Guidelines for types of natural disasters and dangerous diseases supported under Decision No. 142/2009/QĐ-TTg dated December 31, 2009 and Decision No. 49/2012/QĐ-TTg dated November 8, 2012 of the Government

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
On the basis of Decision No. 142/2009/QĐ-TTg dated December 31, 2009 of the Government on mechanisms and policies to support seeds, livestock, and aquatic species to restore production in areas affected by natural disasters and diseases; Decision No. 49/2012/QĐ-TTg dated November 8, 2012 of the Government amending and supplementing Article 3 of Decision No. 142/2009/QĐ-TTg;
At the proposal of the Director of the Legal Department,
The Minister of Agriculture and Rural Development issues this Circular guiding the types of natural disasters and dangerous diseases supported under Decision No. 142/2009/QĐ-TTg dated December 31, 2009 and Decision No. 49/2012/QĐ-TTg dated November 8, 2012 of the Government.
Article 1. Types of Natural Disasters Supported
Types of natural disasters causing direct damage to crops, livestock, and aquaculture as stipulated at point a, Clause 1, Article 1 of Decision No. 142/2009/QĐ-TTg include types of natural disasters as prescribed in Clause 1, Article 3 of the Law on Prevention and Control of Natural Disasters 2013.
Article 2. Types of Harmful Organisms and Dangerous Diseases Supported
Types of harmful organisms and dangerous diseases supported for crops, livestock, and aquaculture as stipulated at point b, Clause 1, Article 1 of Decision No. 142/2009/QĐ-TTg include:
1. Types of harmful organisms dangerous to crops:
a) For rice: Brown planthopper; yellow dwarf, black streaked dwarf, leaf curl virus disease; blast disease; stripe rust, leaf spot; bacterial black spot, bacterial grain rot;
b) For other crops: Sugarcane smut; sugarcane white leaf; dragon's blood disease on sweet potato, lychee; pink wax scale on sweet potato; rubber leaf fall disease caused by Corynespora cassiicola; coffee root-knot nematode disease; quick and slow death diseases on pepper; red spot disease on dragon fruit; black streaked dwarf on corn.
2. Types of dangerous diseases for livestock include:
a) Avian influenza;
b) Foot-and-mouth disease in livestock;
c) Blue ear disease in pigs.
3. Types of dangerous diseases for aquatic animals include:
a) White spot disease in black tiger shrimp and whiteleg shrimp;
b) Yellow head disease in black tiger shrimp and whiteleg shrimp;
c) Acute hepatopancreatic necrosis disease in black tiger shrimp and whiteleg shrimp;
d) Hematopoietic and epithelial organ necrosis disease in black tiger shrimp and whiteleg shrimp;
đ) Neurological necrosis disease in snapper and trevally;
e) Hepatopancreatic mucus disease in tra catfish and basa;
g) Milk disease in spiny lobster;
h) Perkinsus disease when the causative agent is Perkinsus marinus and Perkinsus olseni in green mussel and abalone.
Article 3. Authority to Determine Damage Caused by Natural Disasters; Authority to Declare Harmful Organisms and Dangerous Diseases to Receive Support Policies for Seeds, Livestock, and Aquatic Species
1. Natural Disasters: The authority to determine damage caused by natural disasters shall be carried out in accordance with the laws on prevention and control of natural disasters.
2. Harmful Organisms and Dangerous Diseases
a) For crops and livestock: The authority to declare harmful organisms and dangerous diseases shall be carried out in accordance with the laws on plant protection and quarantine, and veterinary medicine.
b) For aquatic animals: The authority to declare aquatic animal diseases shall be carried out in accordance with the laws on veterinary medicine. In cases where there is no declaration of disease, the Chairman of the People's Committee of the province or centrally governed city shall confirm the occurrence of specific aquatic animal diseases in their locality as a basis for implementing support policies.
Article 4. Implementation provisions
1. This Circular takes effect from August 11, 2014.
2. This Circular replaces Circular No. 39/2010/TT-BNNPTNT dated June 28, 2010 of the Ministry of Agriculture and Rural Development guiding the types of natural disasters and dangerous diseases supported under Decision No. 142/2009/QĐ-TTg dated December 31, 2009 of the Government.
3. During implementation, if any difficulties arise, they should be promptly reported to the Ministry of Agriculture and Rural Development for study and resolution./.
