Program "Building Models for Applying S&T to Serve Rural and Mountainous Economic and Social Development".
To participate in national-level projects and programs, state-owned agricultural farms and forestry companies should refer to the Science and Development Newspaper of the Ministry of Science and Technology and the Ministry's website (http://www.most.gov.vn or http://www.vista.gov.vn). For ministry-level projects and the Rural Development Program, they should contact the Department of Science and Technology under the relevant ministry or provincial Departments of Agriculture and Rural Development, Provincial Industry Departments...
3. Support for State-Owned Agricultural Farms and Forestry Companies to Implement Scientific and Technological Tasks
a) In cases where necessary and when conditions permit as prescribed by law, competent state agencies at all levels responsible for S&T may directly assign S&T tasks to state-owned agricultural farms and forestry companies.
b) When state-owned agricultural farms and forestry companies undertake S&T projects and programs prioritized by the state, they may receive partial funding support or financial assistance and loans from the National S&T Development Fund, sectoral and local funds, or preferential credit loans in accordance with Decree No. 119/1999/NĐ-CP of the Government dated September 18, 1999 on "Certain Policies and Financial Mechanisms to Encourage Enterprises to Invest in S&T Activities." The conditions and procedures for applying for financial support or loans from the National S&T Development Fund are stipulated in the "Regulations on the Organization and Operation of the National S&T Development Fund" issued together with Decree No. 122/2003/NĐ-CP of the Government dated October 22, 2003 on "Establishment of the National S&T Development Fund." The conditions and procedures for applying for financial support or loans from sectoral and local S&T development funds are stipulated in the corresponding regulations on organization and operation.
4. Provision of S&T Information
a) Competent state agencies at all levels responsible for S&T shall promptly provide S&T information to meet the development needs of state-owned agricultural farms and forestry companies through mass media and other means.
b) The state encourages organizations providing S&T services, agricultural extension centers, fisheries extension centers, industrial extension centers, and others to actively engage in activities to provide S&T information to meet the development needs of state-owned agricultural farms and forestry companies.
5. Cooperation and Collaboration Between State-Owned Agricultural Farms and Forestry Companies and Organizations and Individuals Engaged in S&T Activities
a) The state management agencies for science and technology at all levels shall be responsible for timely providing scientific and technological information to serve the development needs of state-owned farms and forestry companies through mass media and other means.
b) The State encourages organizations providing scientific and technological services, agricultural extension centers, fisheries extension centers, and industrial extension centers to intensify their activities in supplying scientific and technological information to meet the development requirements of state-owned farms and forestry companies.
5. Cooperation and collaboration between state-owned farms and forestry companies with organizations and individuals engaged in scientific and technological activities.
a) The State encourages and supports state-owned farms and forestry companies to cooperate and associate with organizations for science and technology through the establishment and implementation of scientific and technological projects using state budget funds or other sources of funding to address scientific and technological issues in production and business as well as in protecting genetic resources, experimenting with model trials, and producing high-yielding and high-quality crop and livestock varieties that are competitive in the market.
b) State management agencies for science and technology at all levels are responsible for developing programs linking scientific and technological research - training - production - business to support state-owned farms and modern forestry companies in updating technology, enhancing production capacity, diversifying high-quality products capable of competing in domestic and international markets.
6. Establishing a scientific and technological service organization and a fund for the development of scientific and technological activities.
a) State management agencies for science and technology at provincial and centrally-administered city levels are responsible for guiding and supporting state-owned farms and forestry companies in establishing and promoting the activities of affiliated scientific and technological service organizations to facilitate and accelerate the application of scientific and technological advancements in production and business, improving product quality and diversification to meet market demands both domestically and internationally.
b) The State encourages and supports state-owned farms and forestry companies to establish a fund for the development of scientific and technological activities aimed at investing in and developing infrastructure, purchasing machinery and equipment, researching and applying new scientific and technological advancements, and assisting in the training and upgrading of technical skills for staff within the units.
III- IMPLEMENTATION
1. Responsibilities of state management agencies for science and technology at all levels and scientific and technological organizations
a) State management agencies for science and technology at all levels guide state-owned farms and forestry companies in building and participating in scientific and technological tasks, annually planning investments in technical infrastructure and training human resources in science and technology for state-owned farms and forestry companies, and reporting to the Ministry of Science and Technology.
b) Scientific and technological organizations strengthen collaboration, joint ventures, and the transfer of science and technology, quickly introducing new technological advancements into the production and business operations of state-owned farms and forestry companies.
2. Effectiveness and responsibility for enforcement
a) This Circular takes effect fifteen days from the date of publication in the Official Gazette.
b) During implementation, if there are any difficulties, they should be reported to the Ministry of Science and Technology for study and resolution./.
