Pursuant to the Forest Protection and Development Law dated August 12, 1991.
Pursuant to the Land Law dated July 14, 1993, the Law Amending and Supplementing Certain Provisions of the Land Law dated December 2, 1998, and the Law Amending and Supplementing Certain Provisions of the Land Law dated June 29, 2001.
Pursuant to Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government on the issuance of the Investment and Construction Management Regulation; Decree No. 12/2000/NĐ-CP dated May 5, 2000 of the Government amending and supplementing certain provisions of the Investment and Construction Management Regulation; Decree No. 07/2003/NĐ-CP dated January 30, 2003 amending and supplementing certain provisions of the Investment and Construction Management Regulation issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999 and Decree No. 12/2000/NĐ-CP dated May 5, 2000 of the Government.
Considering the proposal of the Ministry of Agriculture and Rural Development (document No. 3578 CV/BNN – LN dated November 10, 2003) and the People's Committee of Vinh Phuc Province (document No. 2236/HC-UB dated November 10, 2003); opinions of the Ministry of Finance (document No. 13844 TC/QLCS dated December 31, 2003), the Ministry of Natural Resources and Environment (document No. 3769/BTNMT-ĐKTKĐĐ dated December 23, 2003).

Article 1. Permitting the conversion of 147.3 hectares of forestry land belonging to the Northeast Forestry Science and Production Center in Ngoc Thanh Commune, Me Linh District, Vinh Phuc Province to be used for the Golf Course Project and a cultural, sports, entertainment, leisure, tourism, and ecological complex project (referred to as the Golf Course and Tourism Project) which has been approved by competent authorities.
Article 2. Assigning the Northeast Forestry Science and Production Center to continue managing the remaining 945.6 hectares of forestry land in Ngoc Thanh Commune, Me Linh District, Vinh Phuc Province, to be used for research, experimental science, production of forest tree seedlings, contributing to maintaining and developing the ecological environment in the project area.
Article 3. Assigning the Ministry of Finance to guide the Ministry of Agriculture and Rural Development to implement regulations regarding the transfer of assets, capital, and management of compensation funds according to current regulations to ensure the timely implementation of the land transfer above.
Article 4. Assigning the Ministry of Agriculture and Rural Development to direct the Northeast Forestry Science and Production Center:
- To implement the land transfer for the Golf Course Project in accordance with the agreed stages with the People's Committee of Vinh Phuc Province.
- To develop an effective plan for using the remaining land area mentioned above for research and experimental science work.
Article 5. The People's Committee of Vinh Phuc Province shall be responsible for:
- Directing the specific demarcation and organization of the handover of the converted land area on maps and in the field, determining compensation for losses related to forests and assets according to current regulations; coordinating with the Ministry of Agriculture and Rural Development to resolve the access route to the seedling forest and experimental forest areas of the Center.
- Considering and resolving within its authority the additional land requirements for the Center's research and experimental science work.
Article 6. This Decision takes effect from the date of signature.
The Ministers of the Ministries of Agriculture and Rural Development, Planning and Investment, Finance, Natural Resources and Environment, the Director-General of the Vietnam National Administration of Tourism, heads of relevant agencies, and the Chairman of the People's Committee of Vinh Phuc Province are responsible for implementing this Decision.
