Circular No. 21/2012/TT-BTTTT stipulates the activities of Vietnam Post Corporation in international postal organizations.

CIRCULAR

REGULATIONS ON THE ACTIVITIES OF VIETNAM POST CORPORATION IN INTERNATIONAL ORGANIZATIONS ON POSTAL AFFAIRS

On the basis of The Law on Postal Services dated June 17, 2010;

Decree No. Decree No. 47/2011/NĐ-CP dated June 17, 2011 of the Government detailing implementation of certain provisions of Postal Law;

Decree No. Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Information and Communications; Decree No. Decree No. 50/2011/NĐ-CP dated June 24, 2011 of the Government amending Decree No. Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decision No. Decision No. 41/2011/QĐ-TTg dated August 3, 2011 of the Prime Minister on designation of enterprises to maintain and manage the public postal network, provide universal postal services, and international postal services;

Pursuant to Decision No. Decision No. 1746/QĐ-TTg dated November 16, 2012 of the Prime Minister on transferring the right of state ownership representation at Vietnam Post Corporation from Vietnam Posts and Telecommunications Group to the Ministry of Information and Communications;

At the proposal of the Director of the Post Department;

The Minister of Information and Communications issues this Circular regulating the activities of Vietnam Post Corporation in international organizations on postal affairs,

Article 1. Scope of Regulation

This Circular stipulates the role, content, rights, and obligations of Vietnam Post Corporation when participating in activities in international organizations on postal affairs.

Article 2. Applicability

This Circular applies to Vietnam Post Corporation and organizations and individuals related to the activities of Vietnam Post Corporation in international organizations on postal affairs.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. International treaties on postal affairs that the Socialist Republic of Vietnam is a member of are international treaties currently effective for the Socialist Republic of Vietnam (hereinafter referred to as international treaties), including charters, conventions, regulations, agreements, final protocols, and other rules and regulations of international organizations on postal affairs.

2. International postal services and other services within the framework of international treaties on postal affairs (hereinafter referred to as international postal services) are postal operations or services prescribed in international treaties.

Article 4. International organizations on postal affairs

International organizations on postal affairs that the Socialist Republic of Vietnam is a member of (hereinafter referred to as international organizations on postal affairs) include:

1. Universal Postal Union, comprising Congress, Executive Council, Postal Operations Council, International Bureau, and affiliated committees and associations.

2. Asia-Pacific Postal Union, comprising Congress, Executive Board, Office, and affiliated agencies and associations.

Article 5. Enterprises designated to participate in activities in international organizations on postal affairs

Vietnam Post Corporation is the enterprise designated by the State to implement activities providing international postal services and participate in activities in international organizations on postal affairs within the framework of international treaties on postal affairs stipulated in this Circular and other relevant laws.

Article 6. Contents of participation in international postal organizations by Vietnam Post Corporation

Vietnam Post Corporation participates in activities within international postal organizations with the following contents:

1. Providing international postal services within the framework of international treaties on postal matters.

2. Participating in the Postal Operations Council and associations under international postal organizations.

3. Implementing technical cooperation projects and sustainable development activities related to postal services on a global and regional scale.

4. Participating in the Universal Postal Union Congress and the Asia-Pacific Postal Union Congress.

5. Participating in the implementation of international treaties and overall strategies, comprehensive plans, and action programs of international postal organizations.

6. Participating in the implementation of agreements signed by the Ministry of Information and Communications with member countries of international postal organizations for the implementation of international treaties on postal matters.

Article 7. Tasks and Authorities of Vietnam Post Corporation when participating in activities in international postal organizations

When Vietnam Post Corporation participates in activities within international postal organizations, it has the following tasks and authorities:

1. Adhering to regulations and requirements regarding postal business for enterprises designated in international treaties on postal matters.

2. Adhering to Vietnamese laws concerning participation in international organizations and provision of international postal services.

3. Regarding the provision of international postal services within the framework of international treaties on postal matters:

a) Building, maintaining, managing, and operating an international postal network to ensure the provision of international postal services in accordance with the provisions of international treaties on postal matters and Vietnamese laws on postal services;

b) Preparing material infrastructure and necessary conditions for the sustainable and efficient provision of international postal services.

