Pursuant to the Technology Transfer Law dated June 19, 2017;

Technology;

Pursuant to Decree No. 76/2018/NĐ-CP dated May 15, 2018 of the Government detailing and guiding the Technology Transfer Law;

Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;

Implementing Decision No. 2099/QĐ-TTg dated December 27, 2017 of the Prime Minister on issuing the list of public services using state budget funds under the management of the Ministry of Science and Technology;

At the proposal of the Director of the Department of Technology Application and Development and the Head of the Legal Department;

The Minister of Science and Technology issues this Circular on economic-technical norms for public services using state budget funds for technology assessment services and capacity; technical innovation support services; technological innovation support services; technology transfer support services. This Circular issues four (4) economic-technical norms for public services using state budget funds for technology assessment services and capacity; technical innovation support services; technological innovation support services; technology transfer support services, specifically:

Article 1. Scope of application

1. Economic-technical norm for public services using state budget funds for technology assessment services and capacity is the economic-technical norm for services implementing technology assessment activities specified in Section I.4.1, Section I.5.1, and Section I.5.6 of the Appendix to Circular No. 21/2019/TT-BKHCN issued by the Ministry of Science and Technology on December 18, 2019, which details the procedures for establishing economic-technical norms for public services using state budget funds under the management of the Ministry of Science and Technology (Appendix to Circular No. 21/2019/TT-BKHCN), detailed in Appendix I attached hereto;

2. Economic-technical norm for public services using state budget funds for technical innovation support services is the economic-technical norm for services supporting the construction of technical innovation roadmaps specified in Section I.4.1 of the Appendix to Circular No. 21/2019/TT-BKHCN, detailed in Appendix II attached hereto;

3. Economic-technical norm for public services using state budget funds for technological innovation support services is the economic-technical norm for services supporting technological innovation activities specified in Section I.1.7 of the Appendix to Circular No. 21/2019/TT-BKHCN, detailed in Appendix III attached hereto;

4. Economic-technical norm for public services using state budget funds for technology transfer support services is the economic-technical norm for services supporting technology transfer activities specified in Sections I.4.2, I.4.3, and II.4.5 of the Appendix to Circular No. 21/2019/TT-BKHCN, detailed in Appendix IV attached hereto.

1. Agencies and organizations under the Ministry of Science and Technology using state budget funds to implement services as stipulated in Article 1 of this Circular.

Article 2. Applicability

2. Other agencies and organizations at central and local levels using state budget funds to implement services as stipulated in Article 1 of this Circular.

3. Agencies and organizations not using state budget funds may apply the economic-technical norms issued with this Circular to implement technology assessment services and capacity; technical innovation support services; technological innovation support services; technology transfer support services.

Technology assessment service

Article 3. Explanation of Terms

1. is a service performing technology assessment activities for production capacity in enterprises, industries, and sectors according to the guidance in Circular No. 17/2019/TT-BKHCN dated December 10, 2019, of the Minister of Science and Technology on technology assessment for production capacity. Technical innovation roadmap support service

2. is a service performing support activities during the process of building a technical innovation roadmap according to the guidance of the Minister of Science and Technology on creating technology maps, innovation roadmaps, and innovation plans for key products, important products, and national products in industries and sectors. Technological innovation support service

3. is a service performing support activities for analyzing and evaluating to select appropriate technological innovation options and implementing selected technological innovation options. Technology transfer support service

4. is a service performing advisory, brokerage, evaluation, connection, and technology transfer activities.Economic-technical norm for public services using state budget funds for technology assessment services and capacity; technical innovation support services; technological innovation support services; technology transfer support services (hereinafter referred to as economic-technical norm) is the necessary consumption level of labor, machinery, equipment, materials in specific conditions, according to the corresponding service implementation procedures to complete one unit of product (or a certain amount of work) meeting criteria and standards established by competent authorities.

5. Building a technological innovation roadmap is a detailed plan regarding objectives, contents, procedures, resource utilization plans to implement technological innovation activities to improve productivity and product quality within a defined period.

6. Establishing a roadmap for technological innovation is a detailed plan regarding the objectives, contents, procedures, and resource utilization schemes to implement technological innovation activities aimed at enhancing productivity and product quality within a specified timeframe

7. Technology dossier is a detailed description of the technology including information about the technology description, application scope in industries and products, current technology status in Vietnam and worldwide, and global technology development trends.

8. Current technology assessment is the activity of assessing the quantity, types, level, degree of modernity, value of technology, machinery, and equipment currently being used in enterprises/organizations.

9. Analysis, evaluation, and selection of technological innovation options is the process of supporting enterprises/organizations to analyze technical and economic indicators, compare the advantages and disadvantages of various options to select a suitable technological innovation option that fits the characteristics of the enterprise/organization.

10. Technological Innovation Support is the process of supporting analysis and evaluation to select appropriate technological innovation options and implementing the selected technological innovation options.

11. Technology Transfer Facilitation is the brokerage and promotion activity to support finding partners for technology transfer implementation.

