RESOLUTION
Regarding the division and adjustment of administrative boundaries for some provinces
OF THE NATIONAL ASSEMBLY
SOCIALIST REPUBLIC OF VIET NAM
Based on the Constitution of the Socialist Republic of Vietnam in 1992, amended and supplemented by Resolution No. 51/2001/QH10 dated December 25, 2001 of the Tenth National Assembly, tenth session;
Pursuant to the Report No. 1379/CP-NC dated October 9, 2003 of the Government, the Review Report of the Committee for Legal Affairs, and the opinions of the National Assembly delegates;
RESOLUTION:
Article 1
Divide the province of Can Tho, the province of Dak Lak, and the province of Lai Chau as follows:
1. Divide the province of Can Tho into the centrally governed city of Can Tho and the province of Hau Giang:
a) The centrally governed city of Can Tho has a natural area of 138,959.99 hectares and a current population of 1,112,121 people, including: the area and population of the city of Can Tho; O Mon district; Thot Not district; part of Chau Thanh district, including: Cay Rang town; the hamlets Thanh My, Thanh Hue, Thanh Thang, Yen Ha and 176 hectares of land along with 2,216 people from Phu Quoc hamlet of Dong Thanh commune; the hamlets Thanh Hoa, Thanh Hung, Thanh Thuan, An Hung, Thanh Phu, Khanh Khanh, Khanh Binh and 254.19 hectares of land along with 1,806 people from Phu Hung hamlet of Phu An commune; the hamlets Phu Thanh, Phu Thanh, Phu Thuan, Phu Thuan A and 304.61 hectares of land along with 1,262 people from Phu Loi hamlet of Dong Phu commune; part of Chau Thanh A district, including: Truong Long commune; Nhon Ai commune; Nhon Nghia commune; Tan Thanh Dong hamlet and 84.7 hectares of land along with 640 people from Tan Thanh Tay hamlet of Tan Phu Thanh commune.
b) The province of Hau Giang has a natural area of 160,772.49 hectares and a current population of 766,105 people, including: the area and population of Vi Thanh town; Phung Hiep district; Long My district; Vi Thuong district; the remaining parts of Chau Thanh and Chau Thanh A districts, excluding the areas and populations of these two districts that have been adjusted to the centrally governed city of Can Tho as stipulated in point a, Clause 1, Article 1 of this Decision.
The provincial capital is located at Vi Thanh town.
2. Divide the province of Dak Lak into the province of Dak Lak and the province of Dak Nong:
a) The province of Dak Lak has a natural area of 1,306,201 hectares and a current population of 1,666,854 people, including: the area and population of Buon Ma Thuot city; Ea Sup district; Buon Don district; Cu Mang district; Kroong Buk district; Ea Hleo district; Kroong Nang district; Mdrak district; Ea Kar district; Kroong Pak district; Kroong Bong district; Kroong Ana district; Lak district; the communes Ea Rbin and Nam Ka of Kroong No district; the communes Hoa Khanh, Hoa Xuan, and Hoa Phu of Cu Jut district.
The provincial capital is located at Buon Ma Thuot city.
b) The province of Dak Nong has a natural area of 651,438 hectares and a current population of 363,118 people, including the area and population of Dak Lap district; Dak Nong district; Dak Song district; Dak Mil district; Kroong No district (excluding the communes Ea Rbin and Nam Ka); Cu Jut district (excluding the communes Hoa Khanh, Hoa Xuan, and Hoa Phu).
The provincial capital is located at Gia Nghia town in Dak Nong district.
3. Divide the province of Lai Chau into the province of Lai Chau and the province of Dien Bien:
a) The province of Lai Chau has a natural area of 906,512.30 hectares and a current population of 313,511 people, including: the area and population of Phong Tho district; Tam Duong district; Muong Te district; Sin Ho district; Pu Dao commune, Chan Nu commune, Nam Hang commune, and Thanh Chu hamlet of Xa Tong commune of Muong Lay district; Le Loi ward of Lai Chau town; Than Uyen district of Lao Cai province.
The provincial capital is located at Phong Tho town in Tam Duong district.
b) The province of Dien Bien has a natural area of 955,409.70 hectares and a current population of 440,300 people, including: the area and population of Dien Bien Phu city; Lai Chau town (excluding Le Loi ward); Muong Nhe district; Dien Bien district; Dien Bien Dong district; Tuong Giao district; Tua Chua district; Muong Lay district (excluding: Pu Dao commune, Chan Nu commune, Nam Hang commune, and Thanh Chu hamlet of Xa Tong commune).
The provincial capital is located at Dien Bien Phu city.
Article 2
Adjust the territorial boundaries of Lào Cai Province as follows:
1. Transfer Than Uyên District under Lào Cai Province to be managed by Lai Châu Province;
2. After transferring Than Uyên District from Lào Cai Province to Lai Châu Province, Lào Cai Province will retain a natural area of 635,708 hectares and a current population of 547,106 people, including: the natural area and population of Lào Cai City; Bát Sát District; Bảo Thắng District; Sa Pa District; Văn Bàn District; Bảo Yên District; Mường Khương District; Bắc Hà District; and Si Ma Cai District.
Article 3
Based on the Resolution of the National Assembly on the state budget estimate and the Resolution of the National Assembly on the allocation of the central budget for 2004, the Government shall consider and decide on the total revenue of the state budget in the region, the total revenue of the local budget, the total expenditure of the local budget, the amount supplemented from the central budget to the local budget, and the percentage distribution of revenues between the central budget and the local budget for provinces and centrally-administered cities divided and adjusted according to this Resolution, ensuring that the total revenue and expenditure budget estimates decided by the National Assembly are accurately matched; report to the Standing Committee of the National Assembly at the nearest session.
Article 4
The Government, the Supreme People's Court, and the Supreme People's Procuracy within their respective duties and powers shall direct and organize the implementation of this Resolution; promptly guide the organization and operation of People's Committees, People's Courts, and People's Procuracies in provinces and centrally-administered cities specified in Article 1 and Article 2 of this Resolution; ensure unity, streamlined organization, and cost-effective staffing.
Article 5
The Standing Committee of the National Assembly shall guide the organization and operation of Delegations of National Assembly Members, National Assembly Members, People's Councils, and People's Council Members in provinces and centrally-administered cities specified in Article 1 and Article 2 of this Resolution.
The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, Delegations of National Assembly Members, and National Assembly Members within their respective duties and powers shall supervise the implementation of this Resolution.
This Resolution was adopted by the National Assembly of the Socialist Republic of Vietnam, the eleventh session, fourth meeting, on November 26, 2003./.