4. Regarding participation in the Postal Operations Council and associations under international postal organizations:

a) Participating in the Postal Operations Council as the officially designated enterprise of Vietnam;

b) Proactively deciding to join associations under international postal organizations;

c) Proactively participating in international cooperation activities, conferences, and seminars on postal matters;

d) Taking the lead in researching and preparing operational content related to postal matters concerning operations, business, technology, economics, and technical cooperation.

5. Regarding the implementation of technical cooperation projects and sustainable development activities related to postal services on a global and regional scale:

a) Proactively deciding to join technical cooperation projects and sustainable development activities related to postal services on a global and regional scale;

b) Taking the lead in developing plans and preparing material infrastructure, human resources, and finances;

c) Organizing the implementation of technical cooperation projects and activities already joined.

6. Regarding participation in the Universal Postal Union Congress and the Asia-Pacific Postal Union Congress:

a) Joining the Vietnamese delegation attending the Congress, meetings of councils, committees, and working groups of international postal organizations;

b) Proactively researching and proposing to the Ministry of Information and Communications recommendations for amendments and supplements to international treaties and other relevant operational content;

c) Coordinating in preparing content and other related work according to the requirements of the Ministry of Information and Communications.

7. Regarding participation in the implementation of international treaties, overall strategies, comprehensive plans, and action programs of international postal organizations and agreements stipulated in Clause 6 of Article 6 of this Circular:

a) Cooperating with the Ministry of Information and Communications and related agencies and units to implement international treaties and agreements stipulated in Clause 6 of Article 6 of this Circular;

b) Taking the lead in implementing strategies, comprehensive plans, and action programs for content related to designated postal enterprises;

c) Taking the lead in disseminating international treaties on postal matters throughout the public postal network.

8. Contributing financially according to the regulations of international postal organizations for related activities.

9. Implementing reporting work as stipulated in Article 8 of this Circular.

10. Providing full and timely information related to the Ministry of Information and Communications to serve state management and to receive guidance and support in implementation.

11. Implementing other activities in international postal organizations within the capabilities and conditions of the enterprise and according to the requirements of the Ministry of Information and Communications.

Article 8. Reporting Work

1. The Vietnam Post Corporation shall be responsible for reporting on:

a) Participation in the Postal Operations Council; participation in associations under international postal organizations as specified in point b, Clause 4, Article 7 of this Circular;

b) Results of participation in conferences, seminars, and meetings as specified in point c, Clause 4 and point a, Clause 6, Article 7 of this Circular, no later than fifteen days from the end date of such meetings;

c) Results or progress in implementing the contents specified in Clause 5, Article 7 of this Circular, no later than thirty days from the end date of implementation or according to the time schedule of activities, projects, technical cooperation programs;

d) As required by international postal organizations and the Ministry of Information and Communications.

2. The implementation of reporting as prescribed in Clause 1 of this Article must ensure the following requirements:

a) Within the prescribed deadlines;

b) The content and figures in the report must be consistent and accurate;

c) Sent in both paper and electronic versions to the Ministry of Information and Communications.

3. In cases where the Ministry of Information and Communications designates the Vietnam Post Corporation to directly submit reports to international postal organizations, the Vietnam Post Corporation shall be responsible for sending copies of the submitted reports to the Ministry of Information and Communications within five working days from the date of submission of the report.

4. Reporting on the activities of the Vietnam Post Corporation in international postal organizations and other international cooperation activities shall be carried out in accordance with this Circular and other relevant laws on postal services.

Article 9. Effective Date

1. This Circular takes effect from February 1, 2013.

2. This Circular replaces Decision No. 818/QD-BTTTT dated June 4, 2010 of the Minister of Information and Communications regarding the designation of the Vietnam Post Corporation to participate in certain activities in the Universal Postal Union's Postal Operations Council (POC), and Decision No. 835/QD-BTTTT dated June 4, 2010 of the Minister of Information and Communications regarding the appointment of the Vietnam Post Corporation to participate in the Asia Pacific Postal Union's Asia Pacific Postal Association (APPU).

Article 10. Implementation Organization

The Director of the Office, the Heads of the Postal Department, the International Cooperation Department, the Heads of agencies and units under the Ministry, the General Director of the Vietnam Post Corporation, and related organizations and individuals are responsible for implementing this Circular./.
