On the List of State Secrets
Top Secret Level in the Field of Natural Resources and Environment
Pursuant to the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Ordinance on Protection of State Secrets dated December 28, 2000;
Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protecting State Secrets;
At the request of the Minister of Natural Resources and Environment and the Minister of Public Security;
The Prime Minister issues this Decision on the List of State Secrets at the Top Secret level in the field of natural resources and environment.
Article 1. The List of State Secrets at the Top Secret level in the field of natural resources and environment includes the following information and documents:
1. Regarding water resources including:
a) The Party and State's policies regarding negotiations to establish, maintain, and develop international river basin organizations related to Vietnam; negotiations to protect national interests in activities involving the exploitation, utilization, and protection of international river water resources;
b) Documents serving the demarcation of boundaries along rivers and streams that have not been published or are yet to be published;
c) Documents on basic surveys of rivers, streams, and border water sources;
d) Forms of coded telegrams, frequencies, and communication times for exchanging water resource data on specialized information systems during wartime;
đ) Locations and elevation values of key markers at water resource stations; elevation data and absolute zero points of water resource measurement markers;
e) Topographic documents (horizontal profiles, vertical profiles, cross-section maps) and actual measured flow velocities at hydrological stations in estuary areas within a range of 30 kilometers inland from the sea for rivers in the Red River and Thai Binh River systems; 50 kilometers inland for rivers in the Dong Nai and Mekong River systems; 15 kilometers inland for rivers in other river systems.
2. Regarding the environment, it includes:
Information and documents concerning the Party and State's policies related to activities to address the consequences of chemical warfare agents used in Vietnam that have not been published or are yet to be published.
3. Regarding meteorology and hydrology, it includes:
a) The Party and State's policies on meteorological and hydrological activities serving the defense of national territorial sovereignty;
b) Forms of coded telegrams, frequencies, and communication times for exchanging meteorological and hydrological data on specialized information systems of the sector during wartime;
c) Locations and elevation values of key markers at meteorological, hydrological, and marine stations; elevation data and absolute zero points of marine measurement markers;
d) Topographic documents (horizontal profiles, vertical profiles, cross-section maps) and actual measured flow velocities at hydrological stations in estuary areas within a range of 30 kilometers inland from the sea for rivers in the Red River and Thai Binh River systems; 50 kilometers inland for rivers in the Dong Nai and Mekong River systems; 15 kilometers inland for rivers in other river systems.
4. Regarding surveying and mapping, it includes:
a) Coordinates of national base points of Class II or higher forming a complete national network accompanied by point annotations;
b) Survey and exploration documents about the national border that have not been published.
5. Regarding land, it includes:
Decisions, resolutions on land planning and usage plans, maps, and data and documents on land planning and usage for important projects related to national defense and security in border areas, maritime zones, islands, and national energy that have not been published or are yet to be published.
6. Regarding the sea and islands, it includes:
a) Data, maps, and diagrams on acoustic fields in Vietnam's maritime zones;
b) Documents on topography, geology, resources, and the environment of islands, island groups, and submerged reefs serving defense and security purposes that have not been published or are yet to be published;
c) Specialized documents, data, and maps on deep-sea geological and mineral surveys that have not been published or are yet to be published.
Documents using information and documents included in the List of State Secrets at the Top Secret level of agencies, units, and organizations within and outside the Ministry of Natural Resources and Environment.
Article 2. Effective Date
This Decision takes effect from June 10, 2013. This Decision replaces Decision No. 212/2003/QĐ-TTg dated October 21, 2003 of the Prime Minister on the List of State Secrets at the Top Secret level in the field of natural resources and environment.
Article 3. Implementation Organization
1. The Minister of Natural Resources and Environment and the Minister of Public Security are responsible for guiding and supervising the implementation of this Decision.
2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./.
