GUIDANCE ON CERTAIN PROVISIONS OF THE LAW ON ANIMAL HUSBANDRY REGARDING FEED FOR ANIMAL HUSBANDRY

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Livestock Breeding Law on November 19, 2018;
At the request of the Director of the Livestock Production Department.
The Minister of Agriculture and Rural Development issues this Circular guiding certain provisions of the Law on Animal Husbandry regarding feed for animal husbandry.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides certain contents stipulated in Clause 4 Article 37, Clause 2 Article 46, Point d Clause 2 Article 48, Point c Clause 2 Article 79 of the Law on Animal Husbandry regarding feed for animal husbandry, including:
1. Mandatory quality criteria for feed for animal husbandry to be published in the standard declaration;
2. Labeling of feed for animal husbandry;
3. Report on the production situation of feed for animal husbandry;
4. List of chemicals, biological products, microorganisms prohibited from use in feed for animal husbandry; List of raw materials permitted for use as feed for animal husbandry.
Article 2. Applicability
This Circular applies to organizations and individuals within Vietnam, foreign organizations and individuals engaged in activities related to feed for animal husbandry on the territory of Vietnam.
Chapter II
CONTENTS OF REGULATIONS
Article 3. Mandatory quality criteria for feed for animal husbandry to be published in the standard declaration
The mandatory quality criteria for feed for animal husbandry to be published in the standard declaration are specified in Appendix I attached hereto.
Article 4. Labeling of feed for animal husbandry
1. The content to be displayed on the label of feed for animal husbandry is specified in Appendix II attached hereto.
2. Bulk feed when circulated must have accompanying documentation as specified in Appendix III attached hereto, except in cases where traditional feed that has not been processed and sold directly to livestock farmers.
3. Custom-made feed for animal husbandry and internal consumption feed with packaging when circulated do not need to comply with labeling requirements as stipulated in Clause 1 of this Article but must have markings on the packaging to identify them and avoid confusion, and must have accompanying documentation as specified in Appendix III attached hereto.
Commercial feed production facilities report on the production situation of feed for animal husbandry according to the model specified in Appendix IV attached hereto, sent to the Livestock Production Department and the Department of Agriculture and Rural Development in the locality through the internet or postal service on a monthly basis during the first week of the following month; and report promptly when required by competent authorities.
Article 6. List of chemicals, biological products, microorganisms prohibited from use in feed for animal husbandry; List of raw materials permitted for use as feed for animal husbandry
1. The list of chemicals, biological products, microorganisms prohibited from use in feed for animal husbandry is specified in Appendix V attached hereto.
2. The list of raw materials permitted for use as feed for animal husbandry is specified in Appendix VI attached hereto.
3. The Livestock Production Department shall be responsible for:
a) Summarizing and submitting to the Minister of Agriculture and Rural Development for consideration and updating the lists specified in Clauses 1 and 2 of this Article annually;
b) Updating and announcing traditional feed products and single raw materials commercially available on the Ministry of Agriculture and Rural Development's website. Traditional feed products not announced according to this provision can be produced for the purpose of buying and selling, exchanging within farm households, family households, and individual businesses.
Chapter III
IMPLEMENTATION
Article 7. Effective Date
1. This Circular takes effect from January 14, 2020.
2. This Circular replaces the following documents:
a) Circular No. 28/2014/TT-BNNPTNT dated September 4, 2014, issued by the Minister of Agriculture and Rural Development on the list of chemicals and antibiotics prohibited from importation, production, business, and use in feed for livestock and poultry in Vietnam;
b) Circular No. 42/2015/TT-BNNPTNT dated November 16, 2015, issued by the Minister of Agriculture and Rural Development on the supplementary list of chemicals and antibiotics prohibited from importation, production, business, and use in feed for livestock and poultry in Vietnam;
c) Circular No. 01/2017/TT-BNNPTNT dated January 16, 2017, issued by the Minister of Agriculture and Rural Development on the supplementary list of chemicals and antibiotics prohibited from importation, production, business, and use in feed for livestock and poultry in Vietnam.
d) Circular No. 02/2019/TT-BNNPTNT dated February 11, 2019, issued by the Minister of Agriculture and Rural Development on the list of feed for animal husbandry products according to tradition and single raw materials permitted to circulate in Vietnam.
Article 8. Transitional Provisions
1. Product labels of feed for animal husbandry as prescribed in Circular No. 20/2017/TT-BNNPTNT dated November 10, 2017, issued by the Minister of Agriculture and Rural Development guiding the implementation of Decree No. 39/2017/NĐ-CP dated April 4, 2017, of the Government on the management of feed for animal husbandry and aquatic animals printed before the effective date of this Circular may continue to be used until December 31, 2021.
2. Feed for animal husbandry permitted to circulate in Vietnam as prescribed in Decree No. 39/2017/NĐ-CP dated April 4, 2017, of the Government on the management of feed for animal husbandry and aquatic animals before the effective date of this Circular, which contains raw materials not declared according to Point b Clause 3 Article 6 of this Circular, may continue to circulate until December 31, 2021.
Article 9. Responsibility for implementation
During the implementation process, if there are difficulties or obstacles, organizations, institutions, and individuals are requested to reflect these issues to the Ministry of Agriculture and Rural Development for review and amendment./.