Article 4. Methods and Basis for Establishing Economic and Technical Norms

1. Establishing Economic and Technical Norms shall be based on the provisions of the following legal documents:

a) Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, public officials, and armed forces; Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, public officials, and armed forces;

b) Decision No. 50/2017/QD-TTg dated December 31, 2017 of the Prime Minister on standards and norms for using machinery and equipment;

c) Circular No. 23/2023/TT-BTC dated April 25, 2023 guiding management systems, depreciation, and amortization of fixed assets at agencies, organizations, units, and fixed assets transferred by the State to enterprises for management without being part of the State capital in enterprises;

d) Circular No. 17/2019/TT-BKHCN dated December 10, 2019 of the Minister of Science and Technology guiding the assessment of production technology levels and capabilities;

e) Circular No. 21/2019/TT-BKHCN dated December 18, 2019 of the Minister of Science and Technology stipulating procedures for establishing economic and technical norms for public service activities funded by the state budget under the Ministry of Science and Technology's administrative domain;

2. Establishing Economic and Technical Norms not specifically regulated

The method for establishing economic and technical norms not specifically regulated by legal documents shall be implemented according to the provisions of Article 10 of Circular No. 21/2019/TT-BKHCN dated December 18, 2019 of the Minister of Science and Technology stipulating procedures for establishing economic and technical norms for public service activities funded by the state budget under the Ministry of Science and Technology's administrative domain:

a) Comprehensive Statistical Method

Based on statistical data over three consecutive years prior to the establishment of economic and technical norms and supported by practical experience in evaluating technology levels and capabilities; supporting the development of technological innovation roadmaps; supporting technological innovation and technology transfer.

b) Standard Method

Based on technical standards and legal provisions regarding working hours and rest periods to establish labor norms for each job.

Based on technical standards and legal provisions to determine consumption rates for each job, from which economic and technical norms for equipment and materials are calculated.

c) Analytical and Experimental Method

Conducting survey and experimental activities according to the framework of each procedure and work content to analyze and calculate each component of economic and technical norms applied to activities supporting enterprises/organizations in evaluating technology levels and capabilities; supporting the development of technological innovation roadmaps; supporting technological innovation and technology transfer.

3. Basis for Establishing Economic and Technical Norms

Economic and technical norms stipulated in this Circular are established based on approved service implementation procedures including:

a) Procedures for implementing public service activities funded by the state budget for technology capability and level assessment services.

b) Procedures for implementing public service activities funded by the state budget for supporting the development of technological innovation roadmaps.

c) Procedures for implementing public service activities funded by the state budget for technological innovation support services.

d) Procedures for implementing public service activities funded by the state budget for technology transfer support services.

Article 5. Content of economic and technical norms

Economic and technical norms for construction services as stipulated in Article 14 of Circular No. 21/2019/TT-BKHCN dated December 18, 2019 issued by the Minister of Science and Technology include three (3) basic component norms: labor norms, equipment and machinery norms, and material norms.

1. Labor Standard

Labor norm is the amount of labor consumption necessary for workers according to their specialty and profession to complete the implementation of a public service or to perform a specific step in the process for technology level and capability assessment services; supporting services for developing a technological innovation roadmap; supporting services for technological innovation; and technology transfer supporting services as prescribed.

Labor norm is the necessary direct and indirect labor time to produce a product or to perform a specific step or task, and the labor time during product inspection and acceptance.

a) Direct labor norm is the necessary direct labor time to complete the implementation of a public service or to perform a specific step.

b) Indirect labor norm (management, support) is defined as a percentage (%) of direct labor.

The labor time consumption rate in the norm is calculated as work units, with each work unit corresponding to eight hours of work.

d) Labor norm does not include travel expenses (transportation, accommodation for officials and staff...).

2. Equipment and machinery norms: the necessary usage time for each type of machine and equipment to complete the implementation of a public service funded by the state budget for technology level and capability assessment services; supporting services for developing a technological innovation roadmap; supporting services for technological innovation; and technology transfer supporting services to meet criteria and standards established by competent authorities; the unit of measurement is a shift (shift), with each shift corresponding to eight hours of work.

3. Material norm is the consumption rate of each type of raw materials and supplies necessary to be determined by category and quantity to complete the implementation of a public service funded by the state budget for technology level and capability assessment services; supporting services for developing a technological innovation roadmap; supporting services for technological innovation; and technology transfer supporting services to meet criteria and standards established by competent authorities.

Article 6. Implementation Organization

1. The Director of the Department of Technology Application and Development shall be responsible for organizing guidance, dissemination, and implementation of this Circular.

2. Ministries, ministerial-level agencies, central agencies, government agencies, provincial people's committees, and municipal people's committees directly under the central government shall apply the provisions of this Circular; where necessary, they may issue specific regulations on economic and technical norms suitable to the conditions of service-providing organizations within their jurisdiction at the ministry, sector, or local level, but such regulations shall not exceed the norms set forth in this Circular.

Article 7. Implementation Provisions

1. This Circular takes effect from January 6, 2024.

2. In cases where the documents cited in this Circular are amended, supplemented, or replaced, the new regulations shall be implemented accordingly.

3. During the implementation period, if there are difficulties or obstacles, relevant agencies and units are requested to report to the Ministry of Science and Technology for consideration and resolution./.
