CIRCULAR

Regulations on Competition and Reward Work in the Cultural, Sports, and Tourism Sector

Pursuant to the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated June 14, 2005 and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward dated November 16, 2013;

Pursuant to Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward; Decree No. 39/2012/NĐ-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Reward and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward and Decree No. 65/2014/NĐ-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward in 2013;

Pursuant to Decree No. 76/2013/NĐ-CP dated July 16, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Department of Competition and Reward;

The Minister of Culture, Sports, and Tourism promulgates this Circular regulating competition and reward work in the Cultural, Sports, and Tourism sector,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular stipulates the subjects of competition and reward; organization of competition and standards for commendation titles; forms and standards for rewards; authority to decide, present, procedures, and files for nominating to award commendation titles and reward forms; Competition and Reward Councils, Innovation Councils, and Competition and Reward Funds in the Cultural, Sports, and Tourism sector.

2. This Circular applies to organizations and individuals related to competition and reward work in the Cultural, Sports, and Tourism sector.

Article 2. Subjects of Competition and Reward

1. Subjects of competition include:

a) General Departments and equivalent units, Bureaus, Departments, Inspectorate of the Ministry, Office of the Ministry (hereinafter collectively referred to as units under the Ministry);

b) Public service units and enterprises under the Ministry (hereinafter collectively referred to as units under the Ministry);

c) Provincial Departments of Culture, Sports, and Tourism (hereinafter collectively referred to as Departments of Culture, Sports, and Tourism);

d) District Cultural and Information Offices; Cultural and Sports Centers;

đ) Departments, offices, or equivalent units directly under the units specified in points a and b of this clause;

e) Officials, civil servants, public officials, employees including probationary civil servants, indefinite-term contractual staff, and those with fixed-term contracts of one year or more working at the units specified in points a, b, c, d, and đ of this clause.

2. Subjects of reward include:

a) The subjects of competition specified in Clause 1 of this Article; Associations, Societies, Professional Federations operating in the fields of culture, sports, and tourism (hereinafter collectively referred to as collectives and individuals in the Cultural, Sports, and Tourism sector);

b) Collectives and individuals outside the Cultural, Sports, and Tourism sector who have outstanding achievements in areas under the management of the Ministry of Culture, Sports, and Tourism;

c) Vietnamese organizations and individuals abroad and foreign organizations and individuals who have contributed to the construction and development of the Cultural, Sports, and Tourism sector.

Article 3. Objectives of the competition and reward work

The objectives of the competition and reward work are to create motivation to encourage, attract, and motivate collectives and individuals to promote their patriotic traditions, dynamism, creativity, and strive to excellently complete assigned tasks; recognize the achievements of collectives and individuals for the cultural, sports, and tourism cause, contributing to successfully fulfilling the political tasks of the Ministry and the development goals of the Culture, Sports, and Tourism sector.

Article 4. Principles of the competition and reward work

The competition and reward work in the Culture, Sports, and Tourism sector shall be carried out in accordance with Article 1 of Circular No. 07/2014/TT-BNV dated August 29, 2014, issued by the Ministry of Home Affairs (hereinafter referred to as Circular No. 07/2014/TT-BNV), and according to the principle that individuals engaged in leadership and management work, in addition to long-term contribution award forms, will still be considered and proposed for regular awards and other award forms if they meet the prescribed conditions and standards and must be based on the achievements of the collective under their responsibility.

Article 5. Rights and responsibilities of organizations and individuals in the competition and reward work

1. The Minister of Culture, Sports, and Tourism shall organize the launch and direct the implementation of the competition movement throughout the sector, decide on granting commendation titles and reward forms within the scope of authority or submit to the competent authority for consideration of granting commendation titles and reward forms in accordance with the laws on competition and rewards, and bear responsibility for the competition and reward work in the Culture, Sports, and Tourism sector.

2. The Director of the Department of Competition and Rewards shall provide advice, coordinate with agencies and units under the Ministry to propose to the Minister regarding policies, contents, programs, plans, measures to organize the competition movement; guide, urge, inspect, summarize, and conclude the competition movements and reward work; widely disseminate exemplary models and good deeds in the sector; review application files for competition registration and reward consideration submitted to the Ministry's Competition and Reward Council for examination, and submit to the Minister for consideration and grant according to the scope of authority or submit to the competent authority for consideration of granting commendation titles and reward forms in accordance with the laws on competition and rewards.

3. Heads of agencies and units under the Ministry, Directors of Provincial Departments of Culture, Sports, and Tourism shall be responsible for leading and coordinating with Party committees, Party organizations, Trade Unions, Youth Leagues, Women's Associations at the same level to concretize the contents, targets, measures to organize competition movements, and inspect the implementation; summarize and conclude competition movements, widely disseminate exemplary models; propose rewards and suggest innovations in competition and reward work; give opinions on reward cases when requested by the Ministry's Competition and Reward Council.

4. News and communication agencies under the Ministry shall be responsible for continuously publicizing the competition and reward work; identify exemplary individuals and collectives with outstanding achievements in the competition movement to set examples, widely disseminate exemplary models; criticize negative phenomena and behaviors violating the laws on competition and rewards.

5. Collectives and individuals proposed for consideration of commendation titles and reward forms must fully and promptly comply with the procedures, formalities, and deadlines for submitting reward application files as stipulated in this Circular and relevant laws.

Article 6. Rights and Obligations of Collectives and Individuals Awarded Commendation Titles and Honors

1. Collectives awarded commendation titles and honors shall be granted Certificates of Merit, Certificates of Recognition, and monetary rewards or tangible awards as prescribed by laws on commendation and reward; they have the right to retain, display, and use Certificates of Merit, Certificates of Commendation, Certificates of Recognition, or tangible awards for commendation on official documents and materials of their agencies and units.

