Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 21/2013/NĐ-CP dated March 4, 2013, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Minister of Natural Resources and Environment,

The Prime Minister issues a Decision to provide for the functions, tasks, powers and organizational structure of the Land Administration Agency under the Ministry of Natural Resources and Environment.

Article 1. Position and Functions

1. The Land Management General Department is an agency under the Ministry of Natural Resources and Environment, performing the function of advising and assisting the Minister of Natural Resources and Environment to manage state administration and enforce laws on land throughout the country; implementing public services in the field of land in accordance with the provisions of the law.

2. The Land Management General Department has legal personality, a seal in the shape of the National Emblem, its own account; its headquarters is located in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. To the Minister of Natural Resources and Environment:

a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government, draft decisions of the Prime Minister; draft circulars, joint circulars on land;

b) Strategies, plans, long-term, five-year, annual development programs; programs, projects, proposals on land;

c) Draft decisions, directives, professional procedures, economic and technical norms in land management and use.

2. Organizing, directing, inspecting the implementation of regulatory legal documents, mechanisms, policies, strategies, national programs, plans, proposals, projects on land management and use after being approved by competent authorities; reviewing, systematizing regulatory legal documents on land and codifying the system of regulations on land.

3. Taking the lead and coordinating to implement work on propaganda, dissemination, and education on land laws; answering and resolving issues and recommendations regarding land policies.

4. Regarding land planning and utilization:

a) Organizing the establishment and adjustment of national-level land use planning;

b) Providing professional guidance on the establishment and adjustment of land use planning at provincial and centrally-administered city levels and for land use planning for defense and security purposes;

c) Assisting the Minister of Natural Resources and Environment in organizing the review of the establishment and adjustment of land use planning at provincial and centrally-administered city levels and for land use planning for defense and security purposes;

d) Directing, monitoring, inspecting, and handling according to regulations the implementation of national and provincial-level land use planning indicators;

đ) Organizing inspections of the implementation of land use planning at provincial and centrally-administered city levels and for land use planning for defense and security purposes; the use of land by sectors and fields according to approved planning and plans;

e) Organizing the review of requests to change the purpose of using rice-growing land, special-use forest land, protective forest land within the Prime Minister's decision-making authority.

5. Regarding land registration:

a) Directing, guiding, and inspecting cadastral surveying and updating cadastral maps; the establishment and updating of cadastral records;

b) Guiding and inspecting land registration and registration of other property attached to land; issuing Certificates of Land Use Rights, Ownership Certificates of Housing and Other Property Attached to Land; professional activities related to land registration;

c) Organizing the guidance on building a nationwide land registration system;

d) Organize the issuance and inspection of the management and use of blank certificates of land use rights, ownership of houses, and attached assets;

đ) Compiling data on: land registration, cadastral surveying and map creation, issuance of Certificates of Land Use Rights, Ownership Certificates of Housing and Other Property Attached to Land, creation of cadastral records of provinces and centrally-administered cities;

6. Regarding land prices:

a) Guiding and inspecting the establishment and adjustment of land price lists;

b) Guiding and inspecting the application of land price ranges, principles, and methods for determining land prices; the implementation of procedures and formalities for establishing land price lists; specific land price determination; creation of land price maps;

c) Guiding, inspecting, and reviewing border land prices between provinces and centrally-administered cities within the Prime Minister's decision-making authority;

d) Taking the lead and coordinating with relevant agencies and organizations to resolve or submit to competent authorities for resolution recommendations on the establishment, adjustment, and application of land price lists by provincial and centrally-administered city People's Committees;

đ) Inspecting the valuation of land by organizations with land valuation advisory functions;

e) Organizing surveys, collecting, and managing market land price data in accordance with the law; compiling and providing data and information on land price ranges, land price lists, and specific land prices.

7. Regarding compensation, support, and resettlement when the State recovers land:

a) Guiding and inspecting the implementation of legal provisions on compensation, support, and resettlement when the State recovers land; guiding and inspecting the identification of land users eligible for compensation, support, or non-compensation, non-support;

b) Taking the lead and coordinating with relevant agencies and organizations to organize the review of compensation, support, and resettlement plans for investment projects within the approval authority of the National Assembly, the Prime Minister, and conditional investment projects as stipulated by law; resolving difficulties and obstacles regarding compensation, support, and resettlement when the State recovers land;

c) Guiding and inspecting the management and use of land after clearance of construction sites; issuing Certificates of Land Use Rights, Ownership Certificates of Housing and Other Property Attached to Land in resettlement areas.

