The Prime Minister issues this Decision amending and supplementing certain provisions of the Regulation on Response Activities to Oil Spill Incidents issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister.
Pursuant to Decree No. 80/2006/NĐ-CP dated August 9, 2006 of the Government detailing and guiding the implementation of certain provisions of the Law on Environmental Protection;
Pursuant to Decree No. 91/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
After reaching consensus with the Ministry of Science and Technology regarding the replacement of Vietnam Environmental Standards issued together with Decision No. 35/2002/QĐ-BKHCNMT dated June 25, 2002 of the Minister of Science, Technology, and Environment (Circular No. 2907/BKHCN-TĐC dated October 30, 2006);
Considering the proposal of the Director of the Environmental Department and the Director of the Legal Department,
DECISION:
Article 1. Mandate the application of five Vietnam Environmental Standards issued by the Minister of Science and Technology pursuant to Decision No. 1696/QĐ-BKHCN dated July 28, 2006:
- TCVN 5937:2005 - Air Quality - Ambient Air Quality Standard.
- TCVN 5938:2005 - Air Quality - Maximum Allowable Concentration of Certain Harmful Substances in Ambient Air.
- TCVN 5939:2005 - Air Quality - Industrial Emission Standard for Dust and Inorganic Compounds.
- TCVN 5940:2005 - Air Quality - Industrial Emission Standard for Certain Organic Compounds.
- TCVN 5945:2005 - Industrial Wastewater - Discharge Standard.
Article 2. Apply Column B, Table 1 of TCVN 5939:2005, regional factor (Kv) and discharge flow rate factor (Kp) for new production, processing, trading, and service establishments.
Apply Column A, Table 1 of TCVN 5939:2005, regional factor (Kv) and discharge flow rate factor (Kp) for production, processing, trading, and service establishments that commenced operations from January 1, 2003 until the effective date of this Decision.
Apply Column A, Table 1 of TCVN 5939:2005 for production, processing, trading, and service establishments operating before January 1, 2003.
Apply Column B, Table 1 of TCVN 5939:2005, regional factor (Kv) and discharge flow rate factor (Kp) for all production, processing, trading, and service establishments starting from January 1, 2011.
The values of the factors and methods for calculating the maximum allowable concentration of pollution parameters are specified in Appendix 1 attached to this Decision.
Article 3. Apply the flow rate/receiving water volume factor (Kq) and discharge flow rate factor (Kf) for the industrial wastewater standard TCVN 5945:2005.

Article 4. Abolish the application of standards TCVN 5937:1995, TCVN 5938:1995, TCVN 5939:1995, TCVN 5940:1995, TCVN 5945:1995, TCVN 6980:2001, TCVN 6981:2001, TCVN 6982:2001, TCVN 6983:2001, TCVN 6984:2001, TCVN 6985:2001, TCVN 6986:2001, TCVN 6987:2001, TCVN 6991:2001, TCVN 6992:2001, TCVN 6993:2001, TCVN 6994:2001, TCVN 6995:2001, and TCVN 6996:2001 in the List of Vietnam Environmental Standards issued together with Decision No. 35/2002/QĐ-BKHCNMT dated June 25, 2002 of the Minister of Science, Technology, and Environment. Environment.
Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, and related organizations and individuals are responsible for implementing this Decision./.