2. Individuals awarded commendation titles and honors shall receive Certificates of Merit, Certificates of Recognition, and monetary rewards or tangible awards as prescribed by laws on commendation and reward; they shall be given priority for selection to study and work both domestically and internationally, and for training to enhance their professional qualifications; they shall be given priority in consideration, evaluation, planning, appointment, reappointment, and salary increase before schedule as prescribed.

3. Collectives and individuals awarded commendation titles and honors shall be responsible for promoting their achievements, continuing to strive to achieve higher commendation titles and honors; and preserving the tangible awards received.

Article 7. Groups and Clusters of Competitions

1. Based on the characteristics of position, function, tasks, nature of work, and scope of operation of agencies and units under the Ministry, the Minister decides to establish Competition Groups, and based on specific characteristics and conditions of Cultural, Sports, and Tourism Departments in different regions, the Minister decides to establish Competition Clusters.

2. The Group Leader, Deputy Group Leader of Competition Groups, Cluster Leader, and Deputy Cluster Leader of Competition Clusters shall be recognized by the Minister and shall be responsible to the Minister for the activities of the Groups and Clusters.

3. Tasks and Authorities of Competition Groups and Clusters:

a) Organizing the launch and signing of competition agreements to implement mass competition movements initiated by the Ministry, specifically detailing targets, contents, and measures to build competition movements within the Groups and Clusters to develop strongly, widely, correctly, and effectively;

b) Summarizing and concluding competition movements, proposing directions and tasks for organizing competition movements, exchanging learning experiences, sharing best practices, building new models, and exemplary cases within the Groups and Clusters;

c) Evaluating and ranking within the Groups and Clusters according to regulations; selecting and honoring collectives with outstanding achievements in descending order, and reporting to the Ministry's Competition and Reward Council to propose the Minister to award commendation titles and honors according to authority or to submit to competent authorities for consideration and awarding commendation titles and honors to outstanding collectives within the Groups and Clusters.

Chapter II

ORGANIZATION AND LAUNCH OF COMPETITION MOVEMENTS; COMPETITION TITLES AND STANDARDS FOR COMPETITION TITLES

Article 8. Forms of Organization of Competition Movements

The forms of organization of competition movements shall be implemented in accordance with Article 2 of Circular No. 07/2014/TT-BNV dated August 29, 2014, issued by the Ministry of Home Affairs guiding the implementation of Decrees No. 42/2010/NĐ-CP, No. 39/2012/NĐ-CP, and No. 65/2014/NĐ-CP (hereinafter referred to as Circular No. 07/2014/TT-BNV) and the following provisions:

1. The Ministry of Culture, Sports and Tourism shall launch competition campaigns periodically or on specific topics aimed at achieving success in the five-year socio-economic development plan of the State and completing the annual tasks of the sector.

2. Agencies and units within the sector shall organize competitions to celebrate traditional days of the sector, anniversaries of the establishment of the sector, and anniversaries of the establishment of agencies and units every five years or when there are key or urgent tasks requiring concentrated competition efforts throughout the agency or unit.

Article 9. Content of organizing competitive movements

The content of organizing competitive movements shall be carried out in accordance with the provisions of Article 3 of Circular No. 07/2014/TT-BNV and the following contents:

1. Clearly define the objectives, scope, and target groups for the competition, on this basis, set specific targets, slogans, content, and duration of the competition. The determination of the content and targets of the competition must ensure scientificity, feasibility, and suitability with the actual conditions of the agency, unit, or locality.

2. Emphasize the promotion of information about the content and significance of the competition period, encourage the sense of responsibility and self-awareness of each civil servant, officer, employee, and worker, diversify forms of launching competitions; oppose all manifestations of ostentation and formalism in competitions.

3. Implement measures to organize and mobilize for competitions, monitor the process of organizing competitions, organize pilot guidance to draw lessons and disseminate good experiences among participating entities.

4. For long-term competition periods (one year or more), it is necessary to organize mid-term reviews to draw lessons. At the end of the competition period, conduct a summary, evaluate results, and publicly select outstanding and excellent collectives and individuals in the competition movement for commendation.

Article 10. Registration for Competition, Signing of Competition Pledges

1. Agencies and units organize for collectives and individuals to register their efforts to achieve competition targets and honors for the year and submit the registration form for competition to the Department of Competition and Commendation before March 25th every year.

2. Competition Groups and Clusters organize the signing of competition pledges, unify the scoring table of the Group and Cluster and submit it to the Department of Competition and Commendation before March 30th every year.

Article 11. Honors for Competition

1. Honors for Collectives:

a) Flag of Government Competition;

b) Flag of Excellence of the Ministry;

c) Excellent Labor Collective;

d) Advanced Labor Collective.

2. Honors for Individuals:

a) National Model Competitor;

b) Outstanding Worker at the Ministry Level;

c) Grassroots Model Competitor;

d) Advanced Worker.

Article 12. Criteria for Honors for Collectives and Methods of Granting

1. Honor "Flag of Excellence of the Government":

a) Criteria:

- Achieving outstanding results, exceeding targets, comprehensively completing assigned tasks for the year, leading the competition movement within the Group and Cluster;

- Being the most outstanding collective among those receiving the "Flag of Excellence of the Ministry" honor;

- Having exemplary new factors and models for the whole country to learn from;

- Maintaining internal unity, practicing thrift, combating waste, corruption, and other social evils.

b) Method of Granting:

- Organizing the granting annually during the Ministry's annual work summary;

- The number of collectives proposed for granting shall not exceed 20% of the total number of collectives that have been granted the "Flag of Excellence of the Ministry" honor;

- Based on annual competition registrations with the Government (through the Central Steering Committee for Competition and Commendation), the Ministry of Culture, Sports and Tourism selects and submits to the Government for granting to agencies and units under the Ministry and considers recommending for granting this honor to Provincial Departments of Culture, Sports and Tourism.