8. Regarding land fund development, management, and development of the land use rights market:

a) Guiding and inspecting the implementation of land recovery, compensation, support, and resettlement for land fund development and land use rights auctions;

b) Guiding and inspecting the operations of land fund development organizations nationwide;

c) Guiding and inspecting the management of land funds assigned by the State without payment of land use fees.

9. Regarding land resource investigation and evaluation:

a) Organize investigations and assessments of land quality, potential, degradation, pollution, and classification of agricultural land nationwide and by regions periodically;

b) Organize specialized investigations and assessments on land management and use according to state management requirements for land;

c) Guiding the implementation of land investigations and evaluations in provinces and centrally-administered cities;

d) Compiling and publicly announcing the results of national and regional land resource investigations and evaluations.

10. Regarding the construction of land database and information systems:

a) Establish a unified land information system nationwide; implement and operate the national land information system; provide land information and data to organizations and individuals in accordance with the provisions of the law;

b) Guide and inspect the construction of the land information system; the storage of land data and the provision of land information by localities;

11. Regarding the supervision of land management and use:

a) Monitor and inspect on-site the management and use of land in economic zones, industrial parks, high-tech zones, industrial clusters, golf courses, and forestry and agricultural farms, and other projects and works using land within the jurisdiction of the National Assembly and the Government;

b) Organize the construction, management, and exploitation of a land resource monitoring and surveillance system; conduct land statistics and inventory and prepare land use status maps nationwide in accordance with the provisions of the law;

c) Organize the assessment of the implementation of laws on land; the effectiveness of land management and use nationwide;

d) Organize the assessment of the impact of land policy and law on the economy, society, and environment nationwide and at local levels;

12. Conduct specialized inspections on land throughout the country in accordance with the provisions of the law; participate in providing professional guidance for inspection, examination, handling of violations of the law, resolving disputes, complaints, and denunciations in the field of land according to the division of work by the Minister of Natural Resources and Environment;

13. Regarding international cooperation:

a) Propose participation in negotiating and signing international treaties and agreements; participate in international organizations and forums on land issues according to the division of work by the Minister of Natural Resources and Environment;

b) Assist the Minister of Natural Resources and Environment in serving as the focal point for implementing international treaties and agreements on land issues;

c) Organize the implementation of international cooperation programs and projects on the land sector according to the division of labor by the Minister of Natural Resources and Environment.

14. Organize research, transfer, application, and dissemination of scientific and technological advances in the field of land;

15. Organize the appraisal and certification of products, projects, and programs related to land management and use;

16. Organize the implementation of public services on land in accordance with the provisions of the law; guide and inspect activities of public services on land management and use; issue certificates of practice in the field of land in accordance with the provisions of the law;

17. Implement administrative reform in land management and use according to the administrative reform program of the Ministry of Natural Resources and Environment and the division of work by the Minister;

18. 13. The Land Training and Communication Center.

14. The Cadastre Technology Application and Development Center.

15. The Land Valuation and Cadastre Verification Center.

Article 4. Leadership

1. The Land Management General Department has a Director-General and not more than three Deputy Director-Generals.

2. The Director General and Deputy Directors General are appointed, relieved of duty, or dismissed by the Minister of Natural Resources and Environment in accordance with the provisions of law.

3. The Director-General of the Land Management General Department shall prescribe the functions, tasks, authorities, and organizational structure of subordinate organizations under the Land Management General Department.

4. The Director-General of the Land Management General Department is responsible to the Minister of Natural Resources and Environment and to the law for all activities of the Land Management General Department. Deputy Director-Generals of the Land Management General Department are responsible to the Director-General of the Land Management General Department and to the law for their assigned areas of work.

Article 5. Effective Date

1. This Decision takes effect from April 28, 2014, and replaces Decision No. 134/2008/QĐ-TTg dated October 2, 2008, of the Government Chairman stipulating the functions, tasks, authorities, and organizational structure of the Land Management General Department under the Ministry of Natural Resources and Environment; and Decision No. 25/2011/QĐ-TTg dated April 18, 2011, of the Government Chairman amending and supplementing some points of Clauses 4, 5, 6, 7, and 8, Article 2 of Decision No. 134/2008/QĐ-TTg dated October 2, 2008, of the Government Chairman stipulating the functions, tasks, authorities, and organizational structure of the Land Management General Department under the Ministry of Natural Resources and Environment.

2. The Minister of Natural Resources and Environment, ministers of other ministries, heads of agencies equivalent to ministries, heads of government agencies, chairpersons of provincial people's committees directly under the central government, and the Director of the Land Management General Department shall be responsible for enforcing this Decision./.
