Repealing certain regulatory legal documents issued by the Minister of Agriculture and Rural Development

Based on the Law on Enactment of Legislative Acts dated June 22, 2015;

Based on the Law Amending and Supplementing Certain Provisions of the Law on Enactment of Legislative Acts dated June 18, 2020;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing some articles of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures for implementing the Law on Enacting Regulatory Legal Documents;

Pursuant to Decree No. 105/2022/NĐ-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Director of the Legal Department;

After reaching consensus with the Minister of Labor, Invalids and Social Affairs, the Minister of Finance, and the Minister of Agriculture and Rural Development, the Minister of Agriculture and Rural Development issues this Circular to repeal certain regulatory legal documents issued by the Minister of Agriculture and Rural Development, jointly issued.

Article 1. Abolish all the circulars and joint circulars

Abolish all the following circulars and joint circulars:

1. Circular No. 42/2009/TT-BNNPTNT dated July 10, 2009 of the Minister of Agriculture and Rural Development stipulating management of production, business, and use of super original, original certified rice seeds, parent lines of hybrid rice, and F1 hybrid seeds.

2. Circular Joint No. 66/2010/TTLT-BNNPTNT-BLDTBXH-BTC dated November 16, 2010 of the Minister of Agriculture and Rural Development, the Minister of Labor, Invalids and Social Affairs, and the Minister of Finance guiding the issuance, management, and trial use of Agricultural Vocational Training Cards from the budget of the National Target Program on Education and Training.

3. Circular No. 03/2014/TT-BNNPTNT dated January 25, 2014 of the Minister of Agriculture and Rural Development guiding the implementation of Decision No. 1776/QĐ-TTg dated November 21, 2012 of the Prime Minister approving the "Program for Resettling Population in Areas Affected by Natural Disasters, Particularly Difficult Areas, Border Areas, Islands, Free Migration, and Specialized Forest Areas for the Period 2013-2015 and Orientations until 2020".

4. Circular No. 19/2015/TT-BNNPTNT dated April 27, 2015 of the Minister of Agriculture and Rural Development stipulating the procedures for resettlement and stabilization of population under the Resettlement Program pursuant to Decision No. 1776/QĐ-TTg dated November 21, 2012 of the Prime Minister.

5. Circular No. 35/2016/TT-BNNPTNT dated December 26, 2016 of the Minister of Agriculture and Rural Development guiding the implementation of criteria for counties achieving new rural standards for the period 2016-2020.

Article 2. Partially repealing Circular No. 21/2015/TT-BNNPTNT dated June 8, 2015 of the Minister of Agriculture and Rural Development on plant protection chemical management

1. Repeal Clause 2, Article 31 of Circular No. 21/2015/TT-BNNPTNT dated June 8, 2015 of the Minister of Agriculture and Rural Development on plant protection chemical management.

2. Repeal the content "During operation, if the facility is inspected and rated as Class A according to the regulations of the Minister of Agriculture and Rural Development on inspection and evaluation of agricultural inputs and forestry and aquatic products facilities, then it shall proceed with the procedure to apply for reissue of the Certificate of Eligibility for Plant Protection Chemical Trade in accordance with Clause 1 and 2 of Article 35 of this Circular. The Plant Protection Service or the Crop Production and Plant Protection Service shall issue the Certificate of Eligibility for Plant Protection Chemical Trade within five working days from the date of receipt of a valid application, without forming an inspection team at the trading facility." in Clause 1, Article 36 of Circular No. 21/2015/TT-BNNPTNT dated June 8, 2015 of the Minister of Agriculture and Rural Development on plant protection chemical management.

Article 3. Implementation Provisions

1. This Circular takes effect from February 28, 2023.

2. Investment projects and resettlement plans that have been approved in accordance with Circular No. 03/2014/TT-BNNPTNT dated January 25, 2014 of the Minister of Agriculture and Rural Development guiding the implementation of Decision No. 1776/QĐ-TTg dated November 21, 2012 of the Prime Minister approving the "Program for Resettling Population in Areas Affected by Natural Disasters, Particularly Difficult Areas, Border Areas, Islands, Free Migration, and Specialized Forest Areas for the Period 2013-2015 and Orientations until 2020", and Circular No. 19/2015/TT-BNNPTNT dated April 27, 2015 of the Minister of Agriculture and Rural Development stipulating the procedures for resettlement and stabilization of population under the Resettlement Program pursuant to Decision No. 1776/QĐ-TTg dated November 21, 2012 of the Prime Minister, before this Circular takes effect, shall continue to be implemented in accordance with Circular No. 03/2014/TT-BNNPTNT dated January 25, 2014 and Circular No. 19/2015/TT-BNNPTNT dated April 27, 2015./.