2. Honor "Flag of Excellence of the Ministry":

a) Criteria:

- Excellently and comprehensively completing assigned tasks for the year; being an outstanding model in the industry;

- Having exemplary new factors and models for other collectives in the industry to learn from; being selected and honored as an outstanding collective in the Group and Cluster;

- Maintaining internal unity; actively practicing thrift, combating waste, corruption, and negativity.

b) Method of Granting:

- Organizing the granting during the Ministry's annual work summary;

- The number of collectives proposed for granting follows the annual guidelines of the Ministry.

3. Honor "Excellent Labor Collective":

a) Criteria:

- Innovatively overcoming difficulties to excellently complete assigned tasks, fulfilling national obligations well; selected from collectives achieving the "Advanced Labor Collective" honor;

- Having regular, practical, and effective competition movements;

- All individuals in the collective completing assigned tasks, with at least 70% of them achieving the "Advanced Worker" honor;

- Having individuals achieving the "Outstanding Worker at the Grassroots Level" honor and no individual being disciplined with a warning or higher;

- Maintaining internal unity, setting a good example in implementing Party policies and State laws.

b) Method of Granting:

Granting this honor annually to collectives specified in points a, b, and d of Clause 1 of Article 2 of this Circular.

4. Honor "Advanced Labor Collective":

a) Criteria:

- Completing assigned tasks and plans; selected from collectives completing assigned tasks;

- Having regular, practical, and effective competition movements;

- More than 50% of individuals in the collective achieving the "Advanced Worker" honor and no individual being disciplined with a warning or higher;

- Maintaining internal unity, complying well with Party policies and State laws, and strictly adhering to regulations of the Ministry.

b) Method of Granting:

Granting this honor annually to collectives specified in points a, b, and d of Clause 1 of Article 2 of this Circular.

Article 13. Criteria for commendation titles for individuals and procedures for awarding

1. Title "National Model Worker":

a) Criteria:

- Outstanding achievements, selected from individuals who have continuously achieved the title "Ministry Model Worker" twice, including six consecutive years achieving the title "Basic Unit Model Worker" before the time of nomination for consideration;

- Having an innovation that is a technical solution, management solution, professional work solution, or application of advanced technology to increase labor productivity and work efficiency recognized by the Ministry's Innovation Council, or having a research topic at the Ministry level that has been accepted and achieved high effectiveness with national impact.

b) Method of Granting:

- The awarding process takes place once a year at the first meeting of the Ministry's Commendation-Reward Council annually for individuals who have continuously achieved the title "Ministry Model Worker" twice.

2. Title "Ministry Model Worker":

a) Criteria:

- Outstanding achievements among individuals who have continuously achieved the title "Basic Unit Model Worker" three times;

- Having an innovation or work solution recognized by the Ministry's Innovation Council as effective and positively impacting the industry's activities, or participating primarily in a research topic at the Ministry level, evaluated and accepted with excellent classification by the Ministry's Science Council.

b) Method of Granting:

- The awarding process takes place once a year for individuals working in agencies or units under the Ministry at the end of the working year, or during the National Patriotic Exemplary Movement Congress for individuals working in the cultural, sports, and tourism sector.

3. Title "Basic Unit Model Worker":

a) Criteria:

- Achieving the title "Advanced Worker";

- Excellently completing assigned tasks;

- Having an innovation that is a technical solution, management solution, operational solution, or application of advanced technology to increase labor productivity and work efficiency recognized by the Basic Unit's Innovation Council, or having a research topic that has been accepted.

b) Method of Granting:

The awarding process follows the annual guidance document of the Ministry, with the ratio of nominations not exceeding 15% among employees who have achieved the title "Advanced Worker".

4. Title "Advanced Worker":

a) Criteria:

- Successfully completing assigned tasks with high productivity, quality, and efficiency in work;

- Adhering well to the Party's policies, State laws, agency regulations, overcoming difficulties to complete tasks, supporting colleagues, actively participating in exemplary movements;

- Actively studying to improve professional skills;

- Possessing healthy morals and lifestyle.

b) Method of Granting:

The awarding process takes place annually at the end of the working year for individuals in agencies and units specified in points a, b, and d of Clause 1, Article 2 of this Circular.

Chapter III

FORMS OF REWARD AND STANDARDS FOR REWARD

Article 14. Types of rewards

1. Types of rewards implemented according to Clauses 1, 2, 3, 4, and 6 of Article 10 of Circular No. 07/2014/TT-BNV.

2. Rewards for dedication carried out according to Article 11 of Circular No. 07/2014/TT-BNV.

Article 15. Forms of State rewards

1. Orders:

a) "Golden Star Order";

b) "Ho Chi Minh Medal";

c) "Independence Order" First Class, Second Class, Third Class;

d) "Labor Order" First Class, Second Class, Third Class;

đ) "Bravery Order";

e) "Friendship Order".

2. Friendship Medal

3. Honorary titles of the State:

a) Title "People's Heroic Forces";

b) Title "Heroic Laborer";

c) Title "People's Teacher", "Outstanding Teacher";

d) Title "People's Doctor", "Outstanding Doctor";

đ) Title "People's Artist", "Outstanding Artist";

e) Title "People's Artisan", "Outstanding Artisan".

4. State honorary awards:

a) Ho Chi Minh Award for Literature and Arts;

b) State Award for Literature and Arts.

5. "Prime Minister's Commendation".

Article 16. Forms of reward within the authority to decide of the Minister and heads of agencies and units under the Ministry

1. Forms of reward within the authority to decide of the Minister:

a) Certificate of Merit;

b) Commemorative Medal "For the Cause of Culture, Sports and Tourism".

2. Form of reward within the authority to decide of the heads of agencies and units under the Ministry with separate accounts: Letter of Commendation.

Article 17. Criteria for awarding forms of State rewards

1. Criteria for awarding "Golden Star Order":

a) Criteria for awarding "Golden Star Order" for collectives shall be implemented according to the provisions of Article 7 of Decree No. 65/2014/ND-CP;

b) Criteria for awarding or posthumously awarding "Golden Star Order" for individuals shall be implemented according to the provisions of Clause 2, Article 20 of Decree No. 42/2010/ND-CP.

2. Criteria for awarding "Ho Chi Minh Order":

a) Criteria for awarding "Ho Chi Minh Order" for collectives shall be implemented according to the provisions of Clause 4, Article 21 of Decree No. 42/2010/ND-CP and Article 8 of Decree No. 65/2014/ND-CP;

b) Criteria for awarding or posthumously awarding "Ho Chi Minh Order" for individuals shall be implemented according to the provisions of Clause 1, Article 21 of Decree No. 42/2010/ND-CP.

3. Criteria for awarding Independence Order, First Class, Second Class, Third Class for collectives and individuals shall be implemented according to the provisions of Articles 9, 10 and 11 of Decree No. 65/2014/ND-CP.

4. Criteria for awarding Labor Order, First Class, Second Class, Third Class for collectives and individuals shall be implemented according to the provisions of Articles 15, 16 and 17 of Decree No. 65/2014/ND-CP.

5. Criteria for awarding "Bravery Order" for individuals shall be implemented according to the provisions of Article 38 of Decree No. 42/2010/ND-CP.

6. Criteria for awarding "Friendship Order" for foreign organizations and individuals shall be implemented according to the provisions of Article 39 of Decree No. 42/2010/ND-CP.

7. Criteria for awarding "Friendship Medal" for foreign individuals shall be implemented according to the provisions of Article 22 of Decree No. 65/2014/ND-CP.

8. Criteria for awarding the title of "People's Hero" to present to collectives, to present or posthumously present to individuals shall be implemented according to the provisions of Clause 30, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Mobilization and Reward in 2013.

9. Criteria for awarding the title of "Hero of Labor" to present to collectives, to present or posthumously present to individuals shall be implemented according to the provisions of Clause 31, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Mobilization and Reward in 2013.

10. Criteria for awarding the title of "People's Teacher" for individuals shall be implemented according to the provisions of Clause 2, Article 62 of the Law on Mobilization and Reward amended and supplemented at Clause 32, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Mobilization and Reward in 2013.

11. Criteria for awarding the title of "Outstanding Teacher" for individuals shall be implemented according to the provisions of Clause 3, Article 62 of the Law on Mobilization and Reward.

12. Criteria for awarding the title of "People's Doctor" for individuals shall be implemented according to the provisions of Clause 2, Article 63 of the Law on Mobilization and Reward amended and supplemented at Clause 33, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Mobilization and Reward in 2013.

13. Criteria for awarding the title of "Outstanding Doctor" for individuals shall be implemented according to the provisions of Clause 3, Article 63 of the Law on Mobilization and Reward.

14. Criteria for awarding the titles of "People's Artist", "Outstanding Artist" for individuals shall be implemented according to the provisions of Articles 8 and 9 of Decree No. 89/2014/ND-CP dated September 29, 2014 of the Government on awarding the titles of "People's Artist", "Outstanding Artist".

15. Criteria for awarding the titles of "People's Artisan", "Outstanding Artisan" for individuals shall be implemented according to the provisions of Articles 5 and 6 of Decree No. 62/2014/ND-CP dated June 25, 2014 of the Government on awarding the titles of "People's Artisan", "Outstanding Artisan".

16. Criteria for awarding Ho Chi Minh Prize, State Prize for Literature and Arts for individuals shall be implemented according to the provisions of Articles 9 and 10 of Decree No. 90/2014/ND-CP dated September 29, 2014 of the Government on awarding Ho Chi Minh Prize, State Prize for Literature and Arts.

17. Criteria for awarding "Labor Order", "Certificate of Merit of the Prime Minister" for athletes, coaches who achieve outstanding results at international sports competitions and artists who win high awards at international contests, festivals, exhibitions shall be implemented according to the provisions of the State and the Minister of Culture, Sports and Tourism.

18. Criteria for awarding Certificate of Merit of the Prime Minister for collectives, individuals and families shall be implemented according to the provisions of Article 23 of Decree No. 65/2014/ND-CP.

Article 18. Criteria for awarding commendation forms within the decision-making authority of the Minister and Heads of agencies and units under the Ministry

1. The Certificate of Merit of the Minister shall be awarded annually to collectives according to the following provisions:

a) Awarded annually during the year-end summary of the Ministry's work to the Departments of Culture, Sports and Tourism belonging to the Competitive Group; departments, divisions (or equivalent) under the Departments and subordinate agencies and units of the Departments of Culture, Sports and Tourism of provinces and centrally-administered cities that meet the criteria specified in Clauses 2 and 3 of Article 24 of Decree No. 65/2013/NĐ-CP;

b) Awarded exceptionally to collectives that achieve outstanding results winning high awards at national and international competitions, festivals, exhibitions in the field of state management on culture, family, sports and tourism, or achievements with exemplary effect within the Ministry and sector, not included in the competition targets or not participating in signing competition agreements, or achieving outstanding and exemplary results assessed during competition campaigns launched by the Ministry;

c) Awarded exceptionally to agencies and units outside the Department of Culture, Sports and Tourism both domestically and internationally that have made many outstanding contributions to the development of the sector.

2. The Certificate of Merit of the Minister shall be awarded to individuals according to the following provisions:

a) Awarded annually during the year-end summary of the Ministry's work to individuals under the Departments and subordinate agencies and units of the Departments of Culture, Sports and Tourism of provinces and centrally-administered cities that meet the criteria specified in Clause 1 of Article 24 of Decree No. 65/2013/NĐ-CP;

b) Awarded exceptionally to individuals who achieve particularly outstanding results at national and international competitions, festivals, exhibitions in the fields of culture, family, sports and tourism organized by the Ministry of Culture, Sports and Tourism, or who achieve outstanding and exemplary results assessed during competition campaigns launched by the Ministry;

c) Awarded exceptionally to individuals outside the Department of Culture, Sports and Tourism both domestically and internationally who have made many outstanding contributions to the development of the sector.

3. Commemorative Medal "For the Cause of Culture, Sports and Tourism":

The awarding of the Commemorative Medal "For the Cause of Culture, Sports and Tourism" shall be carried out in accordance with the provisions of Circular No. 11/2014/TT-BVHTTDL dated October 1, 2014, issued by the Minister of Culture, Sports and Tourism regarding the awarding of the Commemorative Medal "For the Cause of Culture, Sports and Tourism" and the amount of monetary reward and preferential treatment implemented in accordance with Clause 2 of Article 76 of Decree No. 42/2010/NĐ-CP.

4. Certificate of Merit of the Head of agencies and units under the Ministry having separate accounts and seals:

The awarding of the "Certificate of Merit of the Head of agencies and units under the Ministry" shall be carried out in accordance with the provisions of Clause 42 of Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Reward 2013.

Chapter IV

AUTHORITY, PROCEDURES, AND DOCUMENTS FOR PROPOSING AWARDS OF COMPETITION AWARDS AND RECOGNITION FORMS AND ORGANIZING THE AWARDING

Article 19. Authority to decide on awarding honorary titles and commendation forms

1. The authority to decide on awarding Orders, Medals of Friendship, National Honorary Titles, National Honorary Awards, "Flag of Excellence from the Government", "National Model Worker", and "Certificate of Merit of the Prime Minister" shall be implemented in accordance with the provisions of Articles 77 and 78 of the Law on Competition and Reward.

2. The Minister of Culture, Sports and Tourism decides to award:

a) Honorary titles "Flag of Excellence from the Ministry", "Outstanding Labor Collective", and "Ministry-Level Model Worker";

b) Honorary titles "Advanced Worker" and "Model Worker at the Base Level" for individuals and the title "Advanced Labor Collective" for collectives for the Departments and the Office of the Ministry;

c) Certificates of Merit and Commemorative Medal "For the Cause of Culture, Sports and Tourism".

3. The Heads of agencies and units under the Ministry having separate accounts and seals decide to award:

a) Honorary titles "Advanced Worker", "Model Worker at the Base Level", and "Advanced Labor Collective" for collectives and individuals under their management;

b) Certificates of Merit.

Article 20. Proposing to confer commendation titles and awards

1. The leading agencies initiating competition campaigns shall select outstanding individuals and collectives for commendation or propose higher authorities to confer awards within their jurisdiction.

2. Heads of agencies and units under the Ministry shall be responsible for conferring awards or submitting proposals to higher authorities for awards within their jurisdiction for individuals and collectives under their management.

3. The Department of Culture, Sports and Tourism shall propose:

a) Provincial People's Committees and Municipal People's Committees directly under the Central Government to examine and submit to the State for the awarding of commendation titles and forms of State awards in accordance with laws on competition and commendation;

b) The Ministry of Culture, Sports and Tourism to examine and confer awards for commendation titles and forms of awards within the authority granted by the Minister of Culture, Sports and Tourism.

4. Heads of agencies and units outside the sector as stipulated in point b, Clause 2, Article 2 of this Circular have already submitted to competent levels for consideration and proposal to the Ministry of Culture, Sports and Tourism for examination and awarding.

5. Collectives and individuals as stipulated in point c, Clause 2, Article 2 of this Circular shall submit to competent levels of the Socialist Republic of Vietnam for consideration and proposal to the Ministry of Culture, Sports and Tourism for examination and awarding.

Article 21. Documents for Proposing Awards

1. Documents for proposing awards shall be sent directly or via postal service to the Department of Competition and Commendation.

a) Documents for proposing awards for the titles of "National Hero of Armed Forces", "National Labor Hero", "National Model Worker", "Prime Minister's Flag of Competition" and forms of awards such as Orders, Medals, and "Prime Minister's Certificate of Merit" include:

- A proposal letter for awarding (with attached list) implemented according to Model No. 01 prescribed in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Model No. 03 prescribed in the Appendix issued together with this Circular;

- Reports on achievements of the collective and individual proposed for awarding implemented according to Models No. 05, 06, 07, 08, and 09 prescribed in the Appendix issued together with this Circular.

In addition to the achievement report according to the prescribed model, in certain cases, the achievement report must include additional contents and accompanying documents:

+ For units and unit heads with the obligation to pay state budget, the report must clearly declare: the actual amount of rent and other revenues paid compared to the registered amount, the percentage of state budget payment compared to the previous year, accompanied by a commitment letter confirming full and timely payment of all types of rent and other revenues as required by law and within the specified time frame, along with a copy of the opinion from the competent revenue collection agency;

+ For scientific research topics, innovative initiatives applying new technologies and winning national or international awards, a clear declaration about the topic, initiative, and award must be included, along with a copy of the acceptance certificate of the scientific council or the ministry-level innovation council and a copy of the national and international award certificate (if applicable);

- Copies of Decisions or Certificates recognizing the receipt of commendation titles and forms of awards from competent authorities for the collective and individual proposed for awarding;

- Opinions of local authorities where the individual resides regarding compliance with Party guidelines, policies, and laws of the State for units and individuals who are heads of agencies and units.

b) Documents for proposing awards for "Minister's Medal", "Ministry's Flag of Competition", "Outstanding Labor Collective", "Ministry-Level Model Worker" include:

- A proposal letter for awarding by the Director of the Department of Culture, Sports and Tourism for collectives and individuals under the Department or heads of agencies and units under the Ministry (with attached list) implemented according to Model No. 02 prescribed in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council of the Department of Culture, Sports and Tourism or of agencies and units under the Ministry implemented according to Model No. 04 prescribed in the Appendix issued together with this Circular;

- Reports on achievements of the collective and individual proposed for awarding implemented according to Models No. 07 and 08 at the Appendix issued together with this Circular;

- Copies of Decisions or Certificates recognizing the receipt of the title "Model Worker at the Base Level" or "Outstanding Labor Collective" from competent authorities;

- Copies of confirmation of innovations, technological applications, and scientific topics from the scientific council or innovation council; copies of national and international award certificates (if applicable).

c) Documents for proposing special awards include:

- A proposal letter for awarding by the agency or unit (with attached list) implemented according to Models No. 01 and 02 prescribed in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Models No. 03 and 04 prescribed in the Appendix issued together with this Circular;

- Reports on achievements of the collective and individual with outstanding achievements implemented according to Model No. 10 prescribed in the Appendix issued together with this Circular.

d) Documents for proposing awards during competition campaigns or thematic areas include:

- A proposal letter for awarding by the agency or unit (with attached list) implemented according to Models No. 01 and 02 prescribed in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Models No. 03 and 04 prescribed in the Appendix issued together with this Circular;

- Achievement reports for awards during competition campaigns or thematic areas of collectives and individuals implemented according to Model No. 11 prescribed in the Appendix issued together with this Circular.

đ) Documents for proposing awards for long-term contributions include:

- A proposal letter for awarding implemented according to Model No. 01 prescribed in the Appendix issued together with this Circular;

- Minutes of the meeting of the Competition and Commendation Council implemented according to Model No. 03 prescribed in the Appendix issued together with this Circular;

- Report on achievements implemented according to Model No. 12 prescribed in the Appendix issued together with this Circular.

3. Number of documents for proposing awards:

a) For the titles of "National Hero of Armed Forces" and "National Labor Hero": 04 original sets and 20 photocopied sets;

b) For the title "National Model Worker": 02 original sets and 03 photocopied sets;

c) For the "Prime Minister's Flag of Competition": 02 original sets;

d) For the form of award Order: 04 original sets.

As for collective entities being considered for awards; individuals under the management of the Politburo, Secretariat are considered for or posthumously awarded the Gold Star Order, Hồ Chí Minh Medal: five original copies.

e) For the form of awarding Medals, "Certificate of Merit from the Prime Minister": three original copies;

g) For commendation titles and forms of reward within the authority of the Minister: one original copy.

4. Deadline for accepting applications to be considered for commendation titles and forms of reward:

a) For the title "Outstanding Labor Collective", "Flag of Excellence from the Government", "Flag of Excellence from the Ministry", Certificate of Merit from the Ministry for agencies and units under the Ministry, Department of Culture, Sports and Tourism of provinces and centrally-administered cities: accept applications before December 5th each year (based on the postmark).

For the title "Outstanding Labor Collective" for the subjects specified in point đ, Clause 1, Article 2 of this Circular, the title "Ministry-level Model Soldier" for individuals in agencies and units under the Ministry, and Ribbon of Merit from the Ministry for the subjects specified in points d, đ, and e, Clause 2, Article 2 of this Circular: accept applications before February 25th of the following year (based on the postmark);

b) For Orders, Medals, Certificates of Merit from the Prime Minister, titles "People's Hero in Armed Forces", "People's Hero in Labor", "National Model Soldier", the deadline for accepting applications and submitting to the State for commendation shall be as follows:

- First round: Accept applications up to March 5th each year (based on the postmark) for Orders, Medals, Ribbons of Merit from the Prime Minister, and the title "National Model Soldier". Hold the Ministry's Commendation Council meeting from April 5th to April 15th each year. Complete the application and submit it to the State-level Commendation Council before April 25th each year. For the title "People's Hero in Armed Forces", "People's Hero in Labor", organize the award every five years during the National Patriotic Exemplary Movement Congress at all levels (in years ending in 5 and 0) and accept applications during this period.

- Second round: Accept applications up to August 20th each year (based on the postmark) for Orders, Medals, Ribbons of Merit from the Prime Minister. Hold the Ministry's Commendation Council meeting from September 15th to September 25th each year. Complete the application and submit it to the State-level Commendation Council before October 5th each year (combined with special commendation forms for schools under the Ministry).

d) For immediate commendations: Immediately after achieving results, the head of the agency or unit has the responsibility to prepare the application and send it to the Ministry's Commendation Council for review and submission for commendation.

đ) For commendation titles and forms of reward within the authority of the head of the agency or unit with separate accounts and seals, the deadline for accepting applications is determined by the agency or unit.

Article 22. Review of Commendation Application Files

1. The Department of Propaganda and Rewards is responsible for receiving and conducting reviews of application files for commendation titles and forms of reward within ten working days from the date of receipt of valid files.

For application files for the title "People's Hero in Armed Forces" before transferring the file to the Ministry of Defense and the titles "People's Hero in Labor", "National Model Soldier" before submitting the file to the Prime Minister for review and submission to the President (through the Central Propaganda and Rewards Board for review), the Department of Propaganda and Rewards is responsible for receiving, checking the file, and presenting it to the Party Cadre Committee for approval.

2. In cases where the application file is incomplete, within three working days, the Department of Propaganda and Rewards will notify the agency or unit to complete the file. Within the latest five working days from the date of receipt of the notification, the agency or unit must complete and resend the file to the Department of Propaganda and Rewards.

3. After completing the review, within ten working days, the Department of Propaganda and Rewards will compile the results and submit them to the Chairman of the Ministry's Commendation Council.

Article 23. Procedures for considering awards and submitting for higher-level approval to grant awards

1. For the form of awarding the Golden Star Order, the Ho Chi Minh Order; titles of "People's Armed Forces Hero", "Labor Hero", "National Model Worker", after receiving the application dossier, the Department of Mobilization and Awards shall be responsible for reporting to seek the opinion of the Minister, Chairman of the Mobilization and Awards Council of the Ministry before submitting to the Mobilization and Awards Council of the Ministry for discussion and voting. The result of the meeting of the Mobilization and Awards Council of the Ministry must reach at least 90% of the votes in favor calculated based on the total number of council members (if council members are absent, their opinions will be sought through ballots).

2. For the consideration of granting commendation titles and forms of awards to individuals and units under the Ministry, the Department of Mobilization and Awards shall complete the dossier and minutes of the Mobilization and Awards Council of the Ministry to submit to the Minister for decision on awarding within the scope of authority or to submit to the Prime Minister for decision (through the Central Mobilization and Awards Board) or to submit to the Prime Minister for submission to the President for decision.

3. For the consideration of granting the title of "Ministry Flag of Excellence" and "Ministry Certificate of Merit" to units and individuals under the Department of Culture, Sports and Tourism, the Department of Mobilization and Awards shall present the results of the dossier review for the Mobilization and Awards Council of the Ministry to convene and examine, vote. The Department of Mobilization and Awards of the Ministry shall complete the dossier and minutes of the Mobilization and Awards Council of the Ministry and submit to the Minister for decision.

4. For the consideration and proposal of awards for units and individuals outside the sector: The Department of Mobilization and Awards shall report to the Mobilization and Awards Council of the Ministry for examination and submit to the Minister for decision.

5. For the consideration and proposal of awards for leaders of the Ministry, the Department of Mobilization and Awards shall have the responsibility to propose to the Mobilization and Awards Council of the Ministry to propose to the Party Cadre Management Board for examination and propose to the Minister for decision on awarding and propose to the State for awarding commendation titles and forms of awards.

6. After the Mobilization and Awards Council of the Ministry convenes to examine and reach a consensus or seeks the opinions of its members, within seven working days, the Department of Mobilization and Awards must complete the procedures as prescribed to submit to the Minister for decision on awarding or to submit to the State-level Mobilization and Awards Council for awarding.

7. In cases of urgent awards, after receiving the application dossier, the Department of Mobilization and Awards shall report to seek the opinion of the Minister, Chairman of the Mobilization and Awards Council of the Ministry before organizing to seek ballots from the Standing Committee of the Mobilization and Awards Council of the Ministry. After seeking the opinion of the Standing Committee of the Mobilization and Awards Council of the Ministry, the Department of Mobilization and Awards shall complete the procedures to submit to the Minister for awarding or to consider submitting to the State-level Mobilization and Awards Council for awarding.

Article 24. Organization of presenting commendation titles and forms of awards

1. Holding rallies and commemorative ceremonies; presenting and receiving National Honorary Titles, State Prizes, Orders, Medals, "Flag of Excellence of the Government", "Prime Minister's Commendation Ribbon" shall be carried out in accordance with the provisions of the law.

2. The Minister of Culture, Sports and Tourism, acting on behalf of the State, organizes the presentation of State forms of awards; organizes the presentation of Ministry forms of awards and authorizes heads of agencies and units to organize presentations.

3. Heads of agencies and units shall be responsible for developing plans for award presentation ceremonies to submit to the Minister for approval.

Article 25. Management and storage of commendation files

The management and storage of commendation files at the Ministry and at units proposing commendations shall be carried out in accordance with Circular No. 09/2011/TT-BNV dated June 3, 2011, of the Ministry of Home Affairs on the retention period for competition and commendation files and documents.

Article 26. Reporting on Competition and Commendation Work

1. Annually, units under the Ministry, Department of Culture, Sports and Tourism; competition groups shall conduct summaries and evaluations of competition and commendation work and submit annual summary reports to the Ministry of Culture, Sports and Tourism (through the Department of Competition and Commendation) before December 5 each year.

2. When launching competitions and after each competition period, units shall organize mid-term and final summaries and submit reports to the Ministry of Culture, Sports and Tourism (through the Department of Competition and Commendation) according to Model No. 11 attached to this Circular.

Chapter V

COMPETITION AND COMMENDATION COUNCILS AND INNOVATION COUNCILS

Article 27. Competition and Commendation Council of the Ministry

1. The Minister decides to establish the Competition and Commendation Council of the Ministry.

2. The Competition and Commendation Council of the Ministry consists of:

a) The Chairman of the Council is a Deputy Minister of Culture, Sports and Tourism;

b) The Vice-Chairman in charge of the Council is the Director of the Department of Competition and Commendation;

c) The other Vice-Chairmen include the Head of the Ministry's Office, the Director of the Department of Organization and Cadres, and the Inspector General;

d) The Members of the Council include the Permanent Secretary of the Party Committee of the Ministry, the Chairman of the Trade Union of the Ministry, the Directors of the General Departments of Physical Education and Sports, and Tourism, the Director of the Department of Planning and Finance, the Heads of the Departments of Performing Arts, Grassroots Cultural Activities, Heritage, Legal Affairs, and the Secretary of the Communist Youth League of Ho Chi Minh City of the Ministry;

e) The Secretariat of the Council includes the leadership of the Department of Competition and Commendation responsible for the Secretariat and some staff members of the Department of Competition and Commendation.

3. The tasks and powers of the Competition and Commendation Council of the Ministry shall be implemented in accordance with Clause 3 of Article 28 of Decree No. 65/2014/NĐ-CP.

4. The Competition and Commendation Council of the Ministry operates based on the principle of democratic centralism and majority voting. In case of equal opinions among Council members, the opinion of the Chairman of the Council shall prevail.

Article 28. Competition and Commendation Councils of Units under the Ministry

1. The head of units under the Ministry with separate accounts and seals decides to establish the Competition and Commendation Council of their unit.

2. The Chairman of the Council is the head of the unit.

3. The Vice-Chairmen include the Chairman of the Trade Union and the Deputy Head of the unit.

4. The Members of the Council include representatives from the Party Committee, the Communist Youth League, and heads of specialized departments as decided by the head of the unit.

5. The Standing Member-Secretary of the Council is the head of the Competition and Commendation department or a staff member assigned to oversee competition and commendation work in the unit.

Article 29. Innovation Council of the Ministry

1. The Minister decides to establish the Innovation Council of the Ministry.

2. The composition and working principles of the Innovation Council of the Ministry are determined by the Minister and implemented in accordance with the laws on competition and commendation.

3. Tasks and Powers of the Innovation Council of the Ministry: Examine, evaluate, and recognize innovations and solutions that have an impact on the Ministry and sector.

Article 30. Initiative Councils at agencies and units under the Ministry

1. The heads of agencies and units under the Ministry with separate accounts and seals shall decide to establish the Initiative Council of their respective agencies and units.

2. The composition and working principles of Initiative Councils at agencies and units under the Ministry shall be stipulated by the head of the agency or unit in accordance with the laws on competition and rewards.

3. Tasks and powers of Initiative Councils of agencies and units under the Ministry: examining, evaluating, recognizing initiatives and work solutions of individuals that have an impact on the agency or unit.

Chapter VI

COMPETITION AND REWARD FUND

Article 31. Sources and levels of contribution to the Competition and Reward Fund

1. The Competition and Reward Fund of the Ministry of Culture, Sports and Tourism shall be established by the Minister of Culture, Sports and Tourism in accordance with the provisions of the law.

2. The sources of the Competition and Reward Fund of the Ministry of Culture, Sports and Tourism shall be formed in accordance with Clause 1, Article 67 of Decree No. 42/2010/NĐ-CP and Circular No. 71/2011/TT-BTC dated May 24, 2011 of the Ministry of Finance guiding the establishment, management, and use of the Competition and Reward Fund (hereinafter referred to as Circular No. 71/2011/TT-BTC).

3. Encouragement is given to organizations and individuals inside and outside the industry to support and contribute to supplementing the Competition and Reward Fund of the Ministry and the Competition and Reward Funds of agencies and units under the Ministry.

Article 32. Management and use of the Competition and Reward Fund of the Ministry

1. The Department of Competition and Rewards shall be responsible for managing the Competition and Reward Fund of the Ministry to serve the competition and reward activities of the sector in accordance with current financial laws. At the end of the year, if the Competition and Reward Fund of the Ministry has not been fully utilized, it may be carried over to the next year for continued use in competition and reward activities.

2. The expenditure from the Competition and Reward Fund of the Ministry shall be implemented in accordance with Clause 1, Article 4 of Circular No. 71/2011/TT-BTC.

Article 33. Responsibilities, levels of rewards, and principles of award distribution

1. Responsibilities for award distribution:

a) The Ministry of Culture, Sports and Tourism shall be responsible for distributing prize money for:

- Commendation titles and reward forms within the authority of the State to be decided upon by the Ministry;

- Commendation titles and reward forms for collectives and individuals receiving salaries at the Ministry's Office;

- Commendation titles and reward forms for collectives and individuals during the annual work summary of the Ministry (with annual guidance documents);

- Other cases to be examined and decided by the Minister.

b) Agencies and units under the Ministry with separate seals and accounts shall be responsible for distributing prize money for:

- Commendation titles and reward forms within the authority of the Minister for collectives and individuals of the agency or unit not covered by point a, Clause 1 of this Article;

- Commendation titles and reward forms within the authority of the head of the agency or unit for collectives and individuals under their responsibility;

- Other cases to be examined and decided by the head of the agency or unit.

2. Levels of prize money accompanying commendation titles and reward forms shall be implemented in accordance with Articles 70, 71, 72, 73, 74, 75, and 76 of Decree No. 42/2010/NĐ-CP and related legal documents.

3. Principles of award distribution:

a) In accordance with points a, b, and c, Clause 2, Article 24 of Circular No. 07/2014/TT-BNV dated August 29, 2014 of the Ministry of Home Affairs guiding the implementation of certain articles of Decree No. 42/2010/NĐ-CP, Decree No. 39/2012/NĐ-CP dated April 27, 2012 of the Government amending and supplementing certain articles of Decree No. 42/2010/NĐ-CP, and Decree No. 65/2014/NĐ-CP.

b) For rewards based on specific topics or fields, they shall be implemented in accordance with Clause 12, Article 53 of Decree No. 42/1010/NĐ-CP.

Chapter VII

IMPLEMENTING PROVISIONS

Article 34. Implementation Organization

1. The Chairman of the Competition and Reward Council, the Director of the Department of Competition and Rewards, the Head of the Ministry's Office, the heads of agencies and units under the Ministry, the Directors of Provincial Departments of Culture, Sports and Tourism, the Heads of Competition Groups and Clusters, and relevant agencies and units shall be responsible for implementing this Circular.

2. The Department of Competition and Rewards, as the permanent body of the Competition and Reward Council of the Ministry, shall be responsible for urging, monitoring, and inspecting the implementation of competition and reward activities throughout the sector, regularly reporting the results of the implementation of this Circular to the Chairman of the Competition and Reward Council of the Ministry.

Article 35. Effective Date

1. This Circular shall take effect from February 10, 2015.

Decision No. 64/2008/QĐ-BVHTTDL dated August 20, 2008 of the Ministry of Culture, Sports and Tourism on the issuance of the Regulations on Competition and Reward in the Cultural, Sports and Tourism Sector shall cease to be effective from the date this Circular takes effect.

2. During the implementation process, if there are difficulties or obstacles, agencies, units, and individuals are requested to report them to the Ministry of Culture, Sports and Tourism for examination and resolution./.
